सं॰ एल0जी0-01-06/2020/2283/लेज—भारत-संविधान के अनुच्छेद 213 के खंड-(1) के अधीन बिहार राज्यपाल दिनांक-11 मई, 2020 को प्रख्यापित निम्नलिखित अध्यादेश इसके द्वारा सर्वसाधारण की सूचना के लिए प्रकाशित किया जाता है ।

बिहार-राज्यपाल के आदेश से, मदन किशोर कौशिक, सरकार के सचिव ।ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 12 मई 2020 2 (बिहार अध्यादेश संख्या-02, 2020) बिहार नगरपालिका (संशोधन) अध्यादेश, 2020 बिहार नगरपालिका अधिनियम, 2007 (बिहार अधिनियम 11, 2007) में संशोधन करने के लिए अध्यादेश। प्रस्तावना- चूँकि राज्य विधानमंडल सत्र में नहीं है, और, चूँकि, बिहार राज्यपाल का समाधान हो गया है कि ऐसी परिस्थितियाँ विद्यमान हैं जिनके कारण बिहार नगरपालिका अधिनियम, 2007 (बिहार अधिनियम 11, 2007) का, इसमें आगे वर्णित रीति से, संशोधन करने के लिए उनके लिए तुरंत कार्रवाई करना आवश्यक हो गया है;

इसलिए, अब, भारत-संविधान के अनुच्छेद 213 के खण्ड (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल निम्नलिखित अध्यादेश प्रख्यापित करते हैं :-

1. संक्षिप्त नाम, विस्तार और प्रारम्भ।- (1) यह अधिनियम बिहार नगरपालिका (संशोधन) अध्यादेश, 2020 कहा जायेगा; (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगा।

2. बिहार अधिनियम, 11, 2007 की धारा-3 का संशोधन।-

(i) उक्त अधिनियम की धारा 3 की उपधारा (1) के द्वितीय परन्तुक निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :- ''परन्तु यह और कि सभी दशाओं में दीर्घकालिक व अल्पकालिक काश्तकार कर्मियों (कृषि कर्मियों) की कुल जनसंख्या उस क्षेत्र की कुल कर्मियों की जनसंख्या का पचास प्रतिशत से कम होगी।''

3. बिहार अधिनियम, 11, 2007 की धारा-50 का संशोधन।-

(i) उक्त अधिनियम की धारा 50 की उपधारा (1) में संख्या ''2/5'' को संख्या ''1/3'' के द्वारा प्रतिस्थापित किया जायेगा।

4. बिहार अधिनियम, 11, 2007 की धारा-67 का संशोधन।-

(i) उक्त अधिनियम की धारा 67 के प्रथम परन्तुक के बाद निम्नलिखित द्वितीय परन्तुक जोड़ा जायेगाः- ''परन्तु यह और कि राज्य सरकार के लिए व्यापक जनहित में ऐसा निदेश जैसा कि वह यथोचित समझे, जारी करना विधि संगत होगा, एवं नगरपालिका प्राधिकारी के लिए ऐसे निदेश का पालन करना अपेक्षित होगा।''

5. बिहार अधिनियम, 11, 2007 की धारा-145 का संशोधन।-

(i) उक्त अधिनियम की धारा 145 की उपधारा (1) को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :- (1) कोई भी व्यक्ति मुख्य नगरपालिका पदाधिकारी की लिखित अनुमति के बिना नगरपालिका के क्षेत्र के अन्तर्गत किसी स्थान में या किसी सार्वजनिक मार्ग अथवा सार्वजनिक स्थान से दिखाई पड़ने वाला कोई विज्ञापन लोकदृष्टि में चाहे वह किसी रीति से हो (इसमें सिनेमा के माध्यम से प्रदर्शित कोई विज्ञापन भी शामिल है) प्रदर्शित नहीं करेगा तथा न ही कोई विज्ञापन किसी जमीन, भवन, दिवाल, टट्‌टी, फ्रेम, छतरी, ढाँचा, गाड़ी, निऑन अथवा आकाशीय चिन्ह के उपर लगायेगा, न प्रदर्शित करेगा, न चिपकायेगा और न रखेगा।'' परन्तु यह कि लोक सभा निर्वाचन एवं विधान सभा निर्वाचन के क्रम मेंं राजनैतिक दलों एवं अभ्यर्थियों द्वारा चुनाव प्रचार के लिए प्रकाशित विज्ञापन के लिए मुख्य नगरपालिका पदाधिकारी की लिखित अनुमति आवश्यक नहीं होगी।

