O.A. No- 200/2014 द्वारा आदेश पारित किया M.C Mehta Vs Union of India & Ors. मामले में दिनांक-22.08.2019 को माननीय NGT द्वारा आदेश पारित किया M.C Mehta Vs Union of India & Ors. गया जिसमें दिये गये निदेश निम्नवत् है :- गया जिसमें दिये गये निदेश निम्नवत् है :-
i. iii. "Till the completion of the above mentioned projects, it is necessary that no untreated sewage is discharged into the River Ganga. Bioremediation and/or phytoremediation or any other remediation measures may start as an interim measure positively from 01.11.2019, failing which the State may be liable to pay compensation of Rs. 5 Lakhs per month per drain to be deposited with the CPCB."
उक्त के आलोक में राष्ट्रीय स्वच्छ गंगा मिशन (NMCG), जल संसाधन, नदी विकास एवं गंगा संरक्षण मंत्रालय, भारत सरकार से उक्त कार्य हेतु एजेंसी चयन करने के लिए अनुरोध किया गया। NMCG द्वारा उक्त कार्य राज्य सराकर की निधि से कराने एवं इस मामले में आवश्यक कार्रवाई राज्य सरकार द्वारा किये जाने का निदेश दिया गया है।
इस बीच माननीय NGT द्वारा उक्त मामले में दिनांक 12.012.2019 को पुनः आदेश पारित किया गया जिसमें दिये गये निदेश निम्नवत् है :-
i. "The Tribunal has also directed that atleast interim measures of treatment of sewage by way of bio-remediation and/or phytoremediation or any other measures may start positively from 01.11.2019, failing which the defaulting States may be liable to pay compensation of Rs. 5 lakhs per month per drain and for such violations, adverse entries must be made in the ACRs of the identified officers."
ii. "We reiterate the said direction and since 01.11.2019 has already gone, wherever interim treatment of untreated sewage has not started in the manner earlier directed, the compensation be deposited with the CPCB which will be personal responsibility of the Chief Secretaries of the concerned States. The Chief Secretaries of concerned States are put to notice that in case of any default in compliance their salaries may be liable to be stopped and for enforcing the directions, further coercive measures including order of civil imprisonment may be liable to be passed personally against the Chief Secretaries."
माननीय NGT के आदेष दिनांक 12.12.2019 के आलोक में CPCB, New Delhi के पत्रांक-190153/NGT/WQM-II/CPCB/2019-20/12129 दिनांक 03.02.2020 द्वारा अनुपचारित नालों के लिए 01.11.19 से 31.01.20 तक की अवधि के लिए रू0 1.20 करोड़ पर्यावरणीय क्षति के रूप में भुगतान करने हेतु निदेश प्राप्त हुआ। उक्त आदेश के विरुद्ध BGCMS के पत्रांक 145 दिनांक 13.03.2020 द्वारा विलम्ब के तथ्यों को अंकित करते हुए Bio-remediation प्रारम्भ करने की समय-सीमा जून 2020 तक विस्तारित करने एवं अधिरोपित पर्यावरणीय शुल्क रू0 1.20 करोड़ के भुगतान से मुक्त करने का अनुरोध किया गया है। उक्त क्रम में CPCB, New Delhi के पत्रांक-1406 दिनांक 16.06.2020 द्वारा सूचित किया गया है कि "You may approach/request Hon'ble NGT for any changes in the timeline. It is, therefore, requested that Environmental Compensation till date for the defaulting drains may kindly be deposited with the CPCB at the earliest."
