बिहार नगरपालिका (संशोधन) अधिनियम 2021

बिहार नगरपालिका अधिनियम, 2007 (बिहार अधिनियम, 11, 2007) का संशोधन करने के लिए अधिनियम।

भारत-गणराज्य के बहत्तरवें वर्ष में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हाें :- 1. संक्षिप्त नाम, विस्तार और प्रारम्भ।-

(1) यह अधिनियम बिहार नगरपालिका (संशोधन) अधिनियम, 2021 कहा जा सकेगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगा।

2. बिहार अधिनियम, 11, 2007 की धारा-36 का संशोधन।-

(i) उक्त अधिनियम की धारा 36 की उपधारा (2) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

''36 (2) उपधारा (1) में उल्लिखित पदाधिकारियों की नियुक्ति या तो नियमित आधार पर या संविदा के आधार पर ऐसी अवधि के लिए की जायेगी, जैसा कि राज्य सरकार विहित करे।''

(ii) उक्त अधिनियम की धारा 36 की उपधारा (3) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

''36 (3)-उपधारा (2) के उपबंधों के अध्यधीन उपधारा (1) में विनिर्दिष्ट पदाधिकारियों एवं नगरपालिकाओं के अन्य कर्मचारियों की नियुक्ति की प्रक्रिया, अपेक्षित अर्हता, आचरण एवं अनुशासन, नियंत्रण एवं अन्य सेवा की शत्र्तें वही होगी, जैसा कि राज्य सरकार विहित करे।''

(iii) उक्त अधिनियम की धारा 36 की उपधारा (4), (5), (6), (7), (8) एव (9) विलोपित किया जायेगा।

3. बिहार अधिनियम, 11, 2007 की धारा-37 का संशोधन।-

(i) उक्त अधिनियम की धारा 37 की उपधारा (4), (5), (6), (7), (8), (9) एवं (10) विलोपित किया जायेगा।

4. बिहार अधिनियम, 11, 2007 की धारा-38 का संशोधन।-

(i) उक्त अधिनियम की धारा 38 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

''38-नियुक्ति प्राधिकारी।-इस अधिनियम के अन्य उपबंधों के अध्यधीन नगरपालिका स्थापना के पदाधिकारी एवं अन्य कर्मचारी के पदों के संबंध में नियुक्ति प्राधिकारः- (क) कोटि ''क'' एवं कोटि ''ख'' के पदों के मामले में सरकार एवं (ख) कोटि ''ग'' के पदों के मामले में नगर विकास एवं आवास विभाग के अधीन नगरपालिका प्रशासन निदेशालय, होगा तथा संवर्ग राज्यस्तरीय होगा।'' 5. बिहार अधिनियम, 11, 2007 की धारा-41 का संशोधन।-

(i) उक्त अधिनियम की धारा 41 के प्रथम परन्तुक निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

''परन्तु यह कि इस प्रकार नियुक्त पदाधिकारी को राज्य सरकार द्वारा स्वप्रेरणा से हटाया जा सकेगा। ''

(ii) उक्त अधिनियम की धारा 41 के द्वितीय परन्तुक को विलोपित किया जायेगा। 6. बिहार अधिनियम, 11, 2007 की धारा-53 का संशोधन।-

(i) उक्त अधिनियम की धारा 53 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

