बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांन्तरण, अनुषासनिक कार्रवाई एवं सेवाषर्त्त) संषोधन

नियमावली, 2024

सं. 11/नियमावली 01-02/2023 (अंश) 786—भारत के संविधान के अनुच्छेद 309 के "परन्तुक" के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए-बिहार राज्यपाल एतद्‌ द्वारा बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्त) नियमावली, 2023 में संशोधन करते हैं तथा निम्नलिखित नियमावली अधिसूचित करते हैं :-

1. संक्षिप्त शीर्षक और प्रारंभः- (1) यह नियमावली '' बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्त) संशोधन नियमावली, 2024'' कही जाएगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह अधिसूचना निर्गत होने की तिथि से प्रवृत्त होगी।

2. बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुषासनिक कार्रवाई एवं सेवाषर्त्तें) नियमावली, 2023 के नियम-2 के उप नियम-(xx) "प्रधान षिक्षक" का विलोपन।- बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023 के नियम-2 के उप नियम-(xx) "प्रधान शिक्षक" को विलोपित किया जाता है।

3. बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुषासनिक कार्रवाई एवं सेवाषर्त्तें) नियमावली, 2023 के नियम-7 के उप नियम-(vi) का प्रतिस्थापन।- बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023 के नियम-7 के उप नियम-(vi) का निम्नलिखित से प्रतिस्थापन होगाः- "(vi) कोई अभ्यर्थी इस नियमावली के अन्तर्गत अधिकतम 5 (पांच) बार परीक्षा में भाग ले सकेगा। 4. बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुषासनिक कार्रवाई एवं सेवाषर्त्तें) नियमावली, 2023 के नियम-13 के बाद निम्नलिखित नियम-13क (फिटमेंट मैट्रिक्स) का अंतःस्थापन।- बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023 के नियम-13 के बाद निम्नलिखित नए नियम-13क (फिटमेंट मैट्रिक्स) के रूप में अंतःस्थापित किया जाएगाः-;बपकरू464द्ध ;द्ध 18 ;बपकरू91द्ध 2024 2 "13क (फिटमेंट मैट्रिक्स)ः- इसके अलावा इस नियमावली के प्रभावी होने पर उनका वेतन फिटमेंट मैट्रिक्स के अनुसार देय होगा। फिटमेंट मैट्रिक्स अनुलग्नक-क के अनुसार होगा। फिटमेंट मैट्रिक्स इस नियमावली के अनुसार विद्यालय अध्यापकों की नियुक्ति को इंगित करता है।

5. बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुषासनिक कार्रवाई एवं सेवाषर्त्तें) नियमावली, 2023 के नियम-13क के बाद निम्नलिखित नियम-13ख (प्रोन्नति) का अंतःस्थापन।- बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023 के नियम-13क के बाद निम्नलिखित नए नियम-13ख (प्रोन्नति) के रूप में अंतःस्थापित किया जाएगाः-

(2) अधिकार के रूप में किसी भी प्रोन्नति का दावा नहीं किया जा सकता है। सभी प्रोन्नति उपलब्ध रिक्तियों के अधीन होगी एवं विभागीय नीतियों को ध्यान में रखते हुए की जाएगी। इसके अलावा, सभी प्रोन्नति, विभाग की तत्‌समय प्रवृत्त नीति के अनुसार की जाएगी और अपेक्षित योग्यता सहित पात्रता के अधीन होगी।''

6. "बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023" के नियम-14 का प्रतिस्थापनः- "बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023" के नियम-14 (अनुशासनिक कार्रवाई) का निम्नलिखित से प्रतिस्थापन होगा :-

"14. अनुषासनिक कार्रवाई :-

14.1 विद्यालय अध्यापक अवचार या कदाचार के विभिन्न कृत्यों के लिए ऐसे अनुशासनिक कार्रवाई के अधीन होंगे, जो नियुक्ति प्राधिकार द्वारा विनिश्चित किए जायेंगे।

