संं॰ जी0पी0एफ0-01-315/2022-1327/वि0—भारत के संविधान के अनुच्छेद-309 के परंतुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल एतद् द्वारा बिहार सामान्य भविष्य निधि नियमावली, 1948 में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-
1. संक्षिप्त नाम, विस्तार एवं आरंभ-
(1) यह नियमावली बिहार सामान्य भविष्य निधि (संशोधन) नियमावली, 2022 कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (3) यह राजपत्र में प्रकाशन की तिथि से प्रवृत होगी ।
2. बिहार सामान्य भविष्य निधि नियमावली के नियम 11 के उपनियम(1) के खंड (ख) के पश्चात निम्नलिखित परंतुक को स्थापित किया जाएगा :-
''परन्तु किसी वित्तीय वर्ष के दौरान मासिक अंशदान की राशि अथवा अंशदान की बकाया राशि का कुल योग आयकर नियमावली, 1962 के नियम 9(घ) के उपनियम (2) के नीचे दिये गये स्पष्टीकरण के खंड ग(1) में दी गयी सीमा से अधिक नहीं होगा ।'' 2 (cid:466)बहार गजट (असाधारण), 26 (cid:465)दस(cid:224)बर 2022 2. वित्तीय वर्ष 2022-23 में उपर्युक्त सीमा के अनुपालन हेतु वैसे मामलों में जहाँ मासिक अंशदान की राशि उपर्युक्त सीमा को पार कर गयी है अथवा उसके समीप है; मूल वेतन के न्यूनतम छः प्रतिशत अंशदान संबंधी प्रावधान को क्षांत करते हुए मासिक अंशदान को रोका अथवा कम किया जा सकेगा ।

FINANCE DEPARTMENT ——— NOTIFICATION The 26th December 2022 No-GPF-01-315/2022-1327/F.—In exercise of the powers conferred under the Proviso of Article-309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following Rules to amend the Bihar General provident fund Rules, 1948 :- 1. Short title, extent and commencement.—
(i) These Rules may be called the Bihar General provident fund (Amendment) Rules, 2022.
(ii) It shall extend to the whole of the State of Bihar. (iii) It shall come into force from the date of its Publication in Official Gazette.
2. The following proviso shall be inserted after clause (b) of sub Rule(1) of rule 11of Bihar General provident fund Rules, 1948 :-
"Provided that the sum of the monthly subscriptions during a financial year together with the amount of arrears shall not exceed the threshold limit referred to in Sub-clause (i) of clause (c) of the explanation below sub-rule (ii) of rule 9(D) of the income tax Rules, 1962"
Note 1. As per Sub-clause (i) of clause (c) of the explanation below sub-rule (ii) of rule 9(D) of the income tax Rules, 1962 w.e.f. financial year 2022-23 threshold limit of Rs. 5(five) Lakh has been imposed on GPF subscriptions during a financial year.
2. For the financial year 2022-23 relaxing the provision of minimum monthly subscription of six percent of the emoluments; in such cases where GPF subscription has already exceeded the threshold limit or likely to reach that limit, monthly subscription shall be stopped or reduced for compliance of the above threshold limit.
