स्व0 दिनेश कुमार सिंह, भूतपूर्व माननीय सदस्य, बिहार विधान मंडल का वर्ष- 1993 में देश से बाहर Queen Elizabeth Hospital, Birmingham, England (U.K) में लिवर प्रत्यारोपण कराया गया। उनके द्वारा उक्त प्रत्यारोपण संबंधी चिकित्सा में हुए व्यय की प्रतिर्पूाि का दावा किया गया जिसे विभाग द्वारा अस्वीकृत किया गया। फलस्वरुप उनके द्वारा माननीय उच्च न्यायालय, पटना में सी0डब्लु0जे0सी0 संख्या-7500/1999 (दिनेश कुमार सिंह बनाम बिहार सरकार एवं अन्य) दायर किया गया। उक्त वाद में दिनांक- 14/09/1999 को माननीय उच्च न्यायालय द्वारा आदेश पारित किया गया जिसकी कार्यकारी अंश निम्नवत् है :-
" ---------This Writ petition is accordingly disposed of with the observation that this court expects the Government to take a decision on the petitioner's claim for reimbursement of expenses concerning consumable medicines and other allied items expeditiously and without any further delay. The petitioner will be naturally informed of the decision taken by the Government. In case the Government finds itself not in a position to make reimbursement of the bills, it will pass a speaking order briefly assigning reasons."
02. उक्त न्यायादेश के आलोक में भूतपूर्व विधायक परिचर्या नियमावली, 1990 के नियम 4 तथा विधान मंडल (सदस्यों का वेतन भाा और पेंशन संशोधन) अधिनियम, 1997 के नियम 9(2) में लिवर प्रत्यारोपण सम्मिलित नहीं रहने तथा बर्हिवासी चिकित्सा का भी प्रावधान नहीं रहने के कारण उनके प्रतिर्पूाि के दावे को समीक्षोपरान्त स्वास्थ्य, चिकित्सा शिक्षा एवं प0 क0 विभाग, बिहार, पटना का आदेश ज्ञापांक- 3616(24), दिनांक- 26.10.99 द्वारा अनुमान्य नहीं की गयी।2 (cid:464)बहार गजट (असाधारण), 1 फरवर(cid:547), 2024 03. सी0डब्लु0जे0सी0 संख्या-7500/1999 (दिनेश कुमार सिंह बनाम बिहार सरकार एवं अन्य) में पारित न्यायादेश के विरुद्ध स्व0 सिंह द्वारा एल0पी0ए0 सं0-1399/99 दायर किया गया जिसमें दिनांक-18.03. 2008 को माननीय उच्च न्यायालय द्वारा आदेश पारित किया गया जिसका कार्यकारी अंश निम्नवत् है :-
" In the result, we respectfully disagree with that part of the order dated 14-09- 99, Passed in C.W.J.C No.- 7500 of 1999, whereby the petitioner's claim for reimbursement for liver transplantation in U.K has been rejected. The appeal is allowed in the manner indicated hereinabove. The original petitioner shall also be entitled to travel expenses along with a companion to and fro, and his/her stay in U.K. to the extent needed for the surgery. Let the payments be made on verification of the claims within a period of four months from today failing which the original petitioner shall be entitled to interest@6% from the date the expenses were incurred till the date of payment. The sanction and the cheque shall now be issued in favour of Ms. Bibha Singh, Widow of the original petitioner, and the present appellant. It goes without saying that the state Government will be entitled to recover the amount of interest from the concerned authorities."
04. एल0पी0ए0 संख्या-1333/1999 विभा सिंह बनाम राज्य सरकार एवं अन्य में दिनांक-18.03.2008 को पारित न्यायादेश के विरुद्ध विधि विभाग के परामर्शानुसार स्वास्थ्य विभाग, बिहार, पटना द्वारा माननीय उच्चतम् न्यायालय, दिल्ली में सिविल अपील संख्या-9341/2010 बिहार राज्य एवं अन्य बनाम विभा सिंह दायर किया गया जिसमें दिनांक- 26.07.2022 को आदेश पारित किया गया जो निम्नवत् है :-
" One week's time is granted to the learned counsel for the appellants to seek instructions as to wether the order passed by the Division Bench of the High Court has been complied with or not."
