सं॰ 06/स्कूल बस-08-17/2020-6992—मोटरयान अधिनियम, 1988 (अधिनियम संख्या-59, 1988) की धारा-138 द्वारा प्रदा शक्तियों का प्रयोग करते हुए बिहार मोटरगाड़ी नियमावली, 1992 के नियम-122 में निम्नलिखित संषोधन किया जाता है।

1111.... संक्षिप्त नाम, विस्तार और आरंभ :संक्षिप्त नाम, विस्तार और आरंभ :संक्षिप्त नाम, विस्तार और आरंभ :संक्षिप्त नाम, विस्तार और आरंभ :-(1) यह नियमावली बिहार मोटरगाड़ी (संषोधन) नियमावली, 2020 कही जा सकेगी।

(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह अधिसूचना बिहार राजपत्र में प्रकाषन की तिथि से प्रवृा होगी।

2222.... बिहार मोटरगाड़ी नियमावली, 1992 के नियम-122 के उपनियम-2 एवं 3 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है :-

''122 (2) (क) विद्यालय वाहनों के सुरक्षित परिचालन एवं उसका उपयोग करने वाले छात्र-छात्राओं के जीवनरक्षा एवं सुरक्षित यात्रा के लिए विद्यालय वाहनों के परिचालन का विनियमन अनुसूची-'7'अनुसूची-'7'अनुसूची-'7'अनुसूची-'7' में अन्तर्निहित प्रावधानों के अनुसार होगा। (ख) परिवहन विभाग द्वारा स्कूल/षिक्षण संस्थान के स्कूली बच्चों/छात्रों के सुरक्षित यात्रा सुनिष्चित करने हेतु मोटरयान अधिनियम, 1988 की धारा-215 के प्रावधानों के तहत निर्गत अधिसूचना सं0-402 दिनांक-18.04.2018 द्वारा गठित सड़क सुरक्षा समिति/जिला सड़क सुरक्षा समिति को अनुसूची-'7'अनुसूची-'7'अनुसूची-'7'अनुसूची-'7' के अन्तर्निहित प्रावधानों के उल्लंघन की स्थिति में दंड अधिरोपित किये जाने हेतु ''नियामक प्राधिकार'' ''नियामक प्राधिकार'' घोषित ''नियामक प्राधिकार'' ''नियामक प्राधिकार'' किया जाता है।

122 (3) इस विनियमन में परिवहन विभाग समय-समय पर अवष्यकतानुसार परिवर्तन, संषोधन, परिवर्द्धन एवं अन्य रूपांतरण कर सकेगा।

1111.... उद्देश्य उद्देश्य उद्देश्य उद्देश्य :- :- :- :- इस विनियमन का मुख्य उद्देश्य वाहनों के माध्यम से विद्यालय जाने वाले छात्र-छात्राओं को सुरक्षित करना है। इसके लिए स्कूली बच्चों के परिवहन के क्रम में निम्नलिखित कार्रवाई अपेक्षित है :-

(क) स्कूली बच्चों की घर से विद्यालय तक एवं वापस घर तक सुरक्षित यात्रा सुनिश्चित करना। (ख) स्कूल बसों/छात्रों के परिवहन में संलग्न अन्य वाहनों के लिए परिवहन व्यवस्था के मानक निर्धारित करना।

(ग) स्कूल बसों/स्कूली वाहनों पर प्रतिनियुक्त चालकों/परिचरों (Attendent) के लिए मानसिक एवं शारीरिक मापदंड का निर्धारण एवं उनके द्वारा वाहन चालन के स्थापित अधिनियम/नियमों का अनुपालन सुनिष्चित कराना।

(घ) स्कूल प्रबंधन एवं स्कूल बच्चों के परिवहन से जुड़े अन्य हितधारकों के उत्तरदायित्व का निर्धारण।

2222.... ''विद्यालय वाहन''''विद्यालय वाहन''''विद्यालय वाहन''''विद्यालय वाहन'' से तात्पर्य हैसे तात्पर्य हैसे तात्पर्य हैसे तात्पर्य है :-ः-ः-ः-

(i) स्कूल प्रबंधन या उसके प्रधानाचार्य/निदेशक या स्कूल के किसी अन्य पदाधिकारी के नाम पर विधिवत पंजीकृत सभी प्रकार के वाहन, या

(ii) विद्यालय में छात्र-छात्राओं के परिवहन हेतु निजी ऑपरेटर एवं विद्यालय प्रबंधन के बीच समझौते के तहत्‌ किराया अथवा लीज पर संचालित स्कूल वाहन, या

(iii) अन्य सभी श्रेणी के विधिमान्य वाहन जो स्कूली बच्चों को विद्यालय अथवा अभिभावक की सहमति से किसी विद्यालय के छात्र-छात्राओं का नियमित रूप से परिवहन कर रहे हों। 3333.... विद्यालय वाहनों के लिए मानकविद्यालय वाहनों के लिए मानकविद्यालय वाहनों के लिए मानकविद्यालय वाहनों के लिए मानक :-

(i) बसों/अन्य वाहनों की बॉडी सुनहरे पीले रंग की होगी। यह रंग IS-5-1994 (समय समय पर यथा संशोधित) के अनुरूप होगा।

(ii) विद्यालय की पहचान के लिए बस की बॉडी पर खिड़की के स्तर के नीचे सभी ओर न्यूनतम 150 मि.मी. चौड़ा 'सुनहरा भूरा' ('सुनहरा भूरा' ('सुनहरा भूरा' ('सुनहरा भूरा' (Golden Brown)))) रंग का एक बैंड पेन्ट कर उसपर स्पष्ट अक्षरों में विद्यालय का नाम लिखा जाना अनिवार्य होगा।

(iii) यदि विद्यालय द्वारा बस या अन्य वाहन किसी वाहन ऑपरेटर से लीज अथवा किराया पर लिया गया है, तो बस के पीछे और सामने स्पष्ट रूप से ''''ऑन स्कूल ड्‌यूटीऑन स्कूल ड्‌यूटीऑन स्कूल ड्‌यूटीऑन स्कूल ड्‌यूटी'''' ((((On School Duty),),),), प्रदर्षित करना होगा।

(iv) मोटरयान अधिनियम, 1988 की धारा-118 के आलोक में स्कूल बसों/स्कूल वाहनों में विनिर्दिष्ट मानक का गति नियंत्रक उपकरण (Speed Governor) लगाना अनिवार्य होगा, जिसकी अधिकतम गति सीमा 40 कि.मी. प्रति घंटा होगी। अधिकतम गतिसीमा समय-समय पर परिवहन विभाग द्वारा निर्धारित की जा सकेगी।

(v) सभी वाहनों में एक प्राथमिक चिकित्सा बॉक्स रखना अनिवार्य होगा। (vi) वाहन में अग्निशामक यंत्र (ड्राई पाउडर टाइप) लगाना अनिवार्य होगा। (vii) प्रत्येक स्कूल वाहन में केंद्रीय मोटर वाहन नियमावली, 1989 के नियम-125H में उल्लिखित भी.एल.टी.डी. (Vehicle Location Tracking Device) और पैनिक बटन (Panic Button) लगाना अनिवार्य होगा।

