संसदीय कार्य विभाग ——— अधिसूचना 23232323 दिसम्बरदिसम्बरदिसम्बरदिसम्बर 2021202120212021 सं0 सं0का0-01/वि0मं0(पदाधिकारियों के वेतन एवं भत्ते) 05-01/2017-904—संसदीय कार्य विभाग, बिहार, पटना की अधिसूचना संख्या-928 दिनांक 23.09.2006 का निम्नलिखित अंग्रेजी अनुवाद, बिहार राज्यपाल के प्राधिकार से एतद्‌ द्वारा प्रकाशित किया जाता है जो भारतीय संविधान के अनुच्छेद 348 के खंड (3) के अधीन उक्त नियमावली का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

(Presiding Officer) 4024/2006-928.—In exercise of powers conferred by section-4 of Officers of Bihar Legislature (Salary and Allowances) Act, 2006, the Governor of Bihar makes the following Rules, namely:-

:: Rules ::

1. (1) These Rules may be called the Officers of Bihar Legislature (Pay and Allowances) Rules, 2006.

(2) These shall come into force with effect from 1st October, 2006.

2. Unless there is anything repugnant to the subject or context, in these Rules:- (a) "Act" means Officers of the Bihar Legislature (Pay and Allowances) Act, 2006;

(b) "Advance" means the amount of advance to be granted to the officers purchasing private vehicle;

(c) "Family" means wife/husband, dependant son/daughter of a officer of Bihar Legislature or such mother/father who is fully dependent on the member;

(d) "Speaker" means Speaker of the Bihar Legislative Assembly; (e) "Deputy Speaker" means Deputy Speaker of the Bihar Legislative Assembly;

(f) "Chairman" means Chairman/Acting Chairman of Bihar Legislative Council;

(g) "Deputy Chairman" means Deputy Chairman of Bihar Legislative Council;

(h) "Joint Committee" means such committee which has been constituted by the Legislative Assembly and Legislative Council incorporating the members of both Houses;

(i) "Joint meeting" means a joint meeting of the members of Legislative Assembly and Legislative Council;

(j) "Meeting of the Assembly" means a meeting of the Bihar Legislative Assembly or a meeting of the committee appointed by the Bihar Legislative Assembly and constituted with the members of the Legislative Assembly;

(k) "Meeting of the Council" means a meeting of the Bihar Legislative Council or a meeting of the Committee appointed by the Bihar Legislative Council and constituted with the members of the Council;

(l) "Government" means the Government of Bihar; (m) "Allowances" means Field Allowance, Hospitality Allowance, Travelling Allowance and Daily Allowance;

(n) "Travelling Allowance" means such allowance which is admissible for journey made by Rail/Bus/Road/Waterways;

(o) "Facilities" means the facilities of residence, vehicle, telephone, medical, furniture, car advance, railway coupon and personal staff.

3. Pay, Allowances and other facilities to the Officers of the Bihar Legislature:-

(a) The Speaker/Chairman shall be entitled to get, allowances and other facilities at par with the Ministers of the Government.

(b) Deputy Speaker/Deputy Chairman shall be entitled to get, allowances and other facilities at par with the State Ministers of the Government. Explanation:- The payment of pay, allowances and other facilities to Speaker/ Deputy Speaker and Chairman/Deputy Chairman shall be made by the Legislative Assembly/Legislative Council Secretariat, as the case may be.

4. The State Government reserves the right to interpret and amend the provisions of these Rules from time to time.

5. Repeal and Savings:-

(i) From the date of commencement of these Rules the following Rules shall deemed to be repealed:-

(1) Presiding Officer of Bihar Legislature (Allowances) Rules –

1954.

(2) Motor Car Advance to Speaker and Chairman Rules, 1953.

Chairman to the Legislative Council Allowances Rules, 1958.

(4) Motor Car Advance to Deputy Speaker and Deputy Chairman

Rules, 1958.

(ii) Notwithstanding these Rules the journey performed under the provisions of previous Rules shall not be adversely affected by these Rules.
