राजस्व एवं भूमि सुधार विभाग ——— अधिसूचना 17 मई 2022 सं॰ 4/क्षे॰स्था॰ सेवा नीति-(अ॰-सह-रा०कर्म॰)-02-01/2021-192(4)/रा०—भारत संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, बिहार अमीन-सह-राजस्व कर्मचारी संवर्ग का गठन और उसमें भर्ती की प्रक्रिया तथा अन्य सेवाशर्त्तों को विनियमित करने के लिए निम्नलिखित नियमावली गठित करते हैं :-

1. संक्षिप्त नाम, विस्तार और प्रारम्भ।-

(i) यह नियमावली बिहार अमीन-सह-राजस्व कर्मचारी संवर्ग नियमावली, 2022 कही जा सकेगी। (ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह अधिसूचना राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगी।

2. परिभाषाएँ।- इस नियमावली में, जब तक कोई बात विषय या संदर्भ के विरूद्ध न होः-

(क) ''राज्य सरकार'' से अभिप्रेत है बिहार राज्य सरकार; (ख) ''विभाग'' से अभिप्रेत है राजस्व एवं भूमि सुधार विभाग; (ग) ''राज्यपाल'' से अभिप्रेत है बिहार के राज्यपाल; (घ) ''संवर्ग'' से अभिप्रेत है बिहार अमीन-सह-राजस्व कर्मचारी संवर्ग ; (ड़) ''नियुक्ति प्राधिकार'' से अभिप्रेत है अपर मुख्य सचिव/प्रधान सचिव/सचिव, राजस्व एवं भूमि सुधार विभाग, बिहार, पटना;

(च) ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है अपर मुख्य सचिव/प्रधान सचिव/सचिव, राजस्व एवं भूमि सुधार विभाग, बिहार, पटना;

(छ) ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष अर्थात पहली अपै्रल से अगले वर्ष के 31 मार्च तक की अवधि; (ज) ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (झ) ''पर्षद'' से अभिप्रेत है बिहार संयुक्त प्रवेश प्रतियोगिता परीक्षा पर्षद; () ''वर्ष के अंदर रिक्ति'' से अभिप्रेत है सेवा में नये पदों का सृजन, सेवानिवृति, मृत्यु सेवा से हटाये जाने और पदच्युत किये जाने से किसी विशिष्ट वर्ष में उद्‌भूत रिक्ति;

3. संवर्ग का गठन।-

(क) इस संवर्ग में अमीन-सह-राजस्व कर्मचारी कोटि के पद होंगे। (ख) यह राज्य स्तरीय अराजपत्रित संवर्ग होगा। (ग) इस नियमावली के लागू होने के पूर्व अमीन एवं राजस्व कर्मचारी कोटि में नियुक्त एवं कार्यरत कर्मी स्वतः इस संवर्ग में शामिल समझे जाऐगें।

4. स्वीकृत बल।-

(क) इस संवर्ग में अमीन-सह-राजस्व कर्मचारी के पदों की संख्या उतनी ही होगी जितनी इस नियमावली के प्रभावी होने की तिथि तक सरकार द्वारा अमीन एवं राजस्व कर्मचारी के पद स्वीकृत/अवधारित किये गए हों तथा उसके बाद की तिथियों से सरकार द्वारा समय-समय पर आवश्यकतानुसार स्वीकृत अथवा अवधारित की जाए।

(ख) स्वीकृत बल की संख्या राज्य सरकार समय-समय पर घटा/बढ़ा सकेगी या पदों की कोई भी संख्या निलंबित संचरण के अधीन रख सकेगी।

(ग) अमीन-सह-राजस्व कर्मचारी को वही वेतनमान/वेतन स्तर अनुमान्य होगा जैसा समय-समय पर वित्त विभाग, बिहार सरकार द्वारा निर्धारित किया जाय।

5. उम्र सीमा।-अमीन-सह-राजस्व कर्मचारी के लिए उम्मीदवार की न्यूनतम आयु, जिस वर्ष आवेदन आमंत्रित किया गया हो, उस वर्ष के 1 अगस्त को 18 वर्ष से कम नहीं होगी। अधिकतम आयु सीमा वही होगी जो राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समय-समय पर नियत की जाय।

6. आरक्षण।- अमीन-सह-राजस्व कर्मचारी के पद पर नियुक्ति में राज्य सरकार द्वारा समय-समय पर यथा निर्धारित आरक्षण/रोस्टर के प्रावधान लागू होंगे।

7. भर्त्ती।-

(क) अमीन-सह-राजस्व कर्मचारी के पदों पर सीधी भर्ती आयोग/पर्षद अथवा विभाग द्वारा इस निमित्त चयनित अन्य प्राधिकार द्वारा इन्टरमीडियट(10+2) स्तरीय प्रतियोगिता परीक्षा के लिए नियत मापदडों एवं प्रक्रियाओं का अनुपालन करते हुए, आयोजित प्रतियोगिता परीक्षा के परीक्षाफल के आधार पर प्राप्त अनुशंसा के आधार पर की जायेगी।

