सं॰ 7/विविध-45/2017-441—भारत संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का भारत संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का सं॰ 7/विविध-45/2017-441 के राजकीयकृत प्रारंभिक विद्यालयों के (जिला संवर्ग के) शिक्षकों के ेग करते हुए बिहार राज्यपाल राज्य के राजकीयकृत प्रारंभिक विद्यालयों के (जिला संवर्ग के) शिक्षकों के प्रयोग करते हुए बिहार राज्यपाल राज्य स्थानान्तरण, अनुशासनिक कार्रवाई एवं
न्तरण, अनुशासनिक कार्रवाई एवं प्रोन्नति विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैं :-

(1) यह नियमावली ''बिहार राजकीयकृत प्रारंभिक विद्यालय शिक्षक- स्थानान्तरण, अनुशासनिक यह नियमावली ''बिहार राजकीयकृत प्रारंभिक विद्यालय शिक्षक- स्थानान्तरण, अनुशासनिक कार्रवाई एवं प्रोन्नति नियमावली, 2018'' कही जा सकेगी। कार्रवाई एवं प्रोन्नति नियमावली, 2018'' कही जा सकेगी। इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृा होगी। (3) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृा होगी।

''प्राथमिक विद्यालय'' से अभिप्रेत है वैसे राजकीयकृत विद्यालय जिनका गठन बिहार गैर त विद्यालय जिनका गठन बिहार गैर सरकारी प्रारंभिक विद्यालय (नियंत्रण ग्रहण) अधिनियम, 1976 के अधीन किया गया हो और अधीन किया गया हो और सरकारी प्रारंभिक विद्यालय (नियंत्रण ग्रहण) अधिनियम, 1976 के र्वामान में कक्षा पाँच तक की शिक्षा की व्यवस्था करता है, परन्तु इसमें अल्पसंख्यक तु इसमें अल्पसंख्यक जो र्वामान में सहायता प्राप्त विद्यालय जो राज्य सरकार द्वारा पूर्णतः अथवा अंशतः विा विद्यालय एवं विद्यालय एवं सहायता प्राप्त विद्यालय जो राज्य सरकार द्वारा पूर्णतः अथवा अंशतः विा पोषित है, शामिल नहीं है ; पोषित है, शामिल नहीं है
(iv) ''मध्य विद्यालय'' से अभिप्रेत है वैसे राजकीयकृत विद्यालय जिनका गठन बिहार गैर सरकारी ''मध्य विद्यालय'' से अभिप्रेत है वैसे राजकीयकृत विद्यालय जिनका गठन बिहार गैर सरकारी ''मध्य विद्यालय'' से अभिप्रेत है वैसे राजकीयकृत विद्यालय जिनका गठन बिहार गैर सरकारी ैर जो र्वामान में ्रारंभिक (नियंत्रण ग्रहण) अधिनियम, 1976 के अधीन किया गया हो और जो र्वामान में प्रारंभिक (नियंत्रण ग्रहण) अधिनियम, 1976 के अधीन किया गया हो आ आठ तक या कक्षा छः एवं सात या कक्षा एक से सात तक या एक से आठ आठ तक या कक्षा छः एवं सात या कक्षा एक से सात तक या ए कक्षा छः से आठ तक या कक्षा छः एवं सात या कक्षा एक से सात तक या ए करते हों, परन्तु इनमें अल्पसंख्यक विद्यालय एवं सहायता प्राप्त तक की शिक्षा व्यवस्था करते हों, परन्तु इनमें अल्पसंख्यक विद्यालय एवं सहायता प्राप्त तक की शिक्षा व्यवस्था विद्यालय सम्मिलित नहीं होंगें ; विद्यालय सम्मिलित नहीं होंग2 (cid:464)बहार गजट (असाधारण), 29 अ(cid:200)तूबर 2020 (v) ''प्रारंभिक विद्यालय'' से अभिप्रेत हैं वैसे राजकीयकृत विद्यालय जो प्राथमिक एवं मध्य विद्यालयों की कोटि के हों ;
