एस॰ ओ॰ 484, दिनांक 5 दिसम्बर 2022—बिहार राज्य तीव्र औद्योगिकीकरण हेतु राज्य के सभी श्रेणी के बॉयलर को वाष्पित्र अधिनियम, 1923 (1923 का 5) के निष्चित प्रावधानों से छुट देना आवष्यक है।
अतः अब वाष्पित्र अधिनियम, 1923 (1923 का 5) की धारा 34 की उपधारा (3) में प्रदत्त शक्तियों का प्रयोग करते हुए राज्य में अधिष्ठापित अथवा भविष्य में अधिष्ठापित होने वाले बॉयलर को अधिनियम की धारा 8 की उपधारा (3) एवं उपधारा (7) के लागू होने के प्रावधानों को निम्न लिखित शर्त्तों के अधीन विमुक्त करती हैः-
(1) किसी दुघर्टना के कारण वाष्पित्र के चलाने पर लगी रोक बॉयलर के वाष्पिकरण अवरूद्ध होने और इसके दबाव उपकरणों अथवा इसके साथ लगे हुए वाष्पित्र पाइप के उपयोग के लिए प्राधिकार हेतु प्रमाण पत्र उस अवधि के लिए नवीकरण, जैसा कि रेगुलेषन में विहित्त हो, प्राप्त करने हेतु दखलकार संबंधित वाष्पित्र निरीक्षक के समक्ष आवेदन करेगा। अन्य मामलों में दखलकार नवीकरण सक्षम व्यक्ति द्वारा किये गये निरीक्षण के उपरान्त उपधारा (3) के प्रावधानों के आलोक में आवेदन करेगा अथवा स्वेच्छा से संबंधित वाष्पित्र निरीक्षक के समक्ष आवेदन करेगा।
(2) अधिनियम, नियमावली एवं इसके अंतर्गत बनाये गये विनियमावली के प्रावधानों के आलोक में बॉयलर अथवा बॉयलर घटकों एवं परिवर्त्तन और जोड़ने के सत्यापन का निरीक्षण वाष्पित्र अधिनियम की धारा 2 की कंडिका (Cb) एवं भारतीय वाष्पित्र विनियमावली, 1950 के 4J के आलोक में सक्षम व्यक्ति द्वारा किया जाएगा। सक्षम व्यक्ति मुख्य निरीक्षक के निदेष का पालन करेगा तथा विनियमावली के प्रतिकूल किसी कृत, भूल, आयोग के लिए उत्तरदायी होगा। (3) बॉयलर का दखलकार, भारतीय वाष्पित्र विनियमावली, 1950 के विनियमन 392 और 392A के तहत, यदि आवश्यक हो, अपने बॉयलर की मरम्मत करेगा, उपयुक्त वर्ग के मरम्मतकर्ता के माध्यम से सक्षम प्राधिकारी द्वारा अपने बॉयलर का निरीक्षण करवाएगा। बायलर की मरम्मत, यदि आवश्यक हो, और बायलर का निरीक्षण भारतीय बायलर विनियमन, 1950 के प्रावधानों के अनुसार किया जाएगा।
(4) बॉयलर की मरम्मत और उसके बाद परीक्षण के लिए उपयोग की जाने वाली सामग्री भारतीय बॉयलर विनियमन, 1950 के तहत निर्धारित तकनीकी विनिर्देशों के अनुसार होगी। बॉयलर की मरम्मत के दौरान वेल्डिंग के लिए तैनात वेल्डर के2 (cid:464)बहार गजट (असाधारण), 5 (cid:465)दस(cid:224)बर 2022 पास उपयुक्त वर्ग का वैध प्रमाण पत्र होगा जैसा कि भारतीय बॉयलर विनियमावली, 1950 के अध्याय XIII में निर्धारित है। बॉयलर के दखलकार द्वारा निरीक्षण, मरम्मत, मरम्मत करने वाले, वेल्डर, सामग्री परीक्षण प्रमाण पत्र, विनाशकारी परीक्षण और गैर विनाशकारी परीक्षण के रिकॉर्ड बनाए रखे जाएंगे और मांग पर बॉयलर निरीक्षणालय को प्रस्तुत किए जाएंगे।
(5) संतोषजनक मरम्मत के यदि अगर किया जाता है; और बॉयलर का निरीक्षण, बॉयलर के दखलकार और सक्षम व्यक्ति द्वारा इस अधिसूचना के साथ संलग्न 'बॉयलर का प्रमाण पत्र' जारी करेंगे, जिसमें यह घोषित किया जाएगा कि बॉयलर निरीक्षण की तारीख से बारह महीने की अवधि के लिए अनुमोदित कार्य दबाव पर संचालित करने के लिए उपयुक्त है। इस योजना को ''बॉयलर का स्व-प्रमाणन'' कहा जाएगा। यह एक वैकल्पिक प्रावधान है।
