वन अरा॰स्था॰-25/2014-572-प०व०ज०प०--भारत संविधान के अनुच्छेद-309 के परन्तुक के अधीन भारत संविधान के अनुच्छेद-309 के परन्तुक के अधीन विभाग में अमीन संवर्ग की प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल पर्यावरण, वन एवं जलवायु परिवर्त्तन, विभाग में अमीन संवर्ग की प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैं :- भर्त्ती एवं अन्य सेवा-शर्त्तों को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैं :-

(2) इसका विस्तार सम्पूर्ण बिहार राज्य (3) यह तुरंत प्रवृत्त होगी।

इस नियमावली में जब तक कोई बात विषय या संदर्भ के विरूद्ध न हो,

परीक्षा परिषद्‌ (BCECEB) चयनित अन्य प्राधिकार; चयनित अन्य प्राधिकार

2222.... उम्र - सीमा। -उम्र - सीमा। -उम्र - सीमा। -उम्र - सीमा। - अमीन के पद के लिए उम्मीदवार की न्यूनतम आयु आवेदन आमंत्रित करने वाले वर्ष के 1 अगस्त को 18 वर्ष से कम नहीं होगी। अधिकतम आयु सीमा वही होगी जो राज्य सरकार के सामान्य प्रशासन विभाग द्वारा, समय-समय पर, नियत की जाय।

3333.... आरक्षण। -आरक्षण। -आरक्षण। -आरक्षण। - इस संवर्ग मेें नियुक्ति में राज्य सरकार द्वारा समय-समय पर निर्धारित आरक्षण/रोस्टर के प्रावधान लागू होंगे।

4444.... नियुक्ति। - नियुक्ति। - नियुक्ति। - नियुक्ति। - (1) अमीन के पदों पर सीधी नियुक्ति, परीक्षा प्राधिकार द्वारा अमीन के पदों के लिए आयोजित प्रतियोगिता परीक्षा में प्राप्त अंक एवं अनुभव के लिए अवधारित अंकों को जोड़कर, घोषित परीक्षाफल के अनुसार प्राप्त अनुशंसा के आधार पर की जायेगी।

(2(2(2(2) ) ) ) (क) अमीन पद पर नियुक्ति के लिए अभ्यार्थी को किसी मान्यता प्राप्त बोर्ड/समकक्ष संस्थान से इन्टरमिडिएट (102) या समकक्ष परीक्षा उत्तीर्ण होना चाहिए। (ख) राज्य सरकार के अधीन अनुभव प्राप्त अमीनों को, उनके अनुभव के आधार पर अंक दिये जायेगे। अनुभव के लिए अधिकत्तम अंक 25 होंगे तथा प्रति वर्ष के अनुभव के लिए 5 अंक दिये जायेंगे।

परन्तु यह कि अनुभव की गणना कैलेण्डर वर्ष के अनुसार की जायेगी एवं 1 (एक) कैलेण्डर वर्ष में 6 माह से अधिक के अनुभव को 1 (एक) वर्ष एवं 6 (छः) माह से कम अनुभव को शून्य वर्ष माना जायेगा। (3)3)3)3) अमीन के पद पर सीधी नियुक्ति हेतु अभ्यर्थियों से प्राप्त आवेदन पत्रों का लघु सूचीकरण (Short- Listing) अभ्यर्थियों के इण्टरमिडिएट एवं इण्टरमिडिएट समकक्ष परीक्षा में प्राप्त अंकों तथा राज्य सरकार के अधीन अनुभव प्राप्त अमीनों का उनके अनुभव के आधार पर विभाग/परीक्षा प्राधिकार के द्वारा किया जायेगा, जो कुल रिक्ति के 10 गुणा से कम नहीं होगा।

