सं॰ एल॰जी॰-01-07-2024/2001/लेजः।-बिहार विधान मंडल द्वारा यथापारित निम्नलिखित अधिनियम, जिसपर माननीय राज्यपाल दिनांक- 14 मार्च, 2024 को अनुमति दे चुके हैंं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता हैः-

वर्ष 2020 में केन्द्र सरकार द्वारा बिहार राज्य सहित पूरे भारतवर्ष में नई राष्ट्रीय शिक्षा नीति लागू की गई है। बिहार जाति आधारित गणना प्रतिवेदन, 2022-23 में बिहार के सभी विद्यार्थियों की शैक्षिक स्थिति का विवरण बताया गया है। संस्कृत शिक्षा सहित विभिन्न शैक्षणिक पाठ्यक्रमों को विनियमित करने वाले कानूनों को राष्ट्रीय शिक्षा नीति के अनुरूप बनाना अनिवार्य हो गया है। इसलिए यह आवश्यक है कि विद्यमान संस्कृत शिक्षा की संरचना को पुनर्संघटित एवं पुनर्गठित किया जाए तथा इसे भाषा-विज्ञान एवं धार्मिक अध्ययन के अलावा विद्यार्थियों को आधुनिक शिक्षा प्रदान करने का भी प्रभावी उपकरण बनाया जाए।
विद्यमान संस्कृत शिक्षा की संरचना को पुनर्संघटित एवं पुनर्गठित करने के उद्देश्य से, इसे व्यावहारिक, साध्य, राष्ट्रीय शिक्षा नीति के अनुरूप एवं संस्कृत शिक्षा के आधुनिकरण हेतु विद्यमान बिहार संस्कृत शिक्षा बोर्ड अधिनियम, 1981 की धारा 4(2), 5, 25 एवं 27 में संशोधन किया जाना आवश्यक है।
इसलिए, भारत-गणराज्य के 75 वें वर्ष में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-
ः-
(i) इस अधिनियम को बिहार संस्कृत शिक्षा बोर्ड (संशोधन) अधिनियम, 2024 कहा जा सकेगा। (ii) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (iii) यह राजपत्र मेें प्रकाशन होने पर तुरंत लागू होगा।
:-
विद्यमान अधिनियम की धारा 4 (2) को निम्नानुसार प्रतिस्थापित किया जाता है :- निदेशक/विशेष निदेशक या कोई अन्य पदाधिकारी जिसे धार्मिक, भाषाई अल्पसंख्यक अथवा प्राच्य शिक्षा हेतु शिक्षा की जिम्मेदारी सौंपी गई हो - पदेन
:-
विद्यमान अधिनियम की धारा-5 में एक नई उप-धारा (3) जोड़ी जाती है :- धारा 5 (1) में निर्धारित कार्यकाल के बावजूद, राज्य सरकार के पास बोर्ड को किसी भी समय विघटित करने की शक्ति होगी यदि वह संतुष्ट हो कि बोर्ड के काम-काज को अधिनियम के लक्ष्य एवं उद्देश्यों के अनुरूप बनाने हेतु बोर्ड का विघटन व्यापक सर्वाजनिक हित में है।
:-
(i) विद्यमान अधिनियम की धारा 25 में एक नई उप-धारा (6) जोड़ी जाती हैः-
(6) (क) अधिनियम के लागू होने की तिथि से विद्यमान संस्कृत शिक्षा बोर्ड विघटित हो जाएगा। (ख) उपरोक्त धारा 6 (क) के तहत विद्यमान संस्कृत शिक्षा बोर्ड के विघटन के उपरांत राज्य सरकार, शिक्षा विभाग में, बोर्ड के मामलों के प्रबंधन हेतु एक प्रशासक, जो कि राज्य सरकार के सचिव के पद से निम्न पद का ना हो, नियुक्त करेगी।
(ii) एक नई निम्नलिखित उप-धारा (7) जोड़ी जाती हैः-
(7) (क) बोर्ड के विघटन होने पर राज्य सरकार, संस्कृत शिक्षा को राष्ट्रीय शिक्षा नीति के अनुरूप बनाने के उद्देश्य एवं वर्तमान में विज्ञान, मानविकी समेत अन्य आधुनिक विषयों में शिक्षण पद्धति को सुदृढ़ करने के साथ-साथ विभिन्न व्यवसायिक विषयों को भी शामिल करने के निमित्त पाठ्यक्रम जारी करने के लिए संस्कृत शिक्षा संरचना के अध्ययन एवं सिफारिश हेतु विशेषज्ञों की एक समिति का गठन करेगी। (ख) राज्य सरकार द्वारा विशेषज्ञ समिति का गठन किया जाएगा जिसमें 5 से अधिक सदस्य नहीं होंगे, जिनमें कम-से-कम एक व्यक्ति संस्कृत एवं प्राच्य अध्ययन का पर्याप्त ज्ञान रखने वाला होना चाहिए। समिति, गठन की तारीख से एक माह की अवधि के भीतर अपनी सिफारिश राज्य सरकार को प्रस्तुत करेगी। समिति को सुप्रचालन-तंत्र की सभी सहायता शिक्षा विभाग, बिहार, सरकार द्वारा प्रदान की जाएगी।
(ग) समिति द्वारा प्रस्तुत अनुसंशा पर राज्य सरकार के शिक्षा विभाग द्वारा इसकी जांच की जाएगी एवं संस्कृत शिक्षा हित में आवश्यक समझे जाने वाले संशोधन के साथ इसे स्वीकार किया जाएगा। (iii) नई निम्नलिखित उप-धारा (8) जोड़ी जाती हैः-
(8) राज्य सरकार बोर्ड के विघटन की तिथि से अधिकतम तीन माह की अवधि के भीतर नई संस्कृत शिक्षा बोर्ड का गठन करेगी।
5. :- धारा 27 को निम्नानुसार प्रतिस्थापित किया जाता है :-
27 (i) यदि विद्यमान अधिनियम या इस संशोधित अधिनियम के प्रावधानों को प्रभावी बनाने में कोई कठिनाई उत्पन्न होती है तो राज्य सरकार ऐसा आदेश जारी कर सकती है अथवा ऐसा कार्य कर सकती है जो कठिनाई को दूर करने में समीचीन एवं आवश्यक प्रतीत होता3 (cid:464)बहार गजट (असाधारण), 14 माच(cid:91), 2024 है तथा जो विद्यमान अधिनियम या इस संशोधित अधिनियम के प्रावधानों के साथ असंगत न हो।
(ii) राज्य सरकार समिति को सौंपे गए कार्य को पूरा करने हेतु उचित निर्देश जारी कर सकती है। राज्य सरकार प्रशासक को विद्यमान अधिनियम या इस संशोधित अधिनियम के उद्देश्यों को पूरा करने हेतु ऐसे निर्देश जैसा की आवश्यक समझा जाए भी जारी कर सकती है तथा प्रशासक राज्य सरकार के ऐसे निर्देशों से बाध्य होगा।

