सं॰ 1/ए॰जी॰-22/2010-4900—भारत संविधान के अनुच्छेद-309 के परन्तुक के अधीन प्रदत शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार कृषि सेवा कोटि-9 (सांख्यिकी) में भर्ती, प्रोन्नति एवं सेवा शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :-

(i) यह नियमावली 'बिहार कृषि सेवा कोटि-9 (सांख्यिकी) भर्ती, प्रोन्नति एवं सेवा शर्त्त नियमावली, 2023 कही जायेगी।

(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह तुरन्त के प्रभाव से प्रवृत होगी। (i) से अभिप्रेत है बिहार राज्य; (ii) से अभिप्रेत है बिहार के राज्यपाल; (iii) से अभिप्रेत है बिहार सरकार; (iv) से अभिप्रेत है बिहार सरकार का कृषि विभाग; (v) से अभिप्रेत है बिहार कृषि सेवा अधिनियम 1982 (बिहार अधिनियम संख्या- 44, 1982);

(vi) से अभिप्रेत है बिहार कृषि सेवा अधिनियम 1982 की धारा- 2 के अंतर्गत अनुसूची- 1 में उद्धत कोटि- 9 (सांख्यिकी);

(vii)

से अभिप्रेत है बिहार राज्य की कृषि सेवा कोटि-9 (सांख्यिकी); (viii) आयोग से अभिप्रेत है (ix) 'वर्ष' से अभिप्रेत है

की अवधि;

(x) से अभिप्रेत है कार्यपालिका नियमावली द्वारा घोषित प्राधिकार;

(xi) से अभिप्रेत है बिहार कृषि सेवा कोटि- 9 (सांख्यिकी) में नियुक्त व्यक्ति; (xii) प्राधिकार से अभिप्रेत है बिहार कार्यपालिका नियमावली में यथानिर्धारित नियुक्ति प्राधिकार;

यह सेवा एक राज्य सेवा होगी तथा कृषि विभाग इस सेवा का नियंत्री विभाग होगा। मूल कोटि का पद।- जिला योजना एवं मूल्यांकन पदाधिकारी/सहायक कृषि निदेशक (मूल्यांकन)/सहायक कृषि निदेशक (सांख्यिकी)/सहायक सांख्यिकी/सहायक सांख्यिकीज्ञ/ सहायक निदेशक (सांख्यिकी) एवं समकक्ष पद। उप कृषि निदेशक (सांख्यिकी)/उप कृषि निदेशक (मूल्यांकन)/ उप कृषि निदेशक (सांख्यिकी एवं मूल्यांकन)/उप निदेशक (सांख्यिकी) एवं समकक्ष पद।

की संरचना एवं बल की पुनर्विलोकन विभाग द्वारा समय-समय पर आवश्यकतानुसार

की जा सकेगी।

(i) सेवा में नियुक्ति के लिए भारत का नागरिक होना अनिवार्य होगा। मूल कोटि के 67 प्रतिशत

पद सीधी नियुक्ति से तथा 33 प्रतिशत पद प्रोन्नति से भरे जायेंगे। (ii) प्रति वर्ष 1 ली अप्रैल को कोटि में स्वीकृत पदों के विरूद्ध प्रोन्नति के लिए तथा सीधी नियुक्ति के लिए रिक्त पदों की गणना अलग-अलग की जायेगी। यह गणना पदों के आधार पर की जायेगी अर्थात सीधी नियुक्ति के पदों के रिक्त होने पर इन्हें सीधी नियुक्ति द्वारा तथा प्रोन्नति के पदों के रिक्त होने पर इन्हें प्रोन्नति द्वारा भरा जायेगा। 30 अप्रैल को रिक्तियों के संबंध में आरक्षण कोटिवार अधियाचना विभाग द्वारा आयोग को प्रेषित कर दी जाएगी।

