सं॰ एल॰जी॰-01-03/2024-1986/लेज।—बिहार विधान मंडल द्वारा यथापारित निम्नलिखित अधिनियम, जिसपर माननीय राज्यपाल दिनांक 14 मार्च, 2024 को अनुमति दे चुके हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है ।
बिहार-राज्यपाल के आदेष से, ज्योतिस्वरूप श्रीवास्तव, सरकार के सचिव (प्र॰)।(cid:464)बहार गजट (असाधारण) 14 माच(cid:91) 2024 2 (बिहार अधिनियम 05,2024)
प्रस्तावनाः -जहां, बिहार राज्य में बिहार राज्य महिला आयोग अधिनियम, 1999 के अनुसरण में बिहार राज्य महिला आयोग का गठन किया गया है। अधिनियम के लागू होने के बाद विभिन्न सरकारी नीतियों और कई न्यायिक घोषणाओं के कारण महिलाओं की सुरक्षा, उनकी उन्नति, भागीदारी आदि के नये आयाम उभरकर आये हैं।
जबकि, ''लैंगिक अपराधों से बच्चों की सुरक्षा अधिनियम, 2012'' के द्वारा कन्या शिशु सहित सभी बच्चों को संरक्षण प्रदान करने के उद्देश्य से अधिनियमित किया गया है,
जबकि, विभिन्न सरकारी संस्थानों में महिलाओं की भागीदारी कई गुणा बढ़ी है,
जबकि, स्थानीय स्वशासन संस्थाओं में उनकी भागीदारी 50 प्रतिशत हो गई है,
जबकि, सरकारी संस्थानों में भी महिलाओं के लिए पद चिन्]ित किये गये हैं,
जबकि, महिलायें अभी भी विभिन्न प्रकार के भेदभाव का सामना करती हैं और असुरक्षित हैं,
जबकि, राज्य सरकार द्वारा राज्य में आवासित नागरिकों के आर्थिक एवं सामाजिक स्थिति का आकलन कराने के उद्देश्य से बिहार जाति आधारित गणना, 2022-2023 करायी गयी है, जिसके आलोक में महिलाओं की स्थिति में सुधार करने हेतु नये सिरे से सुधार करने की आवश्यकता है,
जबकि, महिलाओं की सुरक्षा और कल्याण के लिए अधिनियमित विभिन्न कानूनी प्रावधानों के प्रभावी प्रबंधन के लिए बिहार राज्य महिला आयोग को पुर्नगठित करना अनिवार्य हो गया है।
इसलिए, अब भारत गणराज्य के 75 वें वर्ष में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप में अधिनियमित होः-
(1) यह अधिनियम 'बिहार राज्य महिला आयोग (संशोधन) अधिनियम, 2024' कहा जा सकेगा। (2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह अधिनियम राजपत्र में प्रकाशन की तिथि से तुरंत प्रवृत होगा।
उक्त अधिनियम के अध्याय II की धारा 3 के
उपधारा (2) के बाद निम्नलिखित उपधारा (3) जोड़ी जाएगीः-
''3.(i) वर्तमान संशोधित अधिनियम के लागू होने की तिथि से वर्तमान में कार्यरत बिहार राज्य महिला आयोग भंग हो जाएगा।
(ii) बिहार राज्य महिला आयोग के भंग होने पर, राज्य सरकार आयोग के मामलों के प्रबंधन के लिए एक प्रशासक नियुक्त करेगी। आयोग का प्रशासक सरकार के सचिव स्तर से अन्यून नहीं होगा। (iii) राज्य सरकार के पास प्रशासक को निर्देश/परामर्श जारी करने का अधिकार होगा और ऐसे निर्देश/परामर्श प्रशासक के लिए बाध्यकारी होंगे।''
- उक्त अधिनियम के अध्याय II की धारा 4 की
उपधारा 2 के बाद निम्नलिखित उपधारा 3 जोड़ी जाएगीः-
''4 (3) आयोग का विहित कार्यकाल के होते हुए भी, राज्य सरकार को किसी भी समय आयोग को भंग करने की शक्ति होगी, यदि वह संतुष्ट है कि इस अधिनियम के कार्यकरण और उद्देश्य के अनुरूप आयोग का विघटन व्यापक जनहित में है।''
उक्त अधिनियम
के अध्याय IV की धारा 14 के बाद निम्नलिखित नई धारा 14(क) जोडी जाएगीः-
''14 (क)(i) आयोग के विघटन के उपरांत अंतरकाल के दौरान राज्य सरकार बिहार राज्य महिला आयोग के कामकाज के पुनर्गठन के लिए अपनाए जाने वाले उपायों का सुझाव देने के लिए विशेषज्ञों की एक समिति का गठन करेगी। समिति में पांच सदस्य होंगे, जिनमें से कम से कम एक सदस्य को महिलाओं से संबंधित विभिन्न कानूनी प्रावधानों के प्रबंधन का व्यापक ज्ञान होना आवश्यक होगा।
(ii) विशेषज्ञों की समिति राज्य सरकार को एक माह के अंदर प्रतिवेदन समर्पित करेगी। राज्य सरकार विशेषज्ञों की समिति की अनुशंसाओं को महिलाओं के हित में आवश्यक संशोधनों के साथ स्वीकार कर सकेगी।(cid:464)बहार गजट (असाधारण) 14 माच(cid:91) 2024 3 (iii) विशेषज्ञों की समिति द्वारा की गई अनुशंसाओं को स्वीकार करने पर, राज्य सरकार ऐसे आदेश/अधिसूचना/संकल्प बनाकर इसे लागू करने का प्रयास करेगी, जो उचित समझा जाए।
(iv) धारा 14 क (ii) में निहित एक माह के प्रावधान के पूरा होने के उपरांत राज्य सरकार अधिकतम दो माह के अंदर अधिनियम की धारा 3 के अंतर्गत बिहार राज्य महिला आयोग का गठन करेगी। ''

सं॰ एल॰जी॰-01-03/2024-1987/लेज।—बिहार विधान मंडल द्वारा यथापारित और माननीय राज्यपाल द्वारा दिनांक 14 मार्च, 2024 को अनुमत का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा । बिहार-राज्यपाल के आदेष से, ज्योतिस्वरूप श्रीवास्तव, सरकार के सचिव (प्र॰)।
[Bihar Act 05, 2024] The Bihar State Commission for Women (Amendment) Act, 2024 AN Act
