परिचारी/परिचारी (विषिष्ट) के लिए निम्नलिखित नियमावली 3/वि0वि0प्रयो0-03/2016-गृ0आ0-6244—भारत संविधान के अनुच्छेद-309 के परन्तुक सह पठित भारत संविधान के अनुच्छेद-309 के परन्तुक सह पठित पुलिस अधिनियम-2007 की धारा-15 एवं धारा-94 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल बिहार पुलिस अधिनियम-2007 की धारा-15 एवं धारा-94 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल बिहार पुलिस अधिनियम-2007 की धारा-15 एवं धारा-94 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल बिहार विधि विज्ञान प्रयोगषाला के कार्यालय परिचारी/परिचारी (विषिष्ट) के लिए निम्नलिखित नियमावली राज्य के विधि विज्ञान प्रयोगषाला के कार्यालय बनाते हैंः-

नाम, विस्तार एवं प्रारम्भनाम, विस्तार एवं प्रारम्भनाम, विस्तार एवं प्रारम्भनाम, विस्तार एवं प्रारम्भ। -

1. नाम, विस्तार एवं प्रारम्भनाम, विस्तार एवं प्रारम्भनाम, विस्तार एवं प्रारम्भनाम, विस्तार एवं प्रारम्भ (i) यह नियमावली ''विधि विज्ञान प्रयोगषाला, कार्यालय परिचारी/परिचारी (विषिष्ट) संवर्ग नियमावली, विधि विज्ञान प्रयोगषाला, कार्यालय परिचारी/परिचारी (विषिष्ट) संवर्ग नियमावली, विधि विज्ञान प्रयोगषाला, कार्यालय परिचारी/परिचारी (विषिष्ट) संवर्ग नियमावली, '' कही जा सकेगी। (ii) इसका विस्तार सम्पूर्ण बिहार राज्य से

2020'' कही जा सकेगी। होगा तथा राज्य के सभी विधि विज्ञान प्रयोगषालाओं पर इसका विस्तार सम्पूर्ण बिहार राज्य से होगा तथा राज्य के सभी विधि विज्ञान प्रयोगषालाओं पर समान रूप से लागू होगा। समान रूप से लागू होगा। तुरत प्रवृत होगी।

जब तक संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में -

''राज्य सरकार'' से अभिप्रेत है बिहार राज्य सरकार ;

(iii) यह तुरत प्रवृत होगी। 2222.... परिभाषाएं।परिभाषाएं।परिभाषाएं।परिभाषाएं।----जब तक संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में - (i) ''राज्य सरकार'' से अभिप्रेत है बिहार राज्य सरकार ; (ii) ''नियुक्ति प्राधिकार'' से अभिप्रेत है अपर पुलिस महानिदेषक, अपराध अनुसंधान विभाग, बिहार, प्राधिकार'' से अभिप्रेत है अपर पुलिस महानिदेषक, अपराध अनुसंधान विभाग, बिहार, प्राधिकार'' से अभिप्रेत है अपर पुलिस महानिदेषक, अपराध अनुसंधान विभाग, बिहार, पटना।; (iii) ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है निदेषक, विधि विज्ञान प्रयोगषाला। ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है निदेषक, विधि विज्ञान प्रयोगषाला। (iv) ''चयन समिति्‌'' से अभिप्रेत है नियुक्ति प्राधिकार द्वारा गठित समिति। ''चयन समिति्‌'' से अभिप्रेत है नियुक्ति प्राधिकार द्वारा गठित समिति। (v) ''विभाग'' से अभिप्रेत है गृह विभाग (आरक्षी शाखा); ''विभाग'' से अभिप्रेत है गृह विभाग (आरक्षी शाखा); (vi) ''प्रयोगषाला'' से अभिप्रेत है बिहार राज्य के विधि विज्ञान प्रयोगषाला ; ''प्रयोगषाला'' से अभिप्रेत है बिहार राज्य के विधि विज्ञान प्रयोगषाला ; (vii) ''सदस्य'' से अभिप्रेत हैराज्य के विधि विज्ञान प्रयोगषाला में कार्यरत कार्यालय परिचारी/परिचारी ''सदस्य'' से अभिप्रेत हैराज्य के विधि विज्ञान प्रयोगषाला में कार्यरत कार्यालय परिचारी/परिचारी (विषिष्ट) के पद पर नियुक्त अथवा कार्यरत कोई व्यक्ति। (विषिष्ट) के पद पर नियुक्त अ ''पैनेल'' से अभिप्रेत है चयन समिति द्वारा अनुसंषित उम्मीदवारों की सूची।

