भारत के संविधान के अनुच्छेद 243-छः (11वीं अनुसूची, मद संख्या-17) तथा बिहार पंचायत राज अधिनियम, 2006 की धारा-73 सह पठित धारा 146 के अधीन प्रदा शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल के द्वारा ग्रामीण क्षेत्र के राजकीय, राजकीयकृत, प्रोजेक्ट कन्या एवं उत्क्रमित माध्यमिक/उच्च माध्यमिक विद्यालयों में शिक्षक/पुस्तकालयाध्यक्ष के नियुक्ति/प्रोन्नति एवं उनके सेवाशर्त्त को विनिश्चित करने हेतु जिला परिषद्, माध्यमिक एवं उच्च माध्यमिक विद्यालय सेवा (नियुक्ति, प्रोन्नति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली 2020 में निम्नलिखित संशोधन करते हैं।

राज्य के माध्यमिक विद्यालयों एवं उच्च माध्यमिक विद्यालयों के शिक्षक एवं पुस्तकालयाध्यक्ष की सेवाशर्त को विनिश्चित करने हेतु बिहार जिला परिषद्, माध्यमिक एवं उच्च माध्यमिक विद्यालय सेवा (नियुक्ति, प्रोन्नति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली, 2020 लागू है, परन्तु प्राथमिक एवं मध्य विद्यालयों के शिक्षकों को माध्यमिक एवं उच्च माध्यमिक शिक्षक के रूप में नियोजित होने पर सेवा निरन्तरता के लाभ का प्रावधान उक्त नियमावली में नहीं होने के कारण बिहार जिला परिषद्, माध्यमिक एवं उच्च माध्यमिक विद्यालय सेवा (नियुक्ति, प्रोन्नति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली, 2020 में संशोधन अपेक्षित हो गया है। 2.
ः-
(क) यह नियमावली "बिहार जिला परिषद् माध्यमिक एवं उच्च माध्यमिक विद्यालय सेवा (नियुक्ति, प्रोन्नति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) संशोधन नियमावली, 2023" कही जायेगी।
(ख) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा।2 (cid:464)बहार गजट (असाधारण), 2 अग(cid:232)त, 2023 (ग) यह अधिसूचना बिहार जिला परिषद्, माध्यमिक एवं उच्च माध्यमिक विद्यालय सेवा (नियुक्ति, प्रोन्नति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली 2020 के निर्गत होने की तिथि दिनांक-20.08.2020 से प्रभावी होगी।
3. ः- उक्त नियमावली के नियम-12 उप नियम (vii) को निम्नांकित द्वारा प्रतिस्थापित किया जाता हैः
पूर्व से कार्यरत प्रारंभिक एवं माध्यमिक शिक्षक यदि वर्तमान नियोजन इकाई में अथवा किसी अन्य नियोजन इकाई में उच्च कोटि के पद पर नियोजन हेतु आवेदन देने के इच्छूक हों तो वर्तमान नियोजन प्राधिकार से अनुमति प्राप्त कर नियोजन की प्रक्रिया में शामिल हो सकते हैं।
वर्तमान नियोजन इकाई अथवा किसी अन्य नियोजन इकाई में तद्नुरूप उच्च कोटि के पद पर नियोजन होने की स्थिति में सेवा निरन्तरता का लाभ मात्र वेतन संरक्षण हेतु अनुमान्य होगा।"

No. 11/Niyama–01–01/2020-1718--"Bihar District Board Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Conditions) (Amendment) Rules, 2023"
In exercise of power conferred under Article 243 Chha (11th Schedule, Item no. 17) of the Constitution of India and Section 73 read with Section 146 of the Bihar Panchayat Raj Act, 2006, the Governor of Bihar hereby makes the following amendment in the Bihar District Board Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2020 for determining the appointment/promotion and service conditions of Teacher/Librarian in the Government, Nationalized, Project Girls and Upgraded Secondary/Senior Secondary Schools in the rural area:
1. Preamble: -
The Bihar District Board Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2020 is in force for determining the service conditions of Teachers and Librarians in Secondary and Senior Secondary Schools of the State, however, as there is no provision for benefit of continuity of service for teachers of Primary and Middle schools when they are appointed as Secondary and Senior Secondary teachers, amendment in the Bihar District Board Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2020 is required.
2. Short title, extent and commencement: -
(A) This Rules shall be called 'Bihar District Board Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Conditions) (Amendment) Rules, 2023'.
(B) It extends to the whole of the State of Bihar. (C) This shall come into force from the date of notification – 20.08.2020 of Bihar District Board Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2020
3. Amendment of Rule – 12: -
Rule 12 sub-rule (vii) of the above mentioned Rules is substituted as follows:

If the Primary and Secondary teachers working from earlier are willing to apply for employment on a higher level post in either their present recruitment unit or any other recruitment unit, they can participate in the process of appointment after obtaining permission from their present Appointing Authority.
In the event of being employed in their present recruitment unit or any other recruitment unit on a corresponding higher post, the benefit of only pay protection shall be given to them."