''53-नगरपालिका के साथ किसी संविदा आदि में आर्थिक हित रखने वाला पार्षद या उसके परिवार के किसी सदस्य।-(1) यदि किसी पार्षद या उसके परिवार के किसी सदस्य का नगरपालिका के अधीन नियोजन सहित या रहित किसी संविदा या प्रस्तावित संविदा में अथवा इससे संबद्ध अन्य मामले में कोई प्रत्यक्ष या अप्रत्यक्ष आर्थिक हित हो तथा वह पार्षद नगरपालिका या इसकी किसी समिति की किसी संविदा बैठक में उपस्थित हो, जिसमें ऐसी संविदा या नियोजन या अन्य मामला विचार का विषय हो, तो ऐसी बैठक आरंभ होने के पश्चात्‌ यथाशक्य शीघ्र ऐसी संविदा या नियोजन या अन्य मामले से संबद्ध तथ्य को उजागर करेगा और ऐसी संविदा या नियोजन या अन्य मामले से संबद्ध किसी प्रश्न पर विचार विमर्श में या इसपर मतदान में भाग नहीं लेगा।3 ;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध;बपकरू16द्ध परन्तु यह कि इस धारा के उपबंध ऐसे किसी पार्षद पर लागू नहीं होंगे जिनका करदाता अथवा नगरपालिका क्षेत्र के निवासी या जल उपभोक्ता के रूप में नागरिक सेवा से संबद्ध किसी मामले में कोई हित हो। (2) इस धारा के प्रयोजनार्थ किसी पार्षद या उसके परिवार के किसी सदस्य को किसी संविदा या नियोजन या अन्य मामले में अप्रत्यक्ष या आर्थिक हित रखनेवाला समझा जायेगा, यदि वह या उसके द्वारा नामित व्यक्ति किसी ऐसी कंपनी या अन्य निकाय का सदस्य हो, जिसके साथ संविदा की गयी हो या किये जाने के लिए प्रस्तावित हो अथवा जिसका नियोजन अथवा विचाराधीन अन्य मामले में कोई प्रत्यक्ष आर्थिक हित हो अथवा यदि वह किसी ऐसे फर्म का पार्टनर है जिसके साथ संविदा की गयी हो या किये जाने के लिए प्रस्तावित हो या ऐसे फर्म या व्यक्ति का नियोजन या विचाराधीन अन्य मामले में प्रत्यक्ष आर्थिक हित हो;

परन्तु यह कि-

(i) इस उपधारा के उपबंध किसी ऐसे पार्षद पर लागू नहीं होंगे, जो स्वयं या उसके परिवार के सदस्य तत्समय प्रवृत्त किसी विधि के अधीन किसी लोक संस्था अथवा संगठन का सदस्य हो अथवा इसके अधीन नियोजन में हो, और (ii) किसी पार्षद या उसके परिवार के किसी सदस्य को किसी कंपनी या अन्य निकाय की सदस्यता के कारण ऐेसी कंपनी या अन्य निकाय में कोई आर्थिक हित वाला नहीं माना जायेगा यदि ऐसी कंपनी अथवा अन्य निकाय के किसी अंश या स्टॉक में उसका कोई लाभकारी हित न हो।

व्याख्या-परिवार के सदस्य से अभिप्रेत है, पार्षद पति या पत्नी, पार्षद के पुत्र

एवं पुत्री।

7. बिहार अधिनियम, 11, 2007 की धारा-56 का संशोधन।-

(i) उक्त अधिनियम की धारा 56 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

''(56) नगरपालिका तथा समिति आदि की बैठक में शामिल होने के लिए मुख्य नगरपालिका पदाधिकारी तथा अन्य पदाधिकारियों के अधिकार।-नगरपालिका के मुख्य नगरपालिका पदाधिकारी अथवा इस निमित उसके द्वारा लिखित रूप में प्राधिकृत कोई अन्य पदाधिकारी नगरपालिका या उसकी किसी समिति की बैठक में शामिल रहेंगे तथा उनकी उपस्थित अनिवार्य होगी। परन्तु यह कि मुख्य नगरपालिका पदाधिकारी अथवा इस निमित प्राधिकृत अन्य पदाधिकारी को नगरपालिका तथा समिति आदि की बैठक में मत देने का अधिकार नहीं होगा।''

8. बिहार अधिनियम, 11, 2007 की धारा-435 का संशोधन।-

(i) उक्त अधिनियम की धारा 435 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

मार्ग का अतिक्रमण- (1) कोई भी व्यक्ति नगरपालिका पदाधिकारी या ऐसे अन्य पदाधिकारी, जिसे राज्य सरकार द्वारा प्राधिकृत किया गया हो, की लिखित अनुमति के बिना नगरपालिका क्षेत्र के अन्तर्गत सार्वजनिक मार्ग, पगडंडी, ड्रेनेज, सिवरेज एवं पार्क पर स्थायी या अस्थायी संरचना द्वारा अतिक्रमण एवं अवरोध नहीं करेगा।