(viii) प्रत्येक स्कूल वाहन में केंद्रीय मोटर वाहन नियमावली, 1989 के नियम-104 में उल्लिखित रेट्रो रिफ्लेक्टिव टेप (Retro Reflective Tape) लगाना अनिवार्य होगा।

(ix) प्रत्येक स्कूल बस/स्कूल वाहन को जी.पी.एस. युक्त होना अनिवार्य होगा। (x) स्कूल के बच्चों के परिवहन के लिए उपयोग किए जाने वाले सभी वाहनों में स्कूल बैग के रखने की उचित व्यवस्था सुनिष्चित की जाएगी।

(xi) शारीरिक रूप से असमर्थ (दिव्यांग) छात्रों के लिए स्कूल बस/अन्य वाहन में ऐसी सुविधाएँ होनी चाहिए कि उन्हें वाहन में चढ़ने एवं उतरने में परेषानी नहीं हो।

(xii) स्कूली बच्चों के परिवहन में संलग्न बस एवं अन्य सभी प्रकार के वाहनों का पंजीकरण व्यवसायिक यात्री वाहन के रूप में होगा।

(xiii) मोटरयान अधिनियम, 1988 के तहत्‌ स्कूल वाहनों के लिए सक्षम प्राधिकार से परमिट प्राप्त करना अनिवार्य होगा।

(xiv) 8 वर्ष तक के नये वाहनों को द्विवार्षिक एवं अन्य सभी स्कूली वाहनों को वार्षिक फिटनेस प्रमाण पत्र प्राप्त करना अनिवार्य होगा।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 24 (cid:6)सत(cid:9)बर 2020 (xv) बसों के बॉडी का डिजाईन भारत सरकार, सड़क परिवहन और राजमार्ग मंत्रालय द्वारा निर्धारित AIS-052 मानक (समय-समय पर यथासंषोधित) के अनुरूप होगा।

(xvi) बस के सामने एवं पीछे बाहरी भाग के तल पर 'स्कूल के प्रतीक चिन्ह्‌ को' 'स्कूल के प्रतीक चिन्ह्‌ को' (40 से.मी. x 30 'स्कूल के प्रतीक चिन्ह्‌ को' 'स्कूल के प्रतीक चिन्ह्‌ को' से.मी.) काले रंग के तल पर सुनहरे पीले रंग से अंकित किया जाएगा कि वह सामान्य रूप से सुगोचर हो।

(xvii) प्रत्येक स्कूल बस में दो आपातकालीन द्वार होंगे-पहला बस के दाहिनी ओर के पिछले आधे भाग में और दूसरा बस के पीछे की ओर होगा। 14 सीट तक के वाहनों के लिए अतिरिक्त आपातकालीन द्वार की आवष्यकता नहीं होगी।

(xviii) बस के आपातकालीन निकास द्वार के ऊपर बस के अन्दर और बाहर दोनों तरफ से सफेद पृष्ठभूमि पर लाल रंग से "आकस्मिक निकास""आकस्मिक निकास""आकस्मिक निकास""आकस्मिक निकास" (Emergency Exit) प्रमुखता से लिखा जाएगा।

(xix) बस की खिड़कियों को क्षैतिज ग्रिल के साथ फिट किया जाएगा। (xx) स्कूल बस में सी.सी.टी.वी. को अनिवार्य रूप से स्थापित किया जायेगा, ताकि यात्रा के दौरान वाहन की गतिविधि को रिकार्ड किया जा सके। सी.सी.टी.वी. फुटेज 60 (साठ) दिनों तक स्कूल प्रबंधन को संरक्षित करना होगा। छोटे वाहनों (14-सीटर से कम) के लिए सी.सी.टी.वी. का अधिष्ठापन अनिवार्य नहीं होगा।

(xxi) बस के बाहरी भाग में (सह-चालक की ओर) Stop Signal ('रूकें')('रूकें')('रूकें')('रूकें') को प्रदर्शित करने वाला कम से कम 150 मि.मी. बाहर की ओर निकला हुआ ''''Stop^^^^ ¼¼¼¼हथ्था)हथ्था)हथ्था)हथ्था) अधिष्ठापित किया जाएगा, जिसपर लिखा गया ''''STOP' शब्द कम से कम 40 मि.मी. ऊचाई का होना चाहिए। (xxii) स्कूल बस से भिन्न अन्य व्यवसायिक छोटे वाहन; यथा ऑटो रिक्शा, मारूति ओमनी वैन, टाटा 407, Tata Ace, विंगर एवं अन्य कार जिसका उपयोग स्कूल के छात्रों के परिवहन के लिए नियमित रूप से किया जा रहा है, के द्वारा भी क्रमांक-xv से xxi तक को छोड़कर शेष सभी मानकों का पालन करना अनिवार्य होगा। इस तरह के वाहन पर भी सामने और पीछे की तरफ एक विशिष्ट स्थान पर स्पष्ट अक्षरों में 'स्कूल वैन''स्कूल वैन''स्कूल वैन''स्कूल वैन' अथवा 'ऑन स्कूल ड्‌यूटी' 'ऑन स्कूल ड्‌यूटी' 'ऑन स्कूल ड्‌यूटी' 'ऑन स्कूल ड्‌यूटी' प्रदर्शित करना अनिवार्य होगा।

(xxiii) माननीय सर्वोच्च न्यायालय द्वारा निर्गत सड़क सुरक्षा से संबंधित दिशा-निर्देशों तथा सड़क परिवहन एवं राजमार्ग मंत्रालय, भारत सरकार, परिवहन विभाग, बिहार सरकार या जिला प्रशासन अथवा विभिन्न षिक्षा बोर्ड द्वारा समय-समय पर निर्गत निदेश तत्समय लागू होंगे। 4444.... कर्तव्य एवं दायित्व :-कर्तव्य एवं दायित्व :-कर्तव्य एवं दायित्व :-कर्तव्य एवं दायित्व :-

4444....1111 विद्यालय प्रबंधनविद्यालय प्रबंधनविद्यालय प्रबंधनविद्यालय प्रबंधन की जिम्मेदारीकी जिम्मेदारीकी जिम्मेदारीकी जिम्मेदारी :-ः-ः-ः-

(i) प्रत्येक स्कूल प्रबंधन एक ''परिवहन प्रभारी'' ''परिवहन प्रभारी'' (Transport Incharge) नियुक्त ''परिवहन प्रभारी'' ''परिवहन प्रभारी''

करेगा एवं इसकी सूचना संबंधित जिला परिवहन पदाधिकारी को देगा।

(ii) प्रधानाचार्य परिवहन प्रभारी के माध्यम से स्कूल बसों एवं अन्य स्कूली वाहनों में निर्धारित मानकों के अनुपालन का पर्यवेक्षण करेंगे एवं आवश्यकतानुसार बेहतरी के लिए उपयुक्त कदम उठाएंगे।