(iii) संवर्ग में मूल कोटि के पदों पर सीधी नियुक्ति के लिए न्यूनतम शैक्षणिक योग्यता किसी मान्यता प्राप्त कृषि विश्वविद्यालय/संस्थान/केन्द्रीय विश्वविद्यालय से सांख्यिकी/गणित के साथ स्नातक/कृषि विज्ञान में कृषि सांख्यिकी की डिग्री होगी।

(क) सीधी नियुक्ति आयोग द्वारा संचालित प्रतियोगिता परीक्षा के आधार पर अनुशंसित

अभ्यार्थियों से की जायेगी।

(ख) आवेदन आमंत्रित करने वाले वर्ष के पहली अगस्त को न्यूनतम आयु 21 (इक्कीस) वर्ष होगी। अधिकतम उम्र सीमा वही होगी जो सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी भर्ती के लिए समय-समय पर विनिश्चित की जायगी, किन्तु विशेष परिस्थिति में इसे राज्य सरकार के आदेश से बढ़ाया जा सकेगा।

परन्तु विधिवत्‌ नियोजित एवं कार्यरत संविदा कर्मियों को, समान पद पर सीधी भर्त्ती के तहत नियमित नियुक्ति में, अधिकतम उम्र सीमा में उतने वर्षों तक की छूट दी जायेगी, जितने वर्षों तक उनके द्वारा बिहार सरकार में संविदा के आधार पर समान पद पर कार्य किया गया हो।

(ग) सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी

नियुक्ति के लिए समय-समय पर अवधारित आरक्षण प्रावधान लागू होंगे। (घ) विभाग सीधी नियुक्ति हेतु सामान्य एवं आरक्षण कोटिवार रिक्तियों की संख्या के

साथ अधियाचना प्रत्येक वर्ष आयोग को भेजेगा।

(च)

इस नियमावली के नियम 5 (iv)(क) में उल्लेखित प्रतियोगिता परीक्षा में 100 अंकों के हिन्दी विषय में उत्तीर्ण होना अनिवार्य होगा, किन्तु इसका प्राप्तांक की गणना मेधा सूची बनाने के प्रयोजनार्थ नहीं की जायेगी। मेधा सूची सांख्यिकी/गणित के साथ स्नातक/कृषि विज्ञान में कृषि सांख्यिकी/गणित में स्नातक में 200-200 अंकों के दो प्रश्न पत्रों सामान्य ज्ञान के 100 अंकों के एक प्रश्न पत्र तथा मौखिक परीक्षा के 50 अंकों के विरूद्ध प्राप्तांको के योग के आधार पर तैयार की जायगी। हिन्दी तथा सामान्य ज्ञान का पाठ्‌यक्रम वही होगा जो बिहार लोक सेवा आयोग द्वारा आयोजित संयुक्त प्रतियोगिता परीक्षा के लिए विनिश्चत किया जायेगा। सांख्यिकी/गणित के साथ स्नातक/कृषि विज्ञान में कृषि सांख्यिकी/गणित में3 (cid:464)बहार गजट (असाधारण), 16 नव(cid:224)बर 2023 स्नातक का पाठ्‌यक्रम विभाग द्वारा बिहार लोक सेवा आयोग के परामर्श से तैयार किया जाएगा। सांख्यिकी, गणित, कृषि सांख्यिकी, में स्नातक तथा सामान्य ज्ञान के उपरोक्त तीनों पत्रों के प्राप्तांक के योग के आधार पर अभ्यर्थियों को समुचित संख्या में मौखिक परीक्षा के लिए बुलाया जाएगा। मौखिक परीक्षा 50 अंकों की होगी। (छ) मूल कोटि के पदों पर चयन लिखित एवं मौखिक परीक्षा में प्राप्त अंकों के योग एवं समान पद पर संविदा नियोजन के तहत की गयी कार्य अवधि के लिए अधिमानता देते हुए की जायेगी। चयन के लिए अंको की अधिमानता का निर्धारण निम्नवत्‌ किया जायेगा :- - 75 अंक

