सं॰ 11/मा0आ0(स्था॰)-03/2015-178(11)—भारत संविधान के अनुच्छेद -309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार राज्यपाल, ''बिहार राज्य मानसिक स्वास्थ्य एवं सहबद्ध विज्ञान संस्थान नियमावली, 2005'' में संशोधन करने हेतु निम्नलिखित नियमावली बनाते है :-
1.
(1) यह नियमावली ''बिहार राज्य मानसिक स्वास्थ्य एवं सहबद्ध विज्ञान संस्थान (संशोधन) नियमावली, 2023'' कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र मेे प्रकाशन की तिथि से प्रवृत होगी।
2.
1 उक्त नियमावली के नियम 4 के खण्ड (1) को निम्नलिखित द्वारा प्रतिस्थापित किया
जाएगाः-
''4. -(1) राज्य मानसिक स्वास्थ्य एवं सहबद्ध विज्ञान संस्थान एक स्वशासी संस्थान होगा और इसका प्रबंधन प्रबंधसमिति में निहित होगा, जो निम्नलिखित को मिलाकर गठित होगी :-
| (i) | माननीय मंत्री, स्वास्थ्य विभाग, बिहार, पटना | - | अध्यक्ष |
| (ii) | अपर मुख्य सचिव/प्रधान सचिव/सचिव, स्वास्थ्य विभाग, बिहार सरकार | - | उपाध्यक्ष |
| (iii) | अपर मुख्य सचिव/प्रधान सचिव, विा विभाग, बिहार सरकार या उनके द्वारा नामित पदाधिकारी जो संयुक्त सचिव स्तर से अन्यून नहीं होगें | - | सदस्य |
| (iv) | अपर मुख्य सचिव/प्रधान सचिव, गृह विभाग, बिहार सरकार या उनके द्वारा नामित पदाधिकारी जो संयुक्त सचिव स्तर से अन्यून नहीं होगें | - | सदस्य |
| (v) | अपर मुख्य सचिव/प्रधान सचिव, समाज कल्याण विभाग, बिहार सरकार या उनके द्वारा नामित पदाधिकारी जो संयुक्त सचिव स्तर से अन्यून नहीं होगें | - | सदस्य |
| (vi) | प्रमंडलीय आयुक्त, पटना | - | सदस्य |
| (vii) | कार्यपालक निदेशक, राज्य स्वास्थ्य समिति, बिहार | - | सदस्य |

| (ix) | जिला पदाधिकारी, भोजपुर | - | सदस्य |
| (x) | जिला पुलिस अधीक्षक, भोजपुर | - | सदस्य |
| (xi) | चार गैर सरकारी व्यक्ति (जिसमें कम से कम एक महिला होगी) | - | सदस्य |
| (xii) | निदेशक, राज्य मानसिक स्वास्थ्य एवं सहबद्ध विज्ञान संस्थान, कोईलवर | - | सदस्य सचिव |
गैर सरकारी सदस्य जिन्हें नियम-4 (1) (xi) के तहत नामित किया जाना है, में से एक सदस्य ऐसा होना चाहिए जिनके पास मानसिक स्वास्थ्य के क्षेत्र में 5 वर्ष का अनुभव हो। अन्य तीन सदस्यों को लोक स्वास्थ्य/ सामाजिक कार्य/मानसिक चिकित्सा क्षेत्र में कांउसलिंग का कम से कम पाँच (5) वर्षों को अनुभव होना चाहिए। ———

सं॰ 11/मा0आ0(स्था॰)-03/2015-179(11)/अधिसूचना संख्या 178(11) दिनांक 27 फरवरी 2023 का निम्नलिखित अँग्रेजी अनुवाद, बिहार राज्यपाल के प्राधिकार से, एतदद्वारा प्रकाशित किया जाता है जो भारत का संविधान के अनुच्छेद-348 के खंड (3) के अंतर्गत अँग्रेजी भाषा में अंकित अधिसूचना का प्राधि—त पाठ समझा जायेगा। ——— The 27th February 2023
No. 11/मा0आ0(स्था॰)-03/2015-178(11)—In exercise of powers conferred by proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make following Rules to amend the Bihar State Institute of Mental Health and Allied Sciences Rules, 2005:-
1. Short title, extent & commencement.—
(1) These Rules may be called as the "Bihar State Institute of Mental Health and Allied Sciences (Amendment) Rules, 2023."
(2) In shall extent to the whole of the state of Bihar.
(3) It shall come into force from effect from the date of as publication in official gazette.
2. Subsitution of clause (1) Rule-4 of the Bihar State Institute of Mental Health and Allied Sciences Rules, 2005,.- Clause (1) of Rule-4 of the said Rules shall be substituted by the following:-
3 (cid:464)बहार गजट (असाधारण), 27 फरवर(cid:547) 2023"4. Management Committee:- (1) The State Institute of Mental Health and Allied Sciences shall be an autonomous institution and its management shall be vested in a Management Committee which shall be constituted consisting of the following:-

| (iv) | Additional Chief Secretary/Principal Secretary, Home Department, Government of Bihar or his nominee not below the rank of joint Secretary | - | Member |
| (v) | Additional Chief Secretary/Principal Secretary, Social Welfare Department, Government of Bihar or his nominee not below the rank of joint Secretary | - | Member |
| (vi) | Divisional Commissioner, Patna | - | Member |
| (vii) | Executive Director, State Health Society, Bihar | - | Member |
| (viii) | Managing Director, Bihar Medical Services and Infrastructure Corporation | - | Member |
| (ix) | District Magistrate, Bhojpur | - | Member |
| (x) | District Superintendent of Police, Bhojpur | - | Member |
| (xi) | Four non Official Persons (at least one woman) | - | Member |

Provided that such non official persons shall be nominated under Rule 4 (1)(xi), one member should have experience of atleast 5years in Mental Health field. Other members should have experience of atleast 5 year in Public Health/Social Work/Counselling in Mental Health field. By the order of the Governor of Bihar, (Sd)-Elligble, Secretary of Goverment.
