संŒ बी0/आ0अ0ई0-03/2023-13868--pूँकि यह अभिकथित किया गया है कि श्री धर्मवीर पाण्डेय, पिता-स्व0 जगदीष नारायण पाण्डेय, सा0-बानूछापर, थाना-मुफ्‌सिल, जिला-पष्चिम चम्पारण (बेतिया), वर्तमान पता-सा0-फ्लैट नं0- 102-बी, गीत एनक्लेव, श्रीकृष्ण बिहार कॉलोनी, थाना-बेउर, जिला-पटना ने बिहार राज्य में कृषि विभाग के अन्तर्गत पूर्वी चम्पारण (मोतिहारी) में तत्कालीन जिला कृषि पदाधिकारी (वर्तमान में अनिवार्य सेवानिवृत्त) का पद धारण करते हुए अन्य के साथ भ्रष्टाचार निवारण अधिनियम, 1988 की धारा 13 की उप धारा (1) के खंड (ई) के अधीन अपराध किया और मामले की जांच आर्थिक अपराध थाना कांड सं0-21/2013, दिनांक-07.10.2013 धारा 13 (2) सह पठित धारा 13(1)(ई) संषोधित धारा- 13(1)(बी) भ्रष्टाचार निवारण अधिनियम, 1988 में की गई है;

और चूंकि अभिलेख में उपलब्ध सुसंगत सामग्री की छानबीन करने पर राज्य सरकार की राय है कि श्री धर्मवीर पाण्डेय, पिता-स्व0 जगदीष नारायण पाण्डेय, सा0-बानूछापर, थाना-मुफ्‌सिल, जिला-पष्चिम चम्पारण (बेतिया), बिहार, तत्कालीन जिला कृषि पदाधिकारी (वर्तमान में अनिवार्य सेवानिवृत्त), पूर्वी चम्पारण (मोतिहारी), कृषि विभाग, बिहार सरकार, जिसने भ्रष्ट साधनों का सहारा लेकर अन्य के साथ अपने आय के ज्ञात स्रोत से अननुपातिक संपत्ति संचित किया है, पर प्रथम दृष्टया केस बनता है;

और चूंकि सरकार को यह आवष्यक और समीचीन प्रतीत होता है कि उक्त अपराधियों पर विषे"ा न्यायालय अधिनियम, 2009 (बिहार अधिनियम 5, 2010) की धारा 3 की उपधारा (1) के अधीन स्थापित विषेष न्यायालय द्वारा विचारण किया जाए;

इसलिए, अब विषेष न्यायालय अधिनियम, 2009 की धारा 5 की उपधारा (1) द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए राज्य सरकार एतद्‌ द्वारा यह घोषणा करती है कि उक्त अपराध का निपटारा विषेष न्यायालय अधिनियम, 2009 के अधीन किया जाएगा।

संŒ बी0/आ0अ0ई0-03/2023-13868 का अंग्रेजी में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाषित किया जाता है जो भारतीय संविधान के अनुच्छेद-348 के खण्ड (3) के अधीन अंग्रेजी भाषा में इसका प्राधिकृत पाठ समझा जाएगा ।

(Under Section 5 of the Bihar Special Courts Act, 2009, and Rules 7 of Bihar

Special Courts Rules, 2010)

No. बी0/आ0अ0ई0-03/2023-13868--WHEREAS, It was alleged that SHRI DHARAMVIR PANDEY, S/O-Late Jagdish Narayan Pandey, Vill.-Banuchappar, P.S.-Mufassil, Distt.-West Champaran (Bettiah), A/P- Flat N0.-102/B, Geet Enclave, Shree Krishna Bihar Colony, P.S.-Beur, Distt.-Patna, Bihar while holding the post of the District Agriculture Officer, East Champaran (Motihari), Agriculture Department, Govt. of Bihar (at present compulsory retirement) and serving in different capacities under Government of Bihar committed an offence alongwith others accused under clause (e) of sub-section (1) of Section 13 of the Prevention of Corruption Act, 1988 and that the matter is being investigated in Economic Offences P.S. Case No. 21/2013, dated 07.10.2013, under section 13(2) read with 13(1)(e) and amended section 13(1)(b) of the Prevention of Corruption Act, 1988.

AND WHEREAS, on scrutiny of relevant materials available on record, the State Government is of the opinion that there is prima facie case of commission of above mentioned offence by the said SHRI DHARAMVIR PANDEY, S/O-Late Jagdish Narayan Pandey, Vill.-Banuchappar, P.S.-Mufassil, Distt.-West Champaran (Betiah), the then District Agriculture Officer, East Champaran (Motihari), Agriculture Department, Govt. of Bihar (at present compulsory retirement) and others accused who have accumulated properties disproportionate to his known sources of income by resorting to corrupt means;

AND WHEREAS, it is felt necessary and expedient by the Government that the said offenders should be tried by the Special Court Established under sub-section (1) of Section 3 of Bihar Special Courts Act, 2009;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 5 of Bihar Special Courts Act, 2009, the State Government do hereby declare that the said offence shall be dealt with under the Special Courts Act, 2009.