14.2 विशेष रूप से, नियुक्ति प्राधिकार निम्नलिखित मामलों में एक विद्यालय अध्यापक के खिलाफ अनुशासनिक कार्रवाई शुरू करने के लिए सक्षम होगाः- क. कार्य से अनाधिकृत अनुपस्थिति; ख. जानबूझकर अवज्ञा और अनुशासनहीनता; ग. विद्यालय के शैक्षणिक वातावरण में योगदान न देना; घ. वित्तीय अनियमितता के मामले; ङ. सार्वजनिक जीवन में ईमानदारी का अभाव; च. किसी भी आपराधिक मामले में शामिल होना; छ. बिहार सरकारी सेवक आचार नियमावली, 1976 के प्रावधानों का उल्लंघन; ज. कोई अन्य मामला जिस पर अनुशासनिक प्राधिकार विचार करे; झ. नियम-17 का उल्लंघन (आचार संहिता);

14.3 समझा गया निलंबन ः- कोई भी विद्यालय अध्यापक जो 48 घंटे से अधिक समय से न्यायिक/पुलिस/सिविल अभिरक्षा में रहा है, उसे निलंबित समझा जाएगा और अनुशासनिक प्राधिकार ऐसा आदेश जारी करेगा।

14.4 अनुशासनिक प्राधिकार, दोषी विद्यालय अध्यापक पर निम्नलिखित दंड अधिरोपित कर सकेगा। क. वृहद्‌ दंड- i. बर्खास्तगी ii. अनिवार्य सेवानिवृत्ति iii. निचले पद पर पदावनति iv. कम वेतनमान में पदावनति v. संचयी प्रभाव से वेतनवृद्धि (वेतन वृद्धियों) को रोकना;बपकरू464द्ध ;द्ध 18 ;बपकरू91द्ध 2024 3 ख. लघु दंड- i. निन्दन ii. निर्धारित विधि से निर्दिष्ट दिनों के लिए सक्षम प्राधिकार के समक्ष उपस्थिति दर्ज किया जाना आवश्यक होगा

iii. वेतन से कटौती के माध्यम से वित्तीय जुर्माना लगाना जो 15 दिनों से अधिक न हो iv. गैर-संचयी प्रभाव से वेतन वृद्धि (वेतन वृद्धियों) को रोकना v. प्रोन्नति रोकना

14.5 विभागीय कार्रवाई शुरू करने की प्रक्रिया :- अनुशासनिक प्राधिकार, आरोपित विद्यालय अध्यापक के खिलाफ रिपोर्ट प्राप्त होने पर यह तय करेगा कि क्या रिपोर्ट के आधार पर, वृहद्‌ दंड या लघु दंड का प्रथमदृष्टया मामला बनता है। इस प्रयोजन के लिए, अनुशासनिक प्राधिकार आरोपित विशिष्ट शिक्षक से 7 दिन का समय देते हुए एक कारण पृच्छा पूछ सकता है कि उसके विरूद्ध वृहद्‌/लघु दंड अधिरोपित करने के लिए, जैसा भी मामला हो, कार्यवाही क्यों नहीं प्रारंभ की जाय। उत्तर प्राप्त होने के बाद अनुशासनिक प्राधिकार यह तय करेगा कि वृहद्‌ दंड कार्रवाई या लघु दंड कार्रवाई के लिए आगे बढ़ना है या मामले को बंद करना है। यदि आरोपित विद्यालय अध्यापक ऐसी दो सूचनाओं का उत्तर नहीं देता है, तो अनुशासनिक प्राधिकार मामले को एकपक्षीय रूप से तय करने के लिए सक्षम होगा। यदि अनुशासनिक प्राधिकार वृहद्‌ या लघु दंड के लिए कार्रवाई प्रारंभ करने का विकल्प चुनता है तो इन नियमों में उल्लिखित आगे की प्रक्रिया का पालन किया जाना चाहिए।

14.5.1 निलंबन :- उपर्युक्त वर्णित कारणों से अनुशासनिक कार्रवाई शुरू करते समय, अनुशासनिक प्राधिकार आरोपित विद्यालय अध्यापक को निलंबन पर रख सकता है। परंतु अनुशासनिक प्राधिकार आरोपित विद्यालय अध्यापक को निलंबन के अधीन रखने से पूर्व, कारण पृच्छा करेगा। निलंबन की अवधि के दौरान, उक्त शिक्षक मूल वेतन और मंहगाई भत्ते के 50% के बराबर जीवन निर्वाह भत्ता का हकदार होगा।

