औद्योगिक विवाद (बिहार संशोधन) अधिनियम, 2020 औद्योगिक विवाद अधिनियम, 1947 को संशोधित करने हेतु अधिनियम।
प्रस्तावना ।- चूँकि वर्तमान में कोविड-19 वायरस महामारी के प्रकोप ने बिहार राज्य में औद्योगिक क्रियाकलापों एवं आर्थिक गतिविधियों की गति को कम किया है एवं औद्योगिक क्रियाकलापों तथा आर्थिक गतिविधियों को गति देने हेतु प्रदेश में नये औद्योगिक निवेश के अवसर पैदा करने की आवश्यकता है;
और, चूँकि बिहार राज्यपाल का समाधान हो गया है कि ऐसी परिस्थितियाँ विद्यमान है, जिनके कारण श्रम अधिनियमों में संशोधन करने के लिए तुरंत कार्रवाई करना आवश्यक हो गया है;
और, चूँकि राष्ट्रपति से प्राप्त निर्देश के आलोक में इसे अध्यादेश के रूप में प्रख्यापित किया जा चुका है : इसलिए, भारत गणराज्य के 71वें वर्ष में बिहार राज्य विधानमंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हो।
1. संक्षिप्त नाम, विस्तार और प्रारंभ।-
(1) इस अधिनियम को औद्योगिक विवाद (बिहार संशोधन) अधिनियम, 2020 कहा जायेगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृृत होगा।
2. औद्योगिक विवाद अधिनियम, 1947 में संशोधन।-
(1) औद्योगिक विवाद अधिनियम, 1947 की धारा-25ट में शब्द ''एक सौ'' को शब्द ''तीन सौ'' से प्रतिस्थापित किया जाएगा।
(2) औद्योगिक विवाद अधिनियम, 1947 में धारा- 36 (ख) के पश्चात निम्नलिखित धारा जोडी जायेगी। अर्थात् धारा-
''36(ग) (लोकहित में नये उद्योगों को छूट देने की शक्ति) जहॉं, राज्य सरकार का किसी नये औद्योगिक स्थापना या उपक्रम या नये औद्योगिक स्थापनों या उपक्रमों के वर्ग के बारे में यह समाधान हो जाता है कि ऐसा किया जाना लोकहित में आवश्यक है, वहॉं वह राजपत्र में अधिसूचना द्वारा, इस अधिनियम के सभी या किन्हीं उपबंधों से ऐसे नये स्थापना या उपक्रम या स्थापनाओं या उपक्रमों के वर्ग को शर्त्त सहित या र्शा के बिना ऐसे नये स्थापना या उपक्रम या स्थापनाओं या उपक्रमों के वर्ग को, जैसी भी स्थिति हो उनकी स्थापना के दिनांक से एक हजार दिवस के लिए छूट दी जा सकेगी''।
स्पष्टीकरणः- इस धारा के प्रयोजनों के लिए, नये औद्योगिक स्थापना या नया उपक्रम या नये औद्योगिक स्थापनाआें या उपक्रमों के वर्ग से अभिप्रेत है कि ऐसा औद्योगिक स्थापना या नया उपक्रम या नये औद्योगिक स्थापनाओं या नये उपक्रमों के वर्ग जो अैाद्योगिक विवाद (बिहार संशोधन) अधिनियम, 2020 के लागू होने से एक हजार दिवस की अवधि में स्थापित हुए हों।
3. विधिमान्यकरण ।- अधिनियम की इस धारा 25 ट एवं धारा 36 में संशोधन होते हुए भी, इसके पूर्व में किया गया कुछ भी या विनिश्चय और की गई कार्रवाई विधिमान्य रूप से किया गया या की गई समझी जाएगी और अधिनियम की धारा 25 ट एवं धारा 36 के संशोधन के आधार पर प्रश्नगत नहीं किया जाएगा या की जाएगी। 4. निरसन एवं व्यावृत्ति ।-

(BIHAR ACT 15, 2020) THE INDUSTRIAL DISPUTES (BIHAR AMENDMENT) ACT, 2020 (An Act further to amend the Industrial Disputes Act, 1947) Whereas, the Covid-19 pandemic has deteriorated the Industrial and Economic activities in the State of Bihar and for providing impetus to the Industrial and Economic activities in the State, it is important to provide new opportunities for Industrial investment in the State; And whereas, the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action; And whereas, it has been promulgated as an Ordinance in the light of the instruction received from the President : Be it enacted by the Legislature of the State of Bihar in the Seventy First year of the Republic of India as follows :-
1. Short Title, Extent and Commencement.—
(1) This Act may be called the Industrial Disputes (Bihar Amendment) Act, 2020. (2) It shall extent to the whole of the State of Bihar (3) It shall come into force at once.
2. Amendment of the Industrial Disputes Act, 1947.—
(1) In the Industrial Disputes Act, 1947, in section 25 K, for the words "one hundred", the words "three hundred" shall be substituted.
(2) In the Industrial Disputes Act, 1947, after the sub section 36 (B), the following section shall be added, namely:-
"36-C (Power to exempt new industries in public interest)- Where the State Government in satisfied in relation to any new industrial establishment or new undertaking or class of new industrial establishments or new undertaking that it is necessary in the public interest to do so, it may, by notification in the official Gazette, exempt, conditionally or unconditionally, any such new establishment or new undertaking or class of new establishments or new undertaking from all or any of the provisions of this Act for a period of one thousand days from the date of the establishment of such new industrial establishment or new undertaking or class of new establishments or new undertakings, as the case may be" Explanation:- For the puposes of this section, the expression "new industrial establishment or new undertaking or class of new industrial establishment or new undertakings"means such industrial establihsment or undertaking or class of industrial establishemnts or undertakings which are established within a period of one thousand days after the commencement of the Industrial Disputes (Bihar Amendment) Act, 2020. 3. Validation.— Notwithstanding such amendment in section 25 K and the section 36 of the Act, anything done and decision and action taken prior to it shall be deemed to have been validly done or taken and shall not be questioned on the ground of amendment of section 25 K and the section 36 of the Act.

(i) The Industrial Disputes (Bihar Amendment) Ordinance, 2020. (Bihar Ordinance No-07- 2020 is hereby repealed.
(ii) Notwithstanding such repeal, any thing done or any action takent in exercise of any power conferred by or under the said ordinance shall be deemed to have been done or taken in exercise of the powers conferred by or under this Act as if this Act were in force on the days on which such thing was done or action taken.