(vi) ''शिक्षक'' से अभिप्रेत है राजकीयकृत प्रारंभिक विद्यालय के प्रधानाध्यापक, स्नातक शिक्षक तथा सहायक शिक्षक एवं शिक्षिकाएॅ। इसमें त्रिस्तरीय पंचायतों एवं नगर पंचायतों या निकायों द्वारा नियुक्त शिक्षक शामिल नहीं हैं ;
(vii) ''प्रशिक्षित'' शिक्षक से अभिप्रेत है, वैसे शिक्षक जो निम्नलिखित प्रशिक्षण प्राप्त कियें हों एवं निम्नलिखित प्रशिक्षण परीक्षा में उाीर्ण होंः-
(क) दो वर्षीय शिक्षक प्रशिक्षण, अथवा (ख) बी॰ एड॰, डिप-इन-एड॰ एवं डिप-इन-टीच, अथवा (ग) सेवाकाल में एक वर्षीय शिक्षक प्रशिक्षण ;
(viii) ''मैट्रिक/इन्टर प्रशिक्षित'' से अभिप्रेत है, वैसे शिक्षक जो मैट्रिक अथवा इन्टरमीडिएट या समकक्ष परीक्षोाीर्ण हो और प्रशिक्षित हों ;
(ix) ''स्नातक प्रशिक्षित'' से अभिप्रेत है, वैसे शिक्षक जो किसी मान्यता प्राप्त विश्वविद्यालय द्वारा प्रदत्त स्नातक या समकक्ष योग्यता रखते हों तथा प्रशिक्षित हों ;
(x) ''स्नातकोार प्रशिक्षित'' से अभिप्रेत है, वैसे शिक्षक जो किसी मान्यता प्राप्त विश्वविद्यालय द्वारा प्रदा स्नातकोार या समकक्ष योग्यता रखते हों तथा प्रशिक्षित हों ;
(xi) ''प्रधानाध्यापक'' से अभिप्रेत हैं, राजकीयकृत मध्य विद्यालयों में नियमित रूप से पदस्थापित प्रधानाध्यापक। (xii) ''समान कोटि'' से अभिप्रेत है एक ही कोटि के शिक्षक जैसे सामान्य विषयक एवं उर्दू विषय के सहायक शिक्षक, संबंधित विज्ञान/कला के स्नातक प्रशिक्षित शिक्षक ;
(xiii) ''राज्य सरकार'' से अभिप्रेत है, बिहार सरकार ;
(xiv) ''विभाग'' से अभिप्रेत है, शिक्षा विभाग ;
(xv) ''जिला कार्यक्रम पदाधिकारी (स्थापना)'' से अभिप्रेत है, जिले के प्रारंभिक विद्यालयों के जिला संवर्ग के शिक्षकों की स्थापना के प्रभारी पदाधिकारी ;
(xvi) ''जिला संवर्ग के शिक्षक'' से अभिप्रेत है, जिले के प्रारंभिक विद्यालयों में वेतनमान में नियुक्त शिक्षक ;
(xvii) नियुक्ति प्राधिकार से अभिप्रेत है, जिला संवर्ग के शिक्षकों के लिए संबंधित जिला के जिला शिक्षा पदाधिकारी।
राजकीयकृत प्रारंभिक विद्यालयों में कार्यरत जिला संवर्ग के शिक्षक के लिए निम्नलिखित संवर्ग संरचना होगा :-
(i) मैट्रिक/इण्टर प्रशिक्षित शिक्षक-मूल कोटि (ii) स्नातक प्रशिक्षित शिक्षक- प्रथम प्रोन्नति का पद (iii) मध्य विद्यालय के प्रधानाध्यापक- द्वितीय प्रोन्नति का पद
उपर्युक्त पदों का वेतनमान, समय-समय पर, राज्य सरकार द्वारा स्वीकृत वेतनमान के अनुरूप होगा।
(1) शिक्षकों के स्थानान्तरण एवं प्रोन्नति के लिए जिला स्तर पर ''जिला प्रारंभिक शिक्षक स्थापना समिति'' निम्नलिखित को मिलाकर गठित होगी :-
- अध्यक्ष - सदस्य (i) जिला शिक्षा पदाधिकारी (ii) जिला कार्यक्रम पदाधिकारी (स्थापना) - सदस्य सचिव (iii) जिला पदाधिकारी के द्वारा मनोनित वरीय उप समार्र्हाा (यदि समिति में कोई
