सं॰ : Exp-21/2020/(खंड-139) रोसड़ा-201—लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग के आदेष संख्या- 76/बिहार-वि.स./2020/139/सी.ई.एम.एस.-III दिनांक 05.08.2022 से एतद्द्वारा घोशित किया गया है कि बिहार राज्य के 139- रोसड़ा विधान सभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लड़ने वाले अभ्यर्थी श्री शैलेन्द्र चौधरी, निवासी ग्राम-धनगांवा, गढ़पर, पो॰-धनगांवा, थाना-एकंगर सराय, जिला-नालंदा, इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है (हिन्दी एवं अंग्रेजी में) सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती हैं।

सं. 76/बिहार-वि.स./2020/139/सी.ई.एम.एस.-।।।—यतः, भारत निर्वाचन आयोग द्वारा बिहार विधान सभा के साधारण निर्वाचन 2020 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./64/2020 दिनांक 25 सितम्बर, 2020 के जरिए की गई थी। कार्यक्रम के अनुसार, मतगणना की तारीख 10 नवंबर, 2020 थी। और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और यतः 139- रोसड़ा विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 नवंबर, 2020 को घोशित किया गया था। इस प्रकार, निर्वाचन व्यय के लेखा दाखिल करने की अन्तिम तारीख 10 दिसम्बर, 2020 थी; और यतः, जिला निर्वाचन अधिकारी, समस्तीपुर, बिहार केे पत्र सं. 2571 दिनांक 16 दिसंबर, 2020 द्वारा प्रस्तुत और संयुक्त मुख्य निर्वाचन अधिकारी, बिहार द्वारा पत्र सं.व्यय-21/2020 (खंड- 139)रोसड़ा-7840 के जरिए अग्रेशित दिनांक 24 दिसंबर, 2020 की रिपोर्ट के अनुसार श्री शैलेन्द्र चौधरी, जो बिहार के साधारण निर्वाचन 2020 के 139-रोसड़ा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं। और यतः, जिला निर्वाचन अधिकारी, समस्तीपुर, बिहार और मुख्य निर्वाचन अधिकारी, बिहार की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री शैलेन्द्र चौधरी, को कारण बताओ नोटिस दिनांक 25 जून, 2021 जारी किया गया था; और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 25 जून, 2021 के उपर्युक्त कारण बताओ नोटिस के जरिए श्री शैलेन्द्र चौधरी, को निदेष दिया गया था, कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और यतः, उक्त नोटिस अभ्यर्थी द्वारा दिये गये पते पर वार्ड सदस्य के सामने दिनांक 26.07.2021 को अभ्यर्थी के दरवाजे पर चिपका दिया गया था। वार्ड सदस्य से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, समस्तीपुर, द्वारा अपने दिनांक 02 सितम्बर, 2021 के पत्र संख्या 521/निर्वा॰, के जरिए आयोग को प्रस्तुत कर दी गई है ; और यतः, जिला निर्वाचन अधिकारी, समस्तीपुर, द्वारा दिनांक 02 सितम्बर, 2021 के पत्र संख्या 521/निर्वा॰ के जरिए प्रस्तुत की गई संवीझा रिपोर्ट में यह बताया गया है कि श्री शैलेन्द्र चौधरी, ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ; और यतः, आयोग का यह समाधान हो गया है कि श्री शैलेन्द्र चौधरी, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः- ''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति- i. निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा हैः तथा
ii. उस असफलता के लिए कोई उचित कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा; अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोशणा करता है कि बिहार राज्य के 139- रोसड़ा विधान सभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लड़ने वाले अभ्यर्थी श्री शैलेन्द्र चौधरी, निवासी ग्राम- धनगांवा, गढ़पर, पो॰-धनगांवा, थाना- एकंगर सराय, जिला-नालंदा, इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

No-76/BR-LA/2020/139/CEMS-III--WHEREAS, the General Election to the Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020. As per the schedule, the date of counting of votes was 10 November, 2020.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer,;
AND, WHEREAS, the result of the said election along with 139-Rosera Assembly Constituency was declared by the concerned Returning Officer on 10th November, 2020. Hence, the last date for lodging the account of Election Expenses was 10th December, 2020;
AND WHEREAS, As per the report dated 16th December, 2020, vide letter no. 2571 submitted by the District Election Officer, Samastipur, Bihar and forwarded by the Joint Chief Electoral Officer, Bihar vide their letter No. Expenditure-21/2020(Vol.-139) Rosera- 7840, dated 24 December, 2021, Sh. Shailendra Choudhary, a contesting candidate of Bihar from 139- Rosera Assembly Constituency of Bihar, has failed to lodge account of his election expenses, in the manner, as required under law.
AND WHEREAS, on the basis of the reports of the District Election Officer, Samastipur, Bihar and the Chief Electoral Officer, Bihar, a Show- Cause notice, dated 25th June, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Shailendra Choudhary, for not lodging the account of Election Expenses;
AND WHEREAS, As per the sub rule(6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show- Cause Notice, dated 25th June, 2021 Sh. Shailendra Choudhary, was directed to submit his representation in writing with explaining the reason for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was pasted on the door in front of ward member of candidate on 26th July, 2021, at the address given by candidate. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Samastipur, vide its letter no. 521/District.Nirva, dated 02 September, 2021;
AND WHEREAS, the District Election Officer, Samastipur, in his Supplementary Report, vide its letter No. 521/Nirva, dated 02 September, 2021 has reported that Sh. Shailendra Choudhary, has neither submitted any representation nor any statement of account of election expenses till date. Further, after receipt of the due notice to the Election Commission of India, he has furnished neither any reason nor explanation for the said failure;
AND WHEREAS, the Commission is satisfied that Sh. Shailendra Choudhary, has failed to lodge the account of election expenses and has no good reason or justification for the failure;

"If the Election Commission is satisfied that a person: i. has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and
ii. has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order";
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares Sh. Shailendra Choudhary, resident of Vill- Dhangama Gadhpar, Post- Dhangama, Thana- Ekangar sarai, Dist- Nalanda, a contesting candidate from 139- Rosera, Assembly Constituency of the state of Bihar in the General Election to the Legislative Assembly of Bihar, 2020 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