14.6 वृहद्‌ दंड अधिरोपित करने की प्रक्रिया :- 14.6.1 जब भी अनुशासनिक प्राधिकार के पास यह विश्वास करने का आधार हो कि विद्यालय अध्यापक ने इस नियमावली में विहित किसी नियम के विरूद्ध कोई कार्य किया है अथवा नियमानुसार कार्य नहीं किया है तो वह प्रखंड शिक्षा पदाधिकारी या किसी अन्य पदाधिकारी /कर्मी से दस्तावेजों और अन्य साक्ष्यों के साथ एक मसौदा अरोप-पत्र प्रस्तुत करने के लिए कहेगा। इसके बाद, अनुशासनिक प्राधिकार एक जाँच पदाधिकारी नियुक्त करेगा जो अनुशासनिक कार्यवाही का संचालन करेगा। जाँच पदाधिकारी नैसर्गिक न्याय के सिद्धांतों का पालन करेगा और आरोपित विद्यालय अध्यापक को अपना मामला प्रस्तुत करने के लिए पर्याप्त अवसर प्रदान करेगा। जाँच पदाधिकारी ऐसे कागजात/ दस्तावेज भी उपलब्ध कराएगा जो कार्यालय के पास उपलब्ध हो। जाँच पदाधिकारी विभागीय कार्यवाही दो महीने के अन्दर पूरी कर लेगा। यदि आरोपित विद्यालय अध्यापक दो तिथियों पर जाँच पदाधिकारी के समक्ष उपस्थित नहीं होता है, तो जाँच पदाधिकारी, उपलब्ध दस्तावेजों के आधार पर, एकपक्षीय प्रतिवेदन समर्पित करने के लिए सक्षम होगा।

14.6.2 विभागीय कार्यवाही पूरी होने के बाद जाँच पदाधिकारी एक जांच प्रतिवेदन समर्पित करेगा और उसे आगे की कार्रवाई के लिए अनुशासनिक प्राधिकार को भेजेगा।

14.6.3 अनुशासनिक प्राधिकार अपने पास उपलब्ध पदाधिकारियों में से एक जाँच पदाधिकारी नियुक्त कर सकेगा या जिला पदाधिकारी से जिले में उपलब्ध पदाधिकारियों से इसे नियुक्त करने का अनुरोध कर सकेगा। 14.6.4 अनुशासनिक प्राधिकार जाँच पदाधिकारी के समक्ष विभाग के मामले को प्रस्तुत करने के लिए एक प्रस्तुतकर्त्ता पदाधिकारी भी नियुक्त करेगा। ऐसा प्रस्तुतकर्त्ता पदाधिकारी विभाग के प्रखंड स्तर के कर्मचारियों में से हो सकता है। वैकल्पिक रूप से, वह जिला पदाधिकारी से अन्य विभागों के प्रखंड स्तर के पदाधिकारियों से प्रस्तुतकर्त्ता पदाधिकारी नियुक्त करने का अनुरोध कर सकेगा।

14.7 लघु दंड अधिरोपित करने की प्रक्रिया :- जहाँ अनुशासनिक प्राधिकार की राय में, मामला मामूली दंड अधिरोपित करने के लिए उपयुक्त है, वहां वह आरोपित विद्यालय अध्यापक को पक्ष रखने के लिए 15 दिन का समय देते हुए कारण पृच्छा करेगा कि क्यों नहीं उस पर विशेष लघु दंड अधिरोपित किया जाए। आरोपित विद्यालय अध्यापक से उत्तर प्राप्त होने पर, अनुशासनिक प्राधिकार उस विशेष लघु दंड को अधिरोपित कर सकेगा।

14.8 काम नहीं वेतन नहीं नियम :- जहाँ जिले के किसी पदाधिकारी या प्राधिकार या प्रशासनिक विभाग द्वारा निरीक्षण करने पर, विद्यालय का कोई विद्यालय अध्यापक या कर्मचारी उचित अनुमोदन के बिना अनुपस्थित पाया जाता है तो जिला शिक्षा पदाधिकारी इसके लिए सक्षम होगा कि वह ऐसे अनुपस्थित के वेतन को तुरंत रोक दे। इसके बाद, 7 दिनों का समय देकर अनुपस्थित से कारण बताओ पूछा जाएगा और यदि उत्तर संतोषजनक नहीं होता है, तो अनुपस्थिति की अवधि के लिए अनुपस्थित के वेतन की कटौती की जाएगी।

7. बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुषासनिक कार्रवाई एवं सेवाषर्त्तें) नियमावली, 2023 के नियम-14क (अपील) का अंतःस्थापन।- बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023 के नियम-14 के बाद निम्नलिखित नए नियम-14क (अपील) के रूप में अंतःस्थापित किया जाएगाः-;बपकरू464द्ध ;द्ध 18 ;बपकरू91द्ध 2024 4 "14क. अपील :- अनुशासनिक प्राधिकार द्वारा पारित कोई भी आदेश, आदेश पारित करने के 15 दिनों के अन्दर क्षेत्रीय शिक्षा उप निदेशक के समक्ष अपील योग्य होगा। क्षेत्रीय शिक्षा उप निदेशक 30 दिनों के अन्दर अपील का निष्पादन करेगा। परन्तु क्षेत्रीय शिक्षा उप निदेशक आदेश पारित करने से पहले अपीलकर्त्ता की सुनवाई करेगा। 8. "बिहार विद्यालय विद्यालय अध्यापक नियमावली, 2023" में एक नया नियम-14ख (पुनरीक्षण) का अंतःस्थापन।- बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023 के नियम-14क के बाद निम्नलिखित नए नियम-14ख (पुनरीक्षण) के रूप में अंतःस्थापित किया जाएगाः- "14.ख. पुनरीक्षण ः- क्षेत्रीय शिक्षा उप निदेशक द्वारा पारित आदेश के विरूद्ध एक पुनरीक्षण, प्रमंडलीय आयुक्त के समक्ष होगा। पुनरीक्षण, अपील के निष्पादन के 15 दिनों के अन्दर दायर किया जाना चाहिए तथा प्रमंडलीय आयुक्त 30 दिनों के अन्दर इसका निष्पादन करेंगे।

9. बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुषासनिक कार्रवाई एवं सेवाषर्त्तें) नियमावली, 2023 के नियम-16 (अनुकम्पा के आधार पर नियुक्ति) का प्रतिस्थापन।- बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023 के नियम-16 (अनुकम्पा के आधार पर नियुक्ति) का निम्नलिखित से प्रतिस्थापना होगाः-

''16. अनुकम्पा के आधार पर नियुक्तिः- अनुकम्पा के आधार पर कोई भी नियुक्ति विभाग द्वारा आयोजित स्क्रीनिंग परीक्षा उर्त्तीण करने के अधीन होगा। इसके अलावा अनुकम्पा के आधार पर नियुक्ति विभाग की तत्‌समय प्रवृत्त नीति के अनुसार की जाएगी और अपेक्षित योग्यता एवं रिक्ति के अधीन होगी।''

10. बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुषासनिक कार्रवाई एवं सेवाषर्त्तें) नियमावली, 2023 के नियम-18 (षिकायत एवं अपील) का विलोपन।- बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023 के नियम-18 (शिकायत एवं अपील) को विलोपित किया जाता है।

11. बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानान्तरण, अनुषासनिक कार्रवाई एवं सेवाषर्त्तें) नियमावली, 2023 के नियम-19 के उप-नियम (ii) की प्रतिस्थापनाः- बिहार राज्य विद्यालय अध्यापक (नियुक्ति, स्थानांतरण, अनुशासनिक कार्रवाई एवं सेवाशर्त्तें) नियमावली, 2023 के नियम-19 के उप-नियम (ii) का निम्नलिखित से प्रतिस्थापन होगा।-

''(ii) इन नियमों के तहत प्रावधान के अनुसार या न्यायिक आदेशों के अनुपालन के अतिरिक्त विद्यालय अध्यापकों के पद पर कोई नई नियुक्ति नहीं की जा सकती है।

THE BIHAR STATE SCHOOL TEACHER (APPOINTMENT, TRANSFER,

DISCIPLINARY PROCEEDINGS AND SERVICE CONDITIONS)AMENDMENT

RULES, 2024

No. 11 / Niyamawali 01-02 / 2023(Part) 786--In exercise of the powers conferred

under proviso to Article 309 of the Constitution of India, the Governor of Bihar hereby

amends the Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings

and Service Conditions) Rules, 2023 and notifies the following: -

1. Short title and commencement: -(1) These rules shall be called "The Bihar State School Teacher (Appointment, Transfer, Disciplinary Proceedings and Service conditions) Amendment Rules, 2024".