सं॰ एल॰जी॰-01-07-2024/2002/लेजः।-बिहार विधान मंडल द्वारा यथापारित और माननीय राज्यपाल द्वारा दिनांक 14 मार्च, 2024 को अनुमत बिहार राज्य संस्कृत शिक्षा बोर्ड संशोधन अधिनियम, 2024 का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अधिनियम का अंगेजी भाषा में प्राधिकृत पाठ समझा जायेगा :-

[Bihar Act 09,2024] Bihar Sanskrit Education Board (Amendment) Act, 2024 AN ACT to amend the Bihar Sanskrit Education Board Act, 1981 Introduction:- In the year 2020, the new National Education Policy has been implemented by the Central Government in the whole of India including the State of Bihar. The educational details of all the students of Bihar have been given in the Bihar Caste based Survey Report, 2022-23. It has become imperative to align the laws regulating various educational curriculums including Sanskrit Education with the National Education Policy. Therefore, it is necessary that the existing structure of Sanskrit Education be re-organized and re-structured and it should be made an effective tool for imparting modern education to the students apart from linguistics and religious studies.
With an objective to re-organize and re-structure the existing Sanskrit Education, to make it pragmatic, workable, dove-tail with National Education Policy and modernization of Sanskrit Education, it is necessary to amend section 4 (2), 5, 25 and 27 of the Bihar Sanskrit Education Board Act, 1981.
Be it therefore, enacted by the legislature of the State of Bihar in the 75th year of Republic of India as follows :-
1. Short title, extent and commencement
(i) Name of the Act: This Act may be called Bihar Sanskrit Education Board (Amendment) Act, 2024.
(ii) It shall extend to the whole of the State of Bihar. (iii) It shall come into force immediately on publication in the official gazette.
2. Amendment in Section 4 (2).
Section 4 (2) of the existing Act shall be substituted as follows:
Director/ Special Director or any other officer entrusted with responsibility of education for religious, Linguistic Minority or Oriental Education- Ex-officio 3. Amendment in Section 5.
A new sub-section (3) shall be added in Section 5 of the existing Act :-
Notwithstanding the tenure prescribed in the section 5 (1), the State Government shall have the power to dissolve the Board any time if it is satisfied that the dissolution is in the larger public interest to make the functioning of the Board consistent with the aim and object of the Act. 4. Amendment in Section 25:
(i) A new sub-section (6) shall be added in Section 25 of the existing Act. (6) (a) With effect from the date, the Act comes into force the existing Bihar Sanskrit Education Board shall stand dissolved.
(b) On dissolution of the existing Bihar Sanskrit Education Board under above Sub-section 6 (a) the State Government in Department of5 (cid:464)बहार गजट (असाधारण), 14 माच(cid:91), 2024 Education shall appoint an Administrator not below the rank of Secretary to the Government to manage the affairs of the Board.
(ii) A new Sub-Section (7) shall be added as follows:
(7) (a) Upon dissolution of the Board, the State Government shall constitute a Committee of experts to study and make recommendation for re-organization and re-structuring of Sanskrit Education with a view to make it consistent with National Education Policy and introduce curriculum of education to strengthen the present teaching in various modern subjects including Science, Humanities and also to include other vocational subjects.
(b) The Committee of expert shall be constituted by the State Government comprising of not more than 5 members of whom at least one shall be person possessed of adequate knowledge of Sanskrit and oriental studies. The Committee shall submit its recommendation to the State Government within a period of one month from the date of Constitution. All logistic support to the Committee shall be provided by Education Department, Government of Bihar.
(c) On the recommendation submitted by the Committee, it shall be examined by the State Government in the Department of Education and shall be accepted with such modification as deemed necessary in the interest of Sanskrit Education.
(iii) New Sub-section (8) shall be added as follows:-
(8) The State Government shall constitute a new Sanskrit Education Board latest within a period of three months from the date of its dissolution.
5. Amendment in Section 27:- Section 27 shall be substituted as follows:-
27 (i) If any difficulty arises in giving effect to the provisions of the existing Act or this Amending Act, the State Government may make such order or do such things not inconsistent with the provisions of the existing Act or the Amending Act as it appears to be necessary or expedient for removing the difficulty. (ii) The State Government may issue appropriate direction for accomplishing the task entrusted to the Committee. The State Government may also issue such direction as deemed necessary for carrying out objects of the existing or Amending Act to the administrator and the administrator shall be bound by such direction of the State Government.
