सं॰ 4/क्षे॰स्था॰ रा०कर्म॰ (नियमावली)-02-02/2023-564(4)/रा०—भारत संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल ''बिहार राजस्व कर्मचारी संवर्ग नियमावली, 2011 (समय-समय पर यथासंशोधित)'' में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं :-
-
(i) यह नियमावली ''बिहार राजस्व कर्मचारी संवर्ग (संशोधन) नियमावली, 2023'' कही जा सकेगी ;
(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा ;
(iii) यह तुरंत प्रवृत्त होगी ;
2.
- उक्त नियमावली के नियम-7 के उप नियम-(ii) के बाद निम्नलिखित उप नियम-(iii) जोड़ा जाता है-
'' (iii) ऐसे सरकारी सेवक जिनकी सेवाकाल में मृत्यु हो गई हो, के आश्रितों की, सीधी भर्ती हेतु उपलब्ध रिक्त पदों के विरूद्ध अपेक्षित मापदण्ड पूरा करने पर, अनुकम्पा के आधार पर नियुक्ति हेतु विचार किया जा सकेगा, जिसके लिए आयोग की अनुशंसा अपेक्षित नहीं होगी। परन्तुु सेवाकाल में मृत सरकारी सेवकों के आश्रितों की नियुक्ति के उपरांत, राजस्व कर्मचारी की शेष रिक्तियाँ के लिए अधियाचना आयोग को भेजी जायेगी।''
- उक्त नियमावली के नियम-10 को निम्न द्वारा प्रतिस्थापित किया जाता है :-
''10. राजस्व कर्मचारियों को सेवा संपुष्टि हेतु निम्नलिखित परीक्षा में उत्तीर्णता प्राप्त करना अनिवार्य होगा- (i) मंत्रिमंडल सचिवालय (राजभाषा) विभाग द्वारा संचालित हिन्दी टिप्पण एवं प्रारूपण परीक्षा;
(ii) कम्प्यूटर सक्षमता जाँच परीक्षा ;
2 (cid:464)बहार गजट (असाधारण), 19 अ(cid:200)तूबर 2023(ii) यथानिर्धारित विभागीय परीक्षा, जिसके लिए विषय, पाठ्यक्रम एवं प्रक्रिया का निर्धारण केन्द्रीय परीक्षा समिति, राजस्व पर्षद, पटना द्वारा विभाग के परामर्श से किया जा सकेगा।'' उक्त नियमावली के नियम-13 में निम्नलिखित जोड़ा जाता है - '' परन्तु किसी कैलेण्डर वर्ष में अनुकम्पा के आधार पर नियुक्त राजस्व कर्मचारी उस वर्ष सीधी भर्त्ती से नियुक्त राजस्व कर्मचारी से कनीय होंगे।'' ——— The 19th October 2023 No. 4/kshe. stha. rev. karm. (niyamawali)-02-02/2023-564(4)/Ra—In exercise of the powers conferred by the proviso to Article-309 of the Constitution of India, the Governor of Bihar hereby makes the following rules to amend "The Bihar Rajaswa Karmachari Cadre Rules, 2011 (as amended from time to time)":-
1. Short title, extent and commencement.-
(i) These rules may be called " The Bihar Rajaswa Karmachari Cadre (Amendment) Rules, 2023 ".
(ii) It shall extend to the whole of the State of Bihar.
(iii) It shall come into force with immediate effect.
2. To be added in Rule-7 of the Bihar Rajaswa Karmachari Cadre Rules, 2011 (as amended from time to time).— After sub-rule (ii) of rule-7 of the said rules, the following sub-rule (III) is added-
"(iii) The dependents of such government servants, who have died while in service, shall be considered for the appointment on compassionate ground on fulfilling the requisite criteria against available vacant posts of direct recruitment, for which recommendation of the Commission shall not be required.
Provided that after the appointment of the dependents of the government servants, who have died during the service period, the requisition for the rest vacancies of the Rajaswa Karmachari shall be sent to the Commission."
3. Amendment in rule-10 of the Bihar Rajaswa Karmachari Cadre Rules, 2011 (as amended from time to time)- Rule-10 of the said rules is substituted by the following :-
" 10. It will be mandatory for Rajaswa Karmachari to pass the following examination for confirmation of service -
(i) Hindi Noting and Drafting Examination conducted by the Cabinet Secretariat (Rajbhasha) Department.
(ii) Computer Competency Test.
(iii) Departmental examination as prescribed, for which the subject, syllabus and procedure may be decided by the Central3 (cid:464)बहार गजट (असाधारण), 19 अ(cid:200)तूबर 2023 Examination Committee, Board of Revenue, Patna in consultation with the department."
4. To be added in Rule-13 of The Bihar Rajaswa Karmachari Cadre Rules- 2011 (as amended from time to time)- In rule-13 of the said rules, the following is added-
" Provided that the Rajaswa Karmachari appointed on compassionate ground in any calendar year shall be junior to the Rajaswa Karmachari appointed by direct recruitment in that year."
