सं॰ जी/सेना-05-04/2021-2625--युद्धाभ्यास, खुले क्षेत्र में गोला चलाने तथा तोप दागने का अभ्यास अधिनियम, 1938 (अधिनियम 5, 1938) की धारा 9 की उप धारा-(2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, इसके साथ उपाबद्ध अनुसूची के संपूर्ण क्षेत्र में या उसके किसी विनिर्दिष्ट भाग में 23वीं अगस्त, 2023 से आरंभ होने वाली और 22वीं अगस्त, 2043 को समाप्त होने वाली 20 वर्षों की अवधि के दौरान, मैदानी गोलाबारी और तोपखाना अभ्यास हेतु प्राधिकृत करते हैं। उक्त धारा की उपधारा-(1) के अपेक्षानुसार, उक्त क्षेत्र को ऐसे क्षेत्र के रूप में परिभाषित करने वाली अधिसूचना सं0-12271 दिनांक-16.10.2023, जिसके भीतर 23वीं अगस्त, 2023 से आरंभ होने वाली और 22वीं अगस्त, 2043 को समाप्त होने वाली 20 वर्षों की अवधि के दौरान आवधिक रूप सें मैदानी गोलाबारी और तोपखाना अभ्यास हेतु प्राधिकृत किया जा सकता है, दिनांक-17.10.2023 के बिहार राजपत्र के असाधारण अंक में पहले ही प्रकाषित की जा चुकी है तथा उक्त धारा की उपधारा (3) की अपेक्षानुसार इस अधिसूचना के जारी करने का अभिप्राय प्रकाषित करने वाली अधिसूचना दिनांक-16.01.2024 के बिहार गजट के असाधारण अंक में अधिसूचना सं0-508 दिनांक-16.01.2024 के द्वारा पहले ही प्रकाषित की जा चुकी है।

में उल्लिखित क्षेत्र को कार्यहित में निम्नलिखित शर्तों के साथ परिभाषित किया जाता है :-
(i) फायरिंग से पूर्व अधिसूचित क्षेत्र के अंतर्गत आनेवाले गाँव को पूर्ण रूप से खाली कराने तथा इसका सत्यापन प्रखंड विकास पदाधिकारी/थानाध्यक्ष/मुखिया/ सरपंच के स्तर से किये जाने के उपरान्त ही फायरिंग की अनुमति होगी।
(ii) फायरिंग से संबंधित SOP के किसी भी बिन्दु का उल्लंघन होने की स्थिति में फायरिंग रोकने की शक्ति जिला प्रशासन में निहित होगी।
(iii) फायरिंग के समय किसी भी आकस्मिक परिस्थिति से निपटने हेतु सेना के तरफ से Single Nodal Point स्थापित किया जाएगा।
(iv) मिसफायर गोली तथा गोला एवं बारूद की संख्या की पूर्ण जानकारी के साथ इसके Disposal की पूर्ण जिम्मेदारी संबंधित Firing Incharge/Camp Commandant की होगी।
(v) परिभाषित क्षेत्र के संबंध में दिनांक-20.07.2023 को Station Headquarters Gaya में आयोजित बैठक के कार्यवृत्त में वर्णित बिन्दुओं का अनुपालन करने की जिम्मेदारी Firing Incharge/Camp Commandant की होगी।
3. परिभाषित क्षेत्र की भूमि का विवरण का अवलोकन जिला पदाधिकारी, गया के कार्यालय में किया जा सकता है। (ह॰) अस्पष्ट, 21 मार्च, 2024
सं॰ जी/सेना-05-04/2021-2625, दिनांक 21 मार्च, 2024 का अंग्रेजी में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारत संविधान के अनुच्छेद 348 के खंड-(3) के अधीन अंग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जाएगा। (ह॰) अस्पष्ट, The 21st March 2021
No. G/Sena-05-04/2021-2625--In exercise of the powers conferred by sub- section (2) of section 9 of the Manoeuvers, Field Firing and Artillery Practices Act, 1938 (Act 5 of 1938), the Governor of Bihar is pleased to authorize, during the period commencing from the 23th August, 2023 and ending on the 22th August, 2043, the carrying out of Field Firing and or artillery practice throughout the area described in the schedule hereto annexed. A notification, as required by sub-section (1) of the said section, defining the said areas as the area within which for a period of 20 years commencing from the 23th August, 2023 and ending on the 22th August, 2043, the carrying out periodically of the field firing and the artillery practice may be authorized, has been previously published in the extra-ordinary issue of the "Bihar official Gazette",3 (cid:464)बहार गजट (असाधारण), 21 माच(cid:91), 2024 dated the 17-10-2023 with s.o. no 12271 dated the 16.10.2023 and a notification in respect of the same as required by sub-section (3) of the said section publishing the intention to issue this notification has been previously published in extra-ordinary issue of the "Bihar Gazette", dated the 16-01-2024 with S.O. no.-508, dated the 16-01-2024.

2. In reference to report of the District Magistrate, Gaya vide letter no.- 6428, dated- 24-08-2023 The area mentioned in the above schedule is being defined in the work interest under the followed conditions :-
(i) Firing within the notified area shall be allowed only after the village falling under the area is completely evacuated before firing and it is verified at the level of Block Development Officer/Police Station Head/ Mukhya/Sarpanch.
4 (cid:464)बहार गजट (असाधारण), 21 माच(cid:91), 2024(ii) In case of violation of any point of the SOP's related to the firing, the power to stop the firing will be vested in the district administration.
(iii) To deal with any emergency at the time of firing, a single nodal point shall be established by the army.
(iv) The concerned firing Incharge/Camp Commandant shell have the total responsibility for the detection and complete information alongwith the disposal of the number of misfired bullets, shells and ammo.
(v) It will be the responsibility of the firing Incharge/Camp Commandant to comply with the points mentioned in the minutes of the meeting Regarding the defined area, held on 20.07.2023. at station headquarters, Gaya
3. The Land Plan of Notified area may be inspected in the office of the District Magistrate, Gaya
