-4319/सा॰प्र॰— भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, राज्य के उत्कृष्ट खिलाड़ियों की सीधी नियुक्ति हेतु निम्नलिखित नियमावली बनाते हैं :-

(i) यह नियमावली ''बिहार उत्कृष्ट खिलाड़ियों की सीधी नियुक्ति नियमावली, 2023'' कही जा सकेगी। (ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगी। इस नियमावली में जब तक किसी संदर्भ में अन्यथा अपेक्षित न हो :-

(i) से अभिपे्रत है ''बिहार उत्कृष्ट खिलाड़ियों की सीधी नियुक्ति नियमावली, 2023'' । (ii) से अभिपे्रत है बिहार सरकार। (iii) से अभिपे्रत है वित्तीय वर्ष अर्थात्‌ पहली अप्रैल से अगले वर्ष के 31 मार्च तक। (iv) से अभिपे्रत है संबंधित सेवा/संवर्ग नियमावली में परिभाषित नियुक्ति प्राधिकार। (v) से अभिपे्रत है बिहार राज्य के वैसे खिलाड़ी जो बिहार राज्य के मूल निवासी हों, जिन्होंने भारत वर्ष की ओर से अन्तर्राष्ट्रीय प्रतिस्पर्धाओं में पदक प्राप्त किया हो/सहभागिता की हो/किसी राज्य की ओर से राष्ट्रीय प्रतिस्पर्धाओं में पदक प्राप्त किया हो।

(vi) '' से अभिपे्रत है वैसी स्पर्धा, जिसमें व्यक्तिगत प्रदर्शन से उपलब्धि प्राप्त की गयी हो।

(vii) से अभिपे्रत है वैसी स्पर्धा, जिसमें एक से अधिक खिलाड़ियों द्वारा एक दल के रूप में खेलते हुये उपलब्धि प्राप्त की गयी हो।

(viii)

से अभिप्रेत है बिहार राज्य के मूल निवासी जो भारत देश का प्रतिनिधित्व अंतर्राष्ट्रीय प्रतिस्पर्धाओं में करने वाले खिलाड़ी हैं।2 (cid:464)बहार गजट (असाधारण), 3 माच(cid:91) 2023 (क) इस नियमावली के अंतर्गत निम्नांकित अर्हता प्राप्त खिलाड़ी राज्य सरकार की सेवा में उत्कृष्ट खिलाड़ी की श्रेणी में नियुक्ति के पात्र होंगेः-

(i) जो बिहार राज्य के मूल निवासी हों। (ii)

के लिये निर्धारित पे-बैंड/स्केल एवं वेतन स्तर तथा

दिव्यांग* खिलाड़ियों के लिये भी उपरोक्त अर्हता प्रभावी होगी। *Para sports/deaf/cerebral palsy /autism