(6) बायलर का दखलकार निरीक्षण की तारीख से पन्द्रह दिनों के भीतर समय-समय पर यथाविहित बिहार बायलर निरीक्षणालय में नियम या विनियमन के अधीन यथाविहित नवीकरण निरीक्षण शुल्क के चालान के साथ दो प्रतियों में बायलर का स्व-प्रमाण पत्र प्रस्तुत करेगा। प्रमाण पत्र और चालान की प्राप्ति पर बिहार बॉयलर निरीक्षणालय निरीक्षण पुस्तिका के ज्ञापन में प्रमाण पत्र और चालान दर्ज करेगा और फिर पंद्रह दिनों के भीतर, बॉयलर के दखलकार को फिटनेस प्रमाण पत्र के साथ विधिवत रूप से स्वीकार किए गए प्रमाण पत्र की एक प्रति लौटाएगा। बायलर के दखलकार के विवेक पर, प्रक्रिया को ऑफलाइन माध्यम से पूरा किया जा सकता है। इस योजना के तहत बॉयलर के स्व-प्रमाणन की प्रक्रिया बिहार बॉयलर निरीक्षणालय द्वारा पावती के बाद पूर्ण मानी जाएगी।
(7) बॉयलर अधिनियम, 1923 के प्रावधानों और अधिनियम के तहत बनाए गए नियम/नियमों के अनुसार अपने बॉयलर को चालू करने और बनाए रखने के लिए बॉयलर के दखलकार की जिम्मेदारी होगी। वह प्रावधानों के किसी भी उल्लंघन या दुर्घटना के लिए भी जिम्मेदार होगा।
(8) बॉयलर के स्व अभिप्रमाणन योजना के अन्तर्गत मुख्य वाष्पित्र निरीक्षक को आवेदन देने के साथ सुरक्षित जमा राषि निम्नवत् होगी :-
(क) 1000 वर्ग मी॰ वाष्पित्र क्षेत्र हेतु (रेटिंग) - रू॰ 5,000/- (रू॰ पाँच हजार मात्र) (ख) 1000 वर्ग मी॰ से अधिक वाष्पित्र क्षेत्र हेतु (रेटिंग) - रू॰ 20,000/- (रू॰ बीस हजार मात्र) कोई भी बॉयलर धारक कभी भी मुख्य वाष्पित्र निरीक्षक, बिहार को आवेदन देकर उक्त योजना से अलग हो सकता है। उक्त स्थिति में सुरक्षित जमा राषि बगैर किसी ब्याज के आवेदक को वापस होगी। (9) राज्य सरकार कभी भी इस अधिसूचना को परिवर्त्तित अथवा विलोपित कर सकती है।

S.O. 484, dated 5th December 2022—Whereas the State Government is satisfied that for rapid industrialization of Bihar, it is necessary to exclude all class of boilers from certain provisions of Boilers, Act 1923 (No. 5 of 1923);
Now, therefore, in exercise of the powers conferred by subsection (3) of section 34 of Boilers Act, 1923 (No. 5 of 1923), the Government of Bihar hereby exempt all class of boilers, which have been installed in the state or which will be installed in the future, from the operation of sub section (3) and (7) of section 8 of the Act, subject to following conditions, namely:-
(1) A certificate authorizing the use of boiler ceases to be in force due to an accident or steaming off of the boiler and its pressure parts or steam pipes, attached thereto, the owner of the boiler shall apply to the concerned Boiler Inspector for renewal thereof4 (cid:464)बहार गजट (असाधारण), 5 (cid:465)दस(cid:224)बर 2022 for such period as may be prescribed by regulations. In other cases the owner may apply for renewal after inspection by designated competent person as provisioned in sub section (3) of Section 8 or through concerned Boiler Inspector as per his choice.
