सं॰ एल॰जी॰-01-12/2023-8974/लेज।—बिहार विधान मंडल द्वारा यथापारित का निम्नलिखित अधिनियम, जिसपर माननीय राज्यपाल दिनांक 18 नवम्बर 2023 को अनुमति दे चुके हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है ।

बिहार पदों एवं सेवाओं की रिक्तियों में आरक्षण (अनुसूचित जातियों, अनुसूचित जनजातियों एवं अन्य पिछड़े वर्गों के लिए) अधिनियम, 1991 (बिहार अधिनियम 03, 1992) (समय-समय पर यथा संशोधित) को संशोधित करने के लिए अधिनियम। जहाँ कि भारत के संविधान द्वारा सामाजिक, आर्थिक और राजनैतिक समेत सभी पहलुओं में न्याय की व्यवस्था लागू की गयी है।
जहाँ कि, राज्य सरकार के स्तर से स्थिति और अवसर की समानता प्राप्त करने और इन सभी को बढ़ावा देने का प्रयास किया जाना है।
जहाँ कि राज्य सरकार द्वारा व्यक्तियों और व्यक्तियों के समूह बीच आय के असमानताओं, प्रयास के अवसर, स्थिति, सुविधाओं और अवसरों की असमानताओं कोे कम करने का प्रयास किया जाना है।
जहाँ कि राज्य सरकार द्वारा अनुसूचित जाति/अनुसूचित जनजाति और अन्य कमजोर वर्गों के शैक्षिक और आर्थिक हितों को बढ़ावा दिया जाना है।
जहाँ कि भारतीय संविधान के अनुच्छेद 15 और 16 में सकारात्मक कार्रवाई के लिए सक्षम प्रावधान किए गये हैं।
जहाँ कि इस हद तक संविधान के भाग- IX-(A) में आदेश दिया गया है कि, प्रत्येक पंचायत और नगर निकायों में अनुसूचित जाति और अनुसूचित जनजाति के लिए सीटें आरक्षित की जाएंगी और इस प्रकार आरक्षित सीटों की संख्या लगभग उसी अनुपात में होगी। उस पंचायत/शहरी स्थानीय निकायों में सीधे चुनाव द्वारा भरी जाने वाली सीटों की कुल संख्या, क्योंकि उस क्षेत्र में अनुसूचित जाति या उस क्षेत्र में अनुसूचित जनजाति की जनसंख्या उस क्षेत्र की कुल जनसंख्या से मेल खाती है।
जहाँ कि राज्य का अनिवार्य रूप से सामाजिक, आर्थिक और राजनैतिक न्याय सुरक्षित करना वैध उद्देश्य होना चाहिए।
जहाँ कि राज्य सरकार द्वारा अन्य तथ्यों के साथ-साथ राज्य के निवासियों के स्थान की सामाजिक, आर्थिक, शैक्षणिक स्थिति का पता लगाने के लिए जाति सर्वेक्षण कराया गया है।
जहाँ कि जाति सर्वेक्षण के दौरान एकत्र किए गए आंकड़ों के विश्लेषण से यह स्पष्ट है कि अवसर और स्थिति में समानता के संविधान में पोषित लक्ष्य को पूरा करने के लिए पिछड़े वर्गों, अनुसूचित जाति और अनुसूचित जनजाति के बड़े हिस्से को बढ़ावा देने की आवश्यकता प्रतीत होती है।
जहाँ कि अनुसूचित जाति/अनुसूचित जन जाति एवं अन्य पिछड़े वर्गों के सदस्य सदियों से वंचित और हाशिये पर रहे हैं। यद्यपि संविधान के अंतर्गत साकारात्मक उपाय एवं अनेक कल्याणकारी योजनाओं के द्वारा इनके जीवन मेें उत्थान के लिये कुछ हद तक प्रयास किये गये हैं, हालांकि अभी तक यह लक्ष्य पूरा नहीं हो सका है। तथ्य इस धारणा को मजबूत करते हैं कि राज्य सरकार को पहले से मौजूद उपायाें के अतिरिक्त अनुपातिक समानता के अंतिम उदेश्य में तेजी लाने के लिये और अतिरिक्त कदम उठाने की आवश्यकता है।
जहाँ कि भारतीय संविधान में एक संशोधन के द्वारा आर्थिक रूप से कमजोर वर्गों के लिये 10 प्रतिशत आरक्षण का प्रावधान किया गया है।
जहाँ कि जाति सर्वेक्षण के क्रम में पता चला है कि अनारक्षित वर्ग की आबादी, अल्पसंख्यक समुदाय सहित, राज्य की कुल आबादी में लगभग 15 प्रतिशत है।
जहाँ कि आर्थिक रूप से कमजोर वर्ग के लिए 10 प्रतिशत आरक्षण राज्य में उनकी आबादी-प्रतिशत के संदर्भ में 64.5 प्रतिशत हिस्सेदारी दिखलाता है।