(ज) आयोग लिखित, मौखिक परीक्षा एवं अधिमानता के आधार पर प्राप्त अंकों के योग के आधार पर सामान्य तथा प्रत्येक आरक्षण कोटि के लिए अलग-अलग मेधा सूची तैयार करेगा। इस प्रकार तैयार की गयी सूचियों में से आयोग प्रतिवेदित रिक्तियों के अनुसार अनुशंसा विभाग को करेगा। ।- बिहार कृषि अधीनस्थ सेवा कोटि- 9 से बिहार कृषि सेवा कोटि- 9 (सांख्यिकी) में प्रोन्नति वरीयता, कार्य अनुभव एवं कार्यकुशलता के आधार पर होगी। कृषि अधीनस्थ सेवा कोटि- 9 (सांख्यिकी) में कार्यरत कर्मियों को सामान्य प्रशासन विभाग द्वारा निर्धारित कालावधि एवं पदों की उपलब्धता आदि पर विचार करते हुए सामान्य प्रशाासन विभाग द्वारा समय-समय पर निर्गत नीति निर्धारक परिपत्रों के आलोक में वरीयता के आधार पर सक्षम प्राधिकार द्वारा प्रोन्नति दी जायेगी। ।- (i) सेवा में सीधी भर्ती से नियुक्त प्रत्येक सदस्य पदग्रहण की तिथि से दो वर्षों की अवधि के लिए परिवीक्षा पर होगा किन्तु विशेष परिस्थितियों में लिखित रूप में अभिलिखित किये जाने वाले कारणों से यह अवधि विभाग के द्वारा एक वर्ष तक बढ़ाई जा सकेगी। यदि बढ़ाई गयी अवधि में भी कार्य संतोषप्रद नहीं पाया जायेगा तो ऐसे सदस्यों की सेवा सरकार द्वारा बिना कारण पृच्छा के समाप्त की जा सकेगी, किन्तु इसकी लिखित सूचना कारण सहित दी जाएगी। (ii) परिवीक्षा अवधि की गणना नियमित सेवा के प्रयोजनार्थ की जायेगी। ।- बिहार कृषि सेवा में नियुक्त सदस्यों के लिए प्रथम प्रोन्नति के स्तर पर राज्य सरकार द्वारा विनिश्चित संस्थान से प्रशिक्षण प्राप्त करना अनिवार्य होगा। प्रशिक्षण संस्थानों का चयन समय-समय पर विभाग द्वारा किया जायेगा। ।- (i) सदस्यों को केन्द्रीय परीक्षा समिति (राजस्व पर्षद्‌), बिहार द्वारा आयोजित विभागीय परीक्षा में उत्तीर्ण होना अनिवार्य होगा।

(ii) मूल कोटि के वेतनमान में प्रथम वेतनवृद्धि विभागीय परीक्षा उत्तीर्णता के उपरान्त ही देय होगी।

।- (i) परिवीक्षा अवधि पूरी करने, विभागीय परीक्षा में उत्तीर्णता तथा विनिश्चित प्रशिक्षण कार्यक्रम के संतोषप्रद रूप से पूर्ण किये जाने पर तथा सेवा स्वच्छ पाये जाने पर सीधी नियुक्ति के सदस्यों की सेवा मूल कोटि में संपुष्ट की जायेगी।

(ii) प्रोन्नति द्वारा मूल कोटि में नियुक्त सदस्यों की सेवा उप नियम (i) के अधीन वर्णित शर्त्तों (परिवीक्षा को छोड़कर) के अधीन रहते हुए संपुष्ट की जा सकेगी।

।- सदस्यों की वरीयता का निर्धारण सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्धारित प्रावधानों के आलोक में की जायेगी।4 (cid:464)बहार गजट (असाधारण), 16 नव(cid:224)बर 2023 ।- (i) सेवा के पदसोपान में उच्चतर पदों पर प्रोन्नति ठीक नीचे की पंक्ति में कार्यरत पदाधिकारियों से वरीयता-सह-मेधा के आधार पर तथा सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत आदेशों के आलोक में दी जाएगी, किन्तु सदस्यों को नियम- 8 में यथा प्रावधानित प्रशिक्षण पूरा करने पर ही उक्त प्रोन्नति देय होगी।

