सं॰ एल॰जी॰-01-08/2024-1992/लेज।—बिहार विधान मंडल द्वारा यथापारित निम्नलिखित अधिनियम, जिसपर माननीय राज्यपाल दिनांक 14 मार्च, 2024 को अनुमति दे चुके हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है ।
बिहार-राज्यपाल के आदेष से, ज्योतिस्वरूप श्रीवास्तव, सरकार के सचिव (प्र॰)।;बपकरू464द्ध ;द्ध 14 ;बपकरू91द्ध 2024 2 (बिहार अधिनियम 07,2024) बिहार राज्य बाल श्रमिक आयोग (संशोधन) अधिनियम, 2024 बिहार राज्य बाल श्रमिक आयोग अधिनियम, 1996 (बिहार अधिनियम 1, 1997) को संशोधित करने हेतु अधिनियम। प्रस्तावना :-चूँकि केन्द्र सरकार द्वारा बाल श्रम (प्रतिषेध एवं विनियमन) अधिनियम, 1986 में व्यापक संशोधन करते हुए बाल एवं किशोर श्रम (प्रतिषेध एवं विनियमन) अधिनियम, 1986 लागू किया गया है।
और चूँकि बच्चों के लिए राष्ट्रीय नीति, 2013 का सूत्रण भी केन्द्र सरकार द्वारा किया गया है। और चूँकि अन्तर्राष्ट्रीय श्रम संगठन के न्यूनतम उम्र (138वें सम्मेलन) तथा विभत्स स्वरूपों में बाल श्रम निषेध (182वाँ सम्मेलन) में हुए समझौतों पर भारत सरकार द्वारा सहमति प्रदान की गई है।
और चूँकि बाल श्रम से संबंधित मामलों पर उपर्युक्त पृष्ठभूमि में बाल श्रम से संबंधित कानूनों एवं प्रक्रियाओं में परिवर्तन किये गये हैं।
और चूँकि ऐसी परिस्थितियाँ विद्यमान है, जिनके कारण बिहार राज्य बाल श्रमिक आयोग अधिनियम, 1996 को संशोधन करने के लिए तुरन्त कार्रवाई करना आवश्यक है।
भारत गणराज्य के 75वें वर्ष में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित होः- 1. संक्षिप्त नाम, विस्तार और प्रारंभ।- (1) यह अधिनियम बिहार राज्य बाल श्रमिक आयोग (संशोधन) अधिनियम, 2024 कहा जायेगा।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह अधिसूचना के राजपत्र में प्रकाशित होने के उपरान्त तुरन्त प्रवृत होगा।
2. बिहार राज्य बाल श्रमिक आयोग अधिनियम, 1996 (बिहार अधिनियम 1, 1997) की धारा-5 में संशोधन।-बिहार राज्य बाल श्रमिक आयोग अधिनियम, 1996 (बिहार अधिनियम 1, 1997) की धारा 5 के पश्चात् निम्न परन्तुक जोड़ा जायेगा :-
उपर्युक्त धारा में कार्यकाल का प्रावधान होने के बावजूद राज्य सरकार को यदि यह समाधान हो जाय कि ऐसा किया जाना आयोग के लक्ष्य एवं उद्देश्य की पूर्त्ति के लिए आवश्यक है एवं विस्तृत लोकहित में है तो राज्य सरकार में यह शक्ति निहित होगी कि वह आयोग को किसी भी समय भंग कर सके।
3. बिहार राज्य बाल श्रमिक आयोग अधिनियम, 1996 (बिहार अधिनियम 1, 1997) की धारा-7 के बाद नई धाराओें को जोडना।- बिहार राज्य बाल श्रमिक आयोग अधिनियम, 1996 की धारा 7 के पश्चात् निम्न धारायें 7क, 7ख, 7ग एवं 7घ जोड़ी जायेगी :- 7क (1) उपरोक्त अधिनियम के लागू होने की तिथि से वर्तमान बिहार राज्य बाल श्रमिक आयोग भंग हो जायेगा। (2) वर्तमान बिहार राज्य बाल श्रमिक आयोग के भंग होने के उपरान्त राज्य सरकार द्वारा आयोग के मामलों के प्रबंधन हेतु प्रशासक की नियुक्ति की जायेगी। 7ख (1) बिहार राज्य बाल श्रमिक आयोग के भंग होने के पश्चात् आयोग के प्रावधानों के अनुरूप राज्य सरकार द्वारा आयोग के पुनःसरंचना एवं पुनर्गठन पर अध्ययन एवं अनुशंसा हेतु विशेषज्ञों की समिति गठित की जाएगी। (2) विशेषज्ञों की समिति राज्य सरकार द्वारा गठित की जायेगी, जिसमें 05 से अधिक सदस्य शामिल नहीं होंगे एवं ऐसी समिति में 01 सदस्य वैसे होंगे, जिन्हें बाल श्रम एवं बाल श्रम से संबंधित विभिन्न मामलों में पर्याप्त जानकारी हो। (3) समिति द्वारा अनुशसाऐं उसके गठन की तिथि के 01 माह की अवधि में राज्य सरकार को समर्पित किया जायेगा। श्रम संसाधन विभाग, बिहार सरकार द्वारा समिति के कार्यों के संचालन हेतु सभी लॉजिस्टिक सहयोग प्रदान किया जायेगा। (4) समिति द्वारा समर्पित अनुशंसाओं को राज्य सरकार द्वारा परीक्षण किया जायेगा एवं राज्य सरकार द्वारा इसे संशोधनों/परिवर्त्तनों के साथ स्वीकार किया जा सकेगा, यदि बाल श्रम से संबंधित मामलों एवं अन्य मामलों में ऐसा किया जाना अपेक्षित प्रतीत होता हो। 7ग (1) राज्य सरकार द्वारा नये बिहार राज्य बाल श्रमिक आयोग का गठन इसके विघटन की तिथि के 02 माह के अन्दर कर लिया जायेगा। 7घ (1) यदि वर्तमान अधिनियम अथवा संशोधन अधिनियम के प्रावधानों को प्रभावी करने में यदि किसी प्रकार की कठिनाई उत्पन्न होती हो तब राज्य सरकार ऐसा आदेश अथवा ऐसी कार्रवाई जो वर्तमान अधिनियम अथवा संशोधन अधिनियम के प्रावधानों के प्रतिकूल हो एवं ऐसा किया जाना कठिनाईयों के निराकरण के लिए आवश्यक हो, कर सकेगी। (2) राज्य सरकार समिति को सौंपे गये कार्यों हेतु समुचित निदेश दे सकेगी। राज्य सरकार यदि आवश्यक समझे तो वर्तमान अधिनियम अथवा संशोधन अधिनियम के लक्ष्य एवं उद्देश्यों की पूर्त्ति हेतु प्रशासक को निदेश दे सकेगी एवं प्रशासक के लिए ऐसे निदेश को मानना वाध्यकारी होगा।