जहाँ कि आंकड़ों से पता चलता है कि राज्य सरकार की सेवाओं में अनुसूचित जाति/अनुसूचित जनजाति एवं अन्य पिछड़े वर्गोें के सदस्यों का प्रतिनिधित्व अनुपातिक रूप से कम है।
जहाँ कि अनुपातिक समानता को प्राप्त करने के लिये उपायों एवं साधनों को प्रस्तुत किया जाना आवश्यक है। जहाँ कि अनुसूचित जाति/अनुसूचित जनजाति एवं अन्य पिछड़े वर्गोें के उत्थान एवं राज्य की प्रगति के लिये इनके वर्तमान आरक्षण पर पुनर्विचार किया जाना आवश्यक है।3 (cid:464)बहार गजट (असाधारण), 21 नव(cid:224)बर 2023 इसलिये सम्प्रति राज्य सरकार ऐसे हाशिये पर रहने वाले वर्गों के लाभ पहुँचाने की दृष्टि से नियमानुसार अधिनियमित किया जाए। भारत-गणराज्य के चौहत्तरवें वर्ष में बिहार राज्य विधानमंडल द्वारा निम्नलिखित रूप में अधिनियमित हो :-
(1) यह अधिनियम ''बिहार पदों एवं सेवाओं की रिक्तियों में आरक्षण (अनुसूचित जातियों, अनुसूचित जनजातियों एवं अन्य पिछड़े वर्गों के लिए) (संशोधन) अधिनियम, 2023'' कहा जा सकेगा। (2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत्त होगा।
(क) उक्त अधिनियम की धारा-4(1), 4(2) एवं 4(3) निम्न से प्रतिस्थापित किया जाएगा- 4.
:-
(1) किसी स्थापना में सेवाओं और पदों की सभी नियुक्तियाँ, जो सीधी भर्ती के द्वारा भरी जानेवाली हों, निम्नलिखित रूप में विनियमित की जायेंगी यथाः-
(क) खुली गुणागुण कोटि से - 35 प्रतिशत (ख) आरक्षित कोटि से - 65 प्रतिशत
(2) आरक्षित कोटि की 65 प्रतिशत रिक्तियों में से, आरक्षित उम्मीदवारों की विभिन्न कोटियों की रिक्तियां इस अधिनियम के अन्य उपबंधों के अध्यधीन निम्नलिखित रूप में होगीः- (क) अनुसूचित जातियां - 20 प्रतिशत (ख) अनुसूचित जन जातियां - 02 प्रतिशत (ग) अत्यन्त पिछड़ा वर्ग - 25 प्रतिशत (घ) पिछड़ा वर्ग - 18 प्रतिशत
परंतु यह और कि प्रोन्नति के मामलें में केवल अनुसूचित जाति/अनुसूचित जन-जाति के लिये इस धारा में यथा उपबंधित अनुपात में आरक्षण किया जायेगा।
(3) आरक्षित कोटि के उम्मीदवार जो अपने गुणागुण के आधार पर चुने जाते हैं, की गणना खुला गुणागुण कोटि की 35 प्रतिशत रिक्तियों के विरुद्ध की जायेगी न कि आरक्षण कोटि की रिक्तियों के विरुद्ध ।
(ख) बिहार अधिनियम 11,1993 की धारा- 2(v) को विलोपित किया जाएगा। (ग) बिहार अधिनियम 11,1993 की धारा- 4(2)(ड़) को विलोपित किया जाएगा। (घ) बिहार अधिनियम 11,1993 की धारा- 4(2)(ii) को विलोपित किया जाएगा। (ड़) बिहार अधिनियम 11,1993 की धारा- 4(2)(iii) में अंकित ''तथा पिछड़े वर्ग की
महिलाओं'' को विलोपित किया जाएगा।
एतद्संबंधी पूर्व में निर्गत ऐसे सभी आदेश / संकल्प / परिपत्र/अधिनियम
आदि, जो इस संशोधन अधिनियम से असंगत हो, इस हद तक संशोधित समझे जाएंगे।
ऐसे निरसन के होते हुए भी, उक्त संशोधन द्वारा या इसके अधीन प्रदत्त शक्तियों के प्रयोग में किया गया निर्णय/कार्रवाई वर्त्तमान संशोधन अधिनियम के अधीन की गयी समझी जाएगी।

(बिहार अधिनियम 19, 2023) का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा ।
बिहार-राज्यपाल के आदेष से, ज्योतिस्वरूप श्रीवास्तव, सरकार के सचिव (प्र॰)।4 (cid:464)बहार गजट (असाधारण), 21 नव(cid:224)बर 2023 [Bihar Act 19, 2023] THE BIHAR RESERVATION OF VACANCIES IN POSTS AND SERVICES (FOR SCHEDULED CASTES, SCHEDULED TRIBES AND OTHER BACKWARD CLASSES) (AMENDMENT) ACT, 2023 AN ACT To amend the Bihar Reservation of Vacancies in Posts and Services (For Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1991 (Bihar Act 03, 1992) (As amended from time to time).