किसी भी आमंत्रण/मेमोरियल/गैरआधिकारिक चैम्पियनशीप/प्रतिस्पर्धा को मान्यता नहीं दी

जायेगी। (ख) इस नियमावली के अन्तंर्गत सीधी भर्ती के लिए निर्धारित न्यूनतम खेल अर्हता के आधार पर जिस श्रेणी में सभी प्रक्रियाओं का पालन करते हुए उत्कृष्ट खिलाड़ी की नियुक्ति होती है, वे यदि भविष्य मेंं अपने प्रदर्शन में सुधार कर उच्च श्रेणी के लिए निर्धारित न्यूनतम अर्हता को प्राप्त कर लेते है, तो3 (cid:464)बहार गजट (असाधारण), 3 माच(cid:91) 2023 उन्हें स्वतः उस श्रेणी के लिए योग्य मानते हुए उस रिक्त पद के विरूद्ध सीधी नियुक्ति की जायेगी। परंतु इस तरह की नियुक्ति किये जाने की स्थिति में पूर्व सेवा की गणना की जायेगी तथा कर्मी की सेवा में टूट नहीं माना जायेगा। न्यूनतम शैक्षणिक अर्हता जो समूह-ख के पदों पर नियुक्ति हेतु स्नातक अथवा समकक्ष, समूह-ग के लिपिकीय संवर्ग के निम्नवर्गीय लिपिकीय पदों पर नियुक्ति हेतु इंटरमीडिएट अथवा समकक्ष एवं कार्यालय परिचारी के पदों पर नियुक्ति हेतु मैट्रिक अथवा इसके समकक्ष स्तर की शैक्षणिक योग्यता धारण करते हों। सीधी भर्ती हेतु राज्य सरकार की अनुमति से उपर्युक्त नियम-3(क) (ii) के खिलाड़ी यदि शैक्षणिक योग्यता धारण नहीं करते/करती हों वैसे खिलाड़ियों को नियुक्ति की तिथि से पांच वर्ष के अंदर उस पद हेतु निर्धारित शैक्षणिक अर्हता को प्राप्त करना अनिवार्य होगा अन्यथा यह कि नियुक्त किया गया व्यक्ति संबंधित सेवा में पदोन्नति हेतु विचार किये जाने के लिये तब तक पात्र नहीं होगा/होगी जब तक कि वह विहित शैक्षणिक अर्हता धारण नहीं कर लेता/लेती है। इस नियमावली के अन्तर्गत खेल विधाओं के अलावा किसी भी खिलाड़ी द्वारा मान्यता प्राप्त अंतर्राष्ट्रीय खेल प्रतिस्पर्धा में पदक प्राप्त करने की स्थिति में उस खेल विधा में भी नियुक्ति पर विचार किया जायेगा। इस हेतु सामान्य प्रशासन विभाग में अपर मुख्य सचिव/प्रधान सचिव/सचिव, सामान्य प्रशासन विभाग, बिहार, पटना की अध्यक्षता में गठित खेल विधा समिति द्वारा अनुशंसा की जायेगी। समिति के सदस्य निम्नवत्‌ होंगे :- (I) अपर मुख्य सचिव/प्रधान सचिव/सचिव,

कला, संस्कृति एवं युवा विभाग ः- सदस्य (II) महानिदेषक, बिहार राज्य खेल प्राधिकरण ः- सदस्य (III) भारतीय खेल प्राधिकरण के खेल विषेषज्ञ ः- सदस्य (IV) निदेशक, बिहार राज्य खेल प्राधिकरण ः- सदस्य (i) चयनित खेल विधा में उत्कृष्ट खिलाड़ियों की नियुक्ति असैनिक संवर्ग में सीधी भर्ती हेतु (प्रोन्नति हेतु आरक्षित पदों को छोड़कर) उपलब्ध मूल कोटि के कुल बल के 10 प्रतिशत के अंतर्गत होगी। सिपाही संवर्ग एवं पुलिस अवर निरीक्षक संवर्ग में सीधी नियुक्ति हेतु आगामी प्रत्येक रिक्त पदों में एक प्रतिशत पद खिलाड़ियों के लिए खेल कोटा के रूप में आरक्षित रहेगा। पुलिस उपाधीक्षक के लिये स्वीकृत बल का दस प्रतिशत पद आरक्षित रहेगा।

(ii) चयनित खिलाड़ी आरक्षण की दृष्टि से जिस कोटि से संबंधित होंगे, उनकी गिनती उसी आरक्षण कोटि में की जायेगी, अर्थात्‌ आरक्षित कोटि के चयनित खिलाड़ियों की गणना संगत आरक्षित कोटि के विरुद्ध तथा गैर आरक्षित वर्ग के खिलाड़ियों की गणना गैर आरक्षित वर्ग में की जायेगी।

(iii) चयनित खेल विद्याओं में प्राप्त उपलब्धि के आधार पर समूह-'ख' तथा समूह 'ग' के पदों पर नियुक्ति की जायेगी।

(iv) सामान्य प्रशासन विभाग के द्वारा सभी विभागों/कार्यालयों से प्रत्येक वर्ष 01 अप्रैल से अगले वर्ष 31 मार्च तक नियम-3(क)(ii) के पदों हेतु रिक्तियाँ प्राप्त किया जायेगा।

(v) बिहार के निवासी किसी अन्य राज्य में या भारत सरकार या भारत सरकार के किसी संगठन एवं सार्वजनिक क्षेत्र के उपक्रम में कार्यरत खिलाड़ी खेल के निर्धारित अर्हता को प्राप्त करते हैं तो वे भी आवेदन देने के पात्र होंगे तथा इस तरह की नियुक्ति किये जाने की स्थिति में पूर्व सेवा की गणना की जायेगी एवं कर्मी की सेवा में टूट नहीं माना जायेगा। पूर्व का वेतन स्तर कायम रहेगा।

