EXP.-21/2020(खंड-143)तेघड़ा-7735 के जरिए अग्रेशित दिनांक 21 दिसंबर, 2020 की रिपोर्ट के अनुसार श्री चंदन महतो,श्री चंदन महतो,श्री चंदन महतो,श्री चंदन महतो, जो बिहार के 143-तेघड़ा143-तेघड़ा143-तेघड़ा143-तेघड़ा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं। और यतः, और यतः, और यतः, और यतः, जिला निर्वाचन अधिकारी, बेगूसरायबेगूसरायबेगूसरायबेगूसराय, बिहार और मुख्य निर्वाचन अधिकारी, बिहार, पटना की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री चंदन महतोश्री चंदन महतोश्री चंदन महतोश्री चंदन महतो को कारण बताओ नोटिस दिनांक 25 जून, 2021 जारी किया गया था; और यतः, और यतः, और यतः, और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 25 जून, 2021 के उपर्युक्त कारण बताओ नोटिस के जरिए श्रीश्रीश्रीश्री चंदन महतोचंदन महतोचंदन महतोचंदन महतो को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और यतः,और यतः,और यतः,और यतः, उक्त नोटिस श्री चंदन महतो द्वारा 05 अगस्त, 2021 को प्राप्त किया गया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, बेगूसरायबेगूसरायबेगूसरायबेगूसराय द्वारा अपने दिनांक 23 सितम्बर, 2021 के पत्र संख्या 712 के जरिए आयोग को प्रस्तुत कर दी गई है; और यतः,और यतः,और यतः,और यतः, जिला निर्वाचन अधिकारी, बेगूसराय बेगूसराय बेगूसराय बेगूसराय द्वारा अपने दिनांक 26 अप्रैल, 2022 के पत्र संख्या 552 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री चंदन महतो श्री चंदन महतो श्री चंदन महतो श्री चंदन महतो ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है; और यतः,और यतः,और यतः,और यतः, आयोग को यह समाधान हो गया है कि श्री चंदन महतो श्री चंदन महतो श्री चंदन महतो श्री चंदन महतो निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और यतः,और यतः,और यतः,और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः- "यदि निर्वाचन आयोग को यह समाधान हो जाता है कि कोई व्यक्ति -

i. निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

ii. उस असफलता के लिए कोई उचित कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा;

अतःअतःअतःअतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा घोशणा करता है कि बिहार राज्य के 143-तेघड़ा 143-तेघड़ा 143-तेघड़ा 143-तेघड़ा विधान सभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लड़ने वाले अभ्यर्थी श्री चंदन महतो, ग्रामपोस्ट- सिमरिया घाट बिन्द टोली, थाना- बरौनी, जिला- बेगूसराय, श्री चंदन महतो, ग्रामपोस्ट- सिमरिया घाट बिन्द टोली, थाना- बरौनी, जिला- बेगूसराय, इस आदेष की तारीख श्री चंदन महतो, ग्रामपोस्ट- सिमरिया घाट बिन्द टोली, थाना- बरौनी, जिला- बेगूसराय, श्री चंदन महतो, ग्रामपोस्ट- सिमरिया घाट बिन्द टोली, थाना- बरौनी, जिला- बेगूसराय, से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

ORDER

Nirvachan Sadan, Ashoka Road, New Delhi-110001/ Dated 05 August, 2022 14 Sawan, 1944 (Saka) No. 76/BR-LA/2020/143/CEMS-III—WHEREAS, the General Election to the Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020. As per the schedule, the date of counting of votes was 10 November, 2020.

AND, WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer;

AND, WHEREAS, the result of the said election along with 143-Teghra Assembly Constituency was declared by the concerned Returning Officer on 10th November, 2020. Hence, the last date for lodging the account of Election Expenses was 10th December, 2020;

AND WHEREAS, As per the report dated 16th December, 2020, vide letter no. 2519 submitted by the District Election Officer, Begusarai, Bihar and forwarded by the Joint Chief Electoral Officer, Bihar vide their letter No. Expenditure-21/2020(Vol.-143)Teghra–7735, dated 21st December, 2020, Shri Chandan Mahto, a contesting candidate of Bihar from 143-Teghra Assembly Constituency of Bihar, has failed to lodge account of his election expenses, in the manner, as required under law;

AND WHEREAS, on the basis of the reports of the District Election Officer, Begusarai, Bihar and the Chief Electoral Officer, Bihar, a Show-Cause notice, dated 25th June, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Chandan Mahto, for not lodging the account of Election Expenses;

AND WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 25th June, 2021, Shri Chandan Mahto, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by him on 05th August, 2021, at the address given by Shri Chandan Mahto, The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Begusarai, vide its letter no. 712 dated 23rd September, 2021;

AND WHEREAS, the District Election Officer, Begusarai, in his Supplementary Report, vide its letter No. 552 dated 26th April, 2021 has reported that Shri Chandan Mahto, has neither submitted any representation nor any statement of account of election expenses till date. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure;

AND WHEREAS, the Commission is satisfied that Shri Chandan Mahto, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:- "If the Election Commission is satisfied that a person-

i. has failed to lodge an account of election expenses, within the time and in

the manner required by or under this Act, and

ii. has no good reason or justification for the failure, the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Chandan Mahto, resident of Village+Post- Simriya Ghaat Bind Toli, Thana- Baroni, District- Begusarai, a contesting candidate from 143-Teghra, in General Election to the Legislative Assembly of Bihar 2020, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