(ii) कार्यरत पदाधिकारियों की मूल कोटि में सम्पुष्टि, गोपनीय अभ्युक्ति, आंतरिक स्वच्छता, निगरानी स्वच्छता एवं लोकायुक्त का प्रतिवेदन, सामान्य प्रशासन विभाग द्वारा विनिश्चित कालावधि आदि पर विचार करते हुये वरीयता के आधार पर सक्षम प्राधिकार द्वारा प्रोन्नति दी जायेगी। (iii) विभागीय प्रोन्नति समिति की अनुशंसा पर प्रोन्नति हेतु विचार किया जा सकेगा। विभागीय प्रोन्नति समिति अलग आदेश से सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत संकल्पों/अनुदेशों के आलोक में गठित की जायेगी।

।- (i) इस नियमावली के नियमों के निर्वचन के लिए विभाग सक्षम होगा जिसके लिए, आवश्यकतानुसार, सामान्य प्रशासन विभाग, विधि विभाग, वित्त विभाग का परामर्श प्राप्त किया जाना होगा। (ii) विभाग, विधि विभाग के परामर्श से, इस नियमावली के किसी नियम को लागू करने में आने वाली कठिनाई का निराकरण राजपत्र में समुचित आदेश जो इस नियमावली के प्रावधानों से असंगत न हो, के प्रकाशन द्वारा कर सकेगा। (iii) जिन विषयों या बिन्दुओं का प्रावधान इस नियमावली में नहीं किया गया है, उनके सम्बन्ध में राज्य सरकार द्वारा तत्समय प्रवृत संहिता/नियमावली/संकल्प/अनुदेश में किये गये प्रावधान इस सेवा के संदर्भ में लागू माने जायेंगे।

।- (i) इस संवर्ग के कर्मियों की नियुक्ति/सेवा शर्त्त संबंधी पूर्व में निर्गत सभी परिपत्र/अनुदेश/ संकल्प एतद्‌ द्वारा निरसित किये जाते है।

(ii) ऐसे निरसन के होते हुए भी, पूर्व निर्गत परिपत्र/अनुदेश/संकल्प के अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जाएगी मानों यह नियमावली उस दिन प्रवृत थी, जिस दिन वैसा कुछ किया गया या वैसी कोई कार्रवाई की गयी थी। The 21st September 2023

No. 01/AG-22/2010-4900—In exercise of power conferred under proviso of Article 309 of the Constitution of India, The Governor of Bihar is hereby pleased to make the following rules to regulate appointment, promotion and service conditions in Bihar Agriculture Service Category-09 (Statistics):-

1. Short title, extent and Commencement :-

(i) These rules may be called Bihar Agriculture Service Category-09 (Statistics) Rules- 2023.

(ii) It shall extend to the whole of state of Bihar. (iii) It shall come into force with immediate effect.

2. Definition :-

(i) "State" means the State of Bihar. (ii) "Governor" means the governor of Bihar. (iii) "Government" means the Government of Bihar. (iv) "Department" means Agriculture Department of Bihar. (v) "Agriculture Service Act" means Bihar Agriculture Service Act, 1982 (Bihar Act No. 44, 1982).

(vi) "Category-9" (Statistics) means Category-9 (Statistics "mentioned under Schedule-1 of Section- 2 of Bihar Agriculture Service Act, 1982).

(vii) "Bihar Agriculture Service" (Category-9) means Agriculture Service Category-9 (Statistics) of the State of Bihar.

(viii) "Commission" means Bihar Public Service Commission. (ix) "Year" means financial year or the period from 1st April to 31st March of the next year.

(x) "Competent Authority" means Authority declared by the rules of executive business.