(ii) इस नियमावली के प्रवृत्त होने के पूर्व स्वीकृत निम्नांकित पद कार्यालय परिचारी/परिचारी(विषिष्ट) ग्रेड-I के पद समझे जाएँगे तथा इन पदों के विरूद्ध कार्यरत कर्मी कार्यालय परिचारी/परिचारी (विषिष्ट) पदनामित समझे जाएँगे।

(i) कार्यालय परिचारी (ii) चौकीदार (iii) झाडूकष (iv) फर्राष (v) परिचारक (vi) दफ्तरी (vii) टे्रजरी सरकार

निम्नलिखित पदनिम्नलिखित पदनिम्नलिखित पदनिम्नलिखित पद परिचारी (विषिष्ट) पदनामित होंगेः-परिचारी (विषिष्ट) पदनामित होंगेः-परिचारी (विषिष्ट) पदनामित होंगेः-परिचारी (विषिष्ट) पदनामित होंगेः-

इस नियमावली के लागू होने के पूर्व से उक्त कोटियों में नियुक्त एवं कार्यरत व्यक्ति स्वतः इस संवर्ग के समकक्ष कोटि में शामिल समझे जायेंगे।

III. इस संवर्ग के सभी कोटियों का वेतनमान वही होगा, जो राज्य सरकार (वित्त विभाग) द्वारा समय-समय पर निर्धारित किया जाएगा।

IV. राज्य सरकार इस संवर्ग के विभिन्न कोटि के पदों कास्वीकृत बल अवधारित कर सकेगी तथा इस हेतु स्थायी या अस्थायी पद भी सृजित कर सकेगी, अथवा किसी पद को स्थगित या रिक्त रख सकेगी।

4444.... अर्हत्ता।-अर्हत्ता।-अर्हत्ता।-अर्हत्ता।- समूह-''घ'' के पदों पर सीधी भर्ती मूल कोटि के वेतनमान में होगी। भर्ती हेतुः- (i) उम्मीदवारों की न्यूनतम शैक्षणिक अहर्त्ता दसवीं (मैट्रिक) उत्तीर्ण या समकक्ष होगी। (ii) उम्मीदवारों का स्वस्थ होना एवं साईकिल चलाने का ज्ञान होना आवष्यक होगा। (iii) कार्यालय परिचारी/परिचारी (विषिष्ट) के पद पर संविदा के आधार पर विभाग में विधि विज्ञान प्रयोगषालाओं में कार्यरत व्यक्तियों को नियमित समान पद पर नियुक्ति में नियमानुसार उम्र-सीमा में छूट एवं अंक की अधिमानता दी जाएगी।

5555.... आयु सीमा।-आयु सीमा।-आयु सीमा।-आयु सीमा।- उम्मीदवारों की न्यूनतम आयु 18़ वर्ष और अधिकतम आयु वही होगी जो राज्य सरकार/ सामान्य प्रषासन विभाग द्वारा समय-समय पर अवधारित की जाए।

