सं॰ 7/स्था0-04-12/2019-12726/सा0प्र0—भारत-संविधान के अनुच्छेद 234 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, उच्च न्यायालय, पटना एवं बिहार लोक सेवा आयोग के परामर्श के पश्चात् बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः- बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) (संशोधन) नियमावली, 2020
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।- (1) यह नियमावली बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) (संशोधन) नियमावली, 2020 कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) नियम-3क(i)(क) के बाद निम्नरुपेण जोडे जाने वाले (1) एवं (2) को सामान्य प्रशासन विभाग, बिहार, पटना के पत्रांक-14837 दिनांक 30.10.2019 द्वारा बिहार लोक सेवा आयोग को अधियाचित रिक्तियों की तिथि 30.10.2019 से प्रभावी मानी जायेगी। 2. बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 के नियम-3क(i)(क) के बाद निम्नरूपेण जोड़ा जाएगाः-
(1) असैनिक न्यायाधीश (कनीय कोटि) के पदों की नियुक्तियों में, जो सीधी भर्त्ती द्वारा भरी जाने वाली हो, 10 प्रतिशत रिक्तियाँ आर्थिक रूप से कमजोर वर्गों के लिए आरक्षित रहेंगी। यह प्रावधान राज्य में लागू अन्य किसी नियम के द्वारा विभिन्न आरक्षित कोटि के लिए विहित आरक्षण के अतिरिक्त होगी। परन्तु राज्य से बाहर के अभ्यर्थी इस नियम के अधीन आरक्षण के लाभ हेतु दावा नहीं करेंगे।
(2) आर्थिक रूप से कमजोर वर्ग के उम्मीदवार, जो अपने गुणागुण के आधार पर चुने जाते हैंं, की गणना खुली गुणागुण कोटि में की जायेगी यथा बिहार पदों एवं सेवाओं की रिक्तियों तथा शैक्षणिक संस्थानों मे नामांकन मेंं (आर्थिक रूप से कमजोर वर्गों के लिए) आरक्षण अधिनियम, 2019 (समय-समय पर यथा संशोधित) में परिभाषित की गयी है। 2 ;बपकरू4द्ध ;बपकरू24द्धख्;बपकरू4द्ध;बपकरू4द्ध;बपकरू26द्ध;बपकरू29द्ध

No-7/Astha.-04-12/2019-12726/GAD— In exercise of the powers conferred by Article 234 of the Constitution of India, the Governor of Bihar, after consultation with High Court of Judicature at Patna and the Bihar Public Service Commission, is pleased to make the following amendments in Bihar Civil Service (Judicial Branch) Recruitment Rules, 1955:
The Bihar Civil Service (Judicial Branch) (Recruitment) (Amendment) Rules, 2020
1. Short title, extent and commencement:-
(1) These rules may be called the Bihar Civil Service (Judicial Branch) (Recruitment) Amendment Rules, 2020.
(2) It shall be extended to the whole of the State of Bihar. (3) After Rule 3A (i) (a) thus added (1) and (2) in following manner shall be deemed to have come into force with effect from the date 30.10.2019 when the vacancies were requisitioned to the Bihar Public Service Commission vide General Administration Department, Government of Bihar, letter no. 14837 dated 30.10.2019.
2. In the Bihar Civil Service (Judicial Branch) Recruitment Rules, 1955, after Rule
3A(i)(a), (1) and (2) shall be added in the following manner:- (1) Ten percent of vacancies will be reserved for Economically Weaker Sections in Bihar Civil Service (Judicial Branch) (Recruitment) which are to be filled up by direct recruitment. The aforesaid reservation will be in addition to the provisions of reservation for other categories as have been provided for in other prevailing Rules in the State of Bihar. Provided the candidates out of the State of Bihar shall not claim for benefits of reservation under this Rule.
(2) A reserved category candidate who is selected on the basis of his merit shall be counted against the open merit category as defined under The Bihar Reservation in vacancies in post and in services and in Admissioin in the Education Institutions (For Economically Weaker Section) Act,2019.