(iii) प्रधानाचार्य अपने विद्यालय के प्रत्येक छात्र-छात्रा के सुरक्षित परिवहन के लिए जिम्मेवार होंगे। उन्हें विद्यालय प्रबंधन द्वारा संचालित वाहन के अतिरिक्त ऐसे सभी व्यवसायिक यात्री वाहनों को सूचीबद्ध करना होगा, जिनसे उनके छात्र-छात्रा विद्यालय आते हैं तथा इन सभी वाहन स्वामियों/वाहन ऑपरेटरों के साथ निर्धारित मानकों के अनुपालन के संबंध में एक समझौता करना होगा एवं उनसे इस आशय का बॉण्ड लेना होगा। किसी वाहन स्वामी/वाहन ऑपरेटरवाहन स्वामी/वाहन ऑपरेटरवाहन स्वामी/वाहन ऑपरेटरवाहन स्वामी/वाहन ऑपरेटर द्वारा उल्लंघन की स्थिति में वैसे वाहन स्वामी/वाहन ऑपरेटर के विरूद्ध कार्रवाई हेतु जिला परिवहन पदाधिकारी को अनुशंसा हेतु विद्यालय प्रबंधन जवाबदेह होगा।

(iv) विद्यालय प्रबंधन द्वारा स्कूल बस में बच्चों को चढ़ाने एवं उतारने के लिए योग्य परिचारक (परिचारक (परिचारक (परिचारक (Attendant)))) की व्यवस्था करनी होगी। बालिका विद्यालयों के मामले बालिका विद्यालयों के मामले बालिका विद्यालयों के मामले बालिका विद्यालयों के मामले में एक महिला परिचारक में एक महिला परिचारक में एक महिला परिचारक में एक महिला परिचारक ((((Attendant)))) निश्चित रूप सेनिश्चित रूप सेनिश्चित रूप सेनिश्चित रूप से होगी।

(v) विद्यालय प्रबंधन ऊपर वर्णित सभी वाहनों के चालकों एवं संवाहकों के नाम एवं पता, मोबाईल नंबर संबंधी अभिलेख विद्यालय में संधारित करेगा। साथ ही बसों/वाहनों पर व्यवस्थापक का नाम/पता, ड्राईवर एवं परिचारक (Attendant)4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 24 (cid:6)सत(cid:9)बर 2020 का नाम एवं मोबाईल नंबर एवं ड्राईविंग लाईसेंस नम्बर दृष्टिगोचर स्थान पर अंकित कराया जाना अनिवार्य होगा।

(vi) विद्यालय प्रबंधन द्वारा विद्यालय परिसर में स्कूल बसों/स्कूल वाहनों से छात्र-छात्रा को उतरने एवं उसपर चढ़ने हेतु उचित पार्किग स्थल निर्धारित किया जाना आवश्यक होगा जो सुरक्षित हो।

(vii) विद्यालय प्रबंधन यह सुनिश्चित करेगा कि किसी वाहन में वाहन की बैठान क्षमता से अधिक बच्चों का परिवहन न हो एवं बैठान क्षमता का संख्या का प्रर्दषन वाहन के अन्दर और बाहर दोनों तरफ से प्रमुखता से लिखा जाएगा।

(viii) स्कूल वाहनों में यात्रा कर रहे छात्रों के ब्लड ग्रुप की जानकारी बस में भी उपलब्ध

रखी जाएगी।

(ix) कोई भी खतरनाक एवं ज्वलनशील सामग्री कभी भी वाहन में संग्रहित या परिवहित नहीं की जाएगी। छात्रों के सामान से भिन्न अन्य किसी भी प्रकार की सामग्री वाहनों में रखना अथवा परिवहन करना पूर्णतः प्रतिबंधित एवं दण्डनीय होगा। (x) स्कूल वाहनों में विद्यालय प्रबंधन के साथ मान्य अनुबंध की एक प्रति एवं स्कूली बच्चों की पूरी सूची के साथ-साथ निर्धारित रूट प्लान जो शैक्षणिक संस्थान के द्वारा अभिप्रमाणित हो, रखना होगा।

(xi) सभी वाहनों में वाहन से संबंधित सभी वैध कागजात, यथा-निबंधन प्रमाण पत्र, बीमा, प्रदूषण प्रमाण-पत्र, फिटनेस प्रमाण-पत्र, परमिट, ड्राईविंग लाईसेंस, परिचालक/संवाहक (कंडक्टर) अनुज्ञप्ति, आदि उपलब्ध रखना अनिवार्य होगा। (xii) विद्यालय प्रबंधन समय-समय पर चालकों/संवाहकों/परिचारकों के क्रियाकलाप की समीक्षा करेगा एवं यह सुनिश्चित करेगा कि चालक, संवाहक एवं परिचालक मानसिक एवं शारीरिक रूप से स्वस्थ हैं एवं किसी गंभीर बीमारी अथवा संक्रमित रोग से ग्रसित न हों। चालकों के लिए वाहन चालन के वार्षिक प्रशिक्षण हेतु रिफ्रेसर कोर्स आयोजित कराना विद्यालय प्रबंधन के लिए अनिवार्य होगा। (xiii) विद्यालय प्रबंधन द्वारा सेमेस्टर शुरू होने से पहले छात्र/छात्राओं के लिए भी सड़क सुरक्षा, अग्नि आपदा प्रबंधन, आदि विषयों पर प्रशिक्षण कार्यक्रम आयोजित करना अनिवार्य होगा।

(xiv) विद्यालय प्रबंधन को यह सुनिश्चित करना होगा कि माता-पिता या माता-पिता द्वारा अधिकृत लोगों को छोड़कर अन्य किसी को स्कूली बच्चों को नहीं सौंपा जाएगा। अभिभावकों द्वारा विद्यालय प्रबंधन को एस.एम.एस. के द्वारा दूसरे व्यक्ति किसी भी छात्रा को पुरूष स्टाफ के साथ को अधिकृत करने की सूचना देनी होगी। किसी भी छात्रा को पुरूष स्टाफ के साथ किसी भी छात्रा को पुरूष स्टाफ के साथ किसी भी छात्रा को पुरूष स्टाफ के साथ अकेला नहीं छोड़ा जाएगा।अकेला नहीं छोड़ा जाएगा।अकेला नहीं छोड़ा जाएगा।अकेला नहीं छोड़ा जाएगा।

(xv) वाहन चालक को किसी भी अनुचित देरी यथा बंदी, ट्रैफिक जाम, दुर्घटना, ब्रेक डाउन, सड़क अवरूद्ध, आदि के बारे में स्कूल प्रबंधन को सूचित करना होगा एवं वाहन को सुरक्षित दशा में रखा जाएगा। स्कूल प्रबंधन द्वारा दूरभाष, एस.एम.एस., ई-मेल, व्हाट्‌सएप के माध्यम से इसकी सूचना तुरंत अभिभावकों को दिया जाना अनिवार्य होगा।