(ख) अमीन-सह-राजस्व कर्मचारी के पद पर नियुक्ति के लिए अभ्यर्थी को किसी भी मान्यता प्राप्त बोर्ड/समकक्ष संस्थान से इन्टरमीडियट(10+2) या समकक्ष अर्हता प्राप्त होना अनिवार्य होगा। 8. परिवीक्षा अवधि।-

(क) मौलिक रिक्त पद के विरूद्ध नियुक्त प्रत्येक अमीन-सह-राजस्व कर्मचारी पद ग्रहण की तिथि से दो वर्षों की अवधि के लिए परिवीक्षाधीन रहेगा।

(ख) परिवीक्षा अवधि के दौरान अमीन-सह-राजस्व कर्मचारी का आचरण एवं सेवा संतोषजनक नहीं पाए जाने पर परिवीक्षा अवधि एक अतिरिक्त वर्ष के लिए बढ़ायी जा सकेगी, यदि यह प्रतीत हो कि उसके आचरण एवं सेवा मेंं सुधार की सम्भावना है। बढ़ायी गयी अवधि में भी यदि आचरण एवं सेवा असंतोषजनक पायी जाय तो उसकी सेवा समाप्त की जा सकेगी।

(ग) नियुक्ति के बाद प्रथम वेतन वृद्धि के पश्चात अगली वेतन वृद्धि तभी मिलेगी जब राजभाषा विभाग द्वारा संचालित हिन्दी टिप्पण एवं प्रारूपण परीक्षा तथा NIELIT द्वारा आयोजित कम्प्यूटर सक्षमता जाँच परीक्षा में उर्त्तीणता प्राप्त कर ली जाय।

9. प्रशिक्षण।-

(क) अमीन-सह-राजस्व कर्मचारी के प्रशिक्षण के संबंध में विभाग द्वारा समय-समय पर निर्णय संसूचित किया जायेगा। विभाग के निर्णय के अनुरूप अमीन-सह-राजस्व कर्मचारी को प्रशिक्षण लेना अनिवार्य होगा। यदि प्रशिक्षण के अंत में कोई परीक्षा निर्धारित की जाती है तो उसमें भी उत्तीर्णता प्राप्त करना अनिवार्य होगा।

(ख) अमीन-सह-राजस्व कर्मचारी के पद पर कार्यरत कर्मियों को भू-मापी एवं भू-अभिलेख के कार्याें से संबंधित प्रशिक्षण भी दिया जायगा एवं आवश्यकतानुसार उक्त पदों पर कार्यरत कर्मियों से भू-मापी एवं भू-अभिलेख का कार्य लिया जा सकेगा।

10. सेवा सम्पुष्टि।- परीविक्षा पर नियुक्त अमीन-सह-राजस्व कर्मचारी परिवीक्षा अवधि समाप्त होने पर निम्नलिखित शर्त्तों के अधीन सेवा में सम्पुष्टि का पात्र होगा :-

(क) यदि विभाग कोई विभागीय परीक्षा विहित करता है तो उसमें उत्तीर्णता प्राप्त कर ली गयी हो, (ख) समय-समय पर विहित प्रशिक्षण प्राप्त कर लिया गया हो और प्रशिक्षण के अंत में परीक्षा, यदि आयोजित की गयी हो, में उत्तीर्णता प्राप्त की जा चुकी हो,

(ग) परीविक्षा अवधि में आचरण एवं सेवा संतोषजनक रही हो। (घ) हिन्दी टिप्पण एवं प्रारूपण परीक्षा तथा NIELIT द्वारा आयोजित कम्प्यूटर सक्षमता जाँच परीक्षा में उर्त्तीणता प्राप्त कर ली गयी हो ।3 ;बपकरू464द्ध ;द्धए 17 2022 11. वरीयता।- अमीन-सह-राजस्व कर्मचारी की वरीयता आयोग/पर्षद अथवा विभाग द्वारा इस निमित चयनित अन्य प्राधिकार द्वारा संसूचित मेघा क्रमानुसार निर्धारित की जायेगी। वरीयता का निर्धारण में राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समय-समय पर नियत सिद्धान्तों एवं प्रक्रिया का अनुपालन किया जायेगा। नियमावली के प्रवृत होने के पूर्व नियुक्त अमीन तथा राजस्व कर्मचारी की आपसी वरीयता अपरिवर्तित रहेगी।

12. पूर्व से निर्धारित वेतनमान में नियुक्त एवं कार्यरत अमीन एवं राजस्व कर्मचारी।-

