सं॰ ः Exp-21/2020/(खंड-79) गौड़ाबौराम-224—लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग के आदेष संख्या- 76/बिहार-वि.स./2020/79/सी.ई.एम.एस.-III दिनांक 19.09.2022 से एतद्द्वारा घोशित किया गया है कि बिहार राज्य के 79-गौङाबौराम विधान सभा निर्वाचन क्षेत्र, 2020 से निर्वाचन लड़ने वाले अभ्यर्थी श्री सत्य नारायण पासवान, निवासी ग्राम-विश्णुपुर घाट, पोस्ट-दक्षिणी कसरौर, थाना-घनष्यामपुर, जिला-दरभंगा, इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है (हिन्दी एवं अंग्रेजी में) सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती हैं।

सं.76/बिहार-वि.स./2020/79/सी.ई.एम.एस.-।।।—यतः, भारत निर्वाचन आयोग की दिनांक 25 सितम्बर, 2020 की प्रेस नोट सं. ईसीआई/पी॰.एन॰./64/2020 के अनुसरण में 79-गौङाबौराम विधान सभा निर्वाचन क्षेत्र के लिए बिहार विधान सभा का साधारण निर्वाचन, 2020 आयोजित किया गया था; और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करवाएगा जो उक्त अधिनियम की धारा 77 के तहत उसके या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और यतः, बिहार के 79-गौङाबौराम विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2020 का परिणाम, रिटर्निंग अधिकारी द्वारा दिनांक 10 नवंबर, 2020 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 10 दिसम्बर, 2020 थी; और यतः, मुख्य निर्वाचन अधिकारी, बिहार, के पत्रांक EXP.-21/2020(खण्ड-79) गौङाबौराम-7794, दिनांक 23.12.2020 के तहत उनसे प्राप्त जिला निर्वाचन अधिकारी, दरभंगा की निर्वाचन व्ययों के लेखा दाखिल करने की बाबत रिपोर्ट के अनुसार, श्री सत्य नारायण पासवान, जो बिहार के 79-गौङाबौराम विधान सभा निर्वाचन क्षेत्र, 2020 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, विधि के अंतर्गत यथा अपेक्षित निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं; और यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए श्री सत्य नारायण पासवान, को कारण बताओ नोटिस सं. 76/बिहार.वि.स/2020/सीईएमएस-III, दिनांक 25 जून, 2021 जारी किया गया था; और यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, श्री सत्य नारायण पासवान को लेखे दाखिल नहीं करने के कारणों को स्पश्ट करते हुए आयोग को लिखित में अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, दरभंगा को लेखा प्रस्तुत करने का भी निदेष दिया गया था; और यतः, जिला निर्वाचन अधिकारी, दरभंगा ने अपने पत्र सं. 12/निर्वा॰ दिनांक 5.01.2022 से बताया है कि उक्त नोटिस अभ्यर्थी को दिनांक 14.07.2021 को तामील किया गया था; और यतः, जिला निर्वाचन अधिकारी, दरभंगा ने आगे अपनी अनुपूरक रिपोर्ट सं. 585/निर्वा॰, दिनांक 24.05.2022 में यह कहा है कि श्री सत्य नारायण पासवान, ने न तो कोई इस संबंध में स्पष्टीकरण दिया न ही निर्वाचन व्ययों के सही लेखे का कोई विवरण प्रस्तुत किया है। इसके अतिरिक्त, उपर्युक्त नोटिस के प्राप्त होने के बाद श्री सत्य नारायण पासवान, ने विधि के तहत यथा निर्धारित लेखा दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है; और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः- "यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा।";
यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री सत्य नारायण पासवान, निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और अतः, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोशणा करता है कि बिहार के 79-गौङाबौराम विधान सभा निर्वाचन क्षेत्र, 2020 से निर्वाचन लड़ने वाले अभ्यर्थी श्री सत्य नारायण पासवान, निवासी ग्राम- विश्णुपुर घाट, पोस्ट-दक्षिणी कसरौर, थाना-घनष्यामपुर, जिला-दरभंगा इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

No.76/BR-LA/2020/79/CEMS-III-- WHEREAS, the General Election to the Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020.
AND, WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer;
AND, WHEREAS, the result of the said election along with 79-Gaurabauram Assembly Constituency was declared by the concerned Returning Officer on 10th November, 2020. Hence, the last date for lodging the account of Election Expenses was 10th December, 2020;
AND WHEREAS, As per the letter of Chief Electoral Officer, Bihar dated 23rd December, 2020, vide letter no. Exp-21/2020(Vol.-79)Gaurabauram/7794, on the basis of scrutiny report submitted by the District Election Officer, Darbhanga, Bihar, Shri Satya Narayan Paswan, a contesting candidate from 79-Gaurabauram Assembly Constituency of Bihar, has failed to lodge account of his election expenses, in the manner, as required by law under Rule 89 sub-rule (1).
AND WHEREAS, on the basis of the reports of the District Election Officer, Darbhanga, Bihar Show-Cause Notice no. 76/बिहार.वि. स/2020/सीईएमएस-III dated 25th June, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Satya Narayan Paswan , for not lodging the account of Election Expenses;
AND WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, Shri Satya Narayan Paswan was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice;
AND WHEREAS, District Election Officer, Darbhanga, vide its letter no. 12/Nir. dated 5.01.2022 informed to the Commission that the said notice was received by Shri Satya Narayan Paswan on 14.07.2022;
AND WHEREAS, the District Election Officer, Darbhanga, in his Supplementary Report, vide its letter No. 585/Nir. Dated 24.05.2022 has reported that Shri Satya Narayan Paswan , has neither submitted any representation nor any statement of account of election expenses.Till date further, after receipt of the due notice of the Election Commission of India, he has neither furnished any reason nor explanation for the said failure;
AND WHEREAS, the Commission is satisfied that Shri Satya Narayan Paswan , has failed to lodge the account of election expenses and has no good reason or justification for the failure,4 ;बपकरू464द्ध ;द्ध 25 ;बपकरू224द्ध 2022 AND WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
iii. has failed to lodge an account of election expenses, within the time and in the
manner required by or under this Act, and
iv. has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, dclare
him to be disqualified and any such person shall be disqualified for a period of
three years from the date of the order";
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Satya Narayan Paswan , resident of Village- Vishnupur Ghat, Post- Dakshini Kasrour, Thana-Ghanshyampur, District- Darbhanga, a contesting candidate from 79-Gaurabauram Assembly Constituency during General Election to the Legislative Assembly of Bihar 2020, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