(vi) ट्रायल के आधार पर भर्ती के लिए खेल विधावार ट्रायल, ट्रायल समिति द्वारा आयोजित किया जाएगा। ट्रायल समिति के अध्यक्ष/सदस्य निम्नलिखित होेंगे :-

(क) महानिदेशक, बिहार राज्य खेल प्राधिकरण - अध्यक्ष (ख) निदेशक, कला, संस्कृति एवं युवा विभाग - सदस्य (ग) निदेशक-सह-सचिव, बिहार राज्य खेल प्राधिकरण - संयोजक (घ) बिहार राज्य प्राधिकरण द्वारा मनोनित राष्ट्रीय स्तर के खेल सलाहकार - सदस्य (खेल विधा के अनुसार) (ड.) जिला खेल पदाधिकारी

- सदस्य (i) नियम-3 (ii) के क्रम संख्या (i) से (iv(क)) के पदों के लिये पदक विजेता/सहभागिता प्राप्त करने वाले खिलाड़ियों से आवेदन प्रपत्र में प्राप्त कर, आवेदनों की स्क्रूटिनी कर सीधे तौर पर महानिदेशक, बिहार राज्य खेल प्राधिकरण के अनुशंसा पर सीधी भर्ती प्रक्रिया के अतंर्गत ऐसे खिलाड़ियों की नियुक्ति गठित चयन समिति के अनुमोदन से किया जायेगा।4 (cid:464)बहार गजट (असाधारण), 3 माच(cid:91) 2023 (ii) उत्कृष्ट खिलाड़ियों के चयन हेतु राज्य सरकार द्वारा गठित चयन समिति के निम्नांकित

(iii) किसी एक खेल विधा में (अपवाद एथलेटिक्स), एक वर्ष में पाँच से अधिक उत्कृष्ट खिलाड़ियों की नियुक्ति नहीं की जायेगी। दल द्वारा उत्कृष्ट प्रदर्शन करने पर अधिकतम 5 खिलाड़ियों की नियुक्ति की शर्त्त को विशेष परिस्थिति में शिथिल किया जाएगा।

(iv) टीम आयोजनों में, यदि अपेक्षित योग्यता रखने वाले सभी टीम सदस्य नियुक्ति के लिए अपना आवेदन प्रस्तुत करते हैं, तो चयन समिति भर्ती के लिए ऐसे सभी व्यक्तियों पर विचार करेगी। इस मामले में खिलाड़ी/प्रति खेल/प्रति वर्ष की संख्या पर कोई बंधेज नहीं होगी।

(v) दिव्यांग खिलाड़ियों के लिए आयोजित मान्यता प्राप्त सभी खेल विधाओं को एक ही खेल विधा मानते हुए नियुक्ति के लिए समेकित रूप से विचार किया जायेगा एवं राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समय-समय पर दिव्यांग खिलाड़ियों के लिए निर्धारित कोटा के अनुसार अनुमान्य रिक्त पदों पर उत्कृष्ट दिव्यांग खिलाड़ियों की नियुक्ति की जायेगी। दिव्यांग खिलाड़ियों की नियुक्ति पुलिस सम्वर्ग में नहीं होगी।

(vi) 1. उत्कृष्ट खिलाड़ियों की नियुक्ति हेतु, खेल उपलब्धियाँ तत्काल पिछले 2 वर्षों के अंदर की होनी चाहिये अर्थात्‌ नियुक्ति के वित्तीय वर्ष एवं उससे पहले के दो वित्तीय वर्ष के बीच का होना चाहिये।

2. पदक धारक, पदक जीतने की तिथि से अधिकतम तीन वर्ष के भीतर बिहार राज्य खेल प्राधिकरण के समक्ष आवेदन कर सकते हैं।

(vii) दो या दो से अधिक खिलाड़ियों के द्वारा धारित योग्यता/अंक समान रहने की स्थिति में चयन हेतु निम्नांकित प्राथमिकता/विधि अपनाई जायेगी :- (क) राष्ट्रीय/अन्तर्राष्ट्रीय स्तर पर नये कीर्तिमान बनाने की स्थिति में संबंधित खिलाड़ी को प्राथमिकता दी जायेगी।

