स्ां॰ 4-स्ां॰/नि॰ 1-07/2017— —26—भारत के संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का भारत के संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, संग्रहालय निदेषालय (कला, संस्कृति एवं युवा विभाग) बिहार, पटना के प्रयोग करते हुए बिहार के राज्यपाल, संग्रहालय निदेषालय (कला, संस्कृति एवं युवा विभाग) बिहार, पटना के प्रयोग करते हुए बिहार के राज्यपाल, संग्रहालय निदेषालय (कला, संस्कृति एवं युवा विभाग) बिहार, पटना के में भर्ती/प्रोन्नति एवं सेवा शर्तों को विनियमित करने हेतु नियंत्रणाधीन राजकीय संग्रहालयों के लिपिक संवर्ग नियंत्रणाधीन राजकीय संग्रहालयों के लिपिक संवर्ग में भर्ती/प्रोन्नति एवं सेवा शर्तों को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैंः- निम्नलिखित नियमावली बनाते हैंः-

संक्षिप्त नाम, विस्तार एवं प्रारंभ । -

र्ग (भर्ती एवं सेवा-षर्तें) नियमावली, परिभाषाएँ। - इस नियमावली में जब तक संदर्भ में अन्यथा अपेक्षित नहीं हो :-

से अभिप्रेत है राजकीय संग्रहालयों के लिपिकीय संवर्ग;

(ड.) 'विभाग' से अभिप्रेत है : कला, संस्कृति एवं युवा विभाग; (च) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग;

1. संक्षिप्त नाम, विस्तार एवं प्रारंभ । - यह नियमावली ''बिहार राजकीय संग्रहालय लिपिकीय संवर्ग (भर्ती एवं सेवा-षर्तें) नियमावली, (1) यह नियमावली ''बिहार राजकीय संग्रहालय लिपिकीय संव 2021'' कही जा सकेगी। 2021'' कही जा सकेगी। इसका विस्तार सम्पूर्ण बिहार राज्य के संग्रहालयों के कार्यालयों में होगा। इसका विस्तार सम्पूर्ण बिहार राज्य के संग्रहालयों के कार्यालयों में होगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य के संग्रहालयों के कार्यालयों में होगा। यह तुरन्त प्रवृत्त होगी। (3) यह तुरन्त प्रवृत्त होगी। 2. परिभाषाएँ। - इस नियमावली में जब तक संदर्भ में अन्यथा अपेक्षित नहीं हो :- (क) ''संवर्ग'' से अभिप्रेत है राजकीय संग्रहालयों के लिपिकीय संवर्ग; ''राज्य सरकार'' से अभिप्रेत है बिहार राज्य सरकार; (ख) ''राज्य सरकार'' से अभिप्रेत है बिहार राज्य सरकार; ''नियुक्ति प्राधिकार'' से अभिप्रेत है बिहार के राजकीय संग्रहालयों के लिपिकीय संवर्ग के लिए (ग) ''नियुक्ति प्राधिकार'' से अभिप्रेत है बिहार के राजकीय संग्रहालयों के लिपिकीय संवर्ग के लिए ''नियुक्ति प्राधिकार'' से अभिप्रेत है बिहार के राजकीय संग्रहालयों के लिपिकीय संवर्ग के लिए निदेषक, संग्रहालय, बिहार, पटना; निदेषक, संग्रहालय, बिहार, पटना; ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है, संग्रहालय निदेषालय के कार्यालयों के लिपिकीय संवर्ग के ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है, संग्रहालय निदेषालय के कार्यालयों के लिपिकीय संवर्ग (घ) ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है, संग्रहालय निदेषालय के कार्यालयों के लिपिकीय संवर्ग लिए निदेशक, संग्रहालय, बिहार, पटना; लिए निदेशक, संग्रहालय, बिहार, पटना; 'विभाग' से अभिप्रेत है : कला, संस्कृति एवं युवा विभाग; 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; ''सदस्य'' से अभिप्रेत है संवर्गों में नियुक्त कोई व्यक्ति तथा इसमें इस नियमावली के प्रवृत होने के ''सदस्य'' से अभिप्रेत है संवर्गों में नियुक्त कोई व्यक्ति तथा इसमें इस नियमावली के प्रवृत होने (छ) ''सदस्य'' से अभिप्रेत है संवर्गों में नियुक्त कोई व्यक्ति तथा इसमें इस नियमावली के प्रवृत होने पूर्व से संवर्ग में नियुक्त सभी व्यक्ति शामिल हैं; तथा पूर्व से संवर्ग में नियुक्त सभी व्यक्ति शामिल हैं; तथा ''अनुकम्पा के आधार पर नियुक्ति'' से अभिप्रेत है, सेवा काल में मृत सरकारी सेवकों के आश्रितों ''अनुकम्पा के आधार पर नियुक्ति'' से अभिप्रेत है, सेवा काल में मृत सरकारी सेवकों के आश्रितों (ज) ''अनुकम्पा के आधार पर नियुक्ति'' से अभिप्रेत है, सेवा काल में मृत सरकारी सेवकों के आश्रितों में से किसी एक की प्रासंगिक परिपत्रों/अनुदेषों के अनुसार अनुकम्पा के आधार पर नियुक्ति। में से किसी एक की प्रासंगिक परिपत्रों/अनुदेषों के अनुसार अनुकम्पा के आधार पर नियुक्ति। में से किसी एक की प्रासंगिक परिपत्रों/अनुदेषों के अनुसार अनुकम्पा के आधार पर नियुक्ति।2 ;बपकरू2द्ध;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध 2;बपकरू10द्ध21 3. संवर्ग की संरचना।- लिपिकीय संवर्ग राज्य स्तरीय संवर्ग होगा जिसकी संरचना निम्नलिखित के अनुसार होगीः-

