सं॰ कारा/स्था0 (अरा0)-01-35/2018-8939—भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार के राज्यपाल, कारा एवं सुधार सेवाएँ निरीक्षणालय के अंतर्गत, एक्स-रे-टेक्नीशियन संवर्ग में नियुक्ति एवं अन्य सेवा शर्तों के निर्धारण हेतु निम्नलिखित नियमावली बनाते हैं :-
अध्याय-1 : प्रारम्भिक
1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ। -
(i) यह नियमावली "बिहार कारा एक्स-रे-टेक्नीशियन संवर्ग नियमावली, 2021" कही जा सकेगी। (ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह राजपत्र में प्रकाशन की तिथि से प्रवृत होगी।
2. परिभाषाएँ। - इस नियमावली में, जब तक कि विषय या संदर्भ में अन्यथा अपेक्षित न हो, :-
(i) 'सरकार' से अभिप्रेत है बिहार राज्य सरकार; (ii) 'विभाग' से अभिप्रेत है गृह विभाग (कारा); (iii) 'आयोग' से अभिप्रेत है बिहार तकनीकी सेवा आयोग; अथवा गृह विभाग (कारा) द्वारा प्राधिकृत अन्य आयोग/भर्त्ती एजेन्सी
(iv) 'नियुक्ति प्राधिकार' से अभिप्रेत है महानिरीक्षक, कारा एवं सुधार सेवाएँ, बिहार, पटना; (v) 'संवर्ग' से अभिप्रेत है "बिहार कारा एक्स-रे टेक्नीशियन संवर्ग"।
3. संवर्ग का गठन। -
(i) एक्स-रे-टेक्नीशियन का संवर्ग राज्य स्तरीय होगा और स्थानान्तरण एवं पदस्थापन करने की शक्ति महानिरीक्षक, कारा एवं सुधार सेवाएँ, गृह विभाग (कारा), बिहार, पटना की होगी। (ii) इस संवर्ग में प्रत्येक पदसोपान में पदों की संख्या एवं उनकी कुल संख्या उतनी होगी जितनी राज्य सरकार द्वारा स्वीकृत की गई हो तथा भविष्य में सरकार द्वारा समय-समय पर स्वीकृत अथवा अधिसूचित की जाय।2 ;बपकरू4द्ध ;बपकरू23द्धख्;बपकरू4द्ध;बपकरू4द्ध;बपकरू25द्ध;बपकरू30द्ध (iii) इस संवर्ग के पदों का वेतनमान वही होगा जो राज्य सरकार द्वारा समय-समय पर स्वीकृत किया जाएगा।
4. संवर्ग का पदसोपान।- इस संवर्ग की विभिन्न कोटियाँ अर्थात पदसोपान निम्नवत् होगा :-

नोट :- उपर्युक्त सभी कोटियों का वेतन बैंड/ग्रेड-पे/वेतन स्तर वही होगा जो सरकार द्वारा
समय-समय पर निर्धारित किया जाय।
अध्याय-2 : भर्त्ती
5. भर्त्ती।-इस संवर्ग के मूल कोटि (एक्स-रे-टेक्नीशियन) के पद पर नियुक्त सीधी भर्ती द्वारा आयोग की अनुशंसा के आधार की जाएगी। 6. अर्हताएँ। -
(i) मूल कोटि के पद पर सीधी भर्त्ती के लिए न्यूनतम शैक्षणिक अर्हता इन्टरमीडियट/2 उत्तीर्ण (भौतिक विज्ञान, रसायनशास्त्र, जीव विज्ञान, अँग्रजी के साथ) एवं सरकार द्वारा मान्यता प्राप्त संस्थान से एक्स-रे-टेक्नीशियन डिप्लोमा कोर्स में उत्तीर्णता/बैचलर ऑफ रेडियोइमेजिंग टेक्नोलॉजी एवं तत्संबंधी प्रमाण पत्र प्राप्त रहना आवश्यक होगा।
(ii) एक्स-रे-टेक्नीशियन संवर्ग में सीधी भर्त्ती के लिए न्यूनतम आयु सीमा 18 वर्ष होगी और अधिकतम आयु सीमा वही होगी जो सरकार द्वारा समय-समय पर, आरक्षण कोटिवार, विनिश्चित की जाय। संबंधित वर्ष की 1ली अगस्त को, उम्र के निर्धारणार्थ, कट ऑफ डेट माना जायेगा। 7. भर्त्ती की प्रक्रिया। -
(i) नियुक्ति प्राधिकार, वर्ष की 1ली अप्रैल को स्वी—त बल/कार्यरत बल की स्थिति के आधार पर रिक्ति की गणना कर एवं रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रैल तक भेजेगा।
(ii) भर्त्ती की प्रक्रिया एवं मानदंड वही होगा जो स्वास्थ्य विभाग द्वारा एक्स-रे टेक्नीशियन संवर्ग के लिए निर्धारित होगा।
(iii) अंतिम रूप से सफल अभ्यर्थियों की मेधा सूची रिक्ति के अनुरूप आरक्षण कोटिवार तैयार कर आयोग द्वारा अपनी अनुषंसा सूची नियुक्ति प्राधिकार को उपलब्ध करायी जाएगी।