(ख) नियम-08(क) में उल्लिखित क्रम में उच्चस्तरीय प्रतिस्पर्धा की उपलब्धि को प्राथमिकता दी जायेगी। (ग) व्यक्तिगत उपलब्धि दलीय उपलब्धि से बड़ी मानी जायेगी। (घ) प्रभावी वर्ष में प्राप्त उपलब्धि को प्राथमिकता दी जायेगी। (ङ) यदि नियम-7(vi)(क), (ख), (ग), (घ) एवं (ड.) द्वारा अपनायी गयी प्रक्रिया के बावजूद दो या दो से अधिक खिलाड़ियों के द्वारा धारित योग्यता/अंक समान आता है तो जिनका उम्र अधिक होगा उनका चयन पहले किया जायेगा।

(viii) दलीय प्रतिस्पर्धा में अर्हता प्राप्त दल के सभी सदस्यों के द्वारा नियुक्ति हेतु आवेदन दिये जाने की स्थिति में उपर्युक्त नियम-7(vi) में वर्णित शर्त्तों के अनुसार चयन की प्रक्रिया अपनायी जायेगी। (ix) बिहार राज्य खेल प्राधिकरण द्वारा तैयार औपबंधिक मेधा सूची प्रारूप सामान्य प्रशासन विभाग के माध्यम से चयन समिति के समक्ष रखा जायेगा। चयन समिति द्वारा औपबंधिक मेधा सूची के अनुमोदनोपरांत बिहार राज्य खेल प्राधिकरण बिहार, पटना द्वारा अभ्यर्थियों द्वारा समर्पित खेल प्रमाण पत्रों का सत्यापन संबंधित राष्ट्रीय खेल महासंघों से कराया जायेगा। सत्यापन प्रतिवेदन प्राप्त होने पर यदि औपबंधिक मेधा सूची में संशोधन की आवश्यकता नहीं होगी तो उसे सामान्य प्रशासन विभाग द्वारा तदनुरूप प्रकाशित किया जायेगा, परन्तु यदि औपबंधिक मेधा सूची में संशोधन की आवश्यकता होगी, तब चयन समिति द्वारा औपबंधिक मेधा सूची को तदनुरूप संशोधित किया जाएगा एवं संशोधित औपबंधिक मेधा सूची का प्रकाशन सामान्य प्रशासन विभाग के वेबसाइट पर किया जायेगा।

(क) औपबंधिक मेधा सूची के प्रकाशन की तिथि से पन्द्रह दिनों के अंदर किसी प्रकार की

दावा/आपत्ति बिहार राज्य खेल प्राधिकरण को समर्पित की जा सकेगी।

(ख) प्राप्त दावा/आपत्तियों की जाँच कर बिहार राज्य खेल प्राधिकरण अपना जाँच प्रतिवेदन चयन समिति को प्रस्तुत करेगी एवं चयन समिति उक्त प्रतिवेदन के आधार पर दावा/आपत्ति का निराकरण कर प्रत्येक कोटि एवं पद के लिए अंतिम मेधा सूची जारी करेगी। अंतिम मेधा सूची अधिकतम पाँच खिलाड़ियों की तैयार की जाएगी। अंतिम मेधा सूची का प्रकाशन सामान्य प्रशासन विभाग की वेबसाइट पर किया जायेगा। सामान्य प्रशासन विभाग द्वारा रिक्तियों की अधियाचना के आधार पर अंतिम मेधा सूची में अंकित उत्कृष्ट खिलाड़ियों की अनुशंसा संबंधित नियुक्ति प्राधिकारों को भेजी जायेगी। अंतिम मेधा सूची की वैधता इसके प्रकाशन की तिथि से केवल एक वर्ष तक होगी।