टिप्पणीः- (क) निम्न वर्गीय लिपिक, उच्च वर्गीय लिपिक तथा प्रधान लिपिक के पदों की संख्या एवं वेतनमान वही होगा जो, समय-समय पर, राज्य सरकार के द्वारा अधिसूचित किया गया हो। (ख) इस नियमावली के लागू होने के पूर्व से उक्त कोटियों में नियुक्त एवं कार्यरत व्यक्ति स्वतः इस संवर्ग में शामिल समझे जायेंगे।

4. पद सृजन। - संवर्ग में किसी कोटि के अतिरिक्त स्थायी या अस्थायी रूप से पदों का सृजन विभाग की आवश्यकता के अनुसार किया जा सकेगा।

5. अहर्त्ता। - (1) निम्न वर्गीय लिपिक के पद पर नियुक्ति के लिए न्यूनतम शैक्षणिक योग्यता इन्टरमिडिएट (102) या समकक्ष उाीर्ण के साथ कम्प्यूटर संचालन एवं कप्यूटर टंकण का ज्ञान होना आवश्यक है।

(2) भर्ती के लिए न्यूनतम उम्र 18 वर्ष होगी और अधिकतम उम्र वहीं होगी जो राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा, समय-समय पर, अवधारित की जाय।

6. भर्ती। - (1) निम्न वर्गीय लिपिक का 85 प्रतिषत पद सीधी भर्त्ती से भरा जाएगा और शेष 15 प्रतिषत पद लिपिक के पद पर नियुक्ति की अहर्त्ता रखने वाले सुपात्र कार्यालय परिचारी/ परिचारी (विशिष्ट) में से, वरीयता-सह-योग्यता के आधार पर, प्रोन्नति द्वारा भरे जाएँगे। सीधी भर्ती के लिए 85 प्रतिषत पदों में से 10 प्रतिषत पद अनुकम्पा के आधार पर नियुक्ति के लिए आरक्षित रहेगा।

(2) सीधी भर्ती बिहार कर्मचारी चयन आयोग की अनुषंसा पर निम्न वर्गीय लिपिक की कोटि में की जाएगी।

(3) ''प्रोन्नति द्वारा भर्ती।- (i) नियुक्ति प्राधिकार इण्टरमीडिएट अथवा समकक्ष उाीण्ज्ञ्र कार्यालय परिचारी/परिचारी (विशिष्ट) की वरीयता सूची तैयार करेगा। (ii) कार्यालय परिचारी/परिचारी विशिष्ट से समूह 'ग' में प्रोन्नति, वरीयतानुसार विभागीय प्रोन्नति समिति की अनुशंसा पर दी जायेगी, परन्तु इस प्रकार से प्रोन्नत निम्न वर्गीय लिपिकों को प्रथम वेतन वृद्धि के उपरान्त अगली वेतन वृद्धि तब तक देय नहीं होगी, जब तक की उनके द्वारा कम्प्यूटर सक्षमता परीक्षा एवं हिन्दी टिप्पण एवं प्रारूपण परीक्षा उाीर्ण नहीं कर लिया जाय। उक्त परीक्षाएँ उाीर्ण करने के उपरान्त ही निम्न वर्गीय लिपिक के पद पर उनकी सेवा सम्पुष्ट की जा सकेगी।''

7. आरक्षण।- नियुक्ति/प्रोन्नति में राज्य सरकार द्वारा समय-समय पर अधिसूचित आरक्षण एवं रोस्टर के प्रावधान लागू होंगे।