(xvi) स्कूल प्रबंधन वाहन चालक अथवा परिचर (Attendant) की किसी भी लापरवाही के लिए जिम्मेदार होगा और दोषी चालक/परिचारक के विरूद्ध तत्काल कार्रवाई करेगा।

(xvii) प्रत्येक स्कूल बस में आपातकालीन स्थिति के लिए यात्रा कर रहे छात्रों के संपर्क

नंबरों की जानकारी रखना अनिवार्य होगा।

(xviii) बस मार्ग और समय सारणी बस के अन्दर में एक नक्शे पर प्रदर्शित किया जाएगा। (xix) वैसे विद्यालय जहाँ विधार्थियों की संख्या 2000 से अधिक है, के विद्यालय प्रबंधन यथासंभव अगले तीन वर्षों में विद्यालय के नियंत्रण के अधीन (विद्यालय के नाम पर पंजीकृत अथवा लीज पर अथवा निजी ऑपरेटरों से समझौते के आधार पर) विद्यालय के विधार्थियों को परिवहन सुविधा उपलब्ध कराने हेतु पर्याप्त संख्या में बसों की सुविधा उपलब्ध करायेंगे।

(xx) सभी विद्यालय परिवेषीय पर्यावरण की सुरक्षा हेतु विद्यालय के नियंत्रण के अधीन चलाये जा रहे (विद्यालय के नाम पर पंजीकृत अथवा लीज पर अथवा निजी ऑपरेटरों से समझौते के तहत्‌ परिचालित) सी.एन.जी. (CNG) चालित वाहनों5 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 24 (cid:6)सत(cid:9)बर 2020 अथवा इलेक्ट्रिक (Electric) चालित वाहनों में यथासंभव सम्परिवर्तन अथवा प्रतिस्थापन हेतु कार्ययोजना बनायेगा।

(xxi) विद्यालय प्रबंधन के द्वारा यह सुनिष्चित किया जाएगा कि जब छात्रों का वास्तविक परिवहन स्कूल तक नहीं किया गया हो (लगातार पन्द्रह दिनों से अधिक की अवधि की कोेई भी छुट्‌टी या विद्यालय बंदी की स्थिति जैसे गर्मी की छुटि्‌टयाँ इत्यादि) तो वैसी अवधि का अभिभावकों से लिया जाने वाला बस भाड़ा समानुपातिक रूप से मासिक भाड़े के आधे भाड़े के रूप में गणना करते हुए लिया जायगा। वाहन चालकाें एवं परिचारों की जिम्मेवारी :-ः-ः-ः- 4444....2222 वाहन चालकाें एवं परिचारों की जिम्मेवारी वाहन चालकाें एवं परिचारों की जिम्मेवारी वाहन चालकाें एवं परिचारों की जिम्मेवारी (i) वाहन चालक के पास भारी मोटर वाहन (भारी यात्री वाहन) श्रेणी के लिए वैध ड्राइविंग लाइसेंस अनिवार्य होगा। चालक के पास कम से कम 01 साल भारी यात्री वाहन चालन का अनुभव होना चाहिए।

(ii) चालक के अलावा, प्रत्येक बस में मोटरयान अधिनियम, 1988 की धारा-30 के

आलोक में वैध लाइसेंस रखने वाला एक परिचर (Attendant) होगा। (iii) स्कूल वाहन चालकों को यातायात अनुशासन बनाए रखना आवश्यक होगा। इसमें कोई चूक की स्थिति में, चूककर्ताओं या उपरोक्त निर्देशों के उल्लंघनकर्ताओं के खिलाफ कड़ी कार्रवाई की जायेगी।

(iv) स्कूल वाहन चलाते समय मोबाइल फोन का उपयोग चालकों के लिए प्रतिबंधित होगा। स्कूल के वाहन किसी भी स्टॉप पर खड़ी होने की स्थिति में एवं विषेष स्कूल के वाहन किसी भी स्टॉप पर खड़ी होने की स्थिति में एवं विषेष स्कूल के वाहन किसी भी स्टॉप पर खड़ी होने की स्थिति में एवं विषेष स्कूल के वाहन किसी भी स्टॉप पर खड़ी होने की स्थिति में एवं विषेष रस्थिति में ही वाहन चालक मोबाईल फोन का इस्तेमाल करेंगे। पपिपिपिरिस्थिति में ही वाहन चालक मोबाईल फोन का इस्तेमाल करेंगे। रस्थिति में ही वाहन चालक मोबाईल फोन का इस्तेमाल करेंगे। रस्थिति में ही वाहन चालक मोबाईल फोन का इस्तेमाल करेंगे।

¼v) सभी स्कूल वाहन चालकों को जिला सड़क सुरक्षा समिति की ओर से चयनित चिकित्सकों द्वारा आयोजित उनकी आंखों की रोशनी, नशा आदि की पुष्टि करने वाले नियमित स्वास्थ्य परीक्षण कराना अनिवार्य होगा।

(vi) जिन वाहन चालकों द्वारा लाल बत्ती उल्लंघन, लेन अनुशासन का उल्लंघन या अनाधि—त व्यक्ति को स्कूल वाहन चलाने की अनुमति देने जैसे अपराधों के लिए एक वर्ष में दो बार से अधिक दंडित किया गया है, वैसे वाहन चालक स्कूल वाहन चलाने योग्य नहीं माने जायेंगे।

(vii) वैसे वाहन चालक जिन्हें मोटरयान अधिनियम, 1988 की धारा-183(तेज गति में गाड़ी चलाना), धारा-184 (खतरनाक ड्राईविंग) एवं धारा-185 (नषे में ड्राईविंग) के आरोप में एक बार भी दंडित किया गया है तथा भारतीय दंड संिहत (CrPC) एवं पोस्को एक्ट के तहत अपराध किये जाने हेतु दंडित किया गया है, उन्हें विद्यालय प्रबंधन द्वारा वाहन चलाने की अनुमति नहीं दी जायेगी।

(viii) स्कूल वाहन चालकों को स्कूल वाहन में बच्चों के नाम, कक्षा, आवासीय पते, ब्लड ग्रुप और रुकने के स्थल, रूट प्लान इत्यादि के बारे में पूरी सूची वाहन में उपलब्ध रखना होगा।