महिला सदस्य नही हो तो यथासंभव महिला पदाधिकारी मनोनीत की जाय)
(iv) जिला कार्यक्रम पदाधिकारी (योजना एवं लेखा) - सदस्य - सदस्य (v) अनु॰ जाति/अनु॰ जनजाति के एक पदाधिकारी (जिला पदाधिकारी के द्वारा
मनोनीत)
(2) स्थापना समिति द्वारा इस नियमावली के अधीन स्थानान्तरण, सेवा सम्पुष्टि एवं प्रोन्नति संबंधी सभी निर्णय लिये जायेंगें।
(3) ऐच्छिक अन्तर जिला स्थानान्तरण के संबंध में निम्नलिखित समिति निर्णय लेगीः-
(क) निदेशक, प्राथमिक शिक्षा -अध्यक्ष (ख) क्षेत्रीय शिक्षा उप निदेशक पटना प्रमंडल, पटना -सदस्य (ग) विषय के प्रभारी उप निदेशक/सहायक निदेशक -सदस्य सचिव3 (cid:464)बहार गजट (असाधारण), 29 अ(cid:200)तूबर 2020
(1) शिक्षकों का पद अस्थानान्तरणीय होगा परन्तुनिम्नलिखित परिस्थियों में जिला के भीतर अवस्थित विद्यालयों में शिक्षकों का स्थानान्तरण किया जा सकेगाः- (क) समान कोटि के शिक्षकों का पारस्परिक स्थानान्तरण अथवा (ख) र्वामान में प्रवृा स्थानान्तरण नियमावली के तहत प्रत्येक कोटि के शिक्षको को अपने सेवा काल में अधिकतम दो स्थानान्तरण लेने की छूट दी गई है। परन्तु प्रथम एवं द्वितीय स्थानान्तरण के मध्य कम-से-कम चार वर्षो का अंतराल होना आवश्यक होगा।
(ग) जिला शिक्षा पदाधिकारी तथा शिक्षा विभाग के वरीय पदाधिकारियों की अनुशंसा के आलोक में, निदेशक प्राथमिक शिक्षा द्वारा, प्रारंभिक विद्यालय के प्रधानाध्यापक/सहायक शिक्षक केे, प्रशासनिक आधार पर, स्थानान्तरण हेतु सम्बन्धित जिला शिक्षा पदाधिकारी को आदेश दिया जा सकेगा। प्रशासनिक आधार से निम्नांकित अभिप्रेत हैः- (i) प्रधानाध्यापक/सहायक शिक्षक की गतिविधियों का विद्यालय के अनुशासन तथा शैक्षणिक वातावरण पर कुप्रभाव जिसके कारण विद्यालय के हित में उन्हें स्थानान्तरण आवश्यक हो। (ii) प्रधानाध्यापक/सहायक शिक्षक ऐसी विाीय अनियमितता में संलिप्त पाये गयें हो जिसमें सरकारी राशि के गबन एवं अपराधिक मामले सन्निहित हों । (घ) बच्चों की निःशुल्क एवं अनिवार्य शिक्षा अधिनियम-2009 (समय-समय पर यथा संशोधित) के अधीन अधिसूचित नियमावली के प्रावधान के अनुरूप छात्र एवं शिक्षक के मानक अनुपात को लागू करने के लिए शिक्षको का स्थानान्तरण किया जा सकेगा। इस हेतु जिला पदाधिकारी के अनुमोदन से जिला शिक्षा पदाधिकारी स्थानान्तरण कर सकेंगें।
(2) पारस्परिक अथवा ऐच्छिक स्थानान्तरण के लिए जिला शिक्षा पदाधिकारी को विहित प्रपत्र में आवेदन दिया जा सकेगा।
(3) ऐच्छिक स्थानान्तरण हेतु यदि किसी विद्यालय में एक ही पद पर एक से अधिक आवेदन प्राप्त होता है, तो वरीयतम शिक्षक को वहाँ से स्थानान्तरित किया जायेगा, परन्तु दिव्यांग एवं महिला शिक्षक को प्राथमिकता दी जायेगी।