(2) It shall extend throughout the state of Bihar. (3) It shall come into force from the date of issuance of notification.

2. Deletion of Sub-rule (xx)- "Head Teacher" of Rule 2 of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023:-Sub-rule (xx)- "Head Teacher" of Rule 2 of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 is hereby repealed.

3. Substitution of Sub-rule (vi) of Rule 7 of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 – The sub-rule (vi) of Rule 7 of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 shall be replaced with the following: -

"(vi) Any candidate can appear, maximum five times, in an examination conducted under these rules."

4. Insertion of Rule 13A (Fitment Matrix) after Rule 13 of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023: - A new Rule 13A (Fitment Matrix) shall be inserted after Rule 13 of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 as under:-

6 13(A) Fitment Matrix:-Further, upon these Rules taking effect, their pay shall be as per the The Fitment Matrix be as per the Annexure A. The Fitment Matrix indicates the placement of the School Teachers as per these Rules.

5. Insertion of Rule 13B (Promotion) after Rule 13Aof Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023: - A new Rule 13B (Promotion) shall be inserted after Rule 13A of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 as under:-

"13B. Promotion:- (1) The School Teachers shall be entitled to promotion as per

(2) No promotion can be claimed as a matter of right. All promotions shall be subject to the available vacancies and shall be done in keeping with the Departmental policies. Furthermore, all promotions shall be made as per the prevailing policy of the Department and shall be subject to eligibility including the requisite qualification."

6. Substitution of Rule 14 (Disciplinary Proceeding)of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023: - Rule 14 (Disciplinary Proceeding) of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023shall be substituted by the following:-

" 14. Disciplinary Action - 14.1 The SchoolTeachers shall be subject to such disciplinary action, for various acts of commission or omission, as may be decided the Appointing Authority.

14.2 In particular, the Appointing Authority shall be competent to initiate disciplinary action against an School Teacher in following cases: - a. Unauthorized absence from duty; b. Willful Disobedience and indiscipline; c. Not contributing to the academic atmosphere of the school; d. Matters of financial irregularity; e. Lack of probity in public life; f. Involvement in any criminal case; g. Violation of provisions of Bihar Government Servant Conduct Rules, 1976;

h. Any other matter which the disciplinary authority may consider. i. Violation of Rule 17 (Code of Conduct).

14.3 Deemed Suspension:-Any School Teacher who has been in judicial/police/civil custody for more than 48 hours shall be deemed suspended and the disciplinary authority shall issue such orders.

14.4 The disciplinary authority may impose the following penalties on the delinquent teacher:-

a. Major Penalties- i. Dismissal ii. Compulsory Retirement iii. Demotion to lower post iv. Demotion to lower pay scale v. With holding increment(s) with cumulative effect

b. Minor Penalties-

i. Censure ii. Requiring to mark attendance in such manner and before such authority for specified number of days

iii. Imposing financial penalty by way of deduction from the salary not exceeding 15 days

iv. With holding increment(s) with non-cumulative effect v. With holding promotion

14.5 Procedure for initiating department action:-The disciplinary authority, upon receiving a report against a delinquent teacher shall decide whether on the basis of report, a prima-facie case of major penalty or minor penalty is made out. For the purpose, the disciplinary authority may ask a show cause, giving 7 days time, from the delinquent teacher as to why proceeding against him, for imposing major/minor penalty, as the case may be, be not initiated. After the reply is received the disciplinary authority shall decide whether to proceed for major penalty action or minor penalty action or close the matter. In case the delinquent teacher does not reply to two such notices, the disciplinary authority shall be competent to decide the matter ex-parte. If the disciplinary authority chooses to initiate action for major or minor penalty, then further procedure should be followed as mentioned in these Rules.