(2) The inspection of the boiler and the boiler components and verification of alteration and addition as per the provisions of the said Act, Rules and Regulation framed there under, shall be carried out every year by any of the competent person as defined under clause (cb) of Section-2 of the Boiler Act, 1923, recognized from time to time under Regulation 4J of the Indian Boiler Regulation 1950. The competent person shall follow instructions and guidelines of the Chief Inspector and shall be liable and responsible for any Act, omission or commission committed against the regulation framed there under.
(3) The owner of the boiler will carry out repairs, if necessary, of his boiler, under regulation 392 and 392A of Indian Boiler Regulations 1950, through a repairer of appropriate class shall get inspection done of his boiler by competent authority. The repairs, if necessary, of boiler and inspection of boiler shall be carried out as per provisions of Indian Boiler Regulation 1950.
(4) Material to be used for repair of boiler and testing thereafter shall be as per technical specifications prescribed under Indian Boiler Regulations, 1950. Welder deployed for welding during repair of boiler shall possess a valid certificate of appropriate class as prescribed in chapter XIII of Indian Boiler Regulations 1950. Records of inspection, repair, repairer, welder, material test certificates, destructive testing & non destructive testing shall be maintained by the owner of boiler and shall be produced to boiler inspectorate on demand.
(5) After satisfactory repairs; if carried out; and inspection of boiler, the owner of the boiler and the competent persons shall issue 'Certificate of Boiler' as appended with this notification declaring that the boiler is fit to operate at approved working pressure for a period of twelve months from the date of inspection. This scheme shall be called "Self certification of Boiler". It is an optional provision.
(6) The owner of the boiler shall submit Self-Certificate of Boiler in two copies along with Challan of renewal inspection fee as prescribed under rules or regulation, within fifteen days from date of inspection to Bihar Boiler Inspectorate as prescribed from time to time. On receipt of Certificate and Challan the Bihar Boiler Inspectorate shall record certificate & Challan in Memorandum of Inspection book and then return within fifteen days, one copy of Certificate duly acknowledged, along with the Fitness Certificate to the owner of the boiler. At the discretion for the owner of the Boiler, procedure may be completed through off-line means. The process of self- certification of boiler under this scheme shall be deemed to be completed after acknowledgement by Bihar Boiler Inspectorate.
(7) It will be responsibility of the owner of the boiler to turn & maintain his boiler as per provisions of Boilers Act – 1923 and regulations/rules framed under the Act. He will also be responsible for any violation of the provisions or accident.
(8) The security amount for opting for this scheme of "Self certification of Boiler" after applying to the Chief Inspector of Boilers of Bihar along with the Challan of security deposit as under:-
(a) For boiler up to 1000 sqm heating area (rating): RS. 5000/-
(b) For boiler exceeding 1000 sqm heating surface area (rating): RS. 20000/-5 (cid:464)बहार गजट (असाधारण), 5 (cid:465)दस(cid:224)बर 2022 Any owner of boiler may, at any time, withdraw from the scheme by applying to Chief Inspector of Boilers of Bihar. Security amount shall be refunded to owner of boiler. No interest shall be payable on the security deposit.
(9) The Government may, at any time, modify or withdraw this notification.