(xi) "Member" means persons appointed under Bihar Agriculture Service Category-9 (Statistics).

(xii) "Appointing Authority" means an appointing authority as determined in Bihar Executive Rules.

3. Cadre Control .— This shall be a state service and Agriculture Department shall be its controlling Department.

4. Hierarchy of Post-

(1) (a) Post of basic category- District planning & Evaluation Office/ Assistant Agriculture Director (Evaluation)/Assistant Agriculture Director (Statistics)/ Assistant Statistics/ Assistant Statists/Assistant Director (Statistics) and equivalent post.

(b) First Promotional Post.—Deputy Agriculture Director (Statistics/ Depurty Agriculture Director (Statistics & Evaluation)/ Deputy Director (Statistics) and equivalent post.

(c) Second Promotional Post.— Joint Agriculture Director (Statistics)/ Joint Director (Statistics) and equivalent post.

(d) Third Promotional Post :- Additional Director (Statistics). (2) Structure and Strength of the cadre may be reviewed, from time to time, by the department as per needs.

5. Appointment in the basic Category :-

(i) It shall be obligatory for the candidate to be a citizen of India for appointment in service. 67 percent posts of the basic category shall be filled by direct appointment and 33 percent posts shall be filled up by promotion.

(ii) The calculation of vacant posts for promotion and direct appointment, against the sanctioned posts in the category, shall be made separately as on 1st April, every year. This calculation shall be made on the basis of posts. It means that in case of the post of direct recruitment falling vacant, it shall be filled up by direct appointment and in case of the posts of promotion falling vacant it shall be filled by promotion. Reservation category wise requisition of these vacancies shall be sent by the Department to the Commission by 30th April.

(iii) Educational Qualification.—Minimum Educational qualification for direct recruitment to the post of basic category in the cadre, shall be degree of cachelor in statistics/Bachelor in Mathematics/Bachelor in Agriculture Statistics in Agriculture Science from any recognized Agriculture University/ Institute/Central University.

(iv) Appointment by Direct Recruitment :-

(a) Direct appointment shall be made from the candidates recommended on the casis of competitive examination conducted by the Commission.

(b) "Age limit".— The minimum age shall be 21 (Twenty One) years on the 1st August of the year in which application is invited. The maximum age limit shall be the same as may be prescribed by the department of General Administration, from time to time for direct appointment in the services of the State Government but it may be increased in special circumstances by the order of the State Government.

Provided that the upper age limit for direct appointment may be relaxed for the number of years the applicant is serving on similar contractual post under Government of Bihar and she/he has been appointed following the due process of appointment."

(c) Reservation.— The reservation provisions made by the Department of General Administration, from time to time for direct appointment of the State Government shall be applicable to it.

(d) For direct recruitment, the department shall send the requisition with number of post of general and reservation category wise vacancies every year to the Commission. (e) Subject and Syllabus for the Competitive Examination .— it shall be compulsory to pass in Hindi subject carrying 100 marks, in the competitive examination mentioned in Rule 5(iv)(a) of these Rules but it's obtained marks shall not be calculated for the purpose of preparation of merit list. The merit list shall be prepared on the basis of sum total of marks obtained in two question papers of graduation with statistics/mathematics/agriculture statistics in agriculture science each carrying 200 marks, one question paper of general knowledge carrying 100 marks and oral test of 50 marks. the syllabus of Hindi and General Knowledge, shall be the same, may be determined by the Bihar Public Service Commission for the joint competitive examination. The syllabus of graduation with statistics/mathematics/agriculture statistics in agriculture science shall be prepared by the department in consultation with the Bihar Public Service Commission. The candidates shall be called for oral test in appropriate number on the basis of sum total of marks obtained in aforesaid papers of agriculture science with mathematics, general knowledge. The oral examination shall carry 50 marks.

(f) The selection on basic grade posts shall be on the basis of the marks obtained in written and oral examination after giving weightage for the period of contractual appointment on the similar post.