(iv) आयोग से प्राप्त अनुषंसा सूची के आधार पर एक्स-रे-टेक्नीशियन के पद पर नियुक्ति की कार्रवाई नियुक्ति प्राधिकार अथवा उनके द्वारा प्राधिकृत पदाधिकारी द्वारा किया जायेगा।
अध्याय 3 : परिवीक्षा/विभागीय परीक्षा/सम्पुष्टि
8. परिवीक्षा अवधि। - नियुक्ति के उपरान्त अभ्यर्थी परिवीक्षाधीन रहेंगे। परिवीक्षा अवधि दो वर्षो की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने की दशा में परिवीक्षा अवधि का विस्तार एक वर्ष के लिए किया जायेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जायेगी तो नियुक्ति प्राधिकार ऐसे एक्स-रे-टेक्नीशियन को सेवामुक्त कर सकेगा।
9. सम्पुष्टि।- परिवीक्षा अवधि में सेवा संतोषजनक रहने पर एक्स-रे-टेक्नीशियन की सेवा नियुक्ति प्राधिकार द्वारा सम्पुष्ट किया जा सकेगा।
10. वरीयता। - एक्स-रे-टेक्नीशियन की आपसी वरीयता आयोग के द्वारा निर्धारित मेधासूची के अनुसार निर्धारित की जायेगी।
अध्याय-4 : प्रोन्नति
11. प्रोन्नति के सोपान। -
(i) सेवा सम्पुष्ट एक्स-रे-टेक्नीशियन को रिक्ति की उपलब्धता के अधीन रहते हुए वरीयता-सह-योग्यता के अनुसार संवर्ग के उच्चतर पदों पर प्रोन्नति दिये जाने पर विचार किया जा सकेगा।
(ii) प्रोन्नति पर विचारार्थ, सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत, कालावधि संबंधी अनुदेश का अनुपालन आवश्यक होगा। प्रोन्नति के संदर्भ में चारित्री या PAR, मुहरबन्द लिफाफा3 ;बपकरू4द्ध ;बपकरू23द्धख्;बपकरू4द्ध;बपकरू4द्ध;बपकरू25द्ध;बपकरू30द्ध के अनुशंसा रखे जाने आदि के संबंध में सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत अनुदेशों का अनुपालन आवश्यक होगा।
12. विभागीय प्रोन्नति समिति।- प्रोन्नति विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर होगी। विभागीय प्रोन्नति समिति का गठन नियुक्ति प्राधिकार द्वारा किया जायेगा।
अध्याय-5 : प्रकीर्ण
13. आरक्षण।- सरकार के आरक्षण अधिनियम और सरकार द्वारा समय-समय पर सीधी भर्त्ती एवं प्रोन्नति हेतु निर्गत आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा।
14. कंडिका-4 में अंकित पदसोपान सरकार के अनुमोदन के पश्चात् ही प्रभावी होगा। यदि अनुमोदन पर विचार के क्रम में स्वास्थ्य विभाग द्वारा एक्स-रे टेक्नीषियन के पदसोपान में कोई परिवर्तन या संशोधन किया जाता है तो कंडिका-4 तदनुसार परिवर्तित या संशोधित समझा जायेगा और ऐसा परिवर्तित/संशोधित पदसोपान इस नियमावली का अंग माना जायेगा।
15. अवशिष्ट मामले। -इस नियमावली में जिन विषयों का प्रावधान नहीं हो सका है उनके लिए सरकार की प्रासंगिक संहिताएँ/नियमावली/संकल्प/अनुदेश के प्रावधान लागू होंगे।
16. निर्वचन। - यदि इस नियमावली के किसी उपबंध के निर्वचन में कोई कठिनाई उत्पन्न हो तो इस संबंध में गृह विभाग (कारा) का विनिश्चय अंतिम होगा।
17. कठिनाई का निराकरण। - यदि इस नियमावली के उपबंधों के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग को ऐसी किसी कठिनाई का निराकरण करने की शक्ति होगी।

(Ara) -01-36 / 2018-8939— In exercise of powers conferred by proviso to article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following rules for appointment in the X-ray-Technician Cadre and regulation of other service conditions for Prison and Correctional Services.
Chapter-1 : PRELIMINARY
1. Short title, extent and commencement :-
(i) These Rule may be called "Bihar Prison X-ray-Technician Cadre Rules, 2021".