6666.... रिक्तियों का अनिवार्य विज्ञापन।-रिक्तियों का अनिवार्य विज्ञापन।-रिक्तियों का अनिवार्य विज्ञापन।-रिक्तियों का अनिवार्य विज्ञापन।- नियुक्ति प्राधिकार प्रत्येक वर्ष 1ली अप्रील की स्थिति के आधार पर रिक्तियों का आरक्षण कोटिवार आकलन करेंगे तथा 30 अप्रील तक तदनुसार उपलब्घ रिक्तियों के आधार पर चयन समिति को अधियाचना उपलब्ध कराएँगे। अधियाचना के आलोक में सीधी भर्ती हेतु चयन समिति विज्ञापन के द्वारा आवेदन आमंत्रित करेगी।

7777.... शुल्क ।-शुल्क ।-शुल्क ।-शुल्क ।-उम्मिदवार को आयोग द्वारा निर्धारित शुल्क का भुगतान करना होगा। 8888.... आरक्षण/रोस्टर।-आरक्षण/रोस्टर।-आरक्षण/रोस्टर।-आरक्षण/रोस्टर।- नियुक्ति तथा प्रोन्नति में राज्य में तत्समय प्रवृत्त ''बिहार पदों और सेवाओं की रिक्तियों (अनु0जाति/अनु0जन0जाति और अन्य पिछड़ा वर्ग) को आरक्षण अधिनियम, 1991'' (समय-समय पर संषोधित) एवं तत्संबंधी अन्य प्रावधान तथा समय-समय पर सीधी भर्ती एवं प्रोन्नति हेतु प्रवृत आरक्षण रोस्टर का अनुपालन अनिवार्य होगा।

9. चयन समिति।-चयन समिति।-चयन समिति।-चयन समिति।- विभाग द्वारा पुलिस अधीक्षक, अपराध अनुसंधान विभाग की अध्यक्षता में एक चयन समिति गठित की जाएगी जिसमें अनुसूचित जाति/अनुसूचित जनजाति के प्रतिनिधिभी सम्मिलित होंगे जो उम्मीदवारों के द्वारा मैट्रिक में प्राप्त प्राप्तांक के आधार पर समूह-''घ'' में भर्ती हेतु पैनेल तैयार करेगी।3 ;बपकरू2द्ध;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध;बपकरू16द्ध 1 ख्रिंु 2;बपकरू10द्ध2;बपकरू10द्ध 10101010.... चयन का आधार-।चयन का आधार-।चयन का आधार-।चयन का आधार-। (I) अनुषंसित अभ्यर्थियों की नियुक्ति के क्रम में सामान्य प्रषासन विभाग द्वारा एतदर्थ समय-समय पर निर्गत अनुदेषों/प्रावधानों का अनुपालन सुनिष्चित किया जाएगा।

(II) चयन हेतु पूर्ण 100 अंक में से किसी अभ्यर्थी को प्राप्त अंक का निर्धारण निम्नवत्‌ किया जाएगाः- (क) मैट्रिक/समकक्ष परीक्षा में प्राप्त अंक - 80 अंक (ख) समान पद पर संविदा नियोजन के तहत कार्यरत अवधि के लिए अधिकतम-20 अंक-कुल 8020=100 अंक

नोट :-नोट :-नोट :-नोट :- (i) मैट्रिक/समकक्ष परीक्षा से प्राप्त अंक का निर्धारण संबंधित परीक्षा मेें प्राप्त अंकों के प्रतिषत से 0.8 के गुणक में गुणा कर निर्धारित किया जाएगा। उदाहरणार्थ यदि किसी अभ्यर्थी को मैट्रिक/समकक्ष परीक्षा में 60% अंक प्राप्त हुए हो, तो उस आधार पर इस 60X0.8 अर्थात 48 अंक अनुमान्य होगा। (ii) समान पद पर संविदा नियोजन के तहत कार्यरत प्रत्येक वर्ष के लिए 4 अंक (अधिकतम 20 अंक) अनुमान्य होंगे। किसी वर्ष के अंष के लिए अनुपातिक अंक अनुमान्य किया जाएगा अर्थात मात्र 5 माह के लिए 5X4/12अर्थात 1.6 अंक अनुमान्य होगा।