8. परिवीक्षा अवधि।-निम्न वर्गीय लिपिक की परिवीक्षा अवधि 2 वर्षों की होगी। 9. विभागीय परीक्षा एवं पाठ्‌यक्रम। - लिपिकीय संवर्ग के लिए हिन्दी टिप्पण एवं प्रारुपण परीक्षा तथा केन्द्रीय परीक्षा समिति, राजस्व पर्षद द्वारा संचालित विभागीय परीक्षा के साथ-साथ कम्प्यूटर सक्षमता की जांच परीक्षा में उत्तीर्णता की अनिवार्यता होगी।

10. सम्पुष्टि। - कोई परिवीक्षाधीन व्यक्ति परिवीक्षा अवधि की संतोषजनक समाप्ति तथा हिन्दी टिप्पण एवं प्रारुपण/विभागीय परीक्षा एवं कम्प्यूटर सक्षमता जांच परीक्षा की उत्तीर्णता के बाद सम्पुष्ट किया जाएगा। 11. वरीयता का निर्धारण। - निम्न वर्गीय लिपिक की आपसी वरीयता आयोग द्वारा निर्धारित मेधा क्रमानुसार विनिष्चित की जायेगी, किन्तु इस नियमावली के आरंभ होने के पूर्व विनिष्चित आपसी वरीयता अपरिवर्तनीय रहेगी

परन्तु अनुकम्पा के आधार पर नियुक्त व्यक्ति उन व्यक्तियों से कनीय होंगे, जो संबंधित भर्ती वर्षों में प्रतियोगिता परीक्षा के आधार पर नियुक्त किए गए हैं, लेकिन किसी भर्ती वर्ष में प्रोन्नति द्वारा नियुक्त व्यक्ति संबंधित भर्ती वर्ष में प्रतियोगिता परीक्षा द्वारा नियुक्त व्यक्ति से वरीय होंगे।3 ;बपकरू2द्ध;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध 2;बपकरू10द्ध21 12. प्रोन्नति। - मूल कोटि से उच्चतर कोटि में सरकार (सामान्य प्रषासन विभाग) द्वारा समय-समय पर निर्धारित निष्चित कालावधि पूरा होने पर और विभाग द्वारा गठित विभागीय प्रोन्नति समिति की अनुषंसा पर दी जा सकेगी। विभागीय प्रोन्नति समिति के गठन का आदेश विभाग द्वारा अलग से अधिसूचित किया जायेगा। 13. अवषिष्ट मामले। - ऐसे मामलों के संबंध में जो इस नियमावली द्वारा विषिष्ट रुप से आच्छादित नहीं है, संवर्गों के सदस्य राज्य सरकार के समुचित स्तर के पदाधिकारियों/कर्मचारियों के लिए लागू नियमावली या आदेषों से शासित होंगे।

14. कठिनाईयों का निराकरण। - विभाग समय-समय पर इस नियमावली के प्रावधानों में से किसी के कार्यान्वयन में आ रही कठिनाई के निराकरण के लिए ऐसा सामान्य या विषेष निर्देष, विधि विभाग के परामर्ष से, जारी कर सकेगा, जो आवष्यक हो और इस नियमावली के प्रावधानों से असंगत न हो। 15. निर्वचन। - जहाँ इस नियमावली के प्रावधानों में से किसी के निर्वचन के संबंध में कोई शंका उत्पन्न हो वहाँ मामला, विभाग द्वारा, विधि विभाग के परामर्ष से, विनिष्चित किया जायेगा और ऐसा विनिष्चय अंतिम होगा। 16. निरसन एवं व्यावृत्ति। - (1) इस संवर्ग के संबंध में पूर्व में निर्गत सभी संकल्प एवं अनुदेष एतद्‌ द्वारा

निरसित किये जाते हैं।

(2) ऐसा निरसन के होते हुए भी, ऐसे संकल्प, अनुदेष के अधीन किया गया कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया कार्य या की गयी समझी जाएगी मानो यह नियमावली उस दिन प्रवृत्त थी जिस दिन ऐसा कार्य या कार्रवाई की गयी थी।

No. 4-Sa/Ni.1-07/2017/27—In exercise of the powers conferred under provisoto Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to regulate the recruitment/promotion and service- conditions of the Clerical Cadre of the Government Museums under Directorate of Museums (Department of Art, Culture & Youth) Bihar, Patna:-

Bihar State Museum Clerical Cadre (Recruitment & Service Conditions) Rules,

2021–

1. Short title, extent and commencement –

(1) These Rules may be called Bihar State Museum Clerical Cadre (Recruitment & Service Conditions) Rules, 2021.

(2) It shall extend to the Offices of the Museums of the whole State of Bihar. (3) It shall come into force at once.

