सं. 11/नियमावली 01-02/2023-2460—भारत के संविधान के अनुच्छेद 309 के "परन्तुक" के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल स्थानीय निकायों द्वारा नियुक्त शिक्षकों को ''बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्त) नियमावली, 2023'' के तहत नियुक्त किए गए विद्यालय अध्यापकों के समान करने हेतु निम्नलिखित नियमावली बनाते हैं :-

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह अधिसूचना निर्गत होने की तिथि से प्रवृत होगी।

2.

(1) इस नियमावली में जब तक विषय या संदर्भ के विरूद्ध कोई बात न हो - i. से अभिप्रेत है बिहार सरकार; ii. से अभिप्रेत है शिक्षा विभाग; iii. से अभिप्रेत है संबंधित जिले का जिला शिक्षा पदाधिकारी; iv. से अभिप्रेत है संबंधित जिले का जिला शिक्षा पदाधिकारी; v. से अभिप्रेत है संबंधित प्रमंडल का क्षेत्रीय शिक्षा उप निदेशक; vi. से अभिप्रेत हैं, इस नियमावली के नियम-4 के तहत सक्षमता परीक्षा उत्तीर्ण ऐसे सभी शिक्षक जिन्हें स्थानीय निकायों द्वारा नियुक्त किया गया है और जो संबंधित स्थानीय निकाय शिक्षक नियमावली 2020 के अन्तर्गत आते हैं;

vii. से अभिप्रेत है वैसे व्यक्ति जो संबंधित स्थानीय निकाय शिक्षक नियमावली 2020 के अन्तर्गत कार्यरत हैं, उन्हें विशिष्ट शिक्षक के समान माना जायेगा, बशर्त्ते वे इस नियमावली के नियम-4 के तहत सक्षमता परीक्षा उत्तीर्ण हों। हालाँकि, उन्हें पुस्तकालयाध्यक्ष के रूप में हीं सम्बोधित किया जाता रहेगा;

viii. से अभिप्रेत है बिहार पंचायत राज अधिनियम, 2006 के अधीन गठित जिला परिषद्‌, पंचायत समिति, ग्राम पंचायत जिसमें बिहार नगरपालिका अधिनियम, 2007 के अधीन गठित नगर निगम, नगर परिषद्‌ और नगर पंचायत शामिल हैं;

से अभिप्रेत है ''बिहार पंचायत प्रारंभिक विद्यालय सेवा (नियुक्ति, प्रोन्नति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली, 2020'', ''बिहार नगर प्रारंभिक विद्यालय सेवा (नियुक्ति, प्रोन्नति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली, 2020'', ''बिहार जिला परिषद्‌ माध्यमिक एवं उच्च माध्यमिक विद्यालय सेवा (नियुक्ति, प्रोन्नति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली, 2020'' तथा ''बिहार नगर निकाय माध्यमिक एवं उच्च माध्यमिक विद्यालय सेवा (नियुक्ति, प्रोन्नति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली, 2020'';

x. स्थानीय निकाय शिक्षक नियमावली 2020 से आच्छादित '' इस नियमावली से आच्छादित नहीं माने जायेंगे। xi. संबंधित स्थानीय निकाय शिक्षक नियमावली 2020 के से आच्छादित को विशिष्ट शिक्षक के समान माना जायेगा, बशर्ते वे इस नियमावली के नियम-4 के तहत सक्षमता परीक्षा उत्तीर्ण हों। हालाँकि, उन्हें शारीरिक शिक्षक के रूप में हीं सम्बोधित किया जाता रहेगा;

से अभिप्रेत है विशिष्ट शिक्षक जिसे सक्षम प्राधिकार द्वारा इस xii.