11111111.... परीक्ष्यमान अवधि/सम्पुष्टि।-परीक्ष्यमान अवधि/सम्पुष्टि।-परीक्ष्यमान अवधि/सम्पुष्टि।-परीक्ष्यमान अवधि/सम्पुष्टि।- नियुक्ति के पष्चात संवर्ग के नवनियुक्त सदस्यों की परिवीक्षा अवधि दो वर्षो की होगी, जिसे अभिलिखित किये जा सकने वाले कारणों से एक और वर्ष के लिए बढ़ाया जा सकेगा। विस्तारित अवधि में भी सेवा संतोषजनक नहीं पाये जाने पर संबंधित कर्मी को सेवा-मुक्त किया जा सकेगा। परिवीक्षा अवधि की संतोषजनक समाप्ति तथा निर्धारित प्रषिक्षण, यदि कोई हो, के सफलतापूर्वक पूरा किये जाने पर संबंधित कर्मी की सेवा सम्पुष्ट की जा सकेगी। परन्तु परीक्ष्यमान अवधि में कोई प्रषिक्षण आयोजित नहीं किये जाने पर यह सम्पुष्टि में बाधक नहीं होगा।

12121212.... प्रषिक्षण।-प्रषिक्षण।-प्रषिक्षण।-प्रषिक्षण।- परिवीक्षाधीन अवधि में अथवा बाद में भी संबंधित कर्मी के लिए राज्य सरकार द्वारा निर्धारित विहित प्रषिक्षण प्राप्त करना अनिवार्य होगा।

13131313.... प्रोन्नति।-प्रोन्नति।-प्रोन्नति।-प्रोन्नति।- इस संवर्ग के मूल कोटि के उपर के पदों पर प्रोन्नति विभागीय प्रोन्नति समिति की अनुषंसा से दी जाएगी। प्रोन्नति में सरकार/सामान्य प्रषासन विभाग द्वारा समय-समय पर निर्गत अनुदेषों/परिपत्रों आदि के प्रावधानों का अनुपालन किया जाएगा। विभागीय प्रोन्नति समिति का गठन नियुक्ति प्राधिकार द्वारा विभाग की सहमति से अलग आदेष से किया जाएगा।

14141414.... अवशिष्ट मामले।-अवशिष्ट मामले।-अवशिष्ट मामले।-अवशिष्ट मामले।- (i) जिन विषयों या बिन्दुओं के संदर्भ में प्रावधान इस नियमावली में विषिष्ट रूप से नहीं किया जा सका है उसके संबंध में राज्य सरकार में समकक्ष स्तर के कर्मियों के लिए प्रवृत्त अनुदेष लागू होंगें। (ii) यदि इस नियमावली के किसी प्रावधान को लागू करने में कोई कठिनाई हो तो, विभाग, विधि विभाग के परामर्ष से ऐसी कठिनाई का निराकरण कर सकेगा।

15151515.... निर्वचन।-निर्वचन।-निर्वचन।-निर्वचन।- इस नियमावली के किसी उपबंध के निर्वचन के संबंध में शंका उत्पन्न होने पर विषय विभाग को निर्देषित किया जायेगा और इस संबंध में विभाग द्वारा विधि विभाग के परामर्ष से लिया गया विनिष्चय अंतिम होगा। 16161616.... विनियमावली बनाने की शक्ति।विनियमावली बनाने की शक्ति।विनियमावली बनाने की शक्ति।विनियमावली बनाने की शक्ति।---- इस नियमावली में विहित प्रावधानों को क्रियान्वित करने के लिए नियुक्ति प्राधिकार द्वारा विभाग की सहमति से विनियमावली का गठन किया जा सकेगा।

17171717.... निरसन एवं व्यावृत्ति।-निरसन एवं व्यावृत्ति।-निरसन एवं व्यावृत्ति।-निरसन एवं व्यावृत्ति।- (i) इस संवर्ग के संबंध में बिहार पुलिस हस्तक के नियम-1255 के अधीन परिष्ष्टि-99 में विहित प्रावधान तथा समय-समय पर पूर्व में निर्गत संकल्प/नियमावली/आदेष आदि इस नियमावली के प्रवृत्त होने की तिथि से निरसित समझे जाएँगे।

