सं॰ Exp-21/2020/(खंड-94)मुजफ्फरपुर-38 लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग के आदेष संख्या- 76/बिहार-वि.स./2020/94/सी.ई.एम.एस.-III दिनांक 03.03.2023 से एतद्द्वारा घोशित किया गया है कि बिहार राज्य के 94-मुजफ्फरपुर विधान सभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लड़ने वाले अभ्यर्थी श्री कुमार हर्श, निवासी ग्राम- मादापुर चौबे, पोस्ट- खरौना डीह, थाना- सदर, जिला- मुजफ्फरपुर, बिहार 843113 इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है (हिन्दी एवं अंग्रेजी में) सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती हैं।

भारत निर्वाचन आयोग
——— आदेश निर्वाचन सदन, अषोक रोड, नई दिल्ली-110001/ तारीख 03 मार्च, 2023/12 फाल्गुन, 1944 (षक) सं॰ 76/बिहार-वि.स./2020/94/सी.ई.एम.एस.-III यतः, भारत निर्वाचन आयोग द्वारा बिहार राज्य में विधान सभा के साधारण निर्वाचन 2020 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./64/2020, दिनांक 25 सितम्बर, 2020 के जरिए की गई थी; और, यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और यतः 94-मुजफ्फरपुर विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 नवंबर, 2020 को घोशित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 10 दिसम्बर, 2020 थी; और यतः, जिला निर्वाचन अधिकारी, मुजफ्फरपुर, बिहार के पत्र सं. 2332, दिनांक 16 दिसंबर, 2020 द्वारा प्रस्तुत और संयुक्त मुख्य निर्वाचन अधिकारी, बिहार द्वारा पत्र सं. Exp-21/2020(खंड-94) मुजफ्फरपुर-18 के जरिए अग्रेशित दिनांक 04 जनवरी, 2021 की रिपोर्ट के अनुसार श्री कुमार हर्श, जो बिहार विधान सभा का साधारण निर्वाचन 2020 के निर्वाचन क्षेत्र 94-मुजफ्फरपुर से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और, यतः, जिला निर्वाचन अधिकारी, मुजफ्फरपुर, बिहार, और मुख्य निर्वाचन अधिकारी, बिहार की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री कुमार हर्श, को कारण बताओ नोटिस संख्या 76/बिहार-वि.स./2020/94/सी.ई.एम.एस.-III, दिनांक 25 जून, 2021 जारी किया गया था; और, यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 25 जून, 2021 के उपर्युक्त कारण बताओ नोटिस के जरिए श्री कुमार हर्श, को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और, यतः, संयुक्त मुख्य निर्वाचन पदाधिकारी, बिहार, द्वारा अपने दिनांक 27.12.2022 के पत्रांक संख्या Exp-21/2020(खण्ड-94)5758 पटना, के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी के द्वारा दिनांक 23.07.2021 को प्राप्त किया गया था; और यतः, जिला निर्वाचन अधिकारी, मुजफ्फरपुर द्वारा दिनांक 21.12.2021 के पत्र संख्या 942/निर्वा॰, के जरिए प्रस्तुत की गई आगे की संवीक्षा रिपोर्ट में यह बताया गया है कि श्री कुमार हर्श, ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है; और यतः, आयोग का यह समाधान हो गया है कि श्री कुमार हर्श, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः- "यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा।
अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोशणा करता है कि बिहार राज्य के 94-मुजफ्फरपुर विधान सभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लड़ने वाले अभ्यर्थी श्री कुमार हर्श, निवासी ग्राम- मादापुर चौबे, पोस्ट- खरौना डीह, थाना- सदर, जिला- मुजफ्फरपुर, बिहार 843113 इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

—— ORDER Nirvachan Sadan, Ashoka Road, New Delhi-110001 Dated 03 March, 2023/12 Phalguna, 1944 (Saka) No. 76/BR-LA/2020/94/CEMS-III WHEREAS, the General Election to the Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and
WHEREAS, the result of the said election along with 94-Muzaffarpur, Assembly Constituency was declared by the concerned Returning Officer on 10th November, 2020. Hence, the last date for lodging the account of Election Expenses was 10th December, 2020; and,
WHEREAS, as per the report dated 16th December, 2020, vide letter no. 2332 submitted by the District Election Officer, Muzaffarpur, Bihar and forwarded by the Joint Chief Electoral Officer, Bihar vide their letter No. Expenditure-21/2020(Vol.-94) Muzaffarpur-18, dated 04 January, 2021, Sh. Kumar Harsh, a contesting candidate of Bihar from 94-Muzaffarpur, Assembly Constituency of Bihar, has failed to lodge account of his election expenses, in the manner, as required under law; and,
WHEREAS, on the basis of the reports of the District Election Officer, Muzaffarpur, Bihar and the Chief Electoral Officer, Bihar, a Show-Cause notice, No. 76/BR-LA/2020/94/CEMS- III dated 25th June, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Kumar Harsh, for not lodging the account of Election Expenses; and
WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 25th June, 2021, Sh. Kumar Harsh, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and, WHEREAS, the said notice was received by the candidate on 23.07.2021, the acknowledgment receipt has been submitted to the Commission by the Joint Chief Election Officer, Bihar, vide its letter no. Exp-21/2020(Vol-94) 5758 Patna, dated 27.12.2022; and
WHEREAS, the District Election Officer, Muzaffarpur, in his Supplementary Report, vide its letter No. 942/Nirva., dated 21.12.2021 has reported that Sh. Kumar Harsh, has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and
WHEREAS, the Commission is satisfied that Sh. Kumar Harsh, has failed to lodge the account of election expenses and has no good reason or justification for the failure; and
WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:- "If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and (b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order";
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Kumar Harsh, resident of Gram- Madapur Chaubai, Post- Khrauna Dih, Thana- Sadar, Dist- Muzaffarpur, Bihar 843113 a contesting candidate from 94-Muzaffarpur, Assembly Constituency of the State of Bihar in the4 (cid:464)बहार गजट (असाधारण), 28 माच(cid:91) 2023 General Election to the Legislative Assembly of Bihar, 2020 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