तरह घोषित किया गया है;

(2) अन्य कोई परिभाषा जो इस नियमावली में वर्णित न हो, बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली, 2023 के नियम 2 में दी गई परिभाषाओं से परिभाषित होगी;

(1) स्थानीय निकाय के विभिन्न स्तरों (पंचायतीराज/नगर निकाय) द्वारा नियुक्त सभी शिक्षकों को नियम-4 के तहत सक्षमता परीक्षा उत्तीर्ण करना आवश्यक होगा तथा सक्षमता परीक्षा में उत्तीर्ण होने एवं ऐसी सक्षमता परीक्षा के उपरांत आवंटित विद्यालय में योगदान के पश्चात्‌ वे ''विशिष्ट शिक्षक'' कहलाएंगे। स्थानीय निकायों के विभिन्न स्तरों पर कार्यरत विशिष्ट शिक्षकों को सक्षमता परीक्षा उत्तीर्ण करने एवं ऐसी सक्षमता परीक्षा के उपरांत आवंटित विद्यालय में योगदान करने की तिथि से जिला स्तर पर एकल संवर्ग के रूप में विलय हो जाएंगे। वे एक अलग संवर्ग का गठन करेंगे जिनकी सेवाशर्तों को अब से इस नियमावली द्वारा विनियमित किया जाएगा।

बशर्ते कि नियम-4 के तहत सक्षमता परीक्षा उत्तीर्ण करने पर ये विशिष्ट शिक्षक बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली, 2023 के अधीन नियुक्त विद्यालय अध्यापकों के वेतन एवं अन्य लाभ पाने हेतु पात्र होंगे।

बशर्ते यह कि आगे, ऐसे स्थानीय निकाय शिक्षक जो विशिष्ट शिक्षक बन जाते हैं, तथा जिनके विरुद्ध आज की तिथि तक कोई अनुशासनिक कार्रवाई, सतर्कता जाँच या कोई अन्य अन्वेषण लंबित है, वह इस नयी नियमावली के उपबंधों के अनुसार जारी रहेगा।

(2) जब कभी विशिष्ट शिक्षक सेवानिवृत्त हो जाता है या त्याग पत्र दे देता है या बर्खास्त कर दिया जाता है, तो परिणामी रिक्ति पर स्थानीय निकाय द्वारा नियुक्ति नहीं की जा सकेेगी। विभाग द्वारा परिणामी रिक्ति का नियत प्रतिशत विशिष्ट शिक्षक के प्रोन्नति हेतु एवं शेष को ''बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त) नियमावली, 2023'' के तहत नियुक्त विद्यालय अध्यापकों के संवर्ग को स्थानान्तरित करने हेतु सक्षम होगा।

(3) वैसे शिक्षक जो नियम-4 के तहत सक्षमता परीक्षा में शामिल या उत्तीर्ण नहीं होते हैं, "स्थानीय निकाय" शिक्षक के रूप में बने रहेंगे।

विभाग अपने द्वारा एक सरकारी एजेंसी के माध्यम से इन सभी कार्यरत स्थानीय निकाय शिक्षकों के लिए सक्षमता परीक्षा आयोजित करेगा। सक्षमता परीक्षा इस नियमावली के प्रवृत होने की तिथि से एक वर्ष के अवधि में आयोजित की जायेगी। प्रत्येक स्थानीय निकाय शिक्षक को सक्षमता परीक्षा उत्तीर्ण करने हेतु तीन अवसर प्रदान किया जायेगा। परीक्षा में शामिल होने के समय स्थानीय निकाय शिक्षक को उन जिलों के तीन विकल्प देने होंगे, जहाँ वह विशिष्ट शिक्षक के रूप में सेवा देना चाहते हैं। सक्षमता परीक्षा में उनकी मेधा क्रमांक के आधार पर जिलों का आवंटन किया जायेगा।3 (cid:464)बहार गजट (असाधारण), 26 (cid:465)दस(cid:224)बर 2023 बशर्ते कि, वैसे शिक्षकों जो इस परीक्षा में शामिल नहीं होते हैं अथवा तीसरे प्रयास/अवसर में भी सक्षमता परीक्षा उत्तीर्ण होने में विफल रहेंगे, का मामला विभाग द्वारा अलग से विचार किया जायेगा। विभाग ऐसे सभी स्थानीय निकाय शिक्षकों के मामले पर विचार करने हेतु एक समिति का गठन करेगा और जो सरकार से उचित अनुशंसा करेगा तथा स्थानीय निकाय शिक्षक नियमावली, 2020, उस हद तक संशोधित समझा जाएगा। 5.