(4) अन्तर जिला ऐच्छिक स्थानान्तरण सिर्फ मूल कोटि के शिक्षकों का होगा। अन्तर जिला स्थानान्तरण पर शिक्षक की वरीयता नये जिला संवर्ग में उनके नियुक्ति वर्ष में उस जिला के नियुक्त शिक्षकों से नीचे होगी। जिला संवर्ग के शिक्षकों के विरूद्व अनुशासनिक कार्रवाई बिहार सरकारी सेवक (वर्गीकरण नियंत्रण एवं अपील) नियमावली, 2005 (समय-समय पर यथा संशोधित) प्रावधानों के अधीन की जा सकेगी।
निम्नलिखित शर्तो को पूरा करने पर ही किसी शिक्षक की प्रोन्नति पर विचार किया जा सकेगा :-
(i) प्रोन्नति के लिए न्यूनतम अर्हक सेवा अर्थात कालावधि वही होगी जो सामान्य प्रशासन विभाग द्वारा समय-समय पर विनिश्चित की जायेगी।
(ii) प्रोन्नति निमिा निर्धारित न्यूनतम शैक्षणिक एवं प्रशैक्षणिक अर्हाा रखना,
(iii) सेवा संतोषजनक होना।
मैट्रिक प्रशिक्षित से स्नातक प्रशिक्षित और स्नातक प्रशिक्षित से मध्य विद्यालय के प्रधानाध्यापक के पदों पर प्रोन्नति देते समय राज्य सरकार की प्रोन्नति में आरक्षण नियमों का पालन किया जायेगा। मैट्रिक/इन्टर प्रशिक्षित शिक्षकों को, जिनकी सेवा की न्यूनतम अवधि यथा निर्धारित हो और जो स्नातक की योग्यता रखते हो, वरीयता के आधार पर, स्नातक शिक्षक के पद पर उपलब्ध रिक्ति के अनुरूप, प्रोन्नति देने पर विचार किया जायेगा।
स्नातक प्रशिक्षित वेतनमान में न्यूनतम अवधि यथा निर्धारित हो एवं स्नातकोार योग्यता वाले शिक्षक को वरीयता के आधार पर मध्य विद्यालय के प्रधानाध्यापक के पद पर उपलब्ध रिक्ति के अनुरूप प्रोन्नति देने पर विचार किया जायेगा। प्रोन्नति हेतु अपेक्षित संख्या में शिक्षक उपलब्ध नहीं रहने पर योग्यता एवं कालावधि में शिथिलीकरण की कार्रवाई विभाग द्वारा नियमानुसार की जायेगी।
नियम 10 एवं नियम 11 के अधीन दी गयी प्रोन्नति, अधिसूचना की तिथि से तथा विाीय लाभ योगदान की तिथि से दिया जायेगा।
(1) वरीयता सूची प्रत्येक वर्ष 31 दिसम्बर के आधार पर तैयार की जायेगी।4 (cid:464)बहार गजट (असाधारण), 29 अ(cid:200)तूबर 2020 (2) मैट्रिक/इन्टर प्रशिक्षित शिक्षकों से स्नातक प्रशिक्षित शिक्षकों में अपेक्षित स्नातक योग्यताधारी शिक्षकों की प्रोन्नति हेतु वरीयता सूची विज्ञान एवं कला शिक्षकों के लिए अलग-अलग तैयार की जायेगी। इस सूची में, प्रोन्नति के लिए अपेक्षित सेवा-कालावधि रखने वाले स्नातक शिक्षकों का नाम होगा।
(3) प्रधानाध्यापक के पद पर प्रोन्नति हेतु वरीयता सूची, स्नातक वेतनमान में कार्यरत स्नातकोार योग्यताधारी शिक्षकों के बीच से तैयार की जायेगी।
एक हीं कोटि के कार्यरत शिक्षकों की पारस्परिक वरीयता निम्नलिखित मानकों के अधीन विनिश्चित की जायेगीः-
(i) विशिष्ट कोटि प्राप्त करने की तिथि वरीयता निर्धारण का आधार होगी। कोटि प्राप्त करने की तिथि समान होने पर उससे निम्न कोटि प्राप्त करने की तिथि और उसी प्रकार निम्नतम कोटि प्राप्त करने की तिथि, जहॉ कहीं अपेक्षित हो वरीयता के लिए आधार होगी।
(ii) कोटि प्राप्त करने की तिथि समान होने पर जन्म तिथि आधार होगी।