5555.... लिखित प्रतियोगिता परीक्षा हेतु पाठ्‌यक्रम। -लिखित प्रतियोगिता परीक्षा हेतु पाठ्‌यक्रम। -लिखित प्रतियोगिता परीक्षा हेतु पाठ्‌यक्रम। -लिखित प्रतियोगिता परीक्षा हेतु पाठ्‌यक्रम। - अमीन के पदों पर चयन हेतु प्राधिकृत परीक्षा प्राधिकार द्वारा 75 अंकों की प्रतियोगिता परीक्षा का आयोजन किया जायेगा। प्रतियोगिता परीक्षा में एक प्रश्न पत्र होगा जिसमें निम्नलिखित दो भाग होंगे।

(i) प्रथम खण्ड।- सामान्य ज्ञान, समसाययिक घटना, सामान्य विज्ञान तथा सामान्य हिन्दी- 50 अंक प्रथम खण्ड।- सामान्य ज्ञान, समसाययिक घटना, सामान्य विज्ञान तथा सामान्य हिन्दी- 50 अंक प्रथम खण्ड।- सामान्य ज्ञान, समसाययिक घटना, सामान्य विज्ञान तथा सामान्य हिन्दी- 50 अंक प्रथम खण्ड।- सामान्य ज्ञान, समसाययिक घटना, सामान्य विज्ञान तथा सामान्य हिन्दी- 50 अंक (ii) द्वितीय खण्ड ।- सामान्य गणित-25 अंक'' द्वितीय खण्ड ।- सामान्य गणित-25 अंक'' द्वितीय खण्ड ।- सामान्य गणित-25 अंक'' द्वितीय खण्ड ।- सामान्य गणित-25 अंक''

6666.... परिवीक्षा अवधि।- परिवीक्षा अवधि।- परिवीक्षा अवधि।- परिवीक्षा अवधि।-

(i) मौलिक रिक्त पद के विरूद्ध नियुक्त होने वाला प्रत्येक अमीन पद ग्रहण की तिथि से दो वर्षों की अवधि के लिए परिवीक्षा पर रहेगा।

(ii) परिवीक्षा अवधि पूरी करने पर अमीन का आचरण एवं सेवा संतोषजनक नहीं पाए जाने पर परिवीक्षा अवधि और एक वर्ष के लिए बढ़ायी जा सकेगी, यदि यह प्रतीत हो कि आचरण एवं सेवा में सुधार की संभावना है। बढ़ायी गई अवधि में भी आचरण एवं सेवा संतोष जनक नहीं पायी जाय तो उसकी सेवा समाप्त की जा सकेगी।

7777.... प्रशिक्षण। - प्रशिक्षण। - प्रशिक्षण। - प्रशिक्षण। - अमीनों को समय-समय पर सरकार द्वारा निर्धारित प्रशिक्षण लेना अनिवार्य होगा। यदि प्रशिक्षण के अंत में कोई परीक्षा नियत की जाती है तो उसमें उर्त्तीण होना अनिवार्य होगा।

8888.... विभागीय परीक्षा एवं पाठ्‌यक्रम। - विभागीय परीक्षा एवं पाठ्‌यक्रम। - अमीनों कीे विभागीय परीक्षा के विषय, पाठ्‌यक्रम एवं प्रक्रिया का निर्धारण विभागीय परीक्षा एवं पाठ्‌यक्रम। - विभागीय परीक्षा एवं पाठ्‌यक्रम। -

तथा परीक्षा का आयोजन केन्द्रीय परीक्षा समिति, राजस्व पर्षद द्वारा विभाग के परामर्श से किया जाएगा।

9999.... सम्पुष्टि। - सम्पुष्टि। - सम्पुष्टि। - सम्पुष्टि। - परिवीक्षा पर नियुक्त अमीन परिवीक्षा अवधि की समाप्ति पर, निम्नलिखित शर्त्तों के अधीन रहते हुए, सेवा में सम्पुष्टि का पात्र होगा :-

(i) यदि सरकार कोई विभागीय परीक्षा विहित की गयी हो तो वह अवश्य उर्त्तीण हो चुका हो; (ii) समय-समय पर विहित किया जाने वाला प्रशिक्षण प्राप्त कर लिया गया हो और प्रशिक्षण के अंत में कोई परीक्षा हो तो उसमें उर्त्तीण हो चुका हो;