इस नियमावली के तहत अनुकंपा के आधार पर नियुक्ति के अलावा अन्य कोई सीधी नियुक्ति नहीं होगी। विशिष्ट शिक्षकों का अनुकंपा के आधार पर कोई भी नियुक्ति विभाग द्वारा आयोजित दक्षता परीक्षा उत्तीर्ण होने पर निर्भर करेगा।

परन्तु अनुकंपा के आधार पर नियुक्ति, विभाग की प्रचलित नीति, पात्रता एवं रिक्ति के अनुसार की जाएगी।

6. ऐसे कार्यरत स्थानीय निकाय शिक्षक, विशिष्ट शिक्षक बनने के उपरान्त उसी आरक्षण श्रेणी से सम्बद्ध रहेंगे जिसके लिए उन्हें स्थानीय निकायों द्वारा नियुक्त किया गया था।

7.

7.1 जिला स्तर पर विशिष्ट शिक्षकों की एक वरीयता सूची संधारित की जाएगी। शिक्षकों की प्रत्येक श्रेणी यथा प्राथमिक, मध्य, माध्यमिक और उच्च माध्यमिक के लिए विषयवार एक अलग वरीयता सूची तैयार की जाएगी।

7.2 विशिष्ट शिक्षकों की वरीयता निम्नलिखित मानदंडों के अनुसार तैयार की जाएगीः- क. स्थानीय निकाय शिक्षक के रूप में प्रशिक्षत वेतनमान प्राप्त करने की तिथि। ख. जहाँ दो शिक्षक उपर्युक्त मानदंड (क) के अनुसार एक ही तिथि साझा करते हैं, उनकी जन्म तिथि वरीयता तय करने के लिए मानदंड होगी।

ग. जहाँ दो शिक्षक उपर्युक्त मानदंड (ख) के अनुसार एक ही तिथि साझा करते हैं, अंग्रेजी वर्णमाला क्रम में शिक्षक का नाम, वरीयता तय करेगा।

ा. उपयुक्त मानदंडों में फिट नहीं होने वाले किसी अन्य मामले का निर्णय विभाग द्वारा किया जाएगा।

8.

8.1 विशिष्ट शिक्षक, स्थानीय निकाय नियमावली, 2020 के तहत उन्हें प्रदान किए गए पूर्ण वेतन संरक्षण (पे-प्रोटेक्सन) प्राप्त करेंगे।

8.2 इसके अलावा इस नियमावली के प्रभावी होने पर, उनका वेतन फिटमेंट मैट्रिक्स के अनुसार देय होगा। अन्य भो राज्य सरकार की प्रचलित दरों के अनुसार महंगाई भाा, मकान किराया भाा, चिकित्सा भाा और शहरी परिवहन भाा सहित शामिल है।

8.3 फिटमेंट मैट्रिक्स के अनुसार होगा। फिटमेंट मैट्रिक्स इस नियमावली के अनुसार विशिष्ट शिक्षकों की नियुक्ति को इंगित करता है।

9.2 अधिकार के रूप में किसी भी प्रोन्नति का दावा नहीं किया जा सकता है। सभी प्रोन्नति उपलब्ध रिक्तियों के अधीन होगी और विभागीय नीतियों को ध्यान में रखते हुए की जाएगी। इसके अलावा, सभी प्रोन्नति, विभाग की प्रचलित नीति के अनुसार की जाएगी और अपेक्षित योग्यता सहित पात्रता के अधीन होगी।4 (cid:464)बहार गजट (असाधारण), 26 (cid:465)दस(cid:224)बर 2023 10.

