सं॰ 11/अं०शा०/VAT Audit-07/2024-1486—बिहार मूल्य वर्द्धित कर अधिनियम, 2005 (2005 का अधिनियम सं॰-27) की धारा 26 की उपधारा (2) के साथ पठित बिहार मूल्य वर्द्धित कर नियमावली, 2005 के नियम 22 के उपनियम (1) के खंड (ख) के अधीन प्रदत शक्तियों का प्रयोग करते हुए राज्य कर आयुक्त, बिहार, पटना द्वारा वित्तीय वर्ष 2022-23 के लिए व्यवसाय के विस्तृत वैट अंकेक्षण हेतु व्यवसायियों के चयन के संदर्भ में निम्नांकित मानदण्ड अपनाये गये हैंः-

''(क) बिहार मूल्य वर्द्धित कर अधिनियम, 2005 के अधीन पेट्रोलियम क्रूड, पेट्रोल, डीजल, ATF तथा प्राकृतिक गैस की खरीद-बिक्री हेतु निबंधित वैसे सभी व्यवसायी जिन्होंने वर्ष 2022-23 में अधिनियम के अधीन कर के रूप में रू0 250 करोड़ से अधिक राशि का भुगतान किया हो; (ख) बिहार मूल्य वर्द्धित कर अधिनियम, 2005 के अधीन पेट्रोलियम क्रूड, पेट्रोल, डीजल, ATF तथा प्राकृतिक गैस की खरीद-बिक्री हेतु निबंधित वैसे सभी व्यवसायी जिन्होंने वर्ष 2021-22 में अधिनियम के अधीन कर के रूप में रू0 25 करोड़ से अधिक राशि का भुगतान किया हो एवं जिनके द्वारा वर्ष 2021-22 में भुगताये गये कर के राशि की तुलना में वर्ष 2022-23 में भुगताये गये कर की राशि में 10 प्रतिशत से कम की अभिवृद्धि दर्ज की हो;

(ग) उपर्युक्त कंडिका (क) एवं (ख) में निर्दिष्ट व्यवसायियों के अतिरिक्त बिहार मूल्य वर्द्धित कर अधिनियम, 2005 के अधीन पेट्रोलियम क्रूड, पेट्रोल, डीजल, ATF तथा प्राकृतिक गैस की खरीद-बिक्री हेतु निबंधित वैसे सभी व्यवसायी; (i) जिनका वर्ष 2022-23 में सकल आवर्त रू0 20 करोड़ से अधिक हो, और (ii) जिन्होंने वर्ष 2022-23 में अधिनियम के अधीन किसी मद में एक रूपया या उससे अधिक राशि का भुगतान किया हो, और

(iii) जिनका वर्ष 2021-22 के अंकेेक्षण के लिए चयन नहीं किया गया हो।''

उपर्युक्त मानदण्डों के आधार पर वित्तीय वर्ष 2022-23 हेतु कुल 14 व्यवसायियों को अंकेक्षण हेतु चयनित किया गया है, जिनकी अंचलवार सूची अनुलग्नक के रूप में इस अधिसूचना के साथ संलग्न है।

No. 11/अं०शा०/VAT Audit-07/2024-1486—In exercise of the powers conferred under sub-section(2) of section 26 of the Bihar Value Added Tax Act, 2005 (Act No.- 27 of 2005) read with clause (b) of sub-rule (1) of Rule 22 of the Bihar Value Added Tax rules, 2005 the Commissioner has adopted the following criteria for selecting registered dealers for detailed audit of their business relating to the financial year 2022-23:-

"(A). All dealers registered under the Bihar Value Added Tax Act, 2005 for the sale and purchase of Petroleum crude, Petrol, Diesel, ATF and Natural gas who have paid a sum exceeding Two hundred fifty crore rupees during the year 2022-23 by way of tax payable;

(B). All dealers registered under the Bihar Value Added Tax Act, 2005 for the sale and purchase of Petroleum crude, Petrol, Diesel, ATF and Natural gas who have paid a sum exceeding Twenty five crore rupees during the year 2021-22 by way of tax payable and have also registered an increase of less than 10 percent in the amount of tax paid in the year 2022-23 as compared to the amount of tax paid in the year 2021-22;

(C). All dealers other than those specified in paragraph (A) and (B) above, registered under the Bihar Value Added Tax Act, 2005 for the sale and purchase of Petroleum crude, Petrol, Diesel, ATF and Natural gas ;

(i) Whose gross turnover during the year 2022-23 exceeded twenty crore rupees, and

(ii) Who have paid rupee one or more than Rs. one in any head under this Act during the year 2022-23, and

(iii) Who have not been selected for Audit for the year 2021-22"

A total of 14 dealers have been selected for Audit on the basis of above criteria for the financial years 2022-23. The circle wise list of the selected dealers is appended hereto.