(iii) जन्म तिथि समान होने पर उनके नाम के रोमन लिपि के वर्णाक्षर क्रम से पारस्परिक वरीयता निर्धारित की जायेगी। जिला स्थापना समिति द्वारा लिये गये प्रोन्नति के निर्णय के उपरान्त उपलब्ध रिक्त पदों के विरूद्व प्रोन्नति आदेश (पदस्थापन के साथ) निर्गत किये जायेगें। प्रोन्नति-आदेश प्रोन्नति समिति के सदस्य-सचिव एवं जिला शिक्षा पदाधिकारी के संयुक्त हस्ताक्षर से निर्गत किया जायेगा। उच्च पदो ंके रिक्त होने के कारण शैक्षणिक/प्रशासनिक कार्य के बाधित नहीं होने देने के लिए वैकल्पिक व्यवस्था के तहत वरीय शिक्षकों को उनके वेतनमान में ही उच्च पद का कार्य लिया जा सकेगा। इस व्यवस्था के तहत अतिरिक्त वेतन/प्रोन्नति का दावा मान्य नहीं होगा।
(1) अप्रशिक्षित शिक्षक किसी भी कोटि में प्रोन्नति के पात्र नहीं होंगें। (2) अप्रशिक्षित शिक्षक की वरीयता, उस तिथि से जिस तिथि से उसे प्रशिक्षित वेतनमान दिया गया हो, मूल कोटि में निर्धारित की जाएगी।
यह नियमावली नियोजित शिक्षकों पर लागू नहीं होगी। इस नियमावली के प्रावधानों को लागू करने में उत्पन्न कठिनाईयों का निराकरण, अधिसूचना/आदेश द्वारा, करने हेतु शक्ति राज्य सरकार (शिक्षा विभाग) में निहित होगी।''
इस नियमावली के प्रावधानों के अधीन निर्गत प्रोन्नति, अनुशासनिक कार्रवाई एवं अन्य कार्रवाई एवं स्थानान्तरण के संबंध में आदेश से व्यथित कोई शिक्षक, आदेश निर्गत होने के 30 दिनों के भीतर संबंधित क्षेत्रीय शिक्षा उप निदेशक के समक्ष अपील दायर कर सकेगा।
(1) बिहार राजकीयकृत प्रारंभिक विद्यालय शिक्षक-प्रोन्नति नियमावली, 2011 एवं बिहार राजकीयकृत प्रारंभिक विद्यालय शिक्षक (स्थानान्तरण) नियमावली, 2006 तथा उसके अधीन निर्गत सभी परिपत्र, संकल्प, निदेश आदि एतद्द्वारा निरसित किए जाते हैं।
(2) ऐसे निरसन के होते हुए भी इस नियामवली के प्रवृत होने की तिथि से पूर्व निर्गत उक्त नियमावली परिपत्र संकल्प निर्देश के अधीन किया गया कोई कार्य या की गई कार्रवाई इस नियमावली के अधीन किया गया या की गई कार्रवाई मानी जायेगी मानो यह नियमावली उस दिन प्रवृत थी, जिस दिन वैसा कुछ किया गया अथवा वैसी कोई कार्रवाई की गई थी।

No. 7/Vividh-45/2017-441—In exercise of the powers conferred by provise to article 309 of the Constitution of India the Governor of Bihar makes the following rules to regulate the transfer, disciplinary action and promotion of the teachers (District Cadre) of the Nationlised Preliminary Schools:-
1. Short title, extent and commencement.—
(1) These Rules may be called the Bihar Nationalised Preliminary School Teachers Transfer, Disciplinary Action and Promotion Rules, 2018.
(2) It shall extend to the whole state of Bihar
(3) It shall come into force from the date of its publication in the official gazette.