यह उल्लेखनीय है कि उक्त निदेश के क्रम में मुख्य सचिव, बिहार के अनुमोदन के उपरान्त
Bio-remediation Projects से सम्बन्धित पर्यावरणीय क्षतिपूर्त्ति शुल्क की राशि को माफ करने एवं सीवरेज योजनाओं एवं Bio-remediation Project का Revised Timeline की स्वीकृति हेतु दिनांक 07.08.2020 को माननीय NGT में अपील दायर करने हेतु राज्य सरकार के अधिवक्ता को भेजा गया है।
माननीय NGT के पारित आदेश दिनांक 07.08.2019 के आलोक में गंगा नदी में प्रवाहित होने वाले नालों के safe sludge process and Bio-remediation Treatment हेतु अनुमानित 103.89 करोड़ रू0 (GST सहित) के प्राक्कलन की प्रशासनिक अनुमोदन एवं व्यय की स्वीकृति हेतु प्रस्ताव NMCG को पत्रांक 250 दिनांक 11.06.20 द्वारा भेजा गया था। BGCMS के उक्त अनुरोध पर NMCG के पत्रांक-13015/1/2019-Tech5 NMCG दिनांक 23.06.2020 द्वारा Bio-remediation/Phyto-remediation Projects पर राज्य निधि से ही व्यय करने का निदेश दिया गया है।3 (cid:464)बहार गजट (असाधारण), 6 अ(cid:200)तूबर 2020
उपर्युक्त अंकित तथ्यों एवं विभिन्न विभागों से किये गये पत्राचार एवं माननीय NGT के आदेश से परिलक्षित होता है कि सीवरेज योजनाओं के निर्माण होने तक गंगा नदी में प्रवाहित होने वाले नालों के Sewerage के treatment के बाद ही treated water को प्रवाहित किया जाना है, अन्यथा रू0 5 लाख प्रति नाला प्रतिमाह की दर से पर्यावरण क्षतिपूर्त्ति शुल्क के रूप में राज्य सरकार को भुगतान करने की बाध्यता होगी।
Bio-remediation पद्धति से प्रवाह के उपचार हेतु दिनांक 18.06.2020 को निविदा आमंत्रित किया गया। तकनीकी एवं वित्तीय निविदा के मूल्यांकन के बाद Carron Investment Pvt. Ltd. को सफल निविदादाता पाया गया।
निविदा निस्तारण के बाद Bio-remediation Project पर रू0 49,28,79,570/-excluding GST i.e. 12% सहित रू0 55,20,25,118/- एवं गुणवत्ता जाँच हेतु Third Party (IIT, Patna /NIT, Patna) के भुगतान के लिए राशि रू0 1,44,97,000/- यानी व्यय की कुल राशि रू0 56,65,22,118/-का व्यय होने की संभावना है। यह माननीय NGT के अनुपालन के लिए एन.एम.सी.जी. के निदेश के आलोक में किया जाना आवश्यक है क्योंकि माननीय NGT का आदेश का अनुपालन नहीं होने की स्थिति में पर्यावरणीय क्षतिपूर्ति शुल्क का भुगतान राज्य सरकार द्वारा किया जाना होगा जिसमें दंड के रूप में बहुत अधिक राशि के व्यय होने की संभावना है।
. योजना के कार्यान्वयन पर संभावित व्यय की राशि रू0 56,65,22,118/- का व्यय एक वर्ष में किया जाना है। पुरी राशि का वहन राज्य निधि से किया जाना है।
उक्त प्रस्ताव पर दिनांक 08.09.2020 को सम्पन्न राज्य मंत्रिपरिषद की बैठक के मद संख्या-29 के रूप में
स्वीकृति प्राप्त है।
राज्य में In-Situ Treatment of Sludge of septic tanks of Community/Mobile Toilet and Sewage through Bioremediation for Treatment of the Nallas joining the river Ganga in Bihar योजना के कार्यान्वयन और इसके कार्यान्वयन हेतु संभावित व्यय रू0 55,20,25,118.00 (GST सहित) (पचपन करोड़ बीस लाख पचीस हजार एक सौ अठारह रू0 मात्र) एवं इसके Third Party Inspection पर होने वाले व्यय रू0 1,44,97,000.00 (GST सहित) (एक करोड़ चौवालीस लाख सत्तानवे हजार रू0 मात्र) अर्थात कुल राशि रू0 56,65,22,118.00 (छप्पन करोड़ पैंसठ लाख बाईस हजार एक सौ अठारह रू0 मात्र) का राज्य योजना मद से व्यय किये जाने की स्वीकृृति पर सरकार की सहमति संसूचित की जाती है।
आदेष :- आदेष दिया जाता है कि इस संकल्प को बिहार राजपत्र के असाधारण अंक में प्रकाषित किया जाय एवं इसकी प्रति सरकार के सभी विभागों के विभागाध्यक्षों/प्रमण्डलीय आयुक्तों/जिला पदाधिकारियों/ महालेखाकार, बिहार, पटना को सूचनार्थ भेजी जाय।
