सं. 576/3/ईवीएम/2022/एसडीआर/ख्ण्ड-।।—यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61क में यह प्रावधान किया गया है कि वोटिंग मषीनों द्वारा मतदान और मतों का अभिलेखन ऐसी रीति, जैसी कि निर्धारित की जाए, से ऐसे निर्वाचन क्षेत्र या निर्वाचन क्षेत्रों में अपनाया जाए जैसा कि भारत निर्वाचन आयोग, प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए विनिर्दिश्ट करें; और 2. यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 49क के परन्तुक के अनुसार, भारत निर्वाचन आयोग द्वारा यथाअनुमोदित डिजाइन वाले ड्राप बॉक्स सहित एक प्रिंटर, ऐसे निर्वाचन क्षेत्र या निर्वाचन क्षेत्रों या उसके भागों में मतों के पेपर ट्रेल के मुद्रण के लिए मतदान मषीन के साथ भी जोड़ा जाए जैसा कि भारत निर्वाचन आयोग द्वारा निदेष दिया जाए; और
3. यतः, निर्वाचन आयोग ने दिनांक 3 अक्टूबर, 2022 प्रेस नोट संख्या ईसीआई/प्रे.नो./73/2022 के तहत घोशित महाराश्ट्र के 166-अन्धेरी पूर्व विधान सभा निर्वाचन क्षेत्र, बिहार के 178-मोकामा एवं 101-गोपालगंज विधान सभा निर्वाचन क्षेत्रों, हरियाणा के 47-आदमपुर विधान सभा निर्वाचन क्षेत्र, तेलंगाना के 93-मुनुगोडे विधान सभा निर्वाचन क्षेत्र, उत्तर प्रदेष के 139-गोला गोकरननाथ विधान सभा निर्वाचन क्षेत्र और ओडिषा के 46-धामनगर(अ॰जा॰) विधान सभा निर्वाचन क्षेत्र की परिस्थितियों पर विचार किया है, और निर्वाचन आयोग संतुश्ट है कि उक्त विधान सभा निर्वाचन क्षेत्रों में मतदान करवाने के लिए पर्याप्त संख्या में इलेक्टॉनिक वोटिंग मषीनें तथा पेपर ट्रेल [वोटर वेरिफायबल पेपर ऑडिट ट्रेल (वीवीपैट)] मुद्रित करने के लिए पिं्रटर उपलब्ध हैं, मतदान कार्मिक, इलेक्टॉनिक वोटिंग मषीनों तथा वीवीपैट प्रिंटर के दक्षतापूर्ण संचालन करने के लिए पूर्ण प्रषिक्षित हैं तथा निर्वाचक भी इलेक्ट्रॉनिक वोटिंग मषीनों (ई वी एम) एवं वीवीपैट प्रिंटरों की कार्यप्रणाली से पूर्णतया परिचित हैं।
4. अतः, अब भारत निर्वाचन आयोग, लोक प्रतिनिधित्व अधिनियम, 1951 की उक्त धारा 61क तथा निर्वाचनों का संचालन नियम, 1961 के नियम 49क के अंतर्गत अपनी शक्तियों का प्रयोग करते हुए एतद्द्वारा दिनांक 07.10.2022 को अधिसूचित महाराश्ट्र के 166-अन्धेरी पूर्व विधान सभा निर्वाचन क्षेत्र, बिहार के 178-मोकामा एवं 101-गोपालगंज विधान सभा निर्वाचन क्षेत्रों, हरियाणा के 47-आदमपुर विधान सभा निर्वाचन क्षेत्र, तेलंगाना के 93-मुनुगोडे विधान सभा निर्वाचन क्षेत्र, उत्तर प्रदेष के 139-गोला गोकरननाथ विधान सभा निर्वाचन क्षेत्र और ओडिषा के 46-धामनगर(अ॰जा॰) विधान सभा निर्वाचन क्षेत्र को ऐसे निर्वाचन क्षेत्रों के रूप में विनिर्दिश्ट करता है, जहां निर्वाचनों का संचालन नियम, 1961 के अधीन तथा इस विशय में आयोग द्वारा समय-समय पर जारी किए गए अनुपूरक अनुदेषों के अंतर्गत विहित तरीके से इलेक्ट्रॉनिक वोटिंग मषीनों तथा वीवीपैट प्रिंटर के माध्यम से मत डाले और रिकॉर्ड किए जाएंगे।
5. निर्वाचन आयोग, भारत इलेक्ट्रॉनिक्स लिमिटेड, बंगलौर तथा इलेक्ट्रॉनिक्स कार्पोरेषन ऑफ इण्डिया लिमिटेड, हैदराबाद द्वारा यथा-विकसित इलेक्ट्रॉनिक वोटिंग मषीनों और वीवीपैट पिं्रटरों, जिन्हें उक्त निर्वाचन क्षेत्रों में मत डालने और रिकॉर्ड करने के लिए उपर्युक्त मषीनों से जोड़ा जाएगा, के डिजाइन को भी एतद्द्वारा अनुमोदित करता है।
