सं॰ 01/ए॰जी॰-17/2010-481—संख्या-01/ए॰जी॰-17/2010-4668 दिनांक-14.10.2014 भारत-संविधान के अनुच्छेद-309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल ''बिहार कृषि सेवा कोटि-2 (कृषि अभियंत्रण) भर्त्ती, प्रोन्नति एवं सेवा शर्त्त नियमावली, 2014'' का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं :-
1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-
(1) यह नियमावली ''बिहार कृषि सेवा कोटि-2 (कृषि अभियंत्रण) भर्त्ती, प्रोन्नति एवं सेवा शर्त्त (संशोधन) नियमावली, 2021'' कही जायेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में प्रकाशन की तारीख से प्रवृत होगी।
2. बिहार कृषि सेवा कोटि-2 (कृषि अभियंत्रण) भर्त्ती, प्रोन्नति एवं सेवा शर्त्त नियमावली, 2014 के
नियम-5 की उप कंडिका-4((((ii) का प्रतिस्थापन।- उक्त नियमावली के नियम-5 की उप कंडिका-4(ii) को निम्नवत् प्रतिस्थापित किया जायेगा। ''उम्र सीमा ।- आवेदन आमंत्रित करने वाले वर्ष के पहली अगस्त को न्यूनतम आयु 21 (इक्कीस) वर्ष होगी। अधिकतम उम्र सीमा वही होगी जो सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी भर्त्ती के लिए समय-समय पर, विनिश्चित की जाय, किन्तु विशेष परिस्थितियों में इसे राज्य सरकार के आदेश से बढ़ाया जा सकेगा।
परन्तु विधिवत् नियोजित एवं कार्यरत संविदा कर्मियों को, समान पद पर सीधी भर्त्ती के
तहत नियमित नियुक्ति में, अधिकतम उम्र सीमा में उतने वर्षों तक की छूट दी जायेगी, जितने वर्षों
तक उनके द्वारा बिहार सरकार में संविदा के आधार पर समान पद पर कार्य किया गया हो।''
2 ;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध;बपकरू16द्ध3. बिहार कृषि सेवा कोटि-2 (कृषि अभियंत्रण) भर्त्ती, प्रोन्नति एवं सेवा शर्त्त नियमावली, 2014 के नियम-5 में उप नियम 5(4)(vए) को जोड़ना। उक्त नियमावली के नियम-5 के उप नियम-(4)(v) एवं (4)(vi) के बीच (4)(vए) निम्नवत् जोड़ी जायेगी। ''5(4)(vए) मूल कोटि के पदों पर चयन लिखित एवं मौखिक परीक्षा में प्राप्त अंकों के योग एवं समान पद पर संविदा नियोजन के तहत की गयी कार्य अवधि के लिए अधिमानता देते हुए की जायेगी।
चयन के लिए अंको की अधिमानता का निर्धारण निम्नवत् किया जायेगा-
(क) आयोग की परीक्षा एवं साक्षात्कार में प्राप्त अंकों की अधिमानता- 75 अंक (ख) बिहार सरकार में संविदा के आधार पर समान पद पर
किये गये कार्य अवधि की अधिमानता - 25 अंक (संविदा नियोजन के प्रत्येक एक वर्ष के लिए 5 अंक की दर से अधिकतम 25 अंक होगी) नोटः- संविदा के आधार पर कार्यरत अवधि का विनिश्चय संबंधित नियंत्री पदाधिकारी द्वारा भुगतान के आधार पर निर्गत वेतन भुगतान प्रमाण-पत्र के अनुसार किया जाएगा। इस हेतु आयोग द्वारा प्रकाशित विज्ञापन की तिथि तक की गणना कार्य अनुभव के लिए की जा सकेगी।''
4. बिहार कृषि सेवा कोटि-2 (कृषि अभियंत्रण) भर्त्ती, प्रोन्नति एवं सेवा शर्त्त नियमावली, 2014 के नियम-5 उपनियम-5 का प्रतिस्थापन।- उक्त नियमावली के नियम-5 के उपनियम-5 को निम्नवत् प्रतिस्थापित किया जायेगा।-
प्रोन्नति द्वारा नियुक्ति।- बिहार कृषि सेवा कोटि-2 (कृषि अभियंत्रण) में कृषि अधीनस्थ सेवा कोटि-2 (कृषि अभियंत्रण) से कृषि अभियंत्रण में स्नातक योग्यताधारी को ही प्रोन्नति दी जाएगी। कृषि अधीनस्थ सेवा के कोटि-2 (कृषि अभियंत्रण) में कार्यरत कर्मियों को सामान्य प्रशासन विभाग द्वारा निर्धारित कालावधि एवं पदों की उपलब्धता आदि पर विचार करते हुए सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत नीति निर्धारक परिपत्रों के आलोक में वरीयता के आधार पर सक्षम प्राधिकार द्वारा प्रोन्नति दी जायेगी।

The 29th January 2021 No. 01/A.G.-17/2010-482— In exercise of the power conferred by proviso to Article 309 of the Constitution of India, The Governor of Bihar makes the following rules for amendment of Bihar Agriculture Services Category-2 (Agriculture Engineering) Recruitment, Promotion and Service Conditions Rules, 2014.
