सं॰ : Exp-21/2020/(खंड-150) बेलदौर-108—लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग के आदेष संख्या- 76/बिहार-वि.स./2020/150/सी.ई.एम.एस.-III दिनांक 14.11.2023 से एतद्द्वारा घोशित किया गया है कि बिहार राज्य के 150-बेलदौर विधान सभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लडने वाले अभ्यर्थी श्री गणेष सदा, निवासी ग्राम- बधरा, (ददरोजा), पो.- कुरबन, वार्ड नं.- 12, थाना- बेलदौर इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है (हिन्दी एवं अंग्रेजी में) सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती हैं।

———— आदेष िनवा(cid:170)चन सदन, अशोक रोड, नई िद(cid:208)ली– 110001/ तारीख- 14 नवम्बर, 2023/23 कार्तिक, 1945 (षक)
सं. 76/बिहार-वि.स./2020/150/सी.ई.एम.एस.-III— यतः, भारत निर्वाचन आयोग द्वारा बिहार राज्य में विधान सभा के साधारण निर्वाचन 2020 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./64/2020 दिनांक 25 सितम्बर, 2020 के जरिए की गई थी। यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लडने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और
यतः 150-बेलदौर विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 नवंबर, 2020 को घोशित किए गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 10 दिसम्बर, 2020 थी; और
यतः, जिला निर्वाचन अधिकारी, खगड़िया, बिहार के पत्र सं. 240/निर्वा. दिनांक 21 दिसंबर, 2020 द्वारा प्रस्तुत और संयुक्त मुख्य निर्वाचन अधिकारी, बिहार द्वारा पत्र सं.Exp-21/2020 (खंड- 150) बेलदौर- 36 के जरिए अग्रेशित दिनांक 04 जनवरी, 2021 की रिपोर्ट के अनुसार श्री गणेष सदा, जो बिहार विधान सभा का साधारण निर्वाचन 2020 के निर्वाचन क्षेत्र 150-बेलदौर से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और
यतः, जिला निर्वाचन अधिकारी, खगड़िया, बिहार, और मुख्य निर्वाचन अधिकारी, बिहार की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री गणेष सदा, को कारण बताओ नोटिस 76/बिहार-वि.स./2020/150/सी.ई.एम.एस.-III दिनांक 25 जून, 2021 जारी किया गया था; और
यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 25 जून, 2021 के उपर्युक्त कारण बताओ नोटिस के जरिए श्री गणेष सदा, को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और
यतः, जिला निर्वाचन अधिकारी, खगड़िया, द्वारा अपने दिनांक 19.07.2021 के पत्र संख्या 220/निर्वा॰, के जरिए, आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 09.07.2021 को प्राप्त किया गया था; और
यतः, जिला निर्वाचन अधिकारी, खगड़िया, द्वारा दिनांक 08.07.2022 के पत्र संख्या 277/निर्वा॰ के जरिए भेजी की गई अनुपूरक संवीक्षा रिपोर्ट दिनांक 07.07.2022 में यह बताया गया है कि श्री गणेष सदा ने अपना व्यय लेखा अपेक्षित रीति से दाखिल नहीं किया है। यतः, आयोग ने अभ्यर्थी श्री गणेष सदा, को व्यय लेखा को अपेक्षित रीति से दाखिल करने के लिए पत्र दिनांक 30.01.2023, 19.05.2023 एवं 14.08.2023 के द्वारा अन्तिम अवसर दिया था; और
यतः जिला निर्वाचन अधिकारी, खगड़िया, द्वारा दिनांक 09.10.2023 के पत्र संख्या 751/निर्वा॰, के जरिए बताया कि अभ्यर्थी ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा अपेक्षित रीति से दाखिल किया है; और
यतः आयोग का यह समाधान हो गया है कि श्री गणेष सदा, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और
यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः-
''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा हैः तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा;
अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोशणा करता है कि बिहार राज्य के 150-बेलदौर विधान सभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लडने वाले अभ्यर्थी श्री गणेष सदा, निवासी ग्राम- बधरा, (ददरोजा), पो.- कुरबन, वार्ड नं.- 12, थाना- बेलदौर को इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

No.-76/BR-LA/2020/150/CEMS-III--WHEREAS, the General Election to the Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020.
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and
WHEREAS, the result of the said election along with 150-Beldaur Assembly Constituency was declared by the concerned Returning Officer on 10th November, 2020, Hence, the last date for lodging the account of Election Expenses was 10th December, 2020; and
WHEREAS, as per the report dated 21st December, 2020, vide letter no. 240/Nirva. submitted by the District Election Officer, Khagaria, Bihar and forwarded by the Joint Chief Electoral Officer, Bihar vide letter No. Expenditure-21/2020(Vol-150), Beldaur-36 dated 04th January, 2021, Sh. Ganesh Sada, a contesting candidate of Bihar from 150- Beldaur Assembly Constituency of Bihar, has failed to lodge any account of his election expenses, in the manner, as required under law; and
WHEREAS, on the basis of the reports of the District Election Officer, Khagaria, Bihar and the Chief Electoral Officer, Bihar, a Show- Cause notice, 76/BR- LA/2020/150/CEMS-III dated 25th June, 2021 was issued under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Ganesh Sada, for not lodging the account of Election expenses; and
WHEREAS, As per sub rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show-Cause Notice, dated 25th June, 2021, Sh. Ganesh Sada, was directed to submit his representation in writing with explaining the reason for not lodging the accounts and to lodge his accounts of election expenses within 20 days from the date of receipt of the notice; and
WHEREAS, the said notice was received by the candidate on 09.07.2021 at the address given by candidate. The acknowledgment receipt has been submitted to the Commission by District Election Officer, Khagaria, vide letter no. 220/Nirva. dated 19.07.20211; and
WHEREAS, the District Election Officer, Khagaria, in his Supplementary Report dated 07.07.2023, vide its letter No. 277/Nirva., dated 08.07.2022 has reported that Sh. Ganesh Sada has not submitted his account in manner required under law.
WHEREAS, the Commission had given last opportunity to submit his account in manner require under law letter dated 30.01.2023, 19.05.2023 & 14.08.2023; and
WHEREAS, District Election Officer, Khagaria, has reported vide his letter 751/Nirva. dated 09.10.2023 that the candidate has neither submitted any representation nor any statement of account of election expenses in manner required under law; and
WHEREAS, the Commission is satisfied that Sh. Ganesh Sada has failed to lodge the account of election expenses and has no good reason or justification for the failure, and WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that :- and "If the Election Commission is satisfied that a person:
;बपकरू464द्ध ;द्ध 6 ;बपकरू464द्ध;बपकरू224द्ध 2023 4(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and (b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order'';
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares Sh. Ganesh Sada, resident of Gram- Badhra, (Dadrouja), Post- Kurban, Ward No. 12, Thana- Beldaur a contesting candidate from 150- Beldaur Assembly Constituency of the state of Bihar in the General Election to the Legislative Assembly of Bihar, 2020 to the disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