Preamble:-
Whereas, the Constitution of India has ordained justice in all its facets including social, economic and political, Whereas, State has to strive to achieve equality of status and of opportunity and to promote among them all, Whereas, State has to strive to minimize the inequalities in income, endeavour opportunity, eliminate inequalities in status, facilities and opportunities, amongst individuals as also amongst groups of people, Whereas, State has to promote educational and economic interests of schedule Caste/Schedule Tribe and other weaker sections, Whereas, Article 15 and 16 of the Constitution of India has made enabling provision for affirmative action, Whereas, in Part-IX-(A) the Constitution has mandated that seats shall be reserved for Schedule Caste and Schedule Tribe in every Panchayat and municipal Bodies and number of seats so reserved shall bear as nearly as may be, the same proportion to the total number of seats to be filled by direct election in that Panchayat / Urban Local Bodies, as the population of Schedule Caste in that area or of the Schedule Tribe in that area bears to the total population of that area, Whereas, State should essentially have legitimate aim to secure justice, social, economic and political, Whereas, the State Government has conducted 'Caste based Survey 2022-23' to ascertain inter alia, social, economic, educational status of its domicile, Whereas, on analysis of data collected during 'Caste based Survey 2022-23', it is apparent that large section of backward classes, schedule caste and schedule tribe need to be promoted for them to catch up to satisfy cherished aim in the Constitution of equality in opportunity and status, Whereas, members of SC/ST and Other Backward Classes have remained deprived and marginalized or centuries. Though, affirmative major under the Constitution and several welfare schemes have made improvement in their life to certain extent, however the ultimate goal of equality has not yet been achieved. Date further strengthens the perception that in addition to majors already in place the State is required to take further majors to accelerate ultimate object of proportional equality, Whereas, by an amendment in the Constitution of India, 10% reservation has been provided in favour of Economically Weaker Section, Whereas, the population of unreserved category as ascertained in course of caste based survey is about 15% including that of unreserved minority community out of the total population of the State, Whereas 10% reservation in favour of EWS in context of their population- percentage in the State works out to be approximately 64.5%,5 (cid:464)बहार गजट (असाधारण), 21 नव(cid:224)बर 2023 Whereas the date reveals that in services of the Government members of SC/ST and Other backward Classes are still comparatively less in proportion, Whereas it is imperative to introduce ways and means to achieve proportional equality, Whereas, reservation in favour of S.C./S.T. and Other Backward classes needs to be revisited for not only their development but development of the State as a whole, Now, therefore, with a view to extend the benefit to such marginalized section of the State be it enacted as follows: Be it enacted by the Legislature of the State of Bihar in the Seventy-fourth year of the Republic of India as follows:
1. Short Title, extent and commencement.—
(1) This Act may be called "The Bihar Reservation of Vacancies in posts and services (for Scheduled Castes, Scheduled Tribes and Other Backward Classes) (Amendment)Act, 2023".
(2) It extends to the whole of the State of Bihar. (3) It shall come into force with immediate effect.
2. Amendment of the Bihar Reservation of Vacancies in Posts and Services (For Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1991 (Bihar Act 03, 1992):-
(a) Section-4(1), 4(2) and 4(3) of the aforesaid Act will be substituted as follows: 4. Reservation for direct recruitment .— All appointments to services and posts in an establishment which are to be filled by direct recruitment shall be regulated in the following manner, namely:-
(1) The available vacancies shall be filled up-
(a) From open merit category - 35% (b) From reserved category - 65%
(2) The vacancies from different categories of reserved candidates from amongst the 65% reserved category shall, subject to other provisions of this Act, be as follows –
(a) Scheduled Castes - 20 % (b) Scheduled Tribes - 02 % (c) Extremely Backward Class - 25 % (d) Backward Class - 18 % Total - 65 %
Provided further that in case of promotion reservation shall be made only for Scheduled Castes/Scheduled Tribes in the same proportion as provided in this section.
(3) A reserved category candidate who is selected on the basis of his merit shall be counted against 35% vacancies of open merit category and not against the reserved category vacancies.
(b) Section-2(V) of Bihar Act 11,1993 will be deleted. (c) Section-4(2)(e) of Bihar Act 11,1993 will be deleted. (d) Section-4(2)(ii) of Bihar Act 11,1993 will be deleted. (e) In Section-4(2)(iii) of Bihar Act 11,1993 mentioned "and
Women of Backward Classes" will be deleted.
6 (cid:464)बहार गजट (असाधारण), 21 नव(cid:224)बर 20233. Repeal and Savings.— All Orders / Resolution / Circulars / Acts which are inconsistent with this amendment Act shall be deemed to be amended to this extent.
Notwithstanding such repeal, any decision/action already taken under repealed provision shall be deemed to be validly made under present amending Act.