(क) पूर्व से जिलों में निर्धारित वेतनमान में नियमित रूप से नियुक्त एवं कार्यरत अमीन तथा राजस्व कर्मचारी का संवर्ग मृतप्राय संवर्ग (डाइंग कैडर) होगा तथा इस संवर्ग के अमीन एवं राजस्व कर्मचारी के पद उनकी सेवानिवृति या अन्य कारणों से रिक्त होने के साथ ही स्वतः समाप्त समझे जाएगें।

पूर्व की प्रक्रिया से नियुक्त अमीन एवं राजस्व कर्मचारी की सेवानिवृति एवं अन्य कारणों से होने वाले रिक्त पद रिक्ति की तिथि से इस नियमावली के अधीन नियुक्ति हेतु प्रत्यार्पित समझते हुए इस पद पर इस नियमावली के आलोक में नियुक्ति की जाएगी। 13. प्रकीर्ण/स्थापना संबंधी विषयों पर नियंत्रण।-

(क) इस संवर्ग के सदस्यों का पदस्थापन, सेवा सम्पुष्टि, वरीयता सूची का संधारण, प्रोन्नति एवं स्थापना संबंधी सभी विषय विभाग के अधीन होगा।

(ख) इस संवर्ग के कर्मियों की सेवानिवृति के उपरांत उनके सेवान्त लाभ का भुगतान संबंधित अंचल के अंचलाधिकारी द्वारा समाहर्त्ता के अनुमोदनोपरांत किया जाएगा।

14. निरसन एवं व्यावृति।-

(क) इस नियमावली के लागू होने के पूर्व से अधिसूचित बिहार अमीन संवर्ग नियमावली-2013, बिहार अमीन संवर्ग (संशोधन) नियमावली-2016, बिहार अमीन संवर्ग (संशोधन) नियमावली-2017, बिहार राजस्व कर्मचारी संवर्ग नियमावली-2011, बिहार राजस्व कर्मचारी संवर्ग (संशोधन) नियमावली-2013 एवं विभाग से अमीन एवं राजस्व कर्मचारी की नियुक्ति संबंधी पूर्व में निर्गत सभी पत्र/आदेश/परिपत्र को निरसित किया जाता है।

(ख) ऐसे निरसन के होते हुए भी पूर्व सरकारी परिपत्रों/नियमावलियों या अन्य के अधीन की गई सभी नियुक्तियाँ कानूनन विधिमान्य रहेंगी मानो वे इस नियमावली के सुसंगत उपबंधों के अधीन की गयी हो।

No-04/Kshe.Stha.Seva Niti-(Amin-cum-Raj.Karm.)-02-01/2021-192(4)/Ra.—In exercise of the powers conferred under the proviso to Article 309 of the Constitution of India, the Governor of Bihar hereby frame the following rules for the constitution of the Bihar Amin-cum-Rajaswa Karamchari Cadre and for regulating the procedure of recruitment therein and other conditions of service:-

1. Short title, extent and commencement.—

(i) These rules may be called the Bihar Amin-cum-Rajaswa Karamchari Cadre Rules, 2022.

(ii) It shall extend to the whole of the State of Bihar. (iii) This notification shall come into force from the date of its publication in Official Gazette.

2. Definitions.—In these rules, unless there is anything repugnant to the subject or

context:-

(a) "State Government" means the Government of Bihar; (b) "Department" means the Department of Revenue and Land Reforms; (c) "Governor" means the Governor of Bihar; (d) "Cadre" means the Bihar Amin-cum-Rajaswa Karamchari Cadre; (e) "Appointing authority" means the Additional Chief Secretary/Principal Secretary/ Secretary, Revenue and Land Reforms Department, Bihar, Patna;

(f) "Cadre Controlling Authority" means the Additional Chief Secretary/Principal Secretary/Secretary, Revenue and Land Reforms Department, Bihar, Patna;

(g) "Year" means the financial year i.e. the period from the 1st day of April to the 31st day of March of the following year;

(h) "Commission" means the Bihar Staff Selection Commission; (i) "Board" means the Bihar Combined Entrance Competitive Examination Board; (e) "Vacancy within a year" means a vacancy arising in a particular year from the creation of new posts in the Service, by way of retirement, death, removal and dismissal;

3. Constitution of the cadre.—

(a) This cadre will consist of Amin-cum- Rajaswa Karamchari category posts. (b) It shall be a State level non-gazetted cadre. (c) Before the implementation of these rules, the employees appointed and working in the category of Amin and Rajaswa Karamchari will automatically be deemed to be included in this cadre.

4. Sanctioned Force.—

(a) The number of posts of Amin-cum-Rajaswa Karamchari in this cadre shall be the same as the sanctioned/determined posts of Amin and Rajaswa Karamchari by the Government till the date of coming into force of these rules and with effect from the dates thereafter, as may be approved or determined by the Government from time to time.