2. Definitions- In these rules, unless otherwise requires in the context-

(i) 'Cadre' means the Clerical Cadre of State Museums; (ii) 'State Government' means the Government of Bihar; (iii) 'Appointing Authority' means the Director, Museums, Bihar, Patna for the Clerical Cadre of Government Museums;

(iv) 'Cadre Controlling Authority' means the Director, Museums, Bihar, Patna for the Clerical Cadre of the Offices of Directorate of Museums;

(v) 'Department' means Department of Art, Culture & Youth; (vi) 'Commission' means Bihar Staff Selection Commission; (vii) 'Member' means a person appointed in this Cadre including all the persons appointed in this cadre before enforcement of these rules;

(viii) 'Appointment on Compassionate ground' means appointment of one of the dependents of died government servant during service period according to the Government circulars/orders.

3. Structure of Cadre-

Note – (a) The number and pay scale of Lower Division Clerk, Upper Division Clerk and Head Clerk will be the same which have been notified by State Government from time to time.

(b) All the persons appointed and working in the said categories before the commencement of these Rules will be deemed to be included in this Cadre automatically.

4. Creation of Post – Additional posts of any category in the cadre may be created on permanent/ temporary basis as per the need and necessity of the Department.

5. Qualifications- (1) Minimum educational qualification for the appointment to the post of L.D.C. will be Intermediate (10+2) or equivalent pass with knowledge of Computer Operation or Computer typing.

(2) Minimum age for recruitment will be 18 years and the maximum age will be the same as it may be determined by State Government (General Administration Department) from time to time.

6. Recruitment – (1) 85% posts of L.D.C. will be filled up by way of direct recruitment and rest 15% posts will be filled upby promotion from the office peons /peons (Special) who have requisite qualifications on the basis of seniority-cum- merit. Out of the 85% posts for direct recruitment, 10%posts will remain reserved for the appointment on the compassionate ground.

(2) Direct recruitment in the category of Lower Division Clerk will be made on the recommendation of Bihar Staff Selection Commission.

(3) Recruitment by Promotion- (i) Appointing Authority will prepare a seniority list of Intermediate or equivalent pass Office Peons/ Peons (Special). (ii) Promotion in Class III from Seniority list of Office Peons/Peons (Special) will be given on the basis of recommendation of Departmental Promotion Committee, but promoted L.D.C. will not be given next increment after First Pay increment until they pass Computer Competence test and Hindi Noting and Drafting Examination. Their services will be confirmed onthepostof L.D.C. only after passing the above examinations.

7. Reservation:- In appointment /promotion, the provisions of reservation and roster notified by the State Government from time to time, will be applicable.

8. Probation period – The probation period for L.D.C. will be of two years.

9. Departmental Examination and Syllabus- It will be compulsory for the Clerical Cadre to pass the Hindi Noting and Drafting Examination and Departmental Examination conducted by Central Examination Board, Board of Revenue, along with Computer Competence Test Examination.

10. Confirmation – Any probationer will be confirmed only after completion of probation period satisfactorily and passing the Hindi Noting & Drafting/Departmental Examination and Computer Competence Test Examination.

11. Fixation of Seniority – The inter-se seniority of L.D.C. will be fixed on the basis of seniority list in order of merit prepared by the Commission but the inter-se Seniority fixed before commencement of these Rules will remain unchanged. Provided that the persons appointed on the Compassionate ground will be junior to those, who have been appointed in that appointment year on the basis of Competitive Examination, but the persons appointed on the basis of promotion in a particular year will be senior to those who have been appointed on the basis of Competitive Examination.

12. Promotion – Promotion from basic category to higher category may be given after completion of kalawadhi (time period) as determined by the Government (General Administration Department) from time to time and on the basis of recommendation of Departmental Promotion Committee. Order of constitution of 'Departmental Promotion Committee'will be notified by Department separately.

13. Residuary Matters-With regard tosuch matters, which are not covered by these Rules specifically, the member of the Cadre will be governed by the rules, regulations ororders applicable to equivalent Officers/Employees of State government.

14. Removal of difficulties – The Department may from time to time issue such general or special direction which is necessary and not inconsistent to the provisions of these Rules to remove any difficulty coming in implementation of any of these Rules after consultation of the Law Department.

15. Interpretation- If there any doubt arises in respect of interpretation of any of the provisions of these Rules, the Department will decide the matter after consultation of the Law Department, and such decision will be final.

16. Repeal & Saving – (i) All the resolutions, instructions already issued in respect of this Cadre are hereby repealed. (ii) Notwithstanding such repeal anything done or any action taken under the said resolutions and instructions shall be deemed to have been done or taking under these Rules, as if these Rules were in enforce on the day on which such thing was done or action was taken.