5 (cid:464)बहार गजट (असाधारण), 29 अ(cid:200)तूबर 2020 2. Definitions:- In these Rules, unless anything is repugnant to the subjector context.—
(i) "Establishment Committee" means District Preliminary School Teachers Establishment committee constituted under Rule 4;
(ii) "Category" means categories mentioned in Rule 3 of these Rules; (iii) "Primary School" means such nationalised schools constitution of which is made under the Bihar non-government preliminary school (taken over control) Act, 1976 and which manage of education up to class five at present but it does include minority schools and aided schools which are wholly or partly finance sponsored by the state government;
(iv) "Middle School" means such nationlised schools constitution of which is made under the Bihar non-government preliminary school (taken over control) Act, 1976 and which manage of education from class six to class eight or class six and from class one to class seven or from one to eight but it does not include minority schools and Aided schools;
(v) "Preliminary School" such nationlised school which is of category of primary and middle school;
(vi) "Teacher" means Head master graduate teacher and Assistant teacher/Lady Teachers. It does not include teacher appointed by three tier panchyat and nagar panchyat or Bodies;
(vii) "Trained Teacher" means such teachers who have obtained the following training and have passed in the following examination:-
(a) Two years Teachers Training, or (b) B.Ed, Dip-in Ed, Dip-in-Teach, or (c) One year Teachers Training in the service period,
(viii) "Matriculation/Inter Trained" means such teachers who have passed Matriculation or Intermediate or equivalent examination and is trained;
(ix) "Trained Graduate" means such teacher who have qualification of Graduate conferred by any recognised University or equivalent and is trained;
(x) "Trained Post Graduate" means such teachers who have post graduate qualification or equivalent and is trained;
(xi) "Head master" means the Headmaster regular by posted in the Nationalised Middle school;
(xii) "Similar category'' means teacher of the same category such as Assistant teacher of General Hindi and Urdu subject Trained Teacher of concerned science and Arts Graduate;
(xiii) "State Government'' means Government of Bihar;
(xiv) "Department'' means Education Department;
(xv) "District Programme officer (establishment) means Incharge of Establishment of the teachers of the district cadre of preliminary schools of the district; (xvi) "Teacher of the district cadre'' means teachers appointed in the pay scale in the preliminary schools of the district;
(xvii) "Appointing authority'' means the District Education Officer of the concerned district for the teachers of the district cadre.
3. Cadre structure - The following cadre structure will be for the teachers of the district cadre working in the nationalized preliminary schools.—
(i) Matriculation/Inter trained teachers-Basic Category;
(ii) Trained Graduate Teachers-Post of first promotion;
(iii) Pradhanadhyapak of the Middle school;
Pay scale of the above mentioned posts will be in conformity with the pay scale sanctioned by the State Government, from time to time6 (cid:464)बहार गजट (असाधारण), 29 अ(cid:200)तूबर 2020 4. Establishment Committee.—(1) For transfer and promotion at the district level, a District Preliminary Teacher Establishment Committee will be constituted consisting of the following:-
- Chairman
- Member (i) District Education officer (ii) District Programme Officer (Establishment) - Member-Secretary (iii) Senior Deputy Collector nominated by the District officer (if no woman member in the committee, woman officer may be nominated)
(iv) District Programme Officer (planning and accounts) - Member - Member (v) An officer of scheduled castes and scheduled tribes
(nominated by The District Officer
(2) All decisions relating to transfer, confirmation of service and promotion will be taken under these Rules by the Establishment Committee.
(3) The following committee will take decision in respect of optional Inter-district transfer:-
(a) Director, Primary Education -Chairman (b) Regional Deputy Director Education Patna Division Patna - Member (c) Incharge Deputy Director/Assistant Director of the subject -Member-Secretary 5. General Principal of transfer of the teachers.— (1) Post of the teacher will be non transferable but in the following circumstances, transfer of the teachers may be made in the schools situated within the district:-
(a) Mutual transfer of the teachers of the same category or (b) At present, under the Transfer rules enforced, exemption to take maximum two transfer in his service period has been given to the teachers of each category. Provided that it will be compulsory to be an interval of minimum of four years between first and second transfer.
(c) An order may be given to the concerned District Education officer for transfer of the Head master/Assistant teacher on administrative grounds, in view of the recommendation of the District Education Officer and Senior Officers at the Education Department. '' Administrative grounds '' means-
(i) Bad effects of the activities of the Headmaster/Assistant Teacher on the discipline and educational environment due to which his transfer is necessary in the interest of the school ;
(ii) The Headmaster and the teacher are found involved in such financial irregularity in which embezzlement of government amount and criminal matters are vested.
(d) The teachers may be transferred to implement the norms of pupil-teacher ratio, inconfermity with the provision of the notified Rules under Right of Children to Free and Compulsory Education Act, 2009 (as amended from time to time), can be transferred. For this, District Education Officer may transfer with approval of District Magistrate.
(2) Application for mutual or optional transfer may be given to the District Education Officer in the prescribe form.