(b) The number of the sanctioned strength may be reduced/increased by the State Government from time to time or may place any number of posts under suspended animation.

(c) The pay scale/pay level will be admissible to Amin-cum-Rajaswa Karamchari as may be prescribed by the Finance Department, Government of Bihar from time to time.

5. Age Limit.—The minimum age of the candidate for Amin-cum-Rajaswa Karamchari shall not be less than 18 years as on 1st of August of the year in which the application has been invited. The maximum age limit shall be the same as fixed from time to time by the General Administration Department of the State Government.

6. Reservation.—The provisions of reservation/roster as prescribed by the State Government from time to time will be applicable in the appointment to the post of Amin-cum- Rajaswa Karamchari.

7. Recruitment.—

(a) The direct appointment to the posts of Amin-cum-Rajaswa Karamchari shall be made on the basis of recommendation obtained, based on the result of competitive examination conducted by the Commission/Board or any other authority selected in this behalf by the Department, following the prescribed norms and procedures for the Intermediate (10+2) level competitive examination.

(b) For appointment to the post of Amin-cum-Rajaswa Karamchari, it will be mandatory for the candidate to possess Intermediate (10+2) or equivalent qualification from any recognized Board/Equivalent Institute.

8. Period of probation.—

(a) Every Amin-cum-Rajaswa Karamchari appointed against the basic vacant post shall be on probation for a period of two years from the date of joining.

(b) If the conduct and service of the Amin-cum-Rajaswa Karamchari is not found satisfactory during the period of probation, the period of probation may be extended for a further year, if it appears that there is a possibility of improvement in his conduct and service. If the conduct and service is found unsatisfactory even during the extended period, his service may be terminated.

(c) After the first increment after appointment, the next increment will be available only after passing the Hindi noting and drafting examination conducted by the Department of Rajbhasha and the computer competency test conducted by NIELIT.

9. Training.—

(a) The decision regarding training of Amin-cum-Rajaswa Karamchari will be communicated by the Department from time to time. To take training of Amin- cum-Rajaswa Karamchari as per the decision of the department will be mandatory. If any examination is scheduled at the end of the training, it will be mandatory to qualify in that also.

(b) Training related to the work of land measurement and land records will also be given to the personnel working on the post of Amin-cum-Rajaswa Karamchari and as per requirement, the work of land measurement and land record can be taken from the employees working in the above posts. .

10. Service confirmation.—Amin-cum-Rajaswa Karamchari appointed on probation shall be eligible for confirmation in service on the expiry of the period of probation subject to the following conditions:-

(a) if the Department prescribes any departmental examination, has been passed in that,

(b) has undergone the prescribed training from time to time and passed the examination, if conducted, at the end of the training

(c) The conduct and service during the period of probation has been satisfactory. (d) Passed in Hindi Noting and Drafting Test and Computer Efficiency Test conducted by NIELIT.

11. Seniority.—The seniority of Amin-cum-Rajaswa Karamchari will be determined in order of merit as communicated by the Commission / Board or other authority selected in this behalf by the Department. In determining the seniority the rules and procedure laid down by the General Administration Department of the State Government from time to time will be followed. The mutual seniority of the appointed Amin and the Rajaswa Karamchari before the coming into force of the rules will remain unchanged.

12. Amin and Rajaswa Karamchari appointed and working in pre-determined pay scale.— (a) The cadre of Amin and Rajaswa Karamchari, already appointed and working regularly in the prescribed pay scale in the districts, will be dying cadre and the posts of Amin and Rajaswa Karamchari of this cadre will become automatically terminated after their retirement or for other reasons.

Vacant post obtained due to retirement or other reasons for Amin and Rajaswa Karamchari, appointed on the basis of the earlier procedure, the appointment will be made on this post in the light of these rules, considering it to be added for appointment under these rules.

13. Control over miscellaneous/establishment related matters.-

(a) All the matters related to posting, service confirmation, maintenance of merit list, promotion and establishment of the members of this cadre will be under the department.

(b) After the retirement of the employees of this cadre, their retiral benefits will be paid by the Circle Officer of the concerned zone after the approval of the Collector.

14. Repeal and Saving.—

(a) The Bihar Amin Cadre Rules-2013, Bihar Amin Cadre (Amendment) Rules- 2016, Bihar Amin Cadre (Amendment) Rules-2017, Bihar Rajaswa Karamchari Cadre Rules-2011, Bihar Rajaswa Karamchari Cadre (Amendment) Rules- 2013, notified before the commencement of these rules and All the earlier letters/orders/circulars issued from the Department regarding the appointment of Amin and Rajaswa Karamchari are hereby repealed.

(b) Notwithstanding such repeal, all appointments made under previous Government circulars/rules or otherwise shall be valid by law as if they were made under the relevant provisions of these rules.
