सं॰ एल॰जी॰-01-21/2021-6836/लेज।—बिहार विधान मंडल द्वारा यथापारित का निम्नलिखित अधिनियम, जिसपर महामहिम राज्यपाल दिनांक 12 दिसम्बर 2021 को अनुमति दे चुके हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है।

बिहार तकनीकी सेवा आयोग (संशोधन) अधिनियम, 2021
बिहार तकनीकी सेवा आयोग अधिनियम, 2014 (बिहार अधिनियम 13, 2014) (समय-समय पर यथा संशोधित) का संशोधन करने के लिए अधिनियम ।
1. संक्षिप्त नाम, विस्तार और प्रारंभ।-(1) यह अधिनियम ''बिहार तकनीकी सेवा आयोग (संशोधन) अधिनियम, 2021'' कहा जा सकेगा।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा।
(3) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगा।
2. बिहार तकनीकी सेवा आयोग अधिनियम, 2014 (बिहार अधिनियम 13, 2014) की धारा-3(ii) का संशोधन :-
अधिनियम की धारा-3(ii) में "राज्य सरकार के सामान्य प्रशासन विभाग द्वारा नियुक्त राज्य सेवा के 5 अधिकारी जिनकी न्यूनतम एक वर्ष की सेवा शेष होः" शब्दों के स्थान पर "राज्य सरकार के सामान्य प्रशासन विभाग द्वारा नियुक्त राज्य सेवा के 5 अधिकारी :" शब्द रखे जायेंगे।
3. बिहार तकनीकी सेवा आयोग अधिनियम, 2014 (बिहार अधिनियम 13, 2014) की धारा-4 के पहले परन्तुक का संशोधन एवं धारा-4 के दूसरे परन्तुक के बाद एक अन्य परन्तुक का जोड़ा जाना :-
(1) अधिनियम की धारा-4 के पहले परन्तुक को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-
"परन्तु राज्य सरकार द्वारा विशेष परिस्थिति में, अध्यक्ष या किसी सदस्य के कार्यकाल का विस्तार उस अवधि के लिए जो विनिश्चित किया जाय, किया जा सकेगा।"
(2) अधिनियम की धारा-4 के दूसरे परन्तुक के बाद तीसरा परन्तुक निम्नवत् जोड़ा जायेगा :-
"परन्तु आयोग के अध्यक्ष का पद, रिक्त रहने की स्थिति में, अध्यक्ष पद पर नियमित नियुक्ति होने तक, आयोग के वरीयतम सदस्य कार्यकारी व्यवस्था के तहत अध्यक्ष के दायित्वों का निर्वहन करेंगे। सदस्य की वरीयता की गणना आयोग के सदस्य के रूप में योगदान की तिथि के आधार पर की जायेगी। "
4. बिहार तकनीकी सेवा आयोग अधिनियम, 2014 (बिहार अधिनियम 13, 2014) की धारा- 5 का संशोधन :-
अधिनियम की धारा-5 को निम्नवत् प्रतिस्थापित किया जायेगा -
'' 5. आयोग के अध्यक्ष एवं सदस्यों की उम्र-सीमा :-
आयोग के अध्यक्ष एवं सदस्य के रूप में कार्यरत रहने की अवधि तीन वर्ष या 70 वर्ष की आयु, इसमें से जो पहले हो, तक होगी।''
5. निरसन एवं व्यावृाि।- (1) बिहार तकनीकी सेवा आयोग (संशोधन) अध्यादेश, 2021 (बिहार अध्यादेश-04, 2021) इसके द्वारा निरसित किया जाता है।
(2) ऐसे निरसन के होते हुए भी उक्त अध्यादेश के द्वारा या के अधीन प्रदा किसी शक्ति के प्रयोग में किया गया कोई कार्य या की गई कोई कार्रवाई इस अधिनियम के द्वारा या के अधीन प्रदा शक्तियों के प्रयोग में किया गया या की गई समझी जायेगी, मानो यह अधिनियम उस दिन प्रवृा था, जिस दिन ऐसा कार्य किया गया था या ऐसी कार्रवाई की गई थी।

Bihar Technical Service Commission (amendment) Act, 2021

ACT
to amend the Bihar Technical Service Commission Act, 2014 (Bihar Act 13, 2014)
(as amended time to time)
Be it enacted by the Legislature of the State of Bihar in the Seventy Second year of the Republic of India as follows:-
1. Short title, extent and commencement - (1) This Act may be called "The Bihar Technical Service Commission (amendment) Act, 2021".
(2) It shall extend to the whole of the State of Bihar
(3) It shall come in to force from the date of its publication in the official gazette.
2. Amendment in Section-3(ii) of Bihar Technical Service Commission Act, 2014 (Bihar Act 13, 2014) :- In Section-3(ii) of Said Act for the words "five officers of the state services appointed by the General Administration Department of the State Government whose minimum one year of service remain:" the words "five officers of the State services appointed by the General Administration Department:" shall be substituted.
3. Amendment in first proviso in Section-4 and addition of one another proviso in Section-4 of Bihar Technical Service Commission Act, 2014 (Bihar Act 13, 2014):-
(1) First proviso of Section-4 of the Act shall be substituted by the following:-
"provided that, in special circumstances, the tenure of chairman or a member shall be further that extended for that period as it may be determined by State Government"
(2) After second proviso of the Section-4 of Act following third Proviso shall be added:-
4 बिहार गजट (असाधारण), 14 दिसम्बर 2021"Provided that in the case the post of chairman of the commission is vacant, till the regular appointment of the chairman, senior member of the commission will discharge responsibility of the chairman under the executive order. Calculation of seniority of the member shall be calculated on the basis of date of joining as a member of the commission"
4. Amendment in Section-5 of Bihar Technical Service Commission Act, 2014 (Bihar Act 13, 2014):- Section-5 of Said Act shall be substituted as following:-
"5. Age limit of the chairman and members of the commission :-
Tenure as a chairman and member of the commission shall be 3 years or the age of 70 years, whichever is earlier"
5. Repeal and Savings :- (1) The Bihar Technical Service Commission (Amendment) Ordinance, 2021, (Bihar Ordinance No-04, 2021) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken in exercise of any power conferred by or under the said ordinance shall be deemed to have been done or taken in exercise of the powers conferred by or under this Act as if this Act were in force on the day on which such thing was done or such action was taken.