(iii) इस अवधि में उसका आचरण एवं उसकी सेवा संतोषजनक रही हो।3 (), 26262626 फरवरी 2020फरवरी 2020फरवरी 2020फरवरी 2020 10101010.... वरीयता। -वरीयता। -वरीयता। -वरीयता। - इस संवर्ग के सदस्यों की वरीयता का निर्धारण आयोग से प्राप्त मेधा सूची के क्रमानुसार किया जाएगा तथा यह सामान्य प्रशासन विभाग द्वारा, समय-समय पर, नियत सिद्धांतों एवं प्रक्रिया तथा नियुक्ति प्राधिकार के अधीन रहते हुए होगी।

11111111.... प्रकीर्ण। - (स्थापना संबंधी कार्यों का नियंत्रण) - प्रकीर्ण। - (स्थापना संबंधी कार्यों का नियंत्रण) - प्रकीर्ण। - (स्थापना संबंधी कार्यों का नियंत्रण) - प्रकीर्ण। - (स्थापना संबंधी कार्यों का नियंत्रण) -

(i) इस संवर्ग के सदस्यों की नियुक्ति एवं स्थापना संबंधी सभी कार्य, मुख्य वन संरक्षक, प्रशासन एवं मानव संसाधन विकास, बिहार, पटना के नियंत्रणाधीन होंगे।

(ii) इस संवर्ग के सदस्यों की नियुक्ति, पदस्थापन, स्थानान्तरण, सेवा-सम्पुष्टि, वरीयता सूची का संधारण एवं स्थापना संबंधी सभी विषय यथा स्थिति मुख्य वन संरक्षक, प्रशासन एवं मानव संसाधन विकास, बिहार के अधीन होंगे।

(i) अमीन के पदों के लिए कोई पूर्व संधारित संवर्ग नियमावली नहीं है। विभाग से नियुक्ति संबंधी पूर्व में निर्गत परिपत्रों/आदेशों को एतद्‌ द्वारा निरसित किया जाता है।

(ii) ऐसे निरसन के होते हुए भी, पूर्व के परिपत्रोंं/आदेशों के अधीन की गयी नियुक्ति विधिमान्य बनी रहेगी मानों वह नियुक्ति इस नियमावली के समुचित उपबंधों के अधीन की गयी हो।

Ara. stha.-25/2014-572--/E,F & CC--In exercise of the Powers conferred by the Proviso to Article-309 of the constitution of India, the Governor of Bihar is pleased to make the following rules to regulate the recruitment and other service conditions of the Amins in the Department of Environment, Forest & Climate Change, Government of Bihar:- Short title, extent and commencement -(1) These Rules shall be called " Department of Environment, Forest & Climate Change, Government of Bihar Amin Cadre (Recruitment and Service Conditions) Rules, 2020", (2) It shall extend to the whole of the State of Bihar; (3) It shall come into force at once. 2. Definitions–In these rules, unless there is anything contrary to the subject or context - (i) "State Government" means the Government of Bihar; (ii) "Cadre" means the Department of Environment, Forest & Climate Change, govt. of Bihar Amin cadre;

(iii) "The appointing authority" means the Chief conservator of Forests, Administration & HRD, Bihar, Patna;

(iv) "Cadre controlling Authority" means the Principal Chief Conservator of forests, Bihar, Patna;

(v) "Department" means the Department of Environment, Forest & Climate Change, Government of Bihar;

(vi) Examination Authority means the Bihar state selection Commission or Bihar combined entrance competitive Examination Board (BCECEB) or any other authority selected by the Department of Environment, Forest & Climate Change, Government of Bihar;

(vii) "Year" means the financial year i.e. from 1 April to 31 March of the next years. (viii) "Vacancy within year" means the vacancy occurring on account of creation of new post, retirement, death, termination and discharge from service in a specific year;

(i) The Pay scale, allowances and grade pay/Pay Level of the above posts shall be the same as may be fixed by the Government, from time to time.

