1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।—
(1) यह नियमावली बिहार खनिज (समानुदान, अवैध खनन, परिवहन एवं भंडारण निवारण) (संशोधन) नियमावली, 2020 कही जा सकेगी। 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 18 (cid:6)सत(cid:9)बर 2020 परंतु ईंट भट्ठा के उद्देश्य से ईंट मिट्टी के उत्खनन को खनन गतिविधि नहीं मानी जाएगी, पर्यावरणीय स्वीकृति के लिए पर्यावरणीय सहमति की आवश्यकता नहीं होगी, यदि खनन की गहराई समीपवर्ती जमीन स्तर से डेढ़ मीटर से अधिक नहीं हो।

No. A.N.-01/L.K.(Brick)-42/20-2645/M—In exercise of the powers conferred by section 15 of Mines & Minerals (Development and Regulation) Act, 1957 the Governor of Bihar is hereby pleased to make the following rules to amend the Bihar Minerals (Concession, Prevention Of Illegal Mining, Transportation & Storage) Rules, 2019.
1. Short title, extent and commencement .–
(1) These Rules may be called Bihar Minerals (Concession, Prevention Of Illegal Mining, Transportation & Storage) (Amendment) Rules, 2020.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once.
2. Amendment in Chapter-VIII, Rule-38 (3) of Bihar Minerals (Concession, Prevention
Of Illegal Mining, Transportation & Storage) Rules, 2019.:- Sub-rule (3) of Rule-38 of Chapter-
VIII of said Rules, 2019 shall be substituted by the following:-
"38 (3) On an application made to the Mining Officer by an applicant and on submission of the required documents as prescribed in Rule 34 of these rules along with No Objection Certificate and Emission consent order from the Bihar State Pollution control Board and the consolidated amount of royalty as per Schedule III B of the rules, He/She shall grant a quarrying permit in form 'D' for extraction and removal of brick earth in respect of any brick kiln for a particular brick season from any specified land within the limit of his/her jurisdiction. Provided that the quarrying for the purpose of brick kiln shall be deemed as non- mining activity for the purpose of environmental clearance and shall not require Environmental Clearance if the depth of quarry is not more than one and half meters from the adjoining ground level.''
