3. संवर्ग का गठन।संवर्ग का गठन।संवर्ग का गठन।संवर्ग का गठन।-बिहार नगर विकास एवं आवास विभाग अवर अभियंत्रण (यांत्रिक/विद्युत) संवर्ग के अधीन । इस पद के लिए सरकार द्वारा समय-समय पर मूल कोटि का पद ''कनीय अभियंता (यांत्रिक/विद्यु मूल कोटि का पद ''कनीय अभियंता (यांत्रिक/विद्युत)'' होगा। इस पद के लिए सरकार यथा विनिश्चित वेतनमान एवं ग्रेड-पे देय होगा। यथा विनिश्चित वेतनमान एवं ग्रेड-पे देय होगा।

भाग - भाग - भाग - भाग - II संवर्ग में नियुक्तिसंवर्ग में नियुक्तिसंवर्ग में नियुक्तिसंवर्ग में नियुक्ति 6. नियुक्ति।नियुक्ति।नियुक्ति।नियुक्ति। -इस संवर्ग में प्रथम नियुक्ति सीधी र्भाी के आधार पर कनीय अभियंता (यांत्रिक/विद्युत) के पद पर होगी। इस पद पर प्रोन्नति के आधार पर कोई प्रवेश नहीं होगा। 7. नियुक्ति प्राधिकार द्वारा प्रत्येक वर्ष पहली अप्रैल को रिक्तियों की गणना कोटिवार की जायेगी एवं तद्नुसार विभाग के माध्यम से आयोग को 30 अप्रैल तक आरक्षण कोटिवार अधियाचना भेजी जायेगी। 8. नियम-7 के तहत दी गई अधियाचना के आधार पर आयोग द्वारा समय-समय पर उस रीति से जैसा कि वह उचित समझे, इस संवर्ग की आरक्षण कोटिवार रिक्तियों को, सीधी र्भाी द्वारा, नियुक्ति से भरने के लिए विज्ञापित करेगा।
9. अहर्ताएँ अहर्ताएँ अहर्ताएँ अहर्ताएँ :-ः-ः-ः- (1) इस संवर्ग में नियुक्ति होने के लिए अर्हता निम्नवत् होगी :- ((((i) ) ) ) सरकार के विशेष आदेश को छोड़कर, अभ्यर्थी का भारतीय नागरिक होना आवश्यक है। ((((ii) ) ) ) अवर अभियंत्रण संवर्ग के लिए यांत्रिक/विद्युत अभियंत्रण में डिप्लोमा अथवा समकक्ष योग्यताधारी ((((iii) ) ) ) चयन हेतु तकनीकी योग्यता/अर्हता :-
(क) अखिल भारतीय तकनीकी शिक्षा परिषद, नई दिल्ली से मान्यता प्राप्त संस्थानों के यांत्रिक अभियंत्रण (Mechanical Engineering)/विद्युत अभियंत्रण (Electrical Engineering) के डिप्लोमाधारी जिन्हें संबंधित तकनीकी शिक्षा पर्षद/विश्वविद्यालय के द्वारा डिप्लोमा प्रदा हो, अथवा (ख) UGC Act के प्रावधानों के अन्तर्गत स्थापित DEEMED University द्वारा Non-Distance Mode में यांत्रिक/विद्युत अभियंत्रण में प्रदा डिप्लोमा बर्शो कि उक्त DEEMED University को यांत्रिक अभियंत्रण (Mechanical Engineering)/विद्युत अभियंत्रण (Electrical Engineering) में डिप्लोमा पाठ्यक्रम करने के लिए विश्वविद्यालय अनुदान आयोग की स्वीकृति प्राप्त हो।
10. चयन की प्रक्रिया।चयन की प्रक्रिया।चयन की प्रक्रिया।चयन की प्रक्रिया।-(1) इस संवर्ग के मूल कोटि कनीय अभियंता (यांत्रिक/विद्युत) के पदों पर चयन डिप्लोमा अथवा समकक्ष योग्यता में प्रतिशत प्राप्तांक के आधार पर आयोग द्वारा किया जायेगा। बिहार सरकार या बिहार सरकार के अधीन किसी उपक्रम/निगम/निकाय/प्राधिकार/स्वशासी निकाय में संविदा के आधार पर कनीय अभियंता (यांत्रिक/विद्युत) के पद पर कार्य करने का अनुभव रखने वाले अभ्यर्थी, जो इस संवर्ग में र्भाी की अर्हाा पूरी करते हैं, को चयन में इस नियम के उप नियम-(2) (ख) के अनुसार अतिरिक्त अंक देकर अधिमानता दी जाएगी। (2) अभ्यर्थियों की मेधा सूची निम्नलिखित आधार पर तैयार की जाएगी :- पूर्णांक (क) डिप्लोमा अथवा समकक्ष योग्यता के प्रतिशत प्राप्तांक के आधार पर - 75 अंक (ख) संविदा के आधार पर कार्य करने के निमिा अधिकतम अधिमानता - 25 अंक (प्रति कार्यरत वर्ष के लिए 5 अंक जिसकी अधिकतम सीमा 25 अंक की होगी। किसी वर्ष के अंश के लिए कार्यरत दिवसों की संख्या में संख्या 5 से गुणा करने के पश्चात् 365 से भाग देकर प्राप्त अनुपातिक अंक जोड़ा जाएगा)।

