सं॰ 7/स्था0-04-02/2017-8617/सा0प्र0वि0—भारत-संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत शक्तियों का प्रयोग करते हुए बिहार राज्यपाल ''उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीशों और भूतपूर्व न्यायाधीशों की घरेलू सहायता (संषोधन) नियमावली, 2020'' बनाते हैंः-
1. संक्षिप्त नाम, विस्तार, प्रारम्भ और लागू होना।-(1) यह नियमावली ''बिहार उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीशों और भूतपूर्व न्यायाधीशों की घरेलू सहायता (संषोधन) नियमावली, 2020'' कही जा सकेगी।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह नियमावली राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगी। (4) यह नियमावली ऐसे व्यक्ति पर लागू होगी जिसने पटना उच्च न्यायालय के मुख्य न्यायाधीश या न्यायाधीश के रूप में पद ग्रहण किया हो।
2. उक्त नियमावली ''बिहार उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीशों और भूतपूर्व न्यायाधीशों की घरेलू सहायता नियमावली, 2019'' के नियम-10 के बाद नियम-10ए के रूप में अंतःस्थापित किया जायेगा।
''10ए- इस नियमावली में इसके विरूद्ध प्रावधान होते हुए भी पटना उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीष को यह चयन का अधिकार होगा कि वे अपने स्वविवेक से पटना उच्च न्यायालय में कार्यरत् ग्रुप सी अथवा ग्रुप डी के कर्मी को प्रतिनियुक्ति के आधार पर घरेलू सहायता हेतु विषेष निजी सहायक या घरेलू सहायक के रूप में रख सकेंगे। पटना उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीष को यह सुविधा उनके किसी अन्यत्र स्थान पर पदस्थापन होने पर भी उपलब्ध होगी, जहाँ वे दूसरे पद पर नियुक्ति स्वीकार करते हैं। ऐसे प्रतिनियुक्त कर्मी की सेवा भूूतपूर्व मुख्य न्यायाधीष के साथ प्रतिनियुक्त कर्मी के वार्धक्य सेवानिवृति तक उपलब्ध होगी।'' 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 22 ०सत(cid:20)बर 2(cid:21)2(cid:21)

No-7/Ashta.-04-02/2017-8617/GAD—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India the Governor of Bihar is pleased to make the following Rules to regulate the Domestic Help to Former Chief Justices and Former Judges of High Court (Amendment) Rules, 2020:-
1. Short title, extent, commencement and application.—(1) These Rules may be called the 'Bihar Domestic Help to Former Chief Justices and Former Judges of the High Court (Amendment) Rules, 2020'.
(2) It shall extend to whole of the State of Bihar. (3) These Rules shall come into force from the date of its publication in the official Gazette.
(4) The Rules shall apply to a person who has held office either as a Chief Justice or as a Judge of the Patna High Court.
2. After Rule-10 of The Bihar Domestic Help to Former Chief Justices and
Former Judges of High Court Rules, 2019 Rule 10A shall be inserted as follows:-
"10A-Notwithstanding anything to the contrary in these Rules, a former Chief Justice of Patna High Court will have the choice to keep a serving Group 'C' or Group 'D' employee of Patna High Court with him on deputation as his special Personal Assistant or domestic help. This facility from Patna High Court shall remain available to the former Chief Justice at the place where he may have accepted appointment to another post. Services of such deputed staff shall remain available with the former Chief Justice till the superannuation of the deputed staff."