व्याख्या-स्थायी अतिक्रमण से अभिप्रेत है ईंट, सिमेन्ट, कंक्रीट द्वारा निर्मित संरचना द्वारा अतिक्रमण या अवरोध तथा इसके अतिरिक्त सभी अतिक्रमण या अवरोध को अस्थायी अतिक्रमण एवं अवरोध माना जायेगा।

(2) कोई व्यक्ति जो यथापूर्वोक्त तरीके से नगरपालिका की किसी सम्पति का ऐसा स्थायी या अस्थायी अतिक्रमण या अवरोध करेगा, दोष सिद्ध होने पर स्थायी अतिक्रमण के मामले में बीस हजार रूपये तक तथा अस्थायी अतिक्रमण के मामले में पाँच हजार रूपये तक के जुर्माना से दंडनीय होगा।

(3) नगरपालिका पदाधिकारी या प्राधिकृत पदाधिकारी ऐसे स्थायी अतिक्रमण एवं अवरोध को हटाने हेतु पन्द्रह दिन पूर्व नोटिस निर्गत करेगा। पन्द्रह दिनों के अन्दर ऐसे स्थायी अतिक्रमण या अवरोध के संबंध में नगरपालिका पदाधिकारी या प्राधिकृत पदाधिकारी को कारण सहित संतुष्ट करने में विफल रहने पर नगपालिका पदाधिकारी या प्राधिकृत पदाधिकारी द्वारा संबंधित व्यक्ति को जुर्माना से दंडित कर सकेगा अथवा ऐसे व्यक्ति से होल्डिंग के बकाया के रूप में वसूली कर सकेगी।4 ;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध;बपकरू16द्ध परन्तु यह कि नगरपालिका पदाधिकारी या प्राधिकृत पदाधिकारी द्वारा अस्थायी प्रकार के अतिक्रमण एवं अवरोध को चौबीस घंटे की नोटिस देकर हटा सकेगी।''

THE BIHAR MUNICIPAL (AMENDMENT) ACT, 2021

AN

ACT

To amend the Bihar Municipal Act, 2007 (Bihar Act 11,2007). Be it enacted by the legislature of the state of Bihar in the seventy second year of the Republic of India as follows:-

1. Short title, extent and commencement. —

(1) This Act may be called the Bihar Municipal (Amendment) Act, 2021. (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force from the date of its publication in the official gazette.

2. Amendment of Section-36 of Bihar Act 11, 2007 :-

(i) Sub-section (2) of section 36 of the Bihar Municipal Act, 2007 shall be substituted by following:-

"36 (2) Appointments of officers mentioned in sub-section (1) may be made either on a regular basis or on a contract basis for such term as the State Government may be prescribe."

(ii) Sub-section (3) of section 36 of the Bihar Municipal Act, 2007 shall be substituted by following:-

"36 (3) Subject to the provisions of sub-section (2) officers mentioned in sub-section (1) and other employes of the Municipality, the method of appointment, required qualification, conduct and discipline, control and other conditions of service shall be such as may be prescribed."

(iii) Sub-section (4), (5), (6), (7), (8) and (9) of section 36 of the Bihar Municipal Act, 2007 shall be deleted.

3. Amendment of Section-37 of Bihar Act 11, 2007 :-

(i) Sub-section (4), (5), (6), (7), (8), (9) and (10) of section 37 of the Bihar Municipal Act, 2007 shall be deleted.

4. Amendment of Section-38 of Bihar Act 11, 2007 :-

(i) Section 38 of the Bihar Municipal Act, 2007 shall be substituted by following:-

"38. Appointing Authorities.- Subject to the other provisions of this Act, the appointing authority in respect of the posts of officers and other employees constituting the establishment of the Municipality shall be,-

(a) in the case of category, 'A' and category, 'B' posts, the

Government and

(b) in the case of category 'C' posts,-Directorate of Municipal Administation under Urban Development and Housing Department and the cadre shall be state level."