(3) संविदा के आधार पर कार्यरत अवधि का विनिश्चय संबंधित नियंत्री पदाधिकारी द्वारा निर्गत वेतन भुगतान प्रमाण-पत्र के आधार पर किया जाएगा। इस हेतु आयोग द्वारा प्रकाशित विज्ञापन में अंकित कट-ऑफ डेट की अवधि तक की गणना कार्य अनुभव के लिए की जा सकेगी।
(4) यांत्रिक/विद्युत डिप्लोमाधारी उम्मीदवारों की कनीय अभियंता (यांत्रिक/विद्युत) के रूप में नियुक्ति निम्नलिखित रीति से की जाएगी :-
(क) ''बिहार नगर विकास एवं आवास विभाग अवर अभियंत्रण (यांत्रिक/विद्युत) संवर्ग र्भाी नियमावली, 2021 के नियम-5 के तहत कुल रिक्त पदों का आरक्षण कोटिवार 40 प्रतिशत पद राज्य के अधीन सरकारी पोलिटेक्निक संस्थानों से यांत्रिक/विद्युत डिप्लोमाधारी उम्मीदवारों के लिए आरक्षित रहेगी, जिन्हें आरक्षण3 ;बपकरू2द्ध;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध 15 ;बपकरू4र्द्ध 2;बपकरू10द्ध21 कोटिवार उपरोक्त नियम-10 (2) के द्वारा निर्धारित प्रक्रिया के तहत तैयार मेधा सूची के आधार पर भरा जायेगा।
(ख) शेष रिक्ति आरक्षण कोटिवार ''बिहार नगर विकास एवं आवास विभाग अवर अभियंत्रण (यांत्रिक/विद्युत) संवर्ग र्भाी नियमावली, 2021 के नियम-9 (1) (iii) द्वारा निर्धारित योग्यता/अर्हाा के आधार पर नियम-10 (2) में निर्धारित प्रक्रिया के तहत तैयार मेधा सूची के आधार पर की जाएगी।
(ग) कंडिका-(ख) के रिक्त पदों के सामान्य प्रक्रिया से भरे जाने के पश्चात् अवशेष मेधा सूची के आधार पर कंडिका-(क) के आरक्षित पदों को राज्य के अधीन सरकारी पोलिटेक्निक से उाीर्ण अभ्यार्थियों में से आरक्षण कोटिवार मेधा क्रम में चयन द्वारा भरा जाएगा।
11. आयोग द्वारा नियम-10आयोग द्वारा नियम-10आयोग द्वारा नियम-10आयोग द्वारा नियम-10 के अनुसार चयनित उम्मीदवारों की अंतिम मेधा सूची तैयार की जाएगी एवं उसे सरकार को नियुक्ति हेतु अनुशंसित की जाएगी। आयोग द्वारा अनुशंसित उम्मीदवारों का पैनल एव वर्ष के लिए वैध होगा।
भाग - भाग - भाग - भाग - III प्रोन्नति एवं वरीयता प्रोन्नति एवं वरीयता प्रोन्नति एवं वरीयता प्रोन्नति एवं वरीयता
12. प्रोन्नति। प्रोन्नति। प्रोन्नति। प्रोन्नति। - कनीय अभियंता (यांत्रिक/विद्युत) के पद से उच्चतर पदों पर प्रोन्नति बिहार अभियंत्रण सेवा नियमावली में विनिश्चित प्रावधानों के अधीन होगी।
13. वरीयता का अवधारण।वरीयता का अवधारण।वरीयता का अवधारण।वरीयता का अवधारण। - विभाग, आयोग द्वारा अनुशंसित मेधा क्रमांक के अनुसार, कनीय अभियंताओं (यांत्रिक/विद्युत) की वरीयता का अवधारण करेगा। पूर्व से नियुक्त एवं कार्यरत कनीय अभियंताओं की वरीयता अक्षुण्ण रहेगी।
भाग - भाग - भाग - भाग - IV प्रकीर्ण प्रकीर्ण प्रकीर्ण प्रकीर्ण
14. अनुशासन, नियंत्रण एवं अपीअनुशासन, नियंत्रण एवं अपीअनुशासन, नियंत्रण एवं अपीअनुशासन, नियंत्रण एवं अपील।ल।ल।ल। - (1) बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 (समय-समय पर यथा संशोधित) के प्रावधान अनुशासन, नियंत्रण एवं अपील के मामले में, बिहार नगर विकास एवं आवास विभाग अवर अभियंत्रण (यांत्रिक/विद्युत) संवर्ग के सदस्यों पर लागू होंगे।
15. कठिनकठिनकठिनकठिनाईयों का निराकरण। ाईयों का निराकरण। ाईयों का निराकरण। ाईयों का निराकरण। - इस नियमावली के प्रावधानों में से किसी को प्रभावी करने में यदि कोई कठिनाई उत्पन्न हो तो राज्य सरकार विधि विभाग से परामर्श के पश्चात् राजपत्र में प्रकाशित आदेश द्वारा, जोे इस नियमावली के प्रावधानों से असंगत न हो, ऐसा प्रावधान कर सकेगी जो कठिनाईयों के निराकरण के लिए आवश्यक या समीचीन प्रतीत होता हो।
16. अवशिष्ट मामले ।अवशिष्ट मामले ।अवशिष्ट मामले ।अवशिष्ट मामले । - (1) इस संवर्ग के सभी अवशिष्ट मामले नगर विकास एवं आवास विभाग के प्राधिकार क्षेत्र में होंगे।
(2) इस नियमावली में से किसी भी नियम के निवर्चन कोई संदेह की दशा में उसे विभाग को निर्दिष्ट किया जाएगा, और जिस पर विभाग का विनिश्चय, विधि विभाग के परामर्श के पश्चात् अंतिम होगा।
17. निरसन एवं व्यावृति।निरसन एवं व्यावृति।निरसन एवं व्यावृति।निरसन एवं व्यावृति। - (1) इस संवर्ग में वर्तमान नियमों/विनियमों/निदेशों एवं परिपत्रों को एतद् द्वारा निरसित किया जाता है।
(2) ऐसे निरसन के होते हुए भी उक्त वर्तमान नियमों/विनियमों, निदेशों एवं परिपत्रों के अधीन किया गया कुछ भी अथवा की गयी कार्रवाई इस नियमावली के प्रावधानों के अधीन किया गया अथवा की गयी मानी जायेगी मानों यह नियमावली उस दिन प्रवृत थी, जब वैसा कुछ भी किया गया अथवा वैसी कार्रवाई की गई थी।