(ix) चालक एवं परिचर (Attendant) को अपने पास उचित प्राधिकरण कार्ड, जिसमें

नाम, तस्वीर और अन्य विवरण हो, रखना अनिवार्य होगा।

(x) बसों/अन्य स्कूली वाहनों को साफ-सुथरी अवस्था में रखना ड्राईवर एवं परिचर

(Attendant) के लिए अनिवार्य होगा।

स ऑपरेटरों एवं अन्य स्कूल वाहन ऑपरेटर की जिम्मेवारी :- 4444....3 3 3 3 बबबबस ऑपरेटरों एवं अन्य स्कूल वाहन ऑपरेटर की जिम्मेवारी :- स ऑपरेटरों एवं अन्य स्कूल वाहन ऑपरेटर की जिम्मेवारी :- स ऑपरेटरों एवं अन्य स्कूल वाहन ऑपरेटर की जिम्मेवारी :- (i) एक स्वच्छ और सुरक्षित परिवेष में वाहनों का परिचालन तथा स्कूल के वाहन सेवा

और निरीक्षण के लिए जारी दिशा-निर्देशों का पालन किया जाना अनिवार्य होगा। (ii) समय सारणी के अनुसार उतार और चढ़ाव के समय का पालन। (iii) वाहन चालकों को स्कूल के वाहन चलाने हेतु काम पर रखे जाने के पूर्व उनके स्थायी पते का सत्यापन करते हुए उनके निकटत्‌म दो रिष्तेदारों के स्थायी पता प्राप्त करना एवं सभी का पुलिस से भी सत्यापन कराया जाना आवश्यक होगा। (iv) वाहन चालक एवं परिचर की जिम्मेदारियाँ बस ऑपरेटर द्वारा सुनिश्चित करायी

जायेगी एवं किसी भी लापरवाही के लिए वाहन ऑपरेटर जिम्मेवार होगा। (v) प्रत्येक स्कूल के वाहन में सभी वैध कागजात यथा-वाहन का निबंधन प्रमाण-पत्र, वाहनों का थर्ड पार्टी इंश्योरेंस, PUC सर्टिफिकेट सक्षम प्राधिकारी द्वारा निर्गत फिटनेस सर्टिफिकेट, परमिट आदि की उपलब्धता सुनिश्चित करना अनिवार्य होगा।6 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 24 (cid:6)सत(cid:9)बर 2020 (vi) विद्यालय से अनुबंध अथवा समझौता संबंधी कागजात वाहन में निरीक्षण हेतु उपलब्ध

रखा जाना आवश्यक होगा।

(vii) वाहनों के लिए निर्धारित मानकाें का अक्षरशः अनुपालन अनिवार्य होगा। 4444....4444 माता-पिता/अभिभावकों की जिम्मेवारी माता-पिता/अभिभावकों की जिम्मेवारी माता-पिता/अभिभावकों की जिम्मेवारी माता-पिता/अभिभावकों की जिम्मेवारी ः-ः-ः-ः-

(i) माता-पिता/अभिभावकों द्वारा अपने बच्चों को सड़क सुरक्षा के महत्व पर शिक्षित किया जाना चाहिए। स्कूल बस में चढ़ने एवं उतरने में बरती जाने वाली सावधानियाँ, "क्या करें और क्या ना करें", के संबंध में बच्चों को बताया जाना और यात्रा के दौरान "क्या करें और क्या ना करें", "क्या करें और क्या ना करें", "क्या करें और क्या ना करें", चाहिए।

(ii) माता-पिता/अभिभावक को वाहन चालक या परिचर केे किसी भी अपराध या

लापरवाही के बारे में विद्यालय प्रबंधन को तुरन्त सूचित करना चाहिए।

(iii) अपने बच्चे की बस संख्या, बस चालक एवं परिचर का टेलीफोन नंबर, विद्यालय के परिवहन प्रभारी का टेलीफोन नंबर और विद्यालय स्तरीय समिति के संबध में अवगत रहना चाहिए ताकि आवष्यकतानुसार इसका उपयोग किया जा सके।

(iv) माता-पिता/अभिभावक को विद्यालय के बैठकों में भाग लेना चाहिए और अपने बच्चों के सुरक्षा पहलुओं पर चर्चा करनी चाहिए और इस संवेदनशील विषय पर एक सतर्क पर्यवेक्षक की भूमिका निभानी चाहिए।

(v) यदि विद्यालय प्रबंधन षिकायत पर कार्रवाई नहीं करते हैं तो अभिभावक को इसकी

सूचना जिला पदाधिकारी और जिला परिवहन पदाधिकारी को देना होगा।

5555....1111.... राज्य स्तरीय समितिराज्य स्तरीय समितिराज्य स्तरीय समितिराज्य स्तरीय समिति ।।।।----विद्यालय वाहन परिचालन विनियमन, 2020 के प्रावधानों की समीक्षा/अनुश्रवण बिहार राज्य सड़क सुरक्षा परिषद्‌ के अधीन गठित लीड एजेंसी के द्वारा की जायगी। यह समिति स्कूली बच्चों की सुरक्षा और परिवहन से संबंधित मुद्दों की समीक्षा और अनुश्रवण हेतु छह महीने में कम से कम एक बार बैठक करेगी।

5555....2222.... प्रमंडल स्तरीय समितिप्रमंडल स्तरीय समितिप्रमंडल स्तरीय समितिप्रमंडल स्तरीय समिति ।।।।----प्रमंडल स्तर पर प्रमंडलीय आयुक्त की अध्यक्षता में बच्चों की सुरक्षा और उनके परिवहन से संबंधित मुद्दों के अनुश्रवण हेतु प्रमंडलीय बाल परिवहन समिति होगी। संबंधित प्रमंडल के सभी जिला पदाधिकारी, जिला परिवहन पदाधिकारी एवं जिला षिक्षा पदाधिकारी उक्त समिति के सदस्य होंगे। समिति की न्यूनतम एक बैठक प्रत्येक तीन माह में होगी।

5.3. जिला स्तरीय समितिजिला स्तरीय समितिजिला स्तरीय समितिजिला स्तरीय समिति ।।।।----बिहार के प्रत्येक जिले में जिला मजिस्ट्रेट की अध्यक्षता में पूर्व गठित जिला सड़क सुरक्षा समिति के द्वारा बच्चों की सुरक्षा और उनके परिवहन से संबंधित मुद्दों पर चर्चा, निर्णय और अनुशंसा हेतु समिति होगी। जिला सड़क सुरक्षा समिति के सभी सदस्य उक्त समिति के सदस्य होंगे। जिलान्तर्गत सभी विद्यालयों के प्राचार्य एवं परिवहन प्रभारी उक्त समिति के सदस्य होंगे। समिति की न्यूनतम एक बैठक प्रत्येक तीन माह में होगी जिसमें स्कूली बच्चों के सुरक्षित परिवहन से संबंधित उपायों की समीक्षा और भविष्य की कार्ययोजना तैयार की जाएगी।

5555....4444.... विद्यालय स्तरीय समितिविद्यालय स्तरीय समितिविद्यालय स्तरीय समितिविद्यालय स्तरीय समिति ।।।।----स्कूली बच्चों के सुरक्षित परिवहन व्यवस्था सुनिश्चित करने हेतु

'बाल परिवहन समिति' का गठन करेगा। प्रत्येक स्कूल प्रबंधन एक 'बाल परिवहन समिति' 'बाल परिवहन समिति' 'बाल परिवहन समिति'