(ii) Persons appointed and working in the said category prior to application of these Rules, shall automatically be deemed to be included in this cadre; (iii) The State Government may, from time to time, increase or decrease the number of sanctioned strength or may keep any number or posts under adjourned position;

4. Age- Limit – the minimum age of the candidate for the post of Amin shall not be less than 18 years as on 1st of August of the year in which applications would be invite. The maximum age- limit shall be the same as may be fixed from time to time, by the Department of General Administration, Government of Bihar. 5. Reservation – The Provisions of reservation / roster as fixed from time to time by the State Government, shall be applicable to the appointment of this cadre. 6. Appointment – (1) Direct appointment to the post of Amin will be made on the basis of the recommendation obtained as per the result declared in the Examination conducted for the post of Amin by the Examination authority adding the obtain marks detrminecl for the experience.

(2) (a)- For appointment to the post of amin the candidate must have passed the intermediate (10+2) or any other equivalent from examination any recognized board/equivalent institution.

(b) Mark will be given to the experienced amin on the basis of experience, obtained for services in the state government. The maximum marks for experience will be 25 and 5 marks for each year will be given.

Provided that calculation of experience will be made as per the calendar year and more than six months of experience will be counted as one year and less than six months of one year will be counted as nil (zero) year."

(3) Applications received from candidates for direct appointment to the post of Amin shall be short-listed on the basis of marks obtained in the Intermediate or equivalent to Intermediate exam and experience obtained by Amins working under State government on the basis of their experience, which will not be less than ten times of the total vacancy." 7. Written syllabus for competitive examination – Syllabus for the written Competitive Examination :- Competitive Examination of 75 marks will be held by the Examination Authority authorized for the selection to the post of Amin. There shall be one question paper having two parts in the Competitive Examination as follows :-

(i) first Part-1 General knowledge, Current Affairs, general Science and General Hindi-50 marks.

(ii) Second Part-2 General Maths-25 marks"

8. Probation Period –

(i) Every Amin to be appointed against the basic vacant post shall be on probation for a period of two years from the date of joining.

(ii) In case the conduct and service of a Amin is not found satisfactory after the completion of the probation period, the probation period may be extended for a further period 'of one year by the Government if it appears that there is a possibility of improvement in conduct and service. If the conduct and service is not found satisfactory even during the extended period of probation, his/her service may be terminated.

9. Training – It will be compulsory for the Amins to under go the trainings prescribed by the Government from time to time. If any examination is prescribed at the end of the training, it will be compulsory to pass the same. 10.\ Departmental Examination and syllabus – The determination of subject, syllabus and procedure of the departmental examination for the Amins and the examination will be conducted by the central examination committee, Board of Revenue in consultation with the department. 11. Confirmation – The Amin appointed on probation shall be eligible for confirmation in the service on expiry of the probation period subject to the following conditions :-

(i) If any departmental examination has been prescribed the Government, he must have passed the said examination.

(ii) He has received training to be prescribed, from time to time, and if any examination is fixed at the end of the training he would have passed the same.

(iii) His conduct and his service have been satisfactory during this period.

12. Seniority – Determination of Seniority of the members of this cadre shall be in order of the merit list received from the Commission and subject to the principles and procedure laid down by the Department of General Administration of the State Government and the Appointing authority, from time to time. 13. Miscellaneous – (Control of works relating to establishment) –

(i) All works relating to appointment of the members of this cadre and establishment shall be under the administrative control of the Chief Conservator of Forests, Administration and Human Resources Development, Bihar, Patna.

(ii) The appointment, posting, transfer, confirmation of service, maintenance of seniority list, and all matters relating to establishment of the members of this cadre shall be under the control of the Chief conservator of Forests, Administration and Human Resources Development, Bihar, Patna as the case may be.

14. Saving and Repeal-

(i) No previous cadre Rules for the post of Amin exists. Previous Circulars/Orders issued by the Department regarding appointment are hereby repealed.

(ii) Notwithstanding such repeal, appointment made under earlier Government circulars/orders shall remain valid as if they have been made under the relevant provisions of these rules.