(3) If more than one applications are obtained for transfer to the same post in the school, senior teacher will be transferred but preference will be given to disabled and woman teacher.
(4) Inter district optional transfer will be only of the teachers of basic category. On inter district transfer, seniority of teacher in the new district cadre will be below the appointed teachers of that district in their appointment year.
6. Disciplinary action against teachers of the preliminary schools.— Disciplinary action against the district cadre teachers may be taken under the provisions of the Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 (as amended from time to time).
7 (cid:464)बहार गजट (असाधारण), 29 अ(cid:200)तूबर 2020 7. Conditions of promotion.— After completing the following conditions onlypromotion of any teachers may be considered:-
(i) minimum qualifying service 'Kalawadhi' will be the same which will be determined by the General Administrative Department from time to time.
(ii) to have minimum educational and training qualifications (iii) satisfactory service 8. Reservation.— Rules of reservation in promotion of the State Government will be followed at time of giving promotion from Matriculation Trained to the posts of Graduate Trained and from Graduate Trained to the Head master of the Middle school.
9. Promotion in the category of Graduate Teacher.—Inter Trained Teachers, having minimum period of service as determined and graduate qualification will be considered for giving promotion to the post of Graduate Teacher on the basis of seniority in conformity with available vacancy.
10. Promotion to the post of the headmaster of the middle School.—Teacher's having minimum period as determined, scale and post graduate qualification will be considered for giving promotion to the post of the headmaster on the basis of seniority in conformity with the available vacancies. If the teachers are not available in required number for promotion action for relaxation in qualification and kalawadhi may be taken by the Department according to the rules. Promotion given under rule 10 and 11 will be given from the date of notification and financial benefit from the date of joining.
11. Seniority List for promotion.—
(1) Seniority list will be prepared 31 st December of each year. (2) For Science and arts teacher, seniority List for promotion of the teacher from matriculation/Inter trained teacher to graduate trained teacher having graduate qualification will be prepared separately. Names of graduate teachers having required service period for promotion will be in this List.
(3) Seniority list for promotion to the post of the Headmaster will be prepared amongst the teachers having post graduate degree working in the graduate pay scale.
12. Inter-se-seniority in the same category.—Inter-se-Seniority of the teacher working in the same category will be determined under the following criterion -
(i) Date of getting the specific category will be ground of seniority determination. On being similar date of getting specific category, the date of getting lower category than that and similarly the date of getting lowest category, where is required will be the ground of seniority.
(ii) on being similar on the date of getting category, date of birth will be the ground. (iii) on being date of birth being similar, Inter-se-seniority will be determined by their names in alphabetical order of Roman script.
13. Promotion Order.— Promotion Order (with posting) against the available vacant posts will be issued after decision of promotion taken by the District Establishment Committee. Promotional order will be issued with joint signatures of the member-secretary of the Promotion Committee and the District Education Officer.
14. Optional Arrangement.—Work of higher posts may be taken by the senior teachers in their pay scale under the optional arrangement for not allowing the educational and administrative works be affected due to vacancy of the higher posts. Claim of additional pay and promotion will not be admissible under this arrangement.
15. Untrained Teacher.— (1) Untrained teachers will not be eligible for promotion in any of the categories. (2) Seniority of the untrained teacher will be determined from the date on which he has been given trained pay scale.
16. Non application of these Rules.—These Rules will not apply to the Niyojit Teachers.
17. Removal of difficulties.—Power of removal of difficulties arising in implementation of the provisions of these Rules, by notification/order, will vest in the State Government (Education Department).
18. Appeal.— Any teacher aggrieved by order issued under the provisions of these Rules in respect of promotion, disciplinary action and other action and transferee may prefer8 (cid:464)बहार गजट (असाधारण), 29 अ(cid:200)तूबर 2020 appeal to Regional Deputy Director, Education within thirty days from the date of issue of the order.
19. Repeal and savings.—(1) The Bihar Nationalised Primary School teacher promotion Rules, 2011 and the Bihar Nationalised primary School teacher (Transfer) Rules, 2006 and all circulars, resolution, direction etc. issued there under are here by repealed.
(2) Not with standing such repeal, any thing done or any action taken under the said Rules, Circulars, Resolutions and Direction issued before the date of coming in to force of these Rules shall be deemed to be done or taken under these Rules as if these Rules were come in to force on such day on which such thing was done of such action was taken.