परन्तु यह और कि लोक सभा निर्वाचन एवं विधान सभा निर्वाचन के क्रम मेंं राजनैतिक दलों एवं अभ्यर्थियों द्वारा जन प्रतिनिधित्व अधिनियम 1951 के प्रावधान की परिधि में ही विज्ञापन प्रदर्शित किया जायेगा।पटना। दिनांक :- 11 मई 2020 फागू चौहान, बिहार राज्यपाल। भारत-संविधान के अनुच्छेद 213 के खण्ड (1) के अधीन मैने इस अध्यादेश को प्रख्यापित किया है।पटना। दिनांक :- 11 मई 2020 फागू चौहान, बिहार राज्यपाल। 3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 12 मई 2020 विधि विभाग

संख्या-एल0जी0-01-06/2020/2284/लेज—बिहार राज्यपाल द्वारा dated- 11th May, 2020 को प्रख्यापित बिहार नगरपालिका (संशोधन) अध्यादेश, 2020 (बिहार अध्यादेश संख्या-02,2020) का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा ।

THE BIHAR MUNICIPAL (AMENDMENT) ORDINANCE, 2020

AN

ORDINANCE

TO AMEND THE BIHAR MUNICIPAL ACT, 2007 (ACT 11, 2007)

Preamble- WHEREAS, The Legislature of the State of Bihar is not in session;

AND, WHEREAS, the Governor of Bihar is satisfied that the circumstances exist which render it necessary for him to take immediate action to amend the Bihar Municipal Act, (Act 11, 2007), in the manner hereinafter appearing.

NOW, THEREFORE, in exercise of powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor of Bihar is pleased to promulgate the following Ordinance :-

1. Short title, extent and commencement.— (1) This Act may be called the Bihar Municipal (Amendment) Ordinance, 2020. (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force from the date of its publication in the official gazette.

2. Amendment of Section-3 of Bihar Act 11, 2007:-

(i) Second proviso of sub section (1) of section 3 of the said Act shall be substituted by following:- " Provided further that the total population of main cultivator workers and marginal cultivator workers shall be below fifty percent of total population of workers in such area in all cases."

3. Amendment of Section-50 of Bihar Act 11, 2007:-

(i) In sub-section (1) of section 50 of the said Act the number "2/5" shall be substituted by the number "1/3".

4. Amendment of Section-67 of Bihar Act 11, 2007:- (i) After first proviso of section 67 of the said Act the second proviso shall be inserted by following:- "Provided that it shall be lawful for the State Government in the larger public interest to issue such direction to the Municipal Authorities as may be deemed fit and proper, and the Municipal Authorities will be expected to follow such direction." 5. Amendment of Section-145 of Bihar Act 11, 2007:- (i) Sub section (1) of Section 145 of the said Act shall be substituted by following:-

"(1) No person shall not erect, exhibit, fix or retain upon or over any land, building, wall, hoarding, frame post, kiosk, structure, vehicle, neon-sign of sky-sign, any advertisement or display any advertisement to public view in any manner whatsoever (including any advertisement exhibited by means of cinematograph), visible from a public street of public place, in any place within the Municipal area without permission, in writing, of the Chief Municipal Officer.

Provided that during Lok Sabha Elections and Legislative Assembly elections, written permission of the Chief Municipal Officer will not be necessary for the advertisement published for election campaign by political parties and candidates.

Provided further that during Lok Sabha Elections and Legislative Assembly elections, advertisement will be displayed by the Political Parties and candidates under the provisions of Representation of the People Act, 1951.