10.1 विशिष्ट शिक्षकों का पद राज्य के अन्तर्गत स्थानांतरणीय होगा। प्रारंभ में नियम-4 के अनुसार सक्षमता परीक्षा में शामिल होने के समय, इनसे उन तीन जिलों की प्राथमिकताएँ मांगी जायेगी, जहाँ वे अपनी सेवा देना चाहते हों। सक्षमता परीक्षा में उनकी मेधा क्रमांक के आधार पर उन्हें उनके द्वारा चुना गया जिला प्राप्त होगा, अन्यथा रेन्डोमाइजेशन के आधार पर जिला आवंटित किया जायेगा। 10.2 विशिष्ट शिक्षकों को सामान्य रूप से जिला शिक्षा पदाधिकारी द्वारा शिक्षा का अधिकार अधिनियम, छात्र-शिक्षक अनुपात अथवा जनहित में प्रतिबद्धताओं को ध्यान में रखते हुए जिला के अन्तर्गत स्थानांतरित किया जाएगा। इसके बाद विशिष्ट शिक्षकों को विभाग द्वारा तय की गई अवधि के पूरा होने पर जिला के अन्दर या बाहर स्थानांतरित किया जाएगा। 10.3 ऊपर किसी बात के होते हुए भी, एक विशिष्ट शिक्षक को प्रशासनिक आधार पर या शिक्षा का अधिकार अधिनियम, छात्र-शिक्षक अनुपात के तहत प्रतिबद्धताओं को ध्यान में रखते हुए, निदेशक (प्राथमिक) या निदेशक (माध्यमिक) द्वारा सार्वजनिक हित में, जैसा भी मामला हो, जिले के बाहर स्थानांतरित किया जा सकता है। ऐसे मामले में, संबंधित विशिष्ट शिक्षक की वरीयता नियम 7 के अनुसार पुनः तैयार की जाएगी।

विशिष्ट शिक्षकों के विरूद्ध अनुशासनिक कार्रवाई के लिए विस्तृत दिशा-निर्देश और प्रक्रिया का अलग से अधिसूचना सामान्य प्रशासन विभाग के परामर्श से जारी की जायेगी। 12.

बिहार राज्य शैक्षिक संस्थागत शिक्षक और कर्मचारी (शिकायत निवारण और अपील) नियमावली, 2020 के तहत गठित जिला/राज्य अपीलीय प्राधिकार लंबित वादों/मामलों का इस नियमावली के प्रवृत्त होने की तिथि से 6 माह के अन्दर निष्पादन कर लेंगे। इसके अतिरिक्त इस नियमावली के प्रवृत्त होने की तिथि से जिला/राज्य अपीलीय प्राधिकार कोई भी नया वाद स्वीकार नहीं करेंगे। 13.

प्रशासी विभाग को इस नियमावली के किसी भी प्रावधान को स्पष्ट करने और अधिसूचनाओं और दिशानिर्देशों के माध्यम से इसके कार्यान्वयन में उत्पन्न होने वाली किसी भी कठिनाई को दूर करने की शक्ति होगी।5 (cid:464)बहार गजट (असाधारण), 26 (cid:465)दस(cid:224)बर 2023

Education Department ——— NOTIFICATION The 26th December 2023 THE BIHAR SCHOOL EXCLUSIVE TEACHERS RULES, 2023

No. 11 / Niyamawali 01-02 / 2023-2460.—In exercise of the powers conferred under proviso to Article 309 of the Constitution of India, the Governor of Bihar hereby makes the following rules for the Teachers employed by the local bodies and bringing them at par with the School Teachers recruited under Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023: -

1. Short title and commencement: -

(1) These rules shall be called "THE BIHAR SCHOOL EXCLUSIVE TEACHERS RULES, 2023".

(2) It shall extend throughout the state of Bihar. (3) It shall come into force from the date of issuance of notification.