किसी खिलाड़ी द्वारा योगदान नहीं देने पर उक्त रिक्ति आगामी नियुक्ति

प्रक्रिया में शामिल कर ली जाएगी। कोई प्रतीक्षा सूची संधारित नहीं होगी। खिलाड़ियों की वरीयता निम्न प्रकार से निर्धारित होगी। 1. ऑलम्पिक गेम्स के स्वर्ण पदक विजेता। 2. ऑलम्पिक गेम्स के रजत पदक विजेता। 3. ऑलम्पिक गेम्स के कांस्य पदक विजेता। 4. ऑलम्पिक गेम्स में सहभागिता। 5. एषियन गेम्स के स्वर्ण पदक विजेता 6. कॉमनवेल्थ गेम्स के स्वर्ण पदक विजेता 7. एषियन गेम्स के रजत पदक विजेता 8. कॉमनवेल्थ गेम्स के रजत पदक विजेता 9. एषियन गेम्स के कांस्य पदक विजेता 10. कॉमनवेल्थ गेम्स के कांस्य पदक विजेता 11. एषियन गेम्स में सहभागिता। 12. कॉमनवेल्थ गेम्स में सहभागिता। 13. सीनियर नेषनल गेम्स में स्वर्ण पदक विजेता 14. सीनियर नेषनल गेम्स में रजत पदक विजेता 15. सीनियर नेषनल गेम्स में कांस्य पदक विजेता 16. सीनियर नेषनल चैम्पियनषिप में स्वर्ण पदक विजेता 17. सीनियर नेषनल चैम्पियनषिप में रजत पदक विजेता 18. सीनियर नेषनल चैम्पियनषिप में कांस्य पदक विजेता 19. जूनियर नेषनल चैम्पियनषिप स्वर्ण पदक विजेता 20. जूनियर नेषनल चैम्पियनषिप रजत पदक विजेता 21. जूनियर नेषनल चैम्पियनषिप कांस्य पदक विजेता

(ख) किसी पंचांग (कैलेण्डर) वर्ष में, किसी संवर्ग में प्रोन्नति एवं सीधी भर्त्ती से नियुक्त कर्मी मेधावी खिलाड़ियों से वरीय होंगे परंतु अनुकंपा के आधार पर नियुक्त कर्मी मेधावी खिलाड़ी से कनीय होंगे। उत्कृष्ट खिलाड़ियों की नियुक्ति हेतु न्यूनतम उम्र 18 वर्ष होगी। अधिकतम उम्र की सीमा नहीं होगी। (i) इस नियमावली के प्रावधानों के आलोक में नियुक्त उत्कृष्ट खिलाड़ियों पर बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 (समय-समय पर यथासंशोधित) तथा बिहार खिलाड़ी सरकारी सेवक (सेवा शर्त्त) नियमावली, 2015 लागू होगी।

(ii) खेल कोटा के अधीन नियुक्ति इसी शर्त्त पर की जायेगी कि नियुक्त सभी उम्मीदवार नियुक्ति की तिथि से 05 वर्षों तक सक्रिय खिलाड़ी के रूप में प्रतिस्पर्धाओं में शामिल होंगे एवं इस प्रयोजनार्थ एक बंधपत्र (Bond) अनिवार्य रूप से देंगे। बंधपत्र (Bond) के शर्त्तों को पूरा करने में विफल रहने वाले खिलाड़ियों की सेवा संपुष्टि नहीं की जायेगी। इस नियमावली के किसी नियम उपबंध को लागू करने में कठिनाई होने पर अथवा चयन प्रक्रिया, ट्रायल, अर्हता तथा अन्य मामलों के संबंध में जिनका इस नियमावली में स्पष्ट उपबंध नहीं किया गया है, उन्हें लागू किये जाने हेतु विनियमावली बनाई जायेगी।

किसी अन्य नियमावली में इस नियमावली के प्रतिकूल किसी बात के होने पर भी इस नियमावली के प्रावधानों का अविभावी प्रभाव होगा।6 (cid:464)बहार गजट (असाधारण), 3 माच(cid:91) 2023 इस नियमावली के किसी उपबन्धों के कार्यान्वयन में होने वाली कठिनाईयों के निराकरण के लिये समय-समय पर सरकार यथावश्यक सामान्य या विशेष निर्देश जारी कर सकेगी तथा प्रवृत्त नियमावली में संशोधन कर सकेगी। तत्कालीन कार्मिक एवं प्रशासनिक सुधार विभाग के पत्रांक-3792 दिनांक 14.03.1973 संकल्प संख्या-1086 दिनांक 20.01.1979 एवं बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली-2009 (वर्ष-2012 तक यथासंशोधित) में उत्कृष्ट खिलाड़ी की नियुक्ति से संबंधित सभी अनुदेश, बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली-2014 में उत्कृष्ट खिलाड़ी की नियुक्ति से संबंधित सभी अनुदेश, बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति (संशोधन) नियमावली-2020 एवं गृह विभाग द्वारा अधिसूचित बिहार पुलिस खेल-कूद नीति, 2013 में उत्कृष्ट खिलाड़ी की नियुक्ति से संबंधित सभी अनुदेश निरसित समझे जायेंगे। ऐसा निरसन के होते हुये भी उपर्युक्त परिपत्र/संकल्प/नियमावली के अधीन इस नियमावली के लागू होने के पूर्व की गई कार्रवाई या किये गये किसी कार्य पर कोई प्रतिकूल प्रभाव नहीं पडे़गा।7 (cid:464)बहार गजट (असाधारण), 3 माच(cid:91) 2023 आवेदन संख्या. .................

