सं॰ 11न॰वि॰ RERA विविध-08/2018-645/न॰वि॰आ॰वि॰—बिहार भू-सम्पदा (विनियमन एवं विकास) नियमावली, 2017 के नियम-29(3) में अंकित प्रावधान के अनुसार भू-सम्पदा अपीलीय न्यायाधिकरण, बिहार के अध्यक्ष एवं सदस्यों के वेतन, भत्ते एवं सेवा शर्त्त एतद् द्वारा निम्न प्रकार निर्धारित किया जाता है - (i). बिहार भू-सम्पदा अपीलीय न्यायाधिकरण के अध्यक्ष को इस पदावधि के अन्तराल में वेतन, भाा एवं अन्य सुविधाएँ, नियमित सेवा में होने की स्थिति में उनके सेवा र्शा के अनुरूप अनुमान्य होंगे। नियमित सेवा से सेवानिवृाि के उपरान्त न्यायाधिकरण के अध्यक्ष के वेतन का निर्धारण अन्तिम "मूल वेतन घटाव मूल पेंशन" के आधार पर किया जायगा, जिस पर समय-समय पर राज्य सरकार द्वारा निर्धारित मँहगाई भाा अनुमान्य होगा। अन्य भो एवं सेवा र्शा, सेवानिवृाि के समय उनके द्वारा धारित पद के अनुरूप अनुमान्य हाेंगे।
परन्तु, वेतन तथा भो न्यायाधिकरण में नियुक्ति के ठीक पूर्व अध्यक्ष द्वारा धारित पद के विरूद्ध अनुमान्य वेतन/पेंशन तथा भाों से न्यून नहीं होंगे।
(ii). बिहार भू-सम्पदा अपीलीय न्यायाधिकरण के सदस्य को इस पदावधि के अन्तराल में वेतन, भाा एवं अन्य सुविधाएँ, नियमित सेवा में होने की स्थिति में उनके सेवा र्शा के अनुरूप अनुमान्य हाेंगे। 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11 (cid:5)सत(cid:8)बर 2020

No.-11न॰वि॰ RERA विविध-08/2018-645/न॰वि॰आ॰वि॰—As per the provisions made in the Rule 29(3) of the Bihar Real Estate (Regulation & Development) Rules 2017 the salary, allowance and service conditions of the Chairperson and Members of the Real Estate Appellate Tribunal, is being hereby determined in the following manner :- (i). During the tenure as the Chairperson of the Bihar Real Estate Appellate Tribunal, in case of being in the regular service, the salary, allowances and other facilities shall be presumptive to his service conditions.
After retirement from the regular service, the salary of the Chairperson of the Tribunal shall be determined on the basis of "Basic pay - Pension", on which dearness allowance laid down by the State Government from time to time shall be applicable. Any other allowances and service conditions shall be similar to the post held at the time of retirement.
Provided, the salary and allowances will not be less than the salary / pension and allowances as admissible against the post held by the Chairperson just before the appointment to the Tribunal.
(ii). During the tenure as the Member of the Bihar Real Estate Appellate Tribunal, in case of being in the regular service, the salary, allowances and others facilities shall be presumptive to his service conditions.