For recruitment, determination of weightage marks

(g) Recommendation for candidates by the Commission.— The Commission shall prepare merit-list separately for the candidates of general category and each reservation category, on the basis of aggregate marks obtained in written, oral examination and weightage. The Commission shall recommend to the department from the list so prepared according to the reported vacancies.

6. Appointment by promotion.—The promotion from Bihar Agriculture Sub- Ordinate Service Category-9 (Statistics) to Bihar Agriculture Service Category-9 (Statistics) shall be made on the basis of seniority, work experience and efficiency of work.

The working employees under Bihar Agriculture Sub-ordinate Service, Category-9 (Statistics) shall be given promotion by the competent authority after considering the Kalawadhi determined by General Administration Department and availability of posts in the light of circular and policies framed from time to time and on the basis of seniority.

7. Probation.—

(i) Every member appointed by direct recruitment shall be on probation for the period of 2 years from the date of joining the post but in special circumstances, this period may be extended for one year by the department with reasons to be recorded in writing. if the work of a member is not found satisfactory during the extended period too, services of such members may be terminated by the government without asking any show cause, but its written information with reasons, shall be given.

(ii) The probation period shall be calculated for the purpose of regular service.

8. Training.— It shall be compulsory for the members appointed in the Bihar Agriculture Service to obtain training from the institute determined by the State Government. The training institutes shall be selected by the department, from time to time.

9. Departmental Examination :-

(i) It shall be compulsory for the members to pass the Departmental Examination conducted by the Central Examination Committee (Revenue Board).

(ii) The first increment in the pay scale of basic category shall be payable only after passing the Departmental Examination.

10. Confirmation :-

(i) After completing probation period, passing in the Departmental Examination, and obtaining the determined training satisfactorily, and services of the member of direct recruitment found clear the services shall be confirmed against the cadre posts in the basic category.

(ii) The services of the members appointed in the basic category by promotion, shall be confirmed subject to the conditions as laid down under Sub rule (i) (Except Probation).

11. Determination of Seniority.—The seniority of the members shall be determined as per the circulars and policies laid down by the Department of General Administration from time to time in such matters.

12. Promotion to Higher Post from the basic category :-

(i) In the hierarchy of service cadre, promotion shall be given to a member from the officers working just one post below, on the basis of seniority-cum-merit, in the light of orders issued by the department of general Administration, from time to time but the said promotion shall be given to the member only after completing the training as provided under Rule-8.

(ii) Promotion shall be given to working officers in the basic grade by the competent authority of the basis of seniority, confirmation in the basic category, confidential remarks, internal clearance, clearance of vigilance, and report of Lokayukta and Kalawadhi determined by the department of General Administration etc.

(iii) Departmental Promotion Committee.— It may be considered for promotion on the recommendation of the Departmental promotion committee. The Departmental Promotion Committee shall be constituted for department separately in the light of resolutions/ instructions issued by the Department of General Administration, from time to time.

13. Miscellaneous :-

(i) The department shall be competent to interpret the rule of these Rules for which if necessary, the opinion of General Administration department, Law Department and Finance Department shall be obtained.

(ii) The department may remove the difficulties, coming in implementation of any rule of these rules, by publication of appropriate order in the official Gazette after the opinion of the Law Department.

(iii) The subjects or points for which provisions are not made in these rules, the provisions made in these rules, the provisions made in the code/rules/resolution/instruction/for the time being enforced by the state Government, shall be applicable in context of this service in respect of them.

14. Repeals and Savings :-

(i) All Circulars/Instruction/resolution regarding appointment of staff/ service conditions, of this cadre, are hereby repealed.

(ii) Notwithstanding such repeal anything done or any action taken under the said Circulars/Instruction/Resolution shall be deemed to be done9 (cid:464)बहार गजट (असाधारण), 16 नव(cid:224)बर 2023 of taken under these Rules as if it were endorced on day on which such thing was done or such action was taken.