परिवहन समिति के अध्यक्ष स्कूल के प्रधानाघ्यापक होंगे। समिति में दो अभिभावक, शिक्षक संघ के एक प्रतिनिधि, संबंधित क्षेत्र के यातायात पुलिस निरीक्षक, मोटरयान निरीक्षक, शिक्षा विभाग के एक प्रतिनिधि, स्कूल बस मालिकों के एक प्रतिनिधि सदस्य के रूप में नामित होंगे। विद्यालय के परिवहन प्रभारी 'बाल परिवहन समिति' 'बाल परिवहन समिति' के सदस्य सचिव होंगे। समिति की बैठक 'बाल परिवहन समिति' 'बाल परिवहन समिति' प्रत्येक तीन माह में कम से कम एक बार होगी।

6. नियामक प्राधिकार (नियामक प्राधिकार (नियामक प्राधिकार (नियामक प्राधिकार (Regulatory Authority) :-) :-) :-) :-

(i) इस विनियमन के उल्लंघन हेतु आवष्यकतानुसार विद्यालय प्रबंधन, वाहन स्वामी, वाहन चालक एवं परिचर के विरूद्ध अर्थदंड (PENALTY) अधिरोपित किया जा सकेगा।

(ii) अर्थदंड (PENALTY) अधिरोपित करने के लिए "जिला सड़क सुरक्षा समिति" "जिला सड़क सुरक्षा समिति" को "नियामक "नियामक "नियामक "नियामक "जिला सड़क सुरक्षा समिति" "जिला सड़क सुरक्षा समिति"

प्राधिकार"प्राधिकार"प्राधिकार"प्राधिकार" (Regulatory Authority) घोषित किया जाता है। (iii) 'नियामक प्राधिकार' 'नियामक प्राधिकार' द्वारा उल्लंघनकर्त्ता को जिला परिवहन पदाधिकारी द्वारा प्रस्तुत जाँच रिर्पोट 'नियामक प्राधिकार' 'नियामक प्राधिकार' पर अपना पक्ष प्रस्तुत करने के लिए दस दिन का समय देते हुए नोटिस जारी कर, अवसर प्रदान किया जायेगा।

(iv) नियामक प्राधिकार द्वारा दण्ड अधिरोपित करने संबंधी कार्यों का क्रियान्वयन जिला परिवहन पदाधिकारी के माध्यम से कराया जायगा।7 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 24 (cid:6)सत(cid:9)बर 2020 (v) अर्थदंड की सीमा, 'उल्लंघन''उल्लंघन''उल्लंघन''उल्लंघन' से संबंधित विषय एवं दायित्वहीनता के अनुपात में विचार करते हुए चालक, वाहन स्वामी एवं विद्यालय प्रबंधन को अलग-अलग अधिकतम 1,00,000/-(एक लाख) रूपये होगी।

(vi) जिस उल्लंघन के लिए उन्हें दंडित किया गया हो, उसकी पुनरावृत्ति पर वाहन चालक की अनुज्ञप्ति रद्‌द कर अयोग्य घोषित करने, वाहन स्वामी के परमिट रद्‌द करने की कार्रवाई की जा सकेगी एवं विद्यालय प्रबंधन के विरूद्ध आवष्यक कार्रवाई हेतु संबंधित षिक्षा बोर्ड को अनुषंसा जिला सड़क सुरक्षा समिति-सह-नियामक प्राधिकार द्वारा की जा सकेगी।

(vii) वाहन चालक अथवा वाहन स्वामी द्वारा लापरवाही बरतने पर 'नियामक प्राधिकार' 'नियामक प्राधिकार' द्वारा अन्य 'नियामक प्राधिकार' 'नियामक प्राधिकार' कानूनी प्रावधानों के अनुसार कार्रवाई भी अविलम्ब की जायेगी।

(viii) इस विनियमन के अन्तर्गत "नियामक प्राधिकार""नियामक प्राधिकार""नियामक प्राधिकार""नियामक प्राधिकार" द्वारा अधिरोपित अर्थदंड का भुगतान निर्धारित अवधि के अन्तर्गत उल्लंघनकर्त्ता द्वारा नहीं किए जाने पर "नियामक प्राधिकार""नियामक प्राधिकार""नियामक प्राधिकार""नियामक प्राधिकार" द्वारा 'बिहार लोक 'बिहार लोक 'बिहार लोक 'बिहार लोक माँग वसूली अधिनियम'माँग वसूली अधिनियम'माँग वसूली अधिनियम'माँग वसूली अधिनियम' के अन्तर्गत भू-लगान की वसूली हेतु निर्धारित प्रक्रिया के अनुसार अधियाचना दायर करने का निर्णय लिया जा सकता है। इसका कार्यान्वयन जिला परिवहन पदाधिकारी द्वारा किया जायेगा।

The 24th September 2020 No-06/School Bus-08-17/2020-6992—In exercise of the powers conferred by Section 138 of the Motor Vehicles Act, 1988 (Act No. 59, 1988), the following amendments has been made in Rule 122 of the Bihar Motor Vehicles Rules, 1992.

1. Short title, extent and commencement. –

(1) These rules may be called the Bihar Motor Vehicle (Amendment) Rules, 2020. (2) It shall extent to the whole State of Bihar. (3) It shall come into effect from the date of its publication in the Bihar Gazette. 2. Sub-rules 2 and 3 of Rule 122 of Bihar Motor Vehicle Rules, 1992 are replaced by the following :-

"122 (2) (a) That regulation of the operation of school vehicles shall be in accordance with the provisions contained in the seventh schedule for the safe operation of school vehicles and to save life of the students using them.

(b) For safe operation of school vehicles and for the safe transportation of children/students of school/educational institution, Road Safety Committee/District Road Safety Committee constituted under the provisions of Section-215 of Motor Vehicles Act, 1988 and Notification No. 402 dated 18.04.2018 issued under this provision is declared "Regulatory Authority" by Transport Department for imposing penalty in the case of violation of the provisions contained in seventh schedule.

122 (3) Changes, modifications, addition and any other transformations in this rule can be made by the Transport Department, Government of Bihar from time to time when ever necessary.

School Vehicle Operation Regulation

1. Objective: -The main objective of this regulation is to secure students going to school through vehicles. For this, the following action are required in order of transportation of school children:-

(A) To ensure safe travel of school children from home to school and back home. (B) To set standards for school buses/other vehicles engaged in the transportation of students.

(C) Determination of mental and physical parameters for deputed drivers/attendants on school buses/school vehicles and to ensure compliance with established provision of relevant Act/Rules in course of driving by them.

(D) Determination of responsibilities of school management and other stakeholders related to transportation of school children.

2. "School vehicle" means: -

(i) All types of vehicles duly registered in the name of the school management or its principal / director or any other school official, or

(ii) The school vehicle operated on hire or lease under the agreement between the private operator and the school management for the transportation of students in the school; or

(iii) All other classes of valid vehicles which are regularly transporting school children of a school with the consent of the school or guardian.