2. Definitions:-

(1) In these Rules, unless the context otherwise requires, -

i. "Government" means the Bihar Government; ii. "Administrative Department" means the Education Department; iii. "Appointing Authority" means District Education Officer of the concerned district;

iv. "Disciplinary Authority" means District Education Officer of the concerned district;

v. "Appellate Authority" means Regional Deputy Director of Education of the concerned Division;

vi. "Exclusive Teachers" means all such serving teachers, who have been employed by the local bodies and who are covered under the relevant Local Bodies Teachers Rules 2020 andhave passed competency test under Rule 4 of these Rules;

vii. "Librarians" covered under the relevant Local Bodies Teachers Rules 2020 shall be treated at par with the Exclusive Teachers provided they pass in the competency test under rule 4 of these rules. However, they shall continue to be called Librarians.

viii. "Local Bodies" means Zila Parishad, Panchayat Samiti, Gram Panchayat constituted under Bihar Panchayat Raj Act, 2006 and includes Nagar Nigam, Nagar Parishad and Nagar Panchayat constituted under Bihar Municipal Act, 2007;

ix. "Local Bodies Teachers Rules, 2020" means "Bihar Panchayat Elementary School Service (Appointment, Promotion, Transfer, Disciplinary Proceeding and Service Condition) Rules, 2020", "Bihar Municipal Elementary School Service (Appointment, Promotion, Transfer, Disciplinary Proceeding and Service Condition) Rules, 2020", "Bihar District Board Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceeding and Service Condition) Rules, 2020" and "Bihar Municipal Body Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceeding and Service Condition) Rules, 2020";

x. "Part time Instructors" covered under the relevant Local Bodies Teachers Rules 2020 shall not be covered under these rules.

xi. "Physical Teachers" covered under the relevant Local Bodies Teachers Rules 2020 shall be treated at par with the Exclusive Teachers provided they pass in the competency test under Rule 4 of these rules. However, they shall continue to be called Physical Teachers.

xii. "Trained Exclusive Teacher" means the Exclusive Teacher who has been declared as such by the competent authority;

(2) Any other definition not appearing in these Rules shall derive its meaning from the definitions given in Rule 2 of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023.

3. Constitution of Cadre:-

(1) All the Teachers employed by the various tiers of local bodies (viz. Panchayati Raj and Urban Bodies) shall be required to pass a competency test under Rule 4 and upon passing the test and joining theallotted school thereafter will be called "Exclusive Teachers".The Local Bodies Teachers employed at various tiers of local bodies shall stand merged as a single cadre at the district level from the date of joining the allotted school as per the allotted district in the competency test.They shall constitute a separate cadre whose service conditions shall henceforth be regulated by these Rules.

Provided that these Exclusive Teachers upon passing the competency test under Rule 4 will be entitled to avail the salary and other perks entitled to the school teachers appointed under Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023.

Provided further that any disciplinary action, vigilance enquiry or any other investigation pending against such"Local Bodies" Teachers who become "Exclusive Teachers", shall continue as per the provisions of these new Rules. (2) As and when anExclusive Teacher retires or resigns or is dismissed, the resulting vacancy shall not be filled by local bodies. The Department shall be competent to retain a certain percentage of such vacancies for promotion of these Exclusive Teachers and transfer the remaining to the cadre of School Teachers appointed under Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023. (3) Those "local bodies" teachers who do not appear in or pass the Competency Test as per Rule 4, shall continue to remain "Local Bodies" Teachers.

4. Competency Test.—The Department, through a government agency of its choice shall conduct a competency test for all servingLocal Bodies Teachers. The competency test shall be conducted over a period of one year from the date of promulgation of these Rules. Three attempts to pass the competency test shall be given to each local bodies teacher. At the time of appearing in the test, the local bodies teacher shall be required to give three choices of the districts they wish to serve as Exclusive Teachers. Districts shall be allotted based on their rank in the competency test. Provided that cases of all those local bodies teachers who do not appear or fail to clear the competency test in the 3rd attempt shall be considered separately by the Department. The Department shall constitute a committee to consider the cases8 (cid:464)बहार गजट (असाधारण), 26 (cid:465)दस(cid:224)बर 2023 of all such local bodies teachers and make suitable recommendation to the Government and to that extent, the "Local Bodies Teachers Rules, 2020" shall stand modified.