to amend the Bihar State Commission for Women Act , 1999 (Bihar Act, 6, 1999) Preamble:- Whereas, in the State of Bihar, Bihar State Women Commission has been constituted in pursuance of Bihar State Women Commission Act, 1999. Whereas, after enactment of the Act, 1999, new dimension to protection of women, their advancement, participation etc. has emerged due to various government policies and several judicial pronouncements.
Whereas, Protection of Children from Sexual Offences Act,2012 has been enacted with a view to extend protection to children including female child,
Whereas, participation of women in different government institutions has increased manifold,
Whereas, in government organisations, posts are earmarked for females, Whereas, in local self-government bodies, their participation has increased to more than 50%,
Whereas, the women still face the vagary of various kind of discriminations and are vulnerable,
Whereas, the State Government has conducted Bihar Caste Based Survey, 2022- 2023 to assesses the economic and social condition of the citizens residing in the State. In the light of which, there is a need for fresh reforms to improve the condition of women, Whereas, it has become imperative to re-organise and re-structure the Women Commission to provide for effective management of various legal provisions enacted for the protection and welfare of women,
Now, therefore, the Legislature of the State of Bihar hereby enact, in 75th year of Republic of India as follows:
1. Short Title, Extent and Commencement:-
(1) This Act may be called Bihar State Women Commission (Amendment) Act, 2024.
(2) It shall extend to the whole of the State of Bihar. (3) This Act shall come into force immediately on publication in official gazette.
(cid:464)बहार गजट (असाधारण) 14 माच(cid:91) 2024 42. Amendment in section 3 of Bihar Act 6,1999.- In chapter II of the said act sub section (3) shall be added after sub section (2) of section 3 in following manner:-
"3 (i) With effect from the date of enforcement of the present amending Act, the existing Bihar State Women Commission shall stand dissolved.
(ii) On dissolution of Bihar State Women Commission, the State Government shall appoint an administrator to manage the affairs of the Commission. The Administrator of the Commission shall not be below the rank of Secretary to the Government.
(iii) The State Government shall have the authority to issue directions/ advisory to the Administrator and such directions/advisory shall be binding on the Administrator."
3. Amendment in section 4 of Bihar Act 6,1999.- In chapter II A new sub section 3 shall be added after sub section 2 of section 4 as follows:-
4(3) Notwithstanding prescribed tenure of the Commission, the state Government shall have power to dissolve the Commission at anytime if it issatisfied that dissolution is in the larger public interest to make the functioning of the Commission in consistent with the aim and object of the Act.
4. Addition of section 14(A) after section 14 of Bihar Act 6,1999.-
In chapter IV A new Section 14A shall be added after Section 14 as follows:-
"14A (i) After the dissolution of the Commission, during the interregnum State Government shall constitute a committee of experts to suggest measures to be adopted for re- structuring and re-organizing the functioning of Bihar State Women Commission. The Committee shall consist of five members at least one of which, would have extensive knowledge of management of various legal provisions dealing with women.
(ii) The Committee of experts shall submit a report to the State Government within one month. The State Government may accept the recommendations of the Committee of the experts subject to such modification as may deemed necessary in the interest of women.
(iii) On acceptance of the recommendation made by the Committee of experts, the State Government shall endeavour to implement the same by making such orders/notification/resolution as may be deemed fit and proper.
(iv) On completion of one month as provided in section 14 A(ii) above, the State Government shall constitute Bihar State Women Commission within maximum period of two months under Section 3 of the Act."
