सं॰ ः Exp-21/2020/(खंड-56)अमौर-141—लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग के आदेष संख्या- 76/बिहार/वि.स./56/सी.ई.एम.एस.-III/2020 दिनांक 23.08.2022 से एतद्द्वारा घोशित किया गया है कि बिहार राज्य के 56-अमौर विधान सभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लड़ने वाले अभ्यर्थी श्री उपेन्द्र यादव, निवासी-स्थान-मच्छाता, पोस्ट ऑफिसथाना- अमौर, पिन कोड-854315 बिहार इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है (हिन्दी एवं अंग्रेजी में) सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती हैं। बिहार-राज्यपाल के आदेष सेे, मिथिलेष कुमार साहु, संयुक्त सचिव-सह- संयुक्त मुख्य निर्वाचन पदाधिकारी, बिहार। प्रेस-कृपया यहाँ से यथाक्रमानुसारमुद्रितकरें।2 ;बपकरू464द्ध ;द्ध 16 ;बपकरू224द्ध 2022

िनवा(cid:170)चन सदन, अशोक रोड, नई िद(cid:208)ली – 110001/दिनांक 23 अगस्त, 2022/01 भाद्रपद, 1944 (शक)
सं.76/बिहार/वि.स./56/सी.ई.एम.एस.-।।।/2020—यतः, भारत निर्वाचन आयोग द्वारा बिहार राज्य में विधान सभा के साधारण निर्वाचन 2020 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./64/2020 दिनांक 25सितम्बर, 2020 के द्वारा की गई थी। और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और यतः, 56-अमौर विधान सभा निर्वाचन क्षेत्र के निर्वाचन के परिणाम 10 नवंबर,2020 को घोशित किए गए थे। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 10दिसम्बर,2020 थी; और यतः, जिला निर्वाचन अधिकारी, पूर्णिया, बिहार के पत्र सं. 2094 दिनांक 16दिसंबर 2020 द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, बिहार, के पत्र सं. EXP-21/2020(खंड-56)अमौर/7995 दिनांक 31दिसंबर, 2020 के जरिए अग्रेशित की गई थी। रिपोर्ट के अनुसार श्री उपेंद्र यादव, जो बिहार के 56-अमौर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं। और यतः, जिला निर्वाचन अधिकारी, पूर्णिया, बिहार की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री उपेंद्र यादव को कारण बताओ नोटिस सं. 76/बिहार/वि॰स॰/56/सी.ई.एम.एस.- III/2020 दिनांक 25 जून, 2021 जारी किया गया था; और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, उक्त कारण बताओ नोटिस के जरिए श्री उपेंद्र यादव को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और यतः, जिला निर्वाचन अधिकारी, पूर्णिया द्वारा अपने दिनांक 01फरवरी,2022 के पत्र संख्या 65/जि.नि. के जरिए आयोग को सुचना दी थी कि उक्त नोटिस श्री उपेंद्र यादव द्वारा 07 जनवरी, 2022 को प्राप्त किया गया था; और यतः, जिला निर्वाचन अधिकारी, पूर्णिया द्वारा अपने दिनांक 01फरवरी,2022 के पत्र संख्या 65/नि. के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री उपेंद्र यादव ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ; और यतः, आयोग को यह समाधान हो गया है कि श्री उपेंद्र यादव निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः- ''यदि निर्वाचन आयोग को यह समाधान हो जाता है कि कोई व्यक्ति- i. निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा हैः तथा
ii. उस असफलता के लिए कोई उचित कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा; अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोशणा करता है कि बिहार राज्य के 56- अमौर विधानसभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लड़ने वाले अभ्यर्थी श्री उपेंद्र यादव, निवासी- स्थान-मच्छाता, पोस्ट ऑफिसथाना-अमौर, पिन कोड- 854315, इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

No.76/BR-LA/2020/56/CEMS-III--WHEREAS, the General Election to the Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020.
AND, WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer;
AND, WHEREAS, the result of the said election along with 56-Amour Assembly Constituency was declared by the concerned Returning Officer on 10th November, 2020. Hence, the last date for lodging the account of Election Expenses was 10th December, 2020; AND WHEREAS, As per the report dated 16th December, 2020, vide letter no. 2094 submitted by the District Election Officer, Purnea, Bihar and forwarded by the Chief Electoral Officer, Bihar vide their letter No. Expenditure-21/2020(Vol.-56) Amour/7995, dated 31st December,2020, Shri Upendra Yadav, a contesting candidate from 56-Amour Assembly Constituency of Bihar, has failed to lodge account of his election expenses, in the manner, as required under law.
AND WHEREAS, on the basis of the reports of the District Election Officer, Purnea, Bihar Show- Cause Notice, dated 25th June, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Upendra Yadav, for not lodging the account of Election Expenses;
AND WHEREAS, As per the sub rule(6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show- Cause Notice, Shri Upendra Yadav was directed to submit his representation in writing with explaining the reason for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice;
AND WHEREAS, District Election Officer, Purnea, vide its letter no. 65/Nirvachan dated 1st February, 2022 informed to the Commission that said notice was received by Shri Upendra Yadav on 07th January, 2022;
AND WHEREAS, the District Election Officer, Purnea, in his Supplementary Report, vide its letter No. 65/Nirvachan dated 1st February, 2022 has reported that Shri Upendra Yadav, has neither submitted any representation nor any statement of account of election expenses till date. Further, after receipt of the due notice of the Election Commission of India, he has neither furnished any reason nor explanation for the said failure;
AND WHEREAS, the Commission is satisfied that Shri Upendra Yadav, has failed to lodge the account of election expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

i. has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and
ii. has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order";
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Upendra Yadav, resident of Village-Macchata, Post+Police Station- Amour, Pin Code- 854315 a contesting candidate from 56- Amour Assembly Constituency during General Election to the Legislative Assembly of Bihar 2020, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