5. Direct Recruitment under these Rules.—There shall be no direct recruitment under these Rules except those on compassionate grounds. Any appointment as Exclusive Teacher on compassionate grounds shall be subject to qualifying such efficiency test as the Department may conduct. Provided that any compassionate appointment shall be made subject to the prevailing policy of the Department including the eligibility and vacancy.

6. Reservation.—Upon becoming the Exclusive Teachers, these serving Local bodies Teachers shall continue to belong to the same reservation category against which they were employed by the local bodies.

7. Seniority:-

7.1 A Seniority list of ExclusiveTeachers shall be maintained at the district level. There shall be a separate Seniority list drawn subject wise for each category of teachers of school viz primary, middle, secondary &senior secondary.

7.2 The Seniority of the ExclusiveTeachers shall be drawn as per following criteria:-

a. The date of attainment of trained pay scale as local bodies teachers. b. Where two teachers share the same date as per criterion (a) above, the date of birth shall be the criterion for deciding the seniority.

c. Where, two teachers share the same date as per criterion (b) above, the name of the teacher in English alphabetical order shall decide the seniority.

d. Any other case, not fitting in the above criteria, shall be decided by the Department.

8. Salary:-

8.1 The ExclusiveTeachers shall enjoy the full pay protection as provided to them under Local Bodies Rules, 2020.

8.2 Further, upon these Rules taking effect, their pay shall be as per the Fitment Matrix. Other allowances including the Dearness Allowance, House Rent Allowance, Medical Allowance and City Transport Allowance, as per the prevailing rates of the State Government.

8.3 The Fitment Matrix shall be as per the Annexure A. The Fitment Matrix indicates the placement of the ExclusiveTeachers as per these Rules.

9. Promotion:-

9.1 The ExclusiveTeachers shall be entitled to promotion as per the following

9.2 No promotion can be claimed as a matter of right. All promotions shall be subject to the available vacancies and shall be done in keeping with the Departmental policies. Furthermore, all promotions shall be made as per the prevailing policy of the Department and shall be subject to eligibility including the requisite qualification.

10. Transfer:-

10.1 The ExclusiveTeachers shall be transferable within the State. Initially, at the time of appearing in the Competency Test as per Rule 4, they will be asked 3 preferences of the Districts where they wish to serve. Depending upon their rank in the Competency test, they will either get the district of choice, else the district will be given on the basis of randomization.

10.2 Thereafter, the ExclusiveTeachers shall normally be transferred within the District by the District Education Officer keeping in view the commitments under the Right to Education Act, Pupil-Teacher ratio or in public interest.The ExclusiveTeachers shall be transferred within or outside the District upon completion of such duration as the Department may decide.

10.3 Notwithstanding anything above, anExclusiveTeacher may be transferred outside the District on Administrative grounds or keeping in view the commitments under the Right to Education Act, Pupil-Teacher ratio or in public interest by Director (Primary) or Director (Secondary) as the case may be. In such case, the concerned Exclusive Teacher's seniority shall be redrawn in terms of rule 7.

11. Disciplinary Action.—The detailed guideline and procedure for disciplinary action against Exclusive Teachers shall be notified separately in consultation with the General Administration Department.

12. Repeal and Savings.—The District/State Appellate Authority constituted in terms of Bihar State Educational Institutional Teachers and Employees (Grievance Redressal and Appeal) Rules, 2020 shall dispose of the pending cases/matters within 06 months from the date of promulgation of these Rules.Moreover, the District/State Appellate Authority shall not accept any new case from the date of promulgation of these Rules.

13. Power to remove difficulty.— The Administrative Department shall have powers to clarify any provisions of these Rules and remove any difficulties arising in its implementation by way of notifications and guidelines.