(ii) ऐसे निरसन के होते हुए भी पूर्व में निर्गत संकल्प/नियमावली/आदेष आदि के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गई कोई कार्रवाई इस नियमावली द्वारा या इसके अधीन प्रदत्त शक्ति का प्रयोग करते हुए किया गया समझा जायेगा, मानों यह नियमावली उस तिथि को प्रवृत थी, जिस तिथि को ऐसा कोई कार्य या ऐसी कार्रवाई की गई थी।

No-BBP-03/2016-6244—The Governor of Bihar, Using the powers conferred by the proviso to Article 309 of the Constitution of India makes the following rules for office Attendant/Attendant (Special) of Forensic Science Laboratories of State of Bihar:- 1. Name, extension and commencement.— (i) This Regulation may be called "Forensic Science Laboratory Office Attendant/Attendant (Special) Cadre same Rules, 2020.

(ii) It will extend to the entire state of Bihar and will be applicable equally to all the Forensic Science Laboratories of State of Bihar.

(iii) It will come into force immediately. 2. Definitions :- Unless otherwise required, in this Regulation.— (i) 'State Government' means the Government of Bihar; (ii) 'Appointing Authority' means Additional Director General, Criminal Investigation Department, Bihar, Patna;

(iii) 'Cadre Controlling Authority' means Director, Forensic Science Laboratories; (iv) 'Selection Committee' means a committee constituted by the Appointing Authority; (v) 'Department' Means Home Department (Police Branch), Government of Bihar; (vi) 'Laboratory' means Forensic Science Laboratories of State of Bihar; (vii) 'Member' means any person appointed or working in the office of Forensic Science Laboratories of State of Bihar on the post of an office attendant/attendant (special);

(viii) 'Panel' means the list of candidates recommended by the Selection Committee. 3. Cadre structure.— (i) The hierarchy of this cadre will be as follows.— S.No. Name of the post Grade

(ii) Before application of this rule, following approved posts will be considered as office Attendant/Attendant (Special), grade-1 posts and the personnel working against these posts will be designated as Attendant/Attendant (Special). (i) Following posts will be designated as Office Attendant.—

(1) Office Attendant (2) Watchman (3) Jharukash (4) Farrash (5) Attendant (6) Daftari (7) Treasury Sarkar

(ii) Following posts will be designated as Attendant (Special)

(1) Packer (2) Laboratory Bearer (3) Viscera Cutter

Before implementation of this Manual, individuals appointed and employed in the above categories will automatically be considered to be in the equivalent category of this cadre.

(iii) The pay scale of all categories of this cadre will be the same as determined from time to time by the State government (Finance Department).

(iv) The State Government may determine the approved posts of various categories in this cadre and for this may also create permanent or temporary posts, or postpone or vacate any post.

4. Qualification.— Direct recruitment to Group-D posts will be in the pay scale of the basic category.

For recruitment:—

(i) The minimum educational qualification of the candidates will be tenth (matriculation) pass or equivalent.

(ii) Candidates will have to be healthy and should have knowledge of cycling. (iii) The persons employed in the department on the basis of contract on the posts of Attendant/Attendant (Special) in the Forensic Science Laboratories will be given relaxation in the age limit and preference of marks in regular appointment on the similar post.

5. Age limit.—

The minimum age of the candidates will be 18 year and the maximum age will be as determined by the State Government/General Administration Department from time to time. Provided (i) that the apper age limit mentioned be relaxed for S.C/S.T and OBC. 6. Compulsory advertisement of vacancies.—

The appointing Authority on the basis of the position on 1st April every year will assess the vacancies category wise. On the basis of available vacancies requistion will be sent to the selection committee till 30 April. The Selection committee will invite application through advertisement for direct recruitment in the light of the requisition. In the official Gazetter or in such other manner, as may be deemed fit. 7. fee .—

The candidate shall be required to pay the fee as determined by the Commission.