आदेश से, एस.बी. जोषी, प्रधान सचिव।3 ;बपकरू464द्ध ;द्ध 18 ;बपकरू200द्ध 2022 ELECTION COMMISSION OF INDIA ———— DIRECTION Nirvachan Sadan, Ashoka Road, New Delhi-110001—Dated 15th October, 2022 No. 576/3/EVM/2022/SDR-VOL-II:- Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituency or constituencies as the Election Commission of India may, having regard to the circumstances of each case, specify; and
2. Whereas, as per the proviso to Rule 49A of the Conduct of Election Rules, 1961, a Printer with a drop box of such design, as may be approved by the Election Commission of India, may also be attached to voting machine for printing a paper trail of the vote, in such constituency of constituencies or parts thereof as the Election Commission of India may direct; and
3. Whereas, the Election Commission has considered the circumstances incurrent bye-elections in 166- Andheri East Assembly Constituency of Maharashtra, 178- Mokama & 101-Gopalganj Assembly Constituencies of Bihar, 47-Adampur Assembly Constituency of Haryana, 93-Munugode Assembly Constituency of Telangana, 139- Gola Gokrannath Assembly Constituency of Uttar Pradesh and 46-Dhamnagar (SC) Assembly Constituency of Odisha.announced vide the Election Commission's Press Note No. ECI/PN/73/2022 dated 3rd October, 2022 and is satisfied that sufficient number of Electronic Voting Machines (EVMs) and Printers for Printing Paper Trail [Voter Verifiable paper Audit Trail (VVPAT)] are available for taking the poll inabove said Assembly Constituencies, the polling personnel are well trained in efficient handling of EVMs and 'VVPAT Printers' and the electors are also fully conversant with the operation of the EVMs and the VVPAT Printers;
4. Now, therefore, the Election Commission of India, in exercise of its powers under the said Section 61A of the Representation of the people Act, 1951, and Rule 49A of the Conduct of Election Rules, 1961, hereby specifiescurrent bye-elections in 166- Andheri East Assembly Constituency of Maharashtra, 178-Mokama & 101-Gopalganj Assembly Constituencies of Bihar, 47-Adampur Assembly Constituency of Haryana, 93-Munugode Assembly Constituency of Telangana, 139-Gola Gokrannath Assembly Constituency of Uttar Pradesh and 46-Dhamnagar (SC) Assembly Constituency of Odisha notified on 07-10-2022, as the constituencies inwhich the votesshall be given and recorded by means of EVMs and VVPAT printers in the manner prescribed, under the conduct of Elections Rules, 1961, and the supplementary instructions issued by the Election Commission from time to time on the subject.
5. The Election Commission also hereby approves the design of EVMs and VVPAT Printers as developed by the Bharat Electronics Ltd., Bangalore and Electronics Corporation of India Ltd., Hyderabad, which shall be attached to the said machines, to be used for the giving and recording of votes in the above said Assembly Constituencies.
