सं0 सं0का0-01/वि0मं0(सदस्यों का वेतन एवं भत्ते) 05-06/2017-907—संसदीय कार्य विभाग, बिहार, पटना की अधिसूचना संख्या-1082 दिनांक 16.11.2006 का निम्नलिखित अंग्रेजी अनुवाद, बिहार राज्यपाल के प्राधिकार से एतद् द्वारा प्रकाशित किया जाता है जो भारतीय संविधान के अनुच्छेद 348 के खंड (3) के अधीन उक्त नियमावली का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।
बिहार-राज्यपाल के आदेश से, गुलाम मुस्तफा अंसारी, विशेष कार्य पदाधिकारी। Cabinet (Parliamentary Affairs) Secretariat Department ——— NOTIFICATION The 16th November, 2006 No. San.Ka-1/Vi.M.(Members) 4023/2006-1082—In exercise of powers conferred by section-8 of Bihar Legislature (Salary, Allowances and Pension of members) Act, 2006 (Act No.-16, 2006) the Governor of Bihar makes the following amendments in Bihar Legislature (Pay, Allowances and Pension of members) Rules, 2006: - Bihar Legislature (Pay, Allowances and Pension of members) (Amendment) Rules, 2006
1. Short title and Commencement: -
(1) These Rules may be called The Bihar Legislature (Pay, Allowances and Pension of members) (Amendment) Rules, 2006.
(2) These amendments shall come into effect from the date of notification of the original Rules itself.

2 (d) "Place of residence means –
(i) The place of the elected members of the Bihar Legislature which may be mentioned by them in the nomination paper; or
(ii) His/her permanent place of residence within his/her constituency, which is intimated by the member just after his/her oath;
(iii) For the nominated member, the place where his/her name is mentioned in the Electoral roll. "
3. Amendment in rule 3(b) of the said Rules, 2006.—After the figure "8000" used in fourth line of rule 3(b), words and bracket "(eight thousand)" shall be inserted and words "and admissible allowances" to be deleted.
4. Amendment in rule-4 of the said Rules, 2006.—The figure "10000" used in second line of rule-4 shall be substituted by words, bracket and figure "12000 (twelve thousand)".
5. Amendment in rule-6 of the said Rules, 2006.—The word "facility" used in the heading of rule-6 shall be substituted by the word "allowance" and the figure and words "4000 (four thousand)" used in third line to be substituted by the figure and words "2000 (two thousand)".
6. Amendment in rule-7 of the said Rules, 2006.—The word "payable" used in fourth line of rule-7 shall be substituted by the word "due". 7. Amendment in rule-8 of the said Rules, 2006: -
(1) The word "general" used in fourth line and eighth line of rule 8 (b) and word "permanent" used in second proviso of rule 8(b)(v) are deleted hereby.
(2) The word "any" used in first line of the sixth proviso of rule 8(b)(v) shall be substituted by the word "travelling".
(3) The words "to the limitation of maximum 200 kilometer per day" shall be inserted in between the words "at the rate of" and "mileage allowance" used in third line of the fifth proviso of rule 8(b)(v).
8. Amendment in rule-9 of the said Rules, 2006: -
(1) After the words " twenty days" used in third line the words "journey of" and after the figure and words "15 days" used in fourth line the words "journey of" shall be inserted of paragraph-1 of rule-9 of the said Rules, 2006.
(2) After the first proviso of rule 9(1) of the said Rules, 2006 the following proviso shall be added: -
"Provided further that, the daily allowance admissible for the whole month to the member shall be payable in that case also when the member has performed the admissible journey by Air/Rail/Road."
(3) In the explanation of clause (a) of sub rule (1) of rule-9 of the said Rules, 2006 the word "or meetings of the committees" shall be inserted after the words "joint session".
(4) In the second proviso of clause (a) of sub rule-(1) of rule-9 wherever the word "session" has been used the words "or meetings of the Committees" shall be inserted after that word.
(5) After the words "continuous series of sessions", used in para (ii) of the second explanation of clause (a) of sub rule (1) of rule – 9 the words "continuous series of meetings of committees" and after the word "session" used in second and third lines the words "or continuous series of meetings3 ;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध;बपकरू16द्ध of the committees" shall be inserted and after deleting the full stop at the end of the sentence the words "or no any meeting is held" to be added.
(6) The figure "8" in sub rule (2) of rule 9 shall be substituted by the figure "9".
(7) After the word "session" used in first and second lines of sub rule (2) of rule-9 the words "or meetings of the committees" shall be inserted. 9. The word "personal" used in fifth line of rule 10 of the said Rules is hereby deleted.
10. Amendment in rule-14 of the said Rules, 2006: -
(1) The word "general" used in third line of rule-14 is hereby deleted. (2) The second proviso of rule 14(b)(i) shall be substituted by the following:-
"Provided further that, subject to the value of the admissible local call limit of the same financial year, the member shall be entitled to avail the facility of Mobile and Internet."
11. Amendment in rule-17 of the said Rules, 2006: - After the second proviso of
rule 17(1) the following proviso shall be added: -
"Provided further that, in case of such member of the Bihar Legislature, who have been a member of both the Houses, their pension shall be payable from the House to which they were a member lastly after calculating the tenure of membership of both the Houses."