8. Reservation/Roster:-

In the appointment and promotion, compliance with the "Bihar Reservation of Vacancies in Posts and Services (For Scheduled Classes, Scheduled Tribes and Other Backward Classes) Act, 1991 (As amended from time to time) in the State and from time to time reservation roster in force for direct recruitment and promotion will be mandatory. 9. Selection Committee.—

A selection committee headed by Superintendent of police, Criminal Investigation Department Shall be constituted by the Department in which representative of Scheduled Caste/Scheduled Tribe, will also be involved, who will prepare a panel for Group "D" on the basis of marks obtained in the matric by candidates. 10. Basis of Selection.— (i) In the process of appointment of recommended candidates, the compliance with the instructions/ provisions issued from time to time by the General Administration Department will be ensured.

(ii) For selection, out of the total 100 marks, the marks obtained by a candidate will be determined as follows:

A. Marks obtained in Matriculation/equivalent examination-80 marks B. Maximum 20 marks for the period working under contract employment on the same post-Total 80+20=1000 marks.

Note .— (i) Determination of marks obtained from matriculation/equivalent examination will be determined by multiplying the percentage of marks obtained in the relevant examination by a multiplier of 0.8 For example, if a candidate has got 60% marks in Matriculation/Equivalent Examination, then he will be awarded 60x0.8=i.e. 48 marks.

(ii) For each year working under contract on the same post, 4 marks (maximum 20 marks) will be applicable. Proportional marks will be approximated for the fraction of a year, i.e. 5x4/12 i.e. 1.6 marks for only 5 months.

11. Probation period/Confirmation.—

After the appointment, the probation period of newly appointed members of the cadre will be of two years, which may be extended for one more year for reasons that may be recorded. If the service is not found to be satisfactory even during the extended period,6 ;बपकरू2द्ध;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध 1 ख्रिंु 2;बपकरू10द्ध2;बपकरू10द्ध the concerned personnel will be discharged. On successful completion of the probation period and the successful completion of prescribed training, if any, the service of the concerned personnel will be confirmed. But if on training is organized during probation period, this will bot be a hindrance in confirmation. 12. Training.—

It will be compulsory for the concerned personnel to get the training prescribed by the State Government either during or after the probation period. 13. Promotion.—

The promotions for the above posts on the basic category of this cadre will be given with the recommendation of the Departmental Promotion Committee. In the promotion, the provisions of the instructions/circulars etc. issued by the Government/General Administration Department from time to time will be followed. The Departmental Promotion Committee shall be constituted by the Appointing Authority with the consent of the Department by a separate order.

14. Residual cases.— (i) In relation to the subjects or points in which provision has not been made specifically in this Regulation, the instructions applicable to the employees of equivalent level in the State Government shall apply.

(ii) If there is any difficulty in implementing any provision of this Regulation, the Department, in consultation with the Law Department, will redress such difficulties.

15. Interpretation.—

In case of doubt in relation to any provision of the Rules, the subject shall be directed to the Department and in this regard the decision taken by the Department in consultation with the Law Department will be final. 16. Power to make regulations.—

The Regulations can be made with the consent of the Department by the Appointing Authority to implement the provisions prescribed in this Regulation. 17. Repeal an saving.— (i) in relation to this cadre, the provisions prescribed in Appendix-99 under Rules-1255 of Bihar Police Manual and the Resolutions/Regulation/orders, etc. issued earlier from time to time shall be deemed to be repealed from the date of coming into force of this Regulation.

(ii) Notwithstanding such repeal, any act or action taken in exercise of the powers conferred under resolutions/rules/orders etc. issued earlier, will be deemed to be an act or action taken by that regulation or in exercise of the power conferred there under and it will be as if this Regulation was enlightened on the date on which such work or such action was taken.
