पटना, दिनांक 06/03/2023 विषय : ग्राम पंचायतों के निर्वाचित मुखियागण के वार्ड को, जिसकी मतदाता सूची में उनका नाम मतदाता के रूप में दर्ज है, नगर निकाय में सम्मिलित कर लिये जाने के फलस्वरूप ऐसे मुखिया को अपने पद पर बने रहने के संबंध में। 2 ;बपकरू464द्ध ;द्ध 17 ;बपकरू91द्ध 2023 " The Act or the Rules framed thereunder, however, do not provide for solution to meet the contingency which has arisen in the present matter. When the present Mukhiya was elected he was in the list of voters of the Panchayat because the ward in which his name is in the voter list was part of the Panchayat. However, by operation of law relating to transition from rural to urban area, he ceases to be in the list of voters of Rahmatpur and Makwa Panchayat respectively. Ordinarily not being voter of the Panchayat, they are not qualified to be elected as a member or office bearer of the Panchayat. However, when election was held, indeed both of them were voters of the Panchayat in question. Had there been no reorganization, they would have continued for a period of five years unless the period was circumscribed by operation of law. Since no provision has been made in the parent Act, the Government may have to exercise power conferred under section 172 of the Act which reads as follows :- Removal of difficulties :- If any difficulty arises in giving effect to the provisions of this Act, the Government, may by order, published in the official Gazette, as the occasion may require, do anything which appears to it to be necessary to remove the difficulty.
On reading of above, it is apparent that a difficulty has arisen on account of fact that due to reorganization, an elected Mukhiya who is otherwise entitled to continue for a period of five years, will cease to be a Mukhiya and there is no provision under the Act which deals with a situation of the present class. In view of above the Government may in exercise of its power under section 172 take an appropriate decision in accordance with procedure prescribed therein for removal of the difficulty. " 3. विधि विभाग से प्राप्त परामर्श के आलोक में इस प्रकार की कठिनाई के निवारण हेतु सरकार द्वारा सम्यक विचारोपरांत यह निर्णय लिया गया है कि अगर पंचायत आम चुनाव में निर्वाचित किसी मुखिया का प्रादेशिक निर्वाचन क्षेत्र या वार्ड, जिसकी मतदाता सूची में उसका नाम मतदाता के रूप में दर्ज है, नगर निकाय में सम्मिलित कर लिया गया है, तब यथास्थिति ऐसा मुखिया संबंधित ग्राम पंचायत की कार्यावधि (पांच वर्ष) पूरी होने तक उक्त ग्राम पंचायत के प्रधान के रूप में कार्यरत रहेगा, बशर्ते कि इस बीच वह खुद अपने पद का परित्याग नहीं कर दे या उसे बिहार पंचायत राज अधिनियम, 2006 के संगत प्रावधानों के अधीन विहित प्राधिकार द्वारा पद से नहीं हटा दिया जाय। विहित कार्यावधि समाप्त हो जाने के पश्चात् अधिनियम की धारा 135 के अध्यधीन अगले किसी पंचायत चुनाव में उसे अभ्यर्थी बनने का अधिकार नहीं होगा। 4. कृपया सरकार के उक्त निर्णय से सभी संबंधित अधिकारियों को अपने स्तर से अविलंब अवगत करा देने की कृपा की जाय।