पुनः उक्त वाद में माननीय उच्चतम न्यायालय द्वारा दिनांक- 03.08.2023 को आदेश पारित किया गया, जो निम्नवत् है :-
" 1. This matter pertains to reimbursement of the medical expenses incurred for the treatment of the husband of the respondent. The patient has passed away on 26.01.2005 during the pendency of the appeal. We are told that even the respondent has since passed away on 26.09.2020. 2. The Division Bench of the high court under the 18-03-2008 impugned judgment declared that the respondent is entitled to reimbursement of the medical expenses along with related expenses since the facility of the liver transplantation was not available in India as was opined by the AIIMS, Delhi. This Court has not stayed the High Court judgment and therefore on 26.07.2022, time was granted to the counsel for the State of Bihar as to whether thejudgment of the Division Bench of the High Court has been complied with by the appellants or not. 3. Today when the case is called out, Mr. Mohit Prasad, learned counsel appears for the appellants, but although the specific query was made by this Court as far back as on 26.07.2022, the State's counsel has no information on whether the entitled amount was disbursed to the claimant. Time was given today in the forenoon tothe learned counsel to obtain instructions and he submits that although calls were made, the concerned officer has failed to furnish requisite information.
4. This is indeed an unsatisfactory state of affairs. Be that as it may, on the request of the State's counsel, the matter is deferred to 09.08.2023 as the final opportunity to the appellants to take appropriate steps in the matter.
5. List again on 09.08.2023."3 (cid:464)बहार गजट (असाधारण), 1 फरवर(cid:547), 2024 05. सिविल अपील संख्या-9341/2010 बिहार राज्य एवं अन्य बनाम विभा सिंह में दिनांक-26.07.2022 एवं 03.08.2023 को पारित न्यायादेश के अनुपालन एवं बिहार विधान मंडल के सदस्य/पूर्व सदस्य की चिकित्सा परिचर्या नियमावली, 2008 (अधिसूचना संख्या- 228(14), दिनांक- 25.02.2008) के आलोक में मंत्रिपरिषद् के अनुमोदन की प्रत्याशा में स्वास्थ्य विभागीय पत्रांक- 2121(14), दिनांक- 08.08.2023 द्वारा बिहार विधान सभा, पटना को 06. सिविल अपील संख्या-9341/2010 बिहार राज्य एवं अन्य बनाम विभा सिंह में दिनांक- 16.08.2023 को आदेश पारित किया गया, जिसकी कार्यकारी अंश निम्नवत् है :- " Proceeding with the above, as the Health Department has already consented to sanction the amount, the secretary of the Bihar Legislative Assembly as the disbursing authority is directed to reimburse the expenses incurred on the treatment of the late Sh. Dinesh Kumar Singh ex-Member of the Bihar Legislative Assembly in terms of the judgement dated 18.03.2008. The needful including disbursement of the amount should be done within six weeks from today. Appropriate endorsement be made at the time of disbursal that this is subject to outcome of the present appeal.
07. स्व0 दिनेश कुमार सिंह, पूर्व स0वि0स0 के चिकित्सा प्रतिपूर्ति की जाने वाली राशि संबंधी कागजात/अभिलेख स्वास्थ्य विभाग में उपलब्ध नहीं रहने के कारण बिहार विधान सभा सचिवालय द्वारा स्व0 दिनेश कुमार सिंह, पूर्व स0वि0स0 के वैधानिक उाराधिकारी श्री उदयन सिंह से प्राप्त अभिलेखों/विपत्रों की छायाप्रति के अनुसार माननीय पटना उच्च न्यायालय के दिनांक- 18.03.2008 के आदेश के उपरांत स्व0 दिनेश कुमार सिंह, पूर्व स0वि0स0 की पत्नी श्रीमती विभा सिंह द्वारा स्वास्थ्य विभाग के स्वास्थ्य आयुक्त को जो दावा पत्र दिनांक- 25.06.2008 को प्रस्तुत किया गया था, जिसके अनुसार उन्हें प्रतिपूर्ति की जाने वाली राशि का विवरण निम्न प्रकार है :-
(क). नई दिल्ली से लंदन जाने और वापस नई दिल्ली की यात्रा में व्यय राशि रू0- 75,510/-. (ख). 25 अक्टूबर, 1993 से फरवरी, 1994 तक उपचार के दौरान एक एटेंडेंट के साथ यू0के0 में रहने पर हुई व्यय राशि- 10,500 स्टर्लिंग पाउंड (UK).