No. 26/Ni.Ni.-19-02/2021 GAD/4319—In exercise of the powers conferred by the proviso to Article 309 of Constitution of India, the Governor of Bihar hereby makes the following rules for direct appointment of outstanding sportspersons :-

1. Short title, extent and commencement.:-

(i) These Rules may be called as "The Bihar Outstanding Sportspersons Direct Appointment Rules, 2023." (ii) It shall extend to the whole State of Bihar. (iii) It shall come into force from the date of its publication in the official gazette.

2. Definitions. :- In these rules, unless the context otherwise requires:-

(i) 'Rules' means "The Bihar Outstanding Sportsperson Direct Appointment Rules, 2023."

(ii) 'Government' means, the Government of Bihar. (iii) 'Year' means the financial year i.e. from 1st April to 31st March of next year.

(iv) 'Appointing authority' means Appointing authority as defined in the concerned service/cadre Rules ;

(v) 'Outstanding Sportsperson' means such Sportsperson who is native of the State of Bihar and have won medal/participated in international competitions on behalf of India/ have won medal in national competitions representing any of the state.

(vi) 'Individual event' means such events in which the achievement is by the individual's effort.

(vii) 'Team event' means, such events in which achievement done by two or more than twoindividuals as a team.

(viii) 'Representation of India' means the permanent resident of the Bihar State representing Indiaas Sportsperson in international competition.

3. (a) Qualifications.— Under these rules, the Sportspersons having the following qualifications shall be suitable for appointment in the category of outstanding Sportspersonunder the service of the State Government, who

(i) is the permanent resident of State of Bihar (ii) Pay band/scale and pay level and minimum sports achievement qualification fixed for direct appointment of medal winner :-

Note :- 1. The aforesaid qualifications would also be effective in the matter of the differently abled * sportsperson.

* Para sports/deaf/cerebral palsy /autism

2. Invitation/memorial/non official championships/competitions shall not be recognized for recruitment purposes.

(b). If any outstanding Sportsperson appointed under these rules, attains minimum eligibility criteria required for higher grade by improving his or her performance in future, he/she shall be automatically deemed to be fit for the next higher grade as per his performance level and he/she shall be appointed (Out of turn) in that particular next higher grade directly against the vacant post.

In case of out of turn appointment, the previous service of such sportsperson will also be counted in continuity with his new service.

4. Minimum educational qualification— The minimum academic qualification for appointment to the Group 'B' post, would be graduate or equivalent, and for Group 'C' posts, for appointment to the post of lower Division Clerk (Clerical cadre), Intermediate or equivalent and for appointment to the post of Office Attendant, Matric or equivalent to it. Provided the sportsperson appointed directly, do not have required academic qualification under aforesaid rule 3(a)(ii) he/she, would be mandatorily required to obtain required academic qualification for the said post within five years from the date of his/ her appointment. They would not be eligible for promotion in concerned service/cadre untill they obtain the required academic qualification.

5. Any other sports discipline. .—Under these rules, if any of the sportsperson gets a medal in an affiliated/recognized (Indian Olympic Association) international sports competition, such Sportsperson will also be considered for appointment.