3. Standards for school vehicles: -

(i) The body of buses/other vehicles shall be golden yellow color. This color shall conform to IS-5-1994 (as amended from time to time).

(ii) A band of 150 mm wide of 'Golden Brown' color shall be provided on all sides of the bus below the window level for school identification.

(iii) If a bus or any other vehicle have been hired by school on lease or fare from any vehicle operator, then 'On School Duty' must be clearly displayed on the back and front of the bus.

(iv) As per Section 118 of the Motor Vehicles Act, 1988, it will be compulsory to install a Speed Limit Device (Speed Governor) of the specified standard in school buses/school vehicles, with a maximum speed limit of 40 km. per hour. The maximum speed will be determined by the Department of Transport from time to time.

(v) It will be mandatory to keep a first aid box in all vehicles. (vi) It will be mandatory to install fire extinguishers (Dry Powder Type) in the vehicle.

(vii) Every school vehicle, as mentioned in Rule 125H of the Central Motor Vehicles Rules, 1989, it will be compulsory to install V.L.T.D (Vehicle Location Tracking Device) and Panic Button.

(viii) Every school vehicle will be required to install Retro Reflective Tape as mentioned in Rule 104 of the Central Motor Vehicles Rules, 1989.

(ix) Every school bus/ school vehicle will be compulsorily fitted with GPS.. (x) Ensure proper arrangement for keeping of school bags in all vehicles used for transportation of school children.

(xi) For physically challenged (Divyang) students, the school bus/other vehicle should have such facilities that they are not having trouble in boarding and deboarding of the vehicle.

(xii) Bus and all other types of vehicles involved in transport of school children will be registered as commercial passenger vehicles.

ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 24 (cid:6)सत(cid:9)बर 2020 (xiii) Under the Motor Vehicles Act, 1988, it will be mandatory for school vehicles to obtain a permit from the competent authority.

(xiv) New vehicles up to 8 years of age, biennial and rest other school vehicles will be required to obtain annual fitness certificate.

(xv) The design of the body of the buses shall be in conformity with the AIS-052 standard (as amended from time to time) set by the Government of India, Ministry of Road Transport and Highways.

(xvi) The 'school insignia' (40 cm x 30 cm) on the surface of the front and rear of the bus will be inscribed with golden yellow on the background of black color to make it clearly visible.

(xvii) Each school bus will have two emergency gates - one in the rear half of the right side of the bus and the other on the back of the bus. Vehicles up to 14 seats will not require additional emergency doors.

(xviii) The "Emergency Exit" will be prominently written in red on a white background from both inside and outside the bus above the emergency exit gate of the bus.

(xix) Bus windows will be fitted with horizontal grills. (xx) CCTV in school bus will be mandatorily installed, so that the movement of the vehicle during the journey can be recorded. CCTV footage must be preserved by the school management for 60 (sixty) days. Installation of CCTV for small vehicles (less than 14-seater) will not be mandatory.

(xxi) The stop signal arm should project out of the co-driver side with a minimum projection of 150 mm with the 'STOP' sign of minimum letter height of 40 mm to be installed.

(xxii) Other commercial small vehicles other than school bus such as Auto Rickshaws, Maruti Omni van, Tata 407, Tata Ace, Winger and other Cars which are being used regularly for transportation of school students it will be compulsory to follow all the parameters except serial no-xv to xxi. On such a vehicle, it would also be mandatory to display 'School Van' or 'On School Duty' in clear letters at a specific place on the front and back side.

(xxiii) Guidelines relating to road safety issued by the Hon'ble Supreme Court and issued by the Ministry of Road Transport and Highways, Government of India, Department of Transport, Government of Bihar or District Administration or various Education Boards from time to time will be applicable.

4. Duties and responsibilities: -

4.1 Responsibility of school management: -

(i) Each school management will appoint a "Transport Incharge" and

will inform the concerned District Transport Officer.

(ii) The Principal shall supervise the compliance of the prescribed standards in school buses and other school vehicles through the Transport Incharge and take appropriate steps for betterment as required.

(iii) Principal will be responsible for the safe transportation of every student of his school. In addition to the vehicle operated by the school management, they will have to enlist all such commercial passenger vehicles from which their students come to school and will have an agreement with all these vehicle owners/vehicle operators regarding compliance with the prescribed standards and to be executed a bond to this effect. In the event of a violation by a vehicle owner/vehicle operator, the school management will be responsible for recommending to the District Transport Officer for action against such vehicle owner/vehicle operator.

(iv) The school management will have to arrange a qualified Attendant to get boarded and DE boarded the children in school bus. In the case of girl schools, one female attendant will be essential.

(v) The school management will maintain records of the names and addresses, mobile numbers of the drivers and operators of all the vehicles mentioned above in the school. Also, on buses/vehicles it will be mandatory to mention the name/address of the administrator, the name of the driver and attendant and the mobile number and driving licence number at the visible location.

(vi) The school management will be required to determine the proper parking space which school be safe for the students to get down and board the school buses/school vehicles in the school premises. (vii) The school management will ensure that no transportation of children in any vehicle exceeds its seating capacity and the seating capacity will be prominently displayed from inside and outside of the vehicle. (viii) The information about the blood group of students traveling in school

vehicles will also be made available in the bus.

(ix) No hazardous and in flammable material shall ever be stored or transported in the vehicle. It will be completely prohibited and punishable to store or transport any other type of material other than of the students.

(x) In school vehicles, a copy of the valid agreement with the school management and complete list of school children as well as the prescribed route plan certified by the educational institution will have to be kept.

(xi) In all vehicles, it will be mandatory to keep all valid documents related to the vehicle, such as registration certificate, insurance, pollution control certificate, fitness certificate, permit, driving license, conductor's license, etc. available.

(xii) The school management will periodically review the activities of the drivers/ conductors /attendants and ensure that the driver, conductors and attendants are mentally and physically healthy and do not suffer from any serious illness or infectious disease. It will be compulsory for the school management to organize refresher course for drivers for annual driving training.

(xiii) Before the start of the semester by the school management, it will be compulsory for the students to organize training programs on the topics of road safety, fire disaster management, etc.

(xiv) School management must ensure that school children are not handed over to anyone except parents or those authorized by parents. SMS regarding authorization of another person has to be given to school management by parents. No girl student will be left alone with male staff.

(xv) The driver will have to inform the school management about any undue delay such as closure, traffic jam, accident, break down, road blockage, etc. and the vehicle will be kept in safe condition. It will be mandatory by the school management to inform parents immediately through Telephone, SMS, E-mail, WhatsApp.

(xvi) The school management will be responsible for any negligence of the driver or the attendant and will take immediate action against the convicted driver/attendant.

(xvii) It will be mandatory to keep record of contact numbers of students

traveling in every school bus for emergency.

(xviii) The bus route and time table will be displayed on a map inside the bus.