(ii) It shall extend to the whole State of Bihar. (iii) It shall come into force from the date of publication in the Gazette.
2. Definition:- In these Rules, unless otherwise requires in the subject or context :-
(i) 'Government' means the State Government of Bihar; (ii) Department means Home Department (Kara); (iii) "Commission" means Bihar Technical Services Commission, or other commission/recruitment agency authorized by the Home Department (Kara).
(iv) 'Appointing Authority' means Inspector General, Prison &Correctional Services, Bihar.
(v) 'Cadre' means Bihar Prison X-ray-Technician Cadre;
3. Constitution of the cadre:-
(i) The cadre of X-ray-Technician will be state level and the power of transfer and posting will be to the Inspector General, Prison and Correctional Services, Home Department (Kara), Bihar, Patna.
4 ;बपकरू4द्ध ;बपकरू23द्धख्;बपकरू4द्ध;बपकरू4द्ध;बपकरू25द्ध;बपकरू30द्ध(ii) Number of Posts in each category and their total number shall be such as it has been determined by the Government and in future as it will be sanctioned or notified by the Government from time to time.
(iii) The pay scale of the posts of this cadre shall be the same as will be sanctioned or notified by the Government, from time to time.
4. Constitution of the Cadre:- Hierarchy of the cadre shall be as follows:-

Chapter-2 : RECRUITMENT
5. Recruitment.—The appointment in this cadre will be based on the post of Basic Category (X-ray-Technician) on the recommendation of the Commission.
6. Qualifications.—
(i) For direct recruitment to the post of basic category, The minimum Educational Qualification Shall be Intermediate/ +2 (Physics, Chemistry, Biology with English) and Passing X-ray diploma course from a Government recognized institution and a Certificate related there to shall be necessary.
(ii) For direct recruitment to the post of X-ray-Technician Cadre, the minimum age-limit shall be 18 years and maximum age limit shall be the same as may be determind reservation category wise, from time to time, by the Government. 1st August of the concerned year shall be deemed to be the cut off date for determination of age.
7. Procedure of recruitment:-
(i) The appointing authority, after calculating vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation category wise requisition to the Commission latest by 30th April.
(ii) The procedure and criteria of recruitment will be the same as prescribed by the Health Department for the X-ray-Technician Cadre.
(iii) The merit list of the finally successful candidates will be prepared according to the vacancy reservation quota and the commission will submit its recommendation list to the appointing authority.
(iv) On the basis of the list of recommendations received from the Commission, the appointment to the post of X-ray-Technician Cadre will be processed by the appointing authority or the officer authorized by him.
Chapter-3 :
PROBATION/DEPARTMENTAL EXAMINATION/CONFIRMATION
8. Probation period.—After the appointment, the candidate will be on probation. The probation period will be of two years. In case the service is not found satisfactory during the probation period, the probation period will be extended for one year. If the service is not found to be satisfactory even during the extended period, then the service can be relieved.
9. Confirmation.—The Appointing Authority can make such X-ray-Technician Service confirmed only after satisfactory completion of the probation period.
10. Seniority.—The Inter-Se-Seniority of X-ray-Technician shall be according to the merit list as determined by the commission.

11. Post Chain of Promotion:-
(i) Subject to availability of vacancies, confirmed X-ray-Technicians may be considered for promotion, according to seniority-cum-merit, to the higher post.
(ii) For consideration of promotion compliance of instructions regarding KALAWADHI issued by the General Administration Department from time to time, shall be necessary. Compliance of instruction issued by the General Administration Department regarding character Roll or PAR, maintenance of recommendation in the sealed cover, etc in the context of promotion, shall be necessary at the time of consideration of promotion.
12. Departmental Promotion Committee.—Promotions will be on the basis of recommendations of the Departmental Promotion Committee. The Departmental Promotion Committee shall be constituted by the Appointing Authority.
Chapter-5 : MISCELLANEOUS
13. Reservation.—It will be essential to comply the provisions of the Reservation Act of the Government and reservation roster for direct recruitment as well as promotion, issued by the Government from time to time.
14. The chain of posts mentioned in para-4 shall be effective only after approval of the Government. If, in couse of consideration of approval, any modification or amendment is made by the Government in the chain of posts mentioned in para-4, then the para-4 shall be deemed to be modified or amended accordingly and such modified/amended chain of posts shall be deemed to be the part of these Rules.
15. Residue Matters.—The provisions of relevant Codes/Rules/ Resolutionns /Instructions of the Government shall apply to such subjects for which no provision is made in these Rules.
16. Removal of doubts.—If any doubt arises with respect to interpretation of any provision of these Rules, in this respect decision of the Home Department (KARA) shall be final.
17. Removal of difficulties.—If any difficulty arises in implementation of provisions of these Rules, the Department shall have powers to remove such difficulty.