1. Short title, Extent and Commencement :-
(1) These rules may be called as the "Bihar Agriculture Services Category-2 (Agriculture Engineering) Recruitment, Promotion and Service Conditions Amendment Rules, 2021"
(2) It shall extend to the whole State of Bihar. (3) It shall come into force on the date of Publication in the official Gazette.
2. Substitution of Sub rule 4(ii) of rule-5 of Bihar Agriculture Services Category- 2 (Agriculture Engineering) Recruitment, Promotion and Service Conditions Rules, 2014.— Sub rule 4(ii) of rule 5 of said Rule shall be Substituted as follows :-
"Age limit.— 21 years as on 1st August of the year in which application is invited. The upper age limit shall be the same as determined for direct3 ;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध;बपकरू16द्ध recruitment in the state services by the General Administration Department, provided that the state government may increase in special circumstances.
Provided that the upper age limit for direct appointment may be
relaxed for the number of years the applicant is serving on similar contractual
post under Government of Bihar and she/he has been appointed following the
due process of appointment."
3. Addition of sub rule 5(4)(vA) in rule-5 of Bihar Agriculture Services
Category-2 (Agriculture Engineering) Recruitment, Promotion and Service Conditions
Rules, 2014.Sub Rule 4(vA) shall be added between the sub rule 4(v) and 4(vi) in the rule
5 of the said Rule:-
"5(4)(vA) Appointment on post of basic grade shall be made on the
basis of the marks obtained in the written and oral examination and the
preference given for the period of contractual appointment.
For appointment, preferential marks will be given as below :-
(a) Weightage for marks obtained in the written and — 75 marks oral examination of the Commission :
— 25 marks (b) Weightage for the work experience for working on similar post under Bihar Government
(For each year of working experience on similar post 5 marks will be awarded with maximum limit of 25 marks)
Note: (The working experience on the contractual post shall be determined by
the controlling officer on the basis of payment of the salary. For this the
period upto the date of the publication of advertisement by the
Commission shall be taken into consideration for calculating the period
of work experience)."
4. Substitution of Sub rule 5 of rule-5 of Bihar Agriculture Services Category-2 (Agriculture Engineering) Recruitment, Promotion and Service Conditions Rules, 2014.— Sub rule 5 of rule 5 of the said Rule shall be substituted as follows :-
Appointment by Promotion.— "Only the Agriculture Engineering Graduate qualification holder shall be promoted to the Bihar Agriculture service Category-2 (Agriculture Engineering) from the Agriculture subordinate service Category-2 (Agriculture Engineering). Considering the kalawadhi determined by the General Administration Department and the availability of posts etc. Promotion will given by the Competent Authority on the basis of seniority in view of policy deciding circulars issued by the department of General Administration, from time to time in this regard".
