सं॰ सं॰ सं॰ सं॰ पर्या॰/वन (पर्या॰/वन (पर्या॰/वन (पर्या॰/वन (मु॰)-28/2019मु॰)-28/2019मु॰)-28/2019मु॰)-28/2019-140/-140/-140/-140/प॰व॰ज॰प॰प॰व॰ज॰प॰प॰व॰ज॰प॰प॰व॰ज॰प॰—माननीय राष्ट्रीय हरित न्यायाधिकरण/माननीय उच्चतम न्यायालय में पर्यावरण संबंधी विषयों पर दायर विभिन्न वादों में पारित आदेशों के सामयिक अनुपालन का अनुश्रवण राज्य के मुख्य सचिव, बिहार के स्तर से किया जाना है। इस संदर्भ में दिनांक-06.01.2021 को मुख्य सचिव, बिहार की अध्यक्षता में माननीय राष्ट्रीय हरित न्यायाधिकरण/माननीय उच्चतम न्यायालय द्वारा पारित आदेशाों के अनुपालन की समीक्षा वीडियो कॉन्फ्रेंसिंग के माध्यम से की गयी एवं उक्त बैठक में निदेश दिया गया कि अनुपालन के मुख्य बिन्दुओं की समीक्षा कर पर्यवेक्षण एवं अनुश्रवण हेतु नोडल विभाग का निर्धारण पर्यावरण, वन एवं जलवायु परिवर्तन विभाग द्वारा किया जाय।
उक्त के आलोक में माननीय राष्ट्रीय हरित न्यायाधिकरण, प्रधान बेंच, नई दिल्ली/पूर्वी बेंच, कोलकत्ता में दायर O.A. एवं माननीय उच्चतम न्यायालय में दायर याचिकाओं में पारित आदेशों के अनुपालन के मुख्य बिन्दुओं के आधार पर पर्यवेक्षण एवं अनुश्रवण हेतु नोडल विभागों का निर्धारण अनुलग्नक-क, ख एवं ग में किया गया है। नोडल विभाग का दायित्व एवं कर्त्तव्य निम्नवत् होंगे :- नोडल विभाग का दायित्व एवं कर्त्तव्य निम्नवत् होंगे :- नोडल विभाग का दायित्व एवं कर्त्तव्य निम्नवत् होंगे :- नोडल विभाग का दायित्व एवं कर्त्तव्य निम्नवत् होंगे :- 1. नोडल विभाग माननीय राष्ट्रीय हरित न्यायाधिकरण/माननीय उच्चतम न्यायालय के पारित आदेशों का अनुपालन सुनिश्चित करेंगे।
2. नोडल विभाग द्वारा अन्य विभागों से संबंधित बिन्दुओं पर प्रतिवेदन प्राप्त कर समेकित किया जायेगा एवं माननीय राष्ट्रीय हरित न्यायाधिकरण/माननीय उच्चतम न्यायालय के आदेश की समीक्षा की जायेगी।
3. नोडल विभाग द्वारा समेकित प्रतिवेदन के आधार पर मुख्य सचिव, बिहार को अनुपालन की स्थिति से अवगत कराया जायेगा तथा उनके निदेशानुसार नोडल विभाग माननीय राष्ट्रीय हरित न्यायाधिकरण एवं माननीय उच्चतम न्यायालय में सरकार का पक्ष रखेंगे।
