सं॰ सं0का0-01/वि0मं0(सदस्यों का वेतन एवं भत्ते)05-06/2017-914—संसदीय कार्य विभाग, बिहार, पटना की अधिसूचना संख्या-173, दिनांक 06.03.2017 का निम्नलिखित अंग्रेजी अनुवाद, बिहार राज्यपाल के प्राधिकार से एतद्‌ द्वारा प्रकाशित किया जाता है जो भारतीय संविधान के अनुच्छेद 348 के खंड (3) के अधीन उक्त नियमावली का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

Notification

No P.A.-1/V.M.(Salary & Allowances of Members)-05-02/2011(part)-173—In exercise of the powers conferred by the section 8 of the Bihar Legislature (Salary, Allowances and Pensionof Members) Act, 2006 (Act No. 16, 2006), the Governor of Bihar hereby makes the following Amendments in Bihar Legislature (Pay, Allowances and Pension of Members) Rules, 2006 (as amended from time to time) :-

Rules, 2017

1. Short title and commencement-

(1) These Rules may be called the Bihar Legislature (Pay, Allowances and Pension of Members) (Amendment) Rules, 2017.

(2) They shall come into force from the date of issue of notification. 2. Rule 8(c) of the said Rules, 2006 shall be substituted by the following:-

"(c) Journey for which travelling allowance is admissible under the Rules and which may be performed by rail or road or partly by rail and road, for that, travelling allowance shall be limited to the travelling allowance of nearest route irrespective of type of journey."

3. Rule 9(1)(b) of the said Rules, 2006 shall be substituted by the following :-

"(b) For the purposes of attending meetings of Committee of the Legislature. The members of the committee shall be provided vehicles by the Bihar Legislative Assembly Secretariat/Bihar Legislative Council Secretariat, as the case may be, for site study tour."

4. Rule 10 of the said Rules, 2006 shall be substituted by the following:-

"17. Pension and other facilities to former members - (1) Any such person, who has been elected/nominated to the Bihar Legislative Assembly/Legislative Council as a member shall be entitled to whole life pension of Rs. 25,000 (twenty five thousand) from the date of being notified by the Election Commission of India or nominated by the Governor of Bihar or from the date of commencement of their tenure and pension may be increased at the rate of Rs. 2,000/- (two thousand) per year on the basis of whole tenure. Provided that the period of more than six months and less than one year shall be calculated as a complete year. Provided also that the facilities of pension/family pension to the former members shall be admissible to the elected members of the thirteenth Bihar Legislative Assembly from the date of being notified by the Election Commission of India/from the date of commencement of the tenure of the said Legislative Assembly. Provided further that such members of Bihar Legislature who have been the members of both the Houses shall get their pension from such House where they have been the member last time calculating the period of both the Houses."3 ;बपकरू2द्ध;बपकरू5द्ध ;बपकरू10द्धख्;बपकरू5द्ध;बपकरू5द्ध;बपकरू15द्ध 2 ;बपकरू1द्ध- 2;बपकरू26द्ध21

7. Rule 17(4) of the said Rules, 2006 shall be substituted by the following:-

"(4) Facility of journey by Rail/Air- In every financial year up to Rs. 1,00,000/- (one lakh) shall be admissible to former members of Bihar Legislature for rail coupon/rail journey based on reimbursement or air journey or both types of journey for travelling in any place or places inside India with maximum of three co-travelers. Provided that such former members who are employed on salary in University recognised by the Central Government or any State Government shall also be entitled for rail/air journey. Provided further that they may not get the travelling allowances/daily allowances from their University/College for the journey by rail/air and they will have to submit an affidavit to the Secretary, Legislative Assembly/Secretary, Legislative Council, as the case be or the employment authority to this effect."