[Bihar Act 07, 2024] Bihar State Child Labour Commission (Amendment) Act, 2024 AN Act to amend the Bihar State Child Labour Commission Act, 1996 (Bihar Act 1, 1997) Introduction:- Since the Central Government has implemented the Child and Adolescent Labour (Prohibition and Regulation) Act, 1986 by making comprehensive amendments in the Child Labour (Prohibition and Regulation) Act, 1986. And whereas the National Policy for Children, 2013 has also been formulated by the Central Government. And whereas the Government of India has agreed to the conventions of the International Labour Organization on minimum age (138th Convention) and prohibition of child labour in its worst forms (182nd Convention). And whereas, in the above mentioned background, there have been changes in the laws and procedures relating to child labour on matters relating to child labour. And whereas the circumstances exist which render it necessary to take immediate action to amend the Bihar State Child Labour Commission Act, 1996. Be it enacted by the Bihar State Legislature in the 75th year of the Republic of India as follows:- 1. Short title, extent and commencement:- (1) This Act may be called the Bihar State Child Labour Commission (Amendment) Act, 2024.
(2) It shall extend to the whole state of Bihar.
(3) It shall come into force immediately after its publication in the Official Gazette.
2. Amendment in section 5 of Bihar State Child Labour Commission Act, 1996 (Bihar Act 1, 1997).- The following proviso will be added after Section 5 of the Bihar State Child Labour Commission Act, 1996 (Bihar Act 1, 1997): -
Notwithstanding tenure prescribed in above section, the State Government shall have the power to dissolve the Commission any time if it is satisfied that dissolution is in larger public interest to make the functioning of the commission consistent with its aim and objects.
3. Addition of new sections after section 7 of Bihar State Child Labour Commission Act, 1996 (Bihar Act 1, 1997).- After Section 7 of the Bihar State Child Labour Commission Act, 1996, the following sections 7A, 7B, 7C and 7D will be added: -
7A (1) With effect from the date the Act comes into force, the existing Bihar State Child Labour Commission shall stand dissolved.
;बपकरू464द्ध ;द्ध 14 ;बपकरू91द्ध 2024 4recommendations for reorganization and restructuring of the Commission with a view to make it consistent with the provisions of the Commission.
(2) The committee of experts shall be constituted by the State Government comprising of not more than 05 members of whom at least one member shall be a person possessing adequate knowledge of the subject related to child labour and different affairs of child labour.
(3) The committee shall submit its recommendations to the State Government within a period of one month from the date of constitution. All logistic support to the committee shall be provided by the Labour Resources Department, Government of Bihar.
(4) On recommendation submitted by the committee, it shall be examined by the State Government and shall be accepted with such modification as deemed necessary in the interest of child labour and other affairs related to child labour.
7C (1) The State Government shall constitute a new Bihar State Child Labour Commission within a period of 02 months from the date of its dissolution.
7D (1) If any difficulty arises in giving effect to the provisions of existing Act or the amending Act, the State Government may make such order or do such things not consistent with the provision of existing Act or amending Act as it appears to be necessary or expedient for removing the difficulty.
(2) The State Government may issue appropriate directions for accomplishing the task entrusted to the committee. The State Government may also issue such direction as deemed necessary for carrying out objects of the existing or amending Act to the administrator and administrator shall be bound by such direction of State Government.