In exercise of the powers conferred under proviso to Article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following Rules to regulate the recruitment of Bihar Urban Development & Housing Department Subordinate Engineering (Mechanical/Electrical) Cadre :-
Part – I
1. Short title, extent and commencement.- (1) These Rules may be called "Bihar Urban Development and Housing Department Subordinate Engineering (Mechanical/ Electrical) Cadre Appointment Rules", 2021.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once. 2. Definitions.-In these Rules unless anything contrary to the subject or context :-
(i) 'Government' means the Government of Bihar. (ii) 'Department' means Urban Development and Housing Department. (iii) 'Appointing Authority' means any other Officer authorised for this purpose by the Urban Development and Housing Department.
(iv) 'Commission' means The Bihar Technical Service Commission. (v) 'Cadre' means Bihar Urban Development and Housing Department Subordinate Engineering (Mechanical/Electrical) Cadre;
(vi) 'Member of the Cadre' means a person appointed regularly and working under the provisions of these Rules;
3. Constitution of the cadre.- Post of basic category will be "Junior Engineer (Mechanical/Electrical) under Bihar Urban Development and Housing Department Subordinate Engineering (Mechanical/Electrical) Cadre. For this post, pay scale and grade pay will be admissible, from time to time, as determined by the State Government.
4. Sanctioned strength. - Sanctioned strength of this cadre will be determined by the Department, from time to time.
5. Reservation :- The Provisions of the Bihar Reservation of vacancies in posts and services (for Scheduled Castes, Scheduled Tribes and other Backward classes) Act- 1991 (Act-3, 1992) (as amended from time to time) and the Rules made there under and the horizontal reservation for women issued by resolution No. 963 dated 20.01.2016 and the roaster and reservation as prescribed by the State Government from time to time, shall be applicable to the appointment of this cadre.

Appointment in the Cadre
6. Appointment - First appointment in this cadre will be made by direct recruitment to the post of Junior Engineer (Mechanical/Electrical). No entry on the basis of Promotion will be to this post.
7. Calculation of vacancies will be made category-wise by the Appointing Authority on the 1st April of each year and accordingly reservation category-wise requisition will be sent to the Commission by the 30th April through the Department.