For this purpose, recommendation of a sports discipline committee, constituted in the General Administration Department (GAD) under the Chairmanship of Additional Chief Secretary/ Principal Secretary/ Secretary, GAD, will be required. The following would be the members of the Committee :-

(i) Additional Chief Secretary/ Principal Secretary/ Secretary

Art, Culture and Youth Department- Member

(ii) Director General, Bihar State Sports Authority-Member (iii) Sports specialist of Indian Sports Authority-Member (iv) Director, Bihar State Sports Authority-Member

6. Selection procedure.—

(i) The appointment of outstanding Sportsperson would be done in the selected sports discipline as direct appointment in civil cadre under 10% of total strength of basic cadre [except reserved posts for promotion]

For constable cadre and police sub inspector cadre, a quota of 01% post would be reserved for direct appointment of the sportsperson in every subsequent transaction and for Deputy Superintendent of Police, 10% of sanctioned post would be reserved.

(ii) The sportspersons recruited under these rules will be adjusted in reserved/unreserved category according to the reservation rules of the state. for example: If the sportsperson so recruited belongs to any of the reserved category he/she shall be adjusted under reserved category. Similarly if the sportsperson so recruited belongs to unreserved12 (cid:464)बहार गजट (असाधारण), 3 माच(cid:91) 2023 (General) category he or she shall be adjusted under unreserved (General) category.

(iii) The appointment would be made to the posts of Group 'B' and 'C' on the basis of achievement in respective sports discipline.

(iv) The General Administration Department will collect vacancies between 1st April to 31st March of every year for the posts mentioned in Rule 3(a)(ii) from all departments/offices.

(v) The sportspersons who are native/permanent resident of Bihar and are employed in any public sector or in any other state government/ Government of India are also eligible to submit application if they fulfil required qualification/criteria and service of such appointed persons will be treated as continuous from their previous service and it will not be treated as break in service.

(vi) Trial .— For appointment on the basis of trial, Trial committee will convene sports discipline wise trial. The following would be chairman/members of trial committee :- a. Director General, Bihar State Sports Authority-Chairman b. Director, Art, Culture and Youth Department-Member c. Director-cum-Secretary, Bihar State Sports Authority-

Convenor

d. Any nationally reputed Sports consultant (as per the sport)

nominated by Bihar State Sports Authority- Member e. District Sports Officer- Member

7. Special procedure for medal winner.—

(i) The application form of the sportsperson who have won medal/participants applied for the posts Sl. No. (i) to (iv) (a) of rule 3(a)(ii) shall be received, scrutinized and shall be recommended by Director General, Bihar State Sports Authority under direct recruitment process. Based on the recommendation they would be recruited after the approval of constituted selection committee.

(ii) For selection of outstanding sportsperson, the following shall be the chairman and members of the selection committee constituted by the State Government :-

(a) Additional Chief Secretary/Principal Secretary/ Secretary,

General AdministrationDepartment- Chairman

(b) Additional Chief Secretary/ Principal Secretary/ Secretary,

Art, Culture and Youth Department - Member

(c) Director General, Bihar State Sports Authority-Member (d) An officer not below the rank of Deputy Secretary belonging to Scheduled Caste/Scheduled Tribe nominated by

the General Administration Department-Member

(e) Any nationally reputed Sports consultant (as per the sport)

nominated by Bihar State Sports Authority -Member

(iii) Except Athletics, in any other individual event, not more than five outstanding sportspersons would be appointed in a year.

(iv) In team events, if all the team members having requisite qualifications submit their applications for appointment, the selection committee shall consider all such persons for recruitment. In such, case there will not be any bar on number of players/per game/per year.

(v) For appointment of differently abled sportspersons, all the sports and games included in Para Olympics, Deaf Olympics, Cerebral Palsy/Autism games shall be treated as one sport discipline. They would be appointed against vacant posts as per their quota fixed time to time by the GAD of the State Government. As a rule, differently abled outstanding sportspersons shall not be appointed in police department.

(vi) Time period for applying under this rule :-

1. Those outstanding sportspersons whose achievements are within a maximum period of three years including the year of winning the medal and the same rule applies for participation also.

2. Medal holders can submit their applications to the DG, Bihar State Sports Authority within a maximum period of three years including the year of winning the medal and the same rule applies for participation also.

(vii) Tie breaking procedures:- In case of tie between two or more outstanding sportsperson the following procedures shall be adopted. (a) Person, who has set a new international/National/ Championship

record, shall be given the priority.

(b) The achievement of high level competition, as mentioned in

Rule 8 (a), shall be given priority.

(c) Individual event will prevail over team event. (d) The achievement received in the current year shall be

given priority.