14.5. 1Suspension: - While initiating a disciplinary action on above grounds, the disciplinary authority may place the delinquent Teachers on suspension. However, a show cause shall be asked from the delinquent teacher before passing any order of suspension. During the period of suspension, the said teacher shall be entitled to subsistence allowance equivalent to 50% of basic salary and dearness allowance.

14.6 Procedure for Imposing Major Penalty:- 14.6.1 Whenever the disciplinary authority has reason to believe that the School Teacher has committed any act as mentioned in these Rules, he shall ask the Block Education Officer or any other employee to submit a draft charge-sheet along with documents and other evidences. Thereafter, the disciplinary authority shall appoint an Inquiry Officer who shall conduct the disciplinary proceeding. The Inquiry Officer shall follow the principles of natural justice and provide adequate opportunity to the delinquent teacher to present his case. The Inquiry Officer shall also provide such papers/documents as are available with the office. The Inquiry Officer shall finish the departmental proceedings within two months. If the delinquent teacher does not appear before the Inquiry Officer on two dates, the Inquiry Officer shall, based on available documents, be competent to pass an order ex-parte.

14.6.2 After the completion of the departmental proceeding the Inquiry Officer shall submit this report to the disciplinary authority for further action.

8 14.6.3 The disciplinary authority may appoint an Inquiry Officer from amongst the Officers available at his disposal or may request the District Magistrate to appoint the same from the Officers available in the District.

14.6.4 The disciplinary authority shall also appoint a presenting officer to present the case of the Department before the Inquiry Officer. Such presenting officer can be from amongst the block level employees of the Department. Alternatively, he may request the District Magistrate to appoint the presenting officer from block level officers of the other departments.

14.7 Procedure for Imposing Minor Penalty:- Where, in the opinion of the disciplinary authority, the matter is suitable for imposing minor penalty, he shall ask a show cause giving 15 days time to the delinquent teacher to explain why that particular minor penalty be not imposed. Upon receiving the reply from the delinquent teacher, the disciplinary authority may impose the particular minor penalty.

14.8 No work No pay Rule:-Where upon an inspection by any officer or authority of the District or the Administrative Department, any teacher or staff of the school is found absent without proper approval, it shall be competent for the District Education Officer to withhold the salary of such absentee immediately. Thereafter, a show cause, giving 7 days time, shall be asked from the absentee and if the reply is not satisfactory, the salary of the absentee shall be deducted for the period of absence.

7. Insertion of a new Rule 14A (Appeal)inthe Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 –A newRule 14 A (Appeal) is here by inserted after Rule 14 ofthe Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023as per the following: -

"14A. Appeal:- Any order passed by the disciplinary authority shall be appealable before the Regional Deputy Director within 15 days of passing the order. The Regional Deputy Director shall dispose of the appeal within 30 days. Provided that the Regional Deputy Director shall hear the appellant before passing the order."

8. Insertion of a new Rule 14B (Revision)in the Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 –A newRule 14 B (Revision) is here by inserted after Rule 14Athe Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023as per the following:-

"14B. Revision: - A revision against the order passed by Regional Deputy Director shall lie before the Divisional Commissioner. The Revision must be filed within 15 days of the disposal of the appeal and the Divisional Commissioner shall dispose of the same within 30 days.

9. Substitution of Rule 16 (Appointment on Compassionate Grounds) of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023:-Rule 16 (Appointment on Compassionate Grounds) of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 shall be substituted by the following:-

"16 Appointment on Compassionate Ground- Any appointment as school teacher on compassionate grounds shall be subject to qualifying such screening test as the Department may conduct. Provided further that any compassionate appointment shall be made subject to the prevailing policy of the Department including the eligibility and vacancy."

10. Deletion of Rule 18 (Complaints and Appeals) of Bihar State School

Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions)

Rules, 2023: - Rule 18 (Complaints and Appeals) of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 is repealed.

11. Substitution of Sub-rule (ii) of Rule 19 of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023:-Sub-rule (ii) of Rule 19 of Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023 shall be substituted by the following:-

"(ii) No new appointments to the post of school teachers can be made except as per the provisions under these Rules or in compliance to judicial orders."