5. Amendment of Section-41 of Bihar Act 11, 2007:-

(i) First proviso of Section 41 of the Bihar Municipal Act, 2007 shall be substituted by following:-

"Provided that the officer so appointed may be withdrawn by the State Government suo motu."

(ii) Second proviso of Section 41 of the Bihar Municipal Act, 2007 shall be deleted.

6. Amendment of Section-53 of Bihar Act 11, 2007:-

(i) Section 53 of the Bihar Municipal Act, 2007 shall be substituted by following:- "53. Councillor or his any family member having pecuniary interest in any contract etc. with Municipality. -(1) If a Councillor or his any family member has any pecuniary interest, direct or indirect, in any having contract or proposed contract with or without employment under, or other matter concerning, the Municipality and is present at any meeting of the Municipality or of a committee thereof at which such contract or employment or other matter is subject of consideration, he shall, as soon as practicable after the commencement of such meeting, disclose the fact regarding such contract or employment or other matter, and shall not take part in the consideration or discussion of, or vote on, any question with respect to such contract or employment or other matter;

Provided that the provisions of this Section shall not apply to a Councillor or having interest as a tax-payer or inhabitant of the municipal area or consumer of water or having an interest in any matter relating to any civic service to the public.

(2) For the purposes of this Section, a Councillor or his any family member shall be deemed to have an indirect pecuniary interest in a contract or employment or other matter, if he or his nominee is a member of any company or other body with which the contract is made or is proposed to be made or which has a direct pecuniary interest in the employment or other matter under consideration, or if he is partner in a firm with which, or is in employment under a person with whom, the contract is made or is proposed to be made, or if such firm or person has a direct pecuniary interest in the employment or other matter under consideration; Provided that-(i) the provisions of this sub-section shall not apply to a Councillor or his any family member who is a member of, or is in employment under, any public institution or organization under any law for the time being in force, and6 ;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध;बपकरू16द्ध (ii) A Councillor or his any family member shall not, by reason of his membership of a company or other body, be treated as having any pecuniary interest in such company or other body if he has no beneficial interest in any share or stock of such company or other body.

Explanation. – Family means Councillor husband or wife, Coucillor son and daughter."

7. Amendment of Section-56 of Bihar Act 11, 2007:-

(i) Section 56 of the Bihar Municipal Act, 2007 shall be substituted by following:-

"56. Right of Chief Municipal Officer and other Officers to attend meeting of Municipality and Committees etc. -The Chief Municipal Officer of the municipality or any other officer authorized in writing by him in this behalf shall attend the meeting of the municipality or any of its committees and their attendance shall be compulsory.

Provided that the Chief Municipal Officer or other officer authorized in this behalf shall not have the right to vote in the meeting of the municipality and committee. "

8. Amendment of Section-435 of Bihar Act 11, 2007:-

(i) Section 435 of the Bihar Municipal Act, 2007 shall be substituted by following:-

"Encroachment on streets-

(1) Any person causing encroachment or obstruction on a public road, footpath, drainage, sewerage and park under the municipal area without the written permission of the municipal officer or such other officer as is authorized by the State Government, shall not encroach and block by permanent and temporary structures.

Explanation.—Permanent encroachment means encroachment or obstruction by a structure constructed by brick, cement, concrete and in addition all encroachment or obstruction shall be considered as temporary encroachment and obstruction.

(2) Any person who shall make such permanent or temporary encroachment or blockage of any property of the municipality as aforesaid, punishable with fine up to twenty thousand rupees in case of permanent encroachment and up to five thousand rupees in case of temporary encroachment.

(3) The Municipal Officer or the authorized officer shall issue a notice fifteen days in advance to remove such permanent encroachment and obstruction. Failure to satisfy the Municipal Officer or the Authorized Officer with cause in respect of such permanent encroachment or blockage within fifteen days may be punished by the Municipal Officer or the Authorized Officer with penalty or as arrear of holding from such person will be able to recover.

Provided that the municipal officer or the authorized officer may remove the temporary encroachment and obstruction by giving twenty- four hours notice."