The commission will advertise reservation category-wise vacancies of this cadre to fulfill appointments by direct recruitment, from time to time in such manner which it deem proper, on the basis of requisition given under rule - 7 9. Qualifications - (1) Qualifications to be appointed in this cadre will be as follows :-
(i) Except special order of the Government, it is essential that applicant should be an Indian citizen.
(ii) Diploma in Mechanical/Electrical Engineering or equivalent qualification holder for Subordinate Engineering Cadre.
(iii) Technical Qualification eligibility for selection. :- (A) Diploma holder in Mechanical/Electrical Engineering from the institutes recognized by AICTE, who has obtained Diploma from AICTE/University, OR
(B) Diploma in (Mechanical/ Electrical) Engineering in Non-Distance Mode Diploma from Deemed University established under UGC Act provided that their syllabus of Diploma in Mechanical/Electrical Engineering has been sanctioned by UGC.

Process of Selection.- - (l) Selection to the posts of basic category of Junior Engineer (Mechanical/ Electrical) of this cadre shall be made by the Commission on the basis of percentage of marks obtained in Diploma or equivalent qualification. Such candidates having experience of working on the posts of Junior Engineer (Mechanical/ Electrical) on contract basis under the Government of Bihar or in any Undertaking/Body/Corporation/ Authority/Autonomous Body under the Government of Bihar, who fulfill the qualifications of the recruitment in this cadre, shall be given preference in selection by giving additional marks according to sub rule (2) (b) of this Rule. (2) Merit list of candidates shall be prepared on the following grounds:-
- Full Marks
75 (a) On the basis of percentage of marks obtained in Diploma (Mechanical/ Electrical) or equivalent qualification
- 25 (b) Maximum weightage for the working experience on contract basis (Weightage of per working year shall be 5 marks maximum limit of which will be upto 25 marks. For part of any year, obtained proportionate mark by dividing by 365 to the no. of working days in that year multiplying by number 5, will be added)
Total 100 Marks (3) Determination of working period on the contract basis shall be made on the basis of Payment Certificate issued by their respective Controlling Officers. For this, the period up to the cut-off date mentioned in the advertisement published by the Commission may be calculated for the working experience. (4) Appointment of the Mechanical/Electrical Diploma holding candidates as Junior Engineer (Mechanical/Electrical) shall be made in the following manner :-
(a) As per Rule-5 of the Bihar Urban Development & Housing Department Subordinate Engineering (Mechanical/ Electrical) Cadre Recruitment Rules,2021, 40% seats of total vacant posts shall be reserved for the6 ;बपकरू2द्ध;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध 15 ;बपकरू4र्द्ध 2;बपकरू10द्ध21 candidates holding Mechanical/Electrical Diploma from the Government Polytechnic Institutes under the state as per category wise reservation merit list, which will be filled on the basis of merit list prepared under the procedures determined by the above said Rule 10 (2).
(b) Remaining vacancies shall be filled reservation wise on the basis of merit list prepared under the procedures determined by above in Rule 10 (2) on the basis of eligibilities/qualifications determined by Rule-9 (l) (iii) of Bihar Urban Development & Housing Department Subordinate Engineering (Mechanical/ Electrical) Cadre Recruitment rules, 2021.
(c) After filling vacant posts of clause (b) through general procedure, the reserved posts of clause (a) will be filled from the remaining merit list on the basis of category-wise merit of the candidates passing from the Government Polytechnics of the state.
11. The Commission shall prepare final merit list of selected candidates according to Rule-10 and shall recommend to the Government for appointment. The panel of candidates recommended by the Commission shall be valid for one year."
Part - III
Promotion and Seniority
12. Promotion. - Promotion from the posts of Junior Engineer (Mechanical/ Electrical) to the higher posts will be made under the provisions prescribed in the Bihar Engineering Service Rules.
13. Determination of Seniority.- The Department will determine seniority of the Junior Engineers (Mechanical/Electrical) according to recommended merit list by the Commission. Seniority of Junior Engineers already appointed and working will remain intact.

Miscellaneous
14. Discipline, Control and Appeal. - Provisions of Bihar government Servant (Classification, Control and Appeal) Rules, 2005 (as amended from time to time) will apply in the matter of Discipline, Control and Appeal against members of Bihar Urban Development and Housing Department Junior Engineer (Mechanical/ Electrical) Cadre.
15. Removal of difficulties. - lf any difficulty arises in making any provisions of these Rules effective the State Government, after consultation with the Law Department, will make such provisions by order publishing in the Official Gazette. which will not be irrelevant to the provisions to these Rules and which may be necessary or expedient for removal of difficulties .
16. Residuary matters - (1) All residuary matters concerned with this cadre will be within the area of Jurisdiction of the Urban Development and Housing Department. (2) lf any doubt arises in interpretation of any rule of these Rules the same will be referred to the Department and determination of the Department on which, after consultation with the Law Department, will be final.
17. Repeal and Savings .- (1) The existing rules, regulations directions and circulars in this context are hereby repealed.