2000, to provide transport facility owned by them to the students of the school within next three years and will provide adequate number of buses possible under the control of the school (registered in the name of school or on lease or by agreement with private operators).

(xx) To protect the environment for vehicles running under the control of the school (registered in the name of the school or operated on lease or under agreement with private operators) school management will make an action plan for conversion or replacement of those vehicles in CNG powered vehicles or electric powered vehicles as much as possible.

(xxi) The school management shall ensure that when the actual transportation of the students not have been done to the school (any period of more than fifteen consecutive days of leave or school closure such as summer vacation etc.), the bus fare to be charged from the guardians will be taken proportionately, calculated as half the monthly fare.

4.2 Responsibility of drivers and attendants: -

(i) A valid driving license will be compulsory for the driver of Heavy Motor Vehicle (Heavy Passenger Vehicle) category. He should have minimum 01 Year experience of driving for HPV.

(ii) In addition to the driver, each bus shall have an attendant holding a valid license as per Section 30 of the Motor Vehicles Act, 1988. (iii) School drivers will be required to maintain traffic discipline. In the event of any lapse, strict action will be taken against the defaulters or violators of the above instructions.

(iv) Use of mobile phones will be prohibited to drivers while driving school vehicles. In the event of school vehicles standing at any stop and under special circumstances, drivers will use mobile phones.

(v) All school drivers must undergo regular health tests conducted by the doctors selected by the District Road Safety Committee to confirm their eyesight, intoxication etc.

(vi) Those drivers who have been punished more than twice in a year for offenses such as red light violation, violation of lane discipline or allowing unauthorized person to drive a school vehicle will not be considered suitable to drive school bus.

(vii) Drivers who have been punished even once on charges of Section-183 (driving at high speed), Section-184 (dangerous driving) and Section- 185 (driving in intoxication) of Motor Vehicles Act, 1988 and Punished for committing offenses under the Indian Penal Code, and POSCO Act, they will not be allowed by the school management to drive a school vehicle.

(viii) School drivers will have to keep a complete list of names, their classes, residential addresses, blood groups and stoppages, route plans, etc. available in the vehicle.

(ix) Driver and attendant will be required to keep proper authorization card

with name, photograph and other details.

(x) Keeping buses/other school vehicles in a clean condition will be

compulsory for the driver and attendant.

4.3 Responsibility of bus operators and other school vehicle operators:-

(i) It will be mandatory to follow the guidelines issued for the operation of vehicles in a clean and safe environment and for vehicle service and inspection of the school.

(ii) Adhere to scheduled pick up and drop off in time.

(iii) Before the drivers are hired to operate the school vehicles, it will be necessary to obtain the permanent addresses of the two near relatives and get antecedents of all verified from the police.

(iv) The responsibilities of the driver and attendant will be ensured by the bus operator and the vehicle operator will be responsible for any negligence.

(v) It will be mandatory to ensure the availability of all valid documents such as vehicle registration certificate, third party insurance of vehicles, PUC certificate issued by competent authority, fitness certificate, permit etc. in each school vehicle.

(vi) The documents related to the contract or agreement from the school will be required to be kept available for inspection in the vehicle. (vii) Exact compliance of prescribed standards will be mandatory for

vehicles.

4.4 Responsibilities of parents/guardians: -

(i) Parents/guardians should educate their children on the importance of road safety. Children should be told about precautions while boarding and deboarding of the school bus, and "do's and don'ts" during the journey.

(ii) Parent/guardian should immediately inform the school management

about any offence or negligence of the driver or the attendant.

(iii) Be aware of the bus number of your child, the telephone number of the bus driver and attendant, the telephone number of the transport in- charge of the school and the committee of the school level so that it can be used as per the requirement.

(iv) Parents/Guardians should attend school meetings and discuss the safety aspects of their children and play the role of a vigilant observer on this sensitive subject.

(iv) If the school management does not take action on the complaint, the guardian will have to inform the District Officer and the District Transport Officer.

5. School Vehicle Transport Monitoring / Review Committees:-

5.1. State Level Committee.—The provisions of the School Vehicle Operation Regulation 2020 will be reviewed / monitored by the lead agency constituted under the Bihar State Road Safety Council. This committee will meet at least once in six months to review and monitor the issues related to safety and transportation of school children.

5.2 Divisional Level Committee: -At the divisional level, there will be a Divisional Child Transport Committee headed by the Divisional Commissioner to monitor the issues related to the safety of children and their transportation. All the District Officers, District Transport Officers and District Education Officers of the concerned division will be members of the said committee. A minimum meeting of the committee will be held every three months.

5.3 District Level Committee: -Each District of Bihar will have a 'District Road Safety Committee' to discuss, decide and recommend issues related to the safety of children and their transportation under the chairmanship of the District Magistrate. All members of the District Road Safety Committee shall be members of the said committee. The Principal and Transport Incharge of all the schools under the district will be a member of the said committee. A minimum of one meeting of the committee will be held every three months in which a review of the measures related to safe transportation of school children and a future action plan will be prepared.

ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 24 (cid:6)सत(cid:9)बर 2020 5.4 School Level Committee: -Each school management will set up a 'Child Transport Committee' to ensure safe transportation of school children. The chairman of the transport committee will be the headmaster of the school. The committee will have two parents, one representative of the teachers union, traffic police inspector of the concerned area, motor vehicle inspector, one representative of the education department, one representative member of the school bus owners. The transport in-charge of the school will be the member secretary of the 'Child Transport Committee'. The committee will meet at least once every three months.

6. Regulatory Authority: -

(i) Penalties shall be inflicted upon the school management, vehicle owner, driver and attendant for violation of this regulation.

(ii) "District Road Safety Committee" is declared as 'Regulatory Authority' for imposing penalty.

(iii) 'Regulatory authority' will provide opportunity to the infringer by issuing notice & giving ten days time to present their defence on the inquiry report submitted by the District Transport Officer.

(iv) The work related to imposing the penalty by the regulatory authority will be implemented through the District Transport Officer.

(v) The quantum of penalty, will be proportional to liability and nature of violation for the driver, the vehicle owner and the school management & will be a maximum of Rs. 1,00,000 /- (one lakh).

(vi) On the repetition of the violation for which they have been punished, action can be taken for disqualifying the license of the driver, cancellation of the permit of the vehicle owner and recommendation to the relevant Board of Education concerned for necessary action against the school management by the District Road Safety Committee-cum-Regulatory Authority.

(vii) In case of negligence by the driver or vehicle owner, action will also be taken by the regulatory authority in accordance with other legal provisions.

(viii) Under this regulation, if the penalty imposed by the "Regulatory Authority" is not paid by the infringer within the stipulated period, it can be decided by the "Regulatory Authority" to file the requisition as per the procedure prescribed for recovery of land rent under the Bihar Public Demand Recovery Act. It will be implemented by the District Transport Officer.

(ix) An appeal against this order can be filed with the Divisional Commissioner concerned.