(ग). चिकित्सा में व्यय राशि- 44,201/-स्टर्लिंग पाउंड (UK)।
वर्ष 1993 में एक स्टरर्लिंग पाउंड का मूल्य 45.73/- रूपये था। इस प्रकार 54,701/- स्टरर्लिंग पाउंड का मूल्य कुल 25,01,476/-रूपये होता है और इसमें यात्रा व्यय की राशि जोड़ दिये जाने के उपरांत कुल व्यय राशि रु0 25,76,986/- रूपये होता है और यदि शल्य चिकित्सा के पश्चात् डिस्चार्ज की तिथि को चिकित्सा व्यय राशि की तिथि माने जाने पर माननीय पटना उच्च न्यायालय के आदेशानुसार दिनांक-29.12.1993 से अब तक लगभग 29 वर्ष 9 माह 6 दिन के लिए 6% की दर से उन्हें व्याज भी अनुमान्य होता है। इसकी गणना किये जाने पर 29.76 वर्ष का 6% की दर से आज की तिथि तक साधारण ब्याज 46,01,466/-रूपये होता है। इस प्रकार चिकित्सा व्यय, यात्रा व्यय एवं लंदन में इलाज के दौरान ठहरने में हुए व्यय की राशि तथा इस राशि पर 6% की दर से साधारण ब्याज को जोड़ने पर कुल राशि 25,76,98646,01,466़=71,78,452/- (इकहत्तर लाख अठहतर हजार चार सौ बावन) रूपये मात्र होता है। माननीय सर्वोच्च न्यायालय, नई दिल्ली में दायर सिविल अपील संख्या-9341/2010 में दिनांक- 16.08.2023 को पारित न्यायादेश के अनुपालन हेतु बिहार विधान सभा सचिवालय की संचिका संख्या-चि0प्रति0-51/2020 में स्व0 दिनेश कुमार सिंह, पूर्व स0वि0स0 के वैधानिक आश्रित को रु0 71,78,452/- (इकहत्तर लाख अठहतर हजार चार सौ बावन) रूपये मात्र के भुगतान पर स्वास्थ्य विभाग द्वारा सहमति प्रदान कर दी गई है। 08. बिहार उपचार नियमावली के नियम-26 के अनुसार :- इस नियमावली में किसी बात के होते हुए भी राज्य सरकार को यह शक्ति है कि वह किसी भी व्यक्ति को, जो इस नियमावली के अधीन उपचार या ईलाज के लिये प्राधिकृत नहीं है, उपचार और ईलाज की सुविधा प्रदान करें।
09. भूतपूर्व विधायक परिचर्या नियमावली, 1990 के नियम 4 तथा विधान मंडल (सदस्यों का वेतन भाा और पेंशन संशोधन) अधिनियम, 1997 के नियम 9(2) में लिवर प्रत्यारोपण सम्मिलित नहीं रहने तथा माननीय सदस्य/पूर्व सदस्य को देश से बाहर ईलाज कराने की अनुमति/प्रतिर्पूाि का प्रावधान नहीं होने के कारण एवं माननीय न्यायालयों द्वारा पारित न्यायादेशों के अनुपालन हेतु इस मामले में मंत्रिपरिषद् का अनुमोदन प्राप्त की गई। 10.
4 (cid:464)बहार गजट (असाधारण), 1 फरवर(cid:547), 202411. स्व0 दिनेश कुमार सिंह, भूतपूर्व सदस्य, बिहार विधान सभा के प्रतिर्पूाि की राशि का भुगतान बिहार विधान सभा सचिवालय द्वारा की जायेगी। ————