(e) If the tie persists even after following the above procedures, the person who is elder on the basis of his/her age shall be given priority.

(viii) In team events, if all the team members having requisite qualifications submit their applications for appointment, the process of selection would be followed as per conditions laid out under Rule 7 (vi) above.

(ix) The provisional merit list prepared by the Bihar State Sports Authority, shall be placed before the selection committee of the GAD. Once approved by the selection committee, the provisional merit list will be published. The Bihar State Sports Authority will be the nodal agency for verification of all sports certificates submitted by the qualified applicants. The final merit list will be published by the GAD after the submission of the verification reports by the Bihar State Sports Authority (BSSA). (a) Any claim/objection shall be submitted to the BSSA within a fortnight from the date of publication of the provisional merit list.

(b) The claim/objections received would be examined by the BSSA and it shall be placed before the selection committee. The selection committee on the basis of report will redress the claim/objections and will publish final merit list of five candidates for each category and post. The final merit list will be published on the website of GAD/BSSA.

The GAD will sent the final merit list to the appointing authority for necessary appointment process. The final merit list will be valid only for one year from the date of its publication. If any Sportsperson does not submit his joining report, the said vacancy would be carried forward for next appointment process. No waiting list would be published.

8. Seniority of the Sportspersons.—

(a) The seniority of the sportspersons would be fixed in the following manner :- (1) The winner of Gold medal of Olympic games. (2) The winner of silver medal of Olympic games. (3) The winner of bronze medal of Olympic games. (4) Participation of Olympic games. (5) Winner of gold medal of Asian games. (6) Winner of gold medal of commonwealth games. (7) Winner of silver medal of Asian games. (8) Winner of silver medal of commonwealth games. (9) Winner of bronze medal of Asian games. (10) Winner of bronze medal of commonwealth games. (11) Participation in Asian games. (12) Participation in commonwealth games. (13) Winner of gold medal of senior national games. (14) Winner of silver medal of senior national games. (15) Winner of bronze medal of senior national games. (16) Winner of gold medal of senior national championship. (17) Winner of silver medal of senior national championship. (18) Winner of bronze medal of senior nationalchampionship. (19) Winner of gold medal of junior national championship. (20) Winner of silver medal of junior national championship. (21) Winner of bronze medal of junior national championship. (b) In a calendar year, the persons appointed by direct recruitment or promotion in a service/cadre shall rank senior to outstanding sportsperson but persons appointed on compassionate ground shall rank junior to outstanding sportsperson.

9. Age limit.— The minimum age for appointment of outstanding sportsperson would be 18 years. There will be no upper age limit.

10. Service conditions.—

(i) In the pursuance of provisions of this rules, the Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 as (amended time to time) would be applicable to the appointed outstanding Sportspersons and Bihar Sportspersons Government servants (Service conditions) Rules, 2015 would also be applicable.

(ii) The appointment under the sports quota would be done on the condition that so appointed Sportsperson shall take part actively in all sports competitions for five years from the date of their appointment.

For this purpose, it is mandatory to sign a Bond to this effect. If they fail to fulfil the conditions of the Bond, their services will not be confirmed.

11. Regulations.— To overcome any difficulty in implementing these rules or to further explain the provisions regarding selection, trial, qualifications and other issues, regulations may be notified.

12. Miscellaneous.—Not withstanding anything contained in these rules contrary to any other Rules, provisions of these Rules shall have overriding effect. 13. Removal of difficulties.—The Government may from time to time issue such general or special directions as may be necessary to remove difficulties in the operation of any of the provisions of these Rules and shall amend/modify to in force Rules.

14. Repeal and savings.—Letter No. 3792 dated 14.03.1973, Resolution No. 1086 dated 20.01.1979 and Bihar Outstanding Sportsperson Appointment Rules, 2009 (amended till the year 2012) and also all the directions, Bihar Outstanding Sportsperson Appointment Rules, 2014, Bihar Outstanding Sportsperson Appointment Rules (amendment) Rules, 2020 and Bihar Police Sports Policy, 2013 notified by the Home Department, Bihar, Patna for appointment of outstanding Sportspersons shall be deemed to be repealed. Notwithstanding such repeal, anything done or any action taken under the said circular/resolution/rules/instructions prior to coming into force of these rules, shall have no adverse effect.
