सं0 01/ए० जी० (उद्यान)-45/2023-1206/—०—भारत के संविधान के अनुच्छेद-309 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार उद्यान सेवा (—षि कोटि-7) में भर्त्ती, प्रोन्नति एवं सेवा शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :-

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ (1) यह नियमावली बिहार उद्यान सेवा (—षि कोटि-7) भर्त्ती, प्रोन्नति एवं सेवा शर्त नियमावली-2024 कही जायेगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत के प्रभाव से प्रवृत होगी।

2. परिभाषा :- जब तक संदर्भ में विरूद्ध अन्यथा अपेक्षित न हो, इस नियमावली के प्रयोजन में- (i) 'राज्य' से अभिप्रेत है, बिहार राज्य, (ii) 'राज्यपाल' से अभिप्रेत है, बिहार के राज्यपाल, (iii) 'सरकार' से अभिप्रेत है, बिहार सरकार, (iv) 'विभाग' से अभिप्रेत है, बिहार सरकार का —षि विभाग, (v) '—षि सेवा अधिनियम' से अभिप्रेत है, बिहार —षि सेवा अधिनियम 1982 (बिहार अधिनियम संख्या-44, 1982),

(vi) '(—षि कोटि-7)' से अभिप्रेत है बिहार —षि सेवा अधिनियम 1982 की धारा-2 के अधीन अनुसूची-1 में उद्धृत कोटि-7 (उद्यान), जो अब बिहार उद्यान सेवा (—षि कोटि-7) कही जाएगी।

(vii) 'संवर्ग' से अभिप्रेत है बिहार उद्यान सेवा (—षि कोटि-7) का संवर्ग, (viii) 'आयोग' से अभिप्रेत है बिहार लोक सेवा आयोग, (ix) 'वर्ष' से अभिप्रेत है ''वित्तीय वर्ष अर्थात 1 अप्रैल से अगले वर्ष के 31 मार्च तक'' की अवधि, (x) 'सक्षम प्राधिकार' से अभिप्रेत है कार्यपालिका नियमावली द्वारा घोषित प्राधिकार, (xi) 'सदस्य' से अभिप्रेत है बिहार उद्यान सेवा (—षि कोटि-7) में नियुक्त व्यक्ति, (xii) 'नियुक्ति' प्राधिकार से अभिप्रेत है राज्य सरकार,;बपकरू464द्ध ;द्ध 1 ;बपकरू292द्ध 2024 2 3. संवर्ग नियंत्रण :- यह सेवा एक राज्य सेवा होगी तथा —षि विभाग इस सेवा का नियंत्री विभाग होगा। 4. पद सोपान :- (1) (क) मूल कोटि का पद अनुमण्डल उद्यान पदाधिकारी/सहायक निदेशक (उद्यान) एवं समकक्ष पद।

(ख) प्रथम प्रोन्नति का पद-जिला उद्यान पदाधिकारी/उप निदेशक उद्यान एवं समकक्ष पद। (ग) द्वितीय प्रोन्नति का पद-संयुक्त निदेशक (उद्यान) एवं प्रमण्डल स्तरीय समकक्ष पद। (घ) तृतीय प्रोन्नति का पद-अपर निदेशक (उद्यान)।

(2) संवर्ग की संरचना एवं बल का पुनर्निर्धारण विभाग द्वारा समय-समय पर आवश्यकतानुसार, की जा सकेगी।

5. मूल कोटि में नियुक्ति एवं प्रोन्नति ः- (1) सेवा में नियुक्ति के लिए भारत का नागरिक होना अनिवार्य होगा। मूल कोटि के 67 प्रतिशत पद सीधी नियुक्ति से तथा 33 प्रतिशत पद प्रोन्नति से भरे जायेंगे। (2) प्रति वर्ष 1 ली अप्रैल को कोटि में स्वीकृत पदों के विरूद्ध प्रोन्नति के लिए तथा सीधी नियुक्ति के लिए रिक्त पदों की गणना अलग-अलग की जायेगी। यह गणना पदों के आधार पर की जायेगी अर्थात सीधी नियुक्ति के पदों के रिक्त होने पर इन्हें सीधी नियुक्ति द्वारा प्रोन्नति के पदों के रिक्त होने पर इन्हें प्रोन्नति द्वारा भरा जाएगा। 30 अप्रैल को रिक्तियों के संबंध में कोटिवार अधियाचना विभाग द्वारा आयोग को प्रेषित कर दी जाएगी।

(3) शैक्षणिक योग्यता-संवर्ग में सीधी नियुक्ति या प्रोन्नति के लिए न्यूनतम शैक्षणिक योग्यता किसी मान्यता प्राप्त —षि विश्वविद्यालय/अन्य विश्वविद्यालय (—षि संकाय) से उद्यान विज्ञान में स्नातक या Elective उद्यान विज्ञान के साथ —षि विज्ञान में स्नातक।

(4) सीधी भर्त्ती द्वारा नियुक्ति-

(i) सीधी नियुक्ति आयोग द्वारा संचालित प्रतियोगिता परीक्षा के आधार पर अनुशंसित अभ्यर्थियों से की जाएगी।

(ii) ''उम्र सीमा - आवेदन आमंत्रित करने वाले वर्ष के पहली अगस्त को न्यूनतम आयु 21 (इक्कीस) वर्ष होगी। अधिकतम उम्र सीमा वही होगी जो सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी भर्त्ती के लिए समय-समय पर, विनिश्चित की जाय, किन्तु विशेष परिस्थितियों में इसे राज्य सरकार के आदेश से बढ़ाया जा सकेगा।

परन्तु विधिवत्‌ नियोजित एवं कार्यरत संविदा कर्मियों को, समान पद पर सीधी भर्त्ती

के तहत नियमित नियुक्ति में, अधिकतम उम्र सीमा में उतने वर्षों तक की छूट दी

जायेगी, जितने वर्षों तक उनके द्वारा बिहार सरकार में संविदा के आधार पर समान

पद पर कार्य किया गया हो।''

(iii) आरक्षण- सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी नियुक्ति के लिए, समय-समय पर अवधारित आरक्षण प्रावधान लागू होंगे।

(iv) विभाग सीधी नियुक्ति हेतु सामान्य एवं आरक्षण कोटिवार रिक्तियों की संख्या के साथ, अधियाचना प्रत्येक वर्ष आयोग को भेजेगा।

(v) प्रतियोगिता परीक्षा के विषय तथा पाठ्‌यक्रमः- इस नियमावली के नियम 5 (4) (i) में उल्लेखित प्रतियोगिता परीक्षा में 100 अंको के हिन्दी विषय में उत्तीर्ण होना अनिवार्य होगा किन्तु इसका प्राप्तांक की गणना मेधा सूची बनाने के परियोजनार्थ नही की जायेगी। मेधा सूची उद्यान विज्ञान में 200-200 अंको के दो प्रश्न पत्रों, सामान्य ज्ञान के 100 अंको के प्रश्न पत्र तथा मौखिक परीक्षा के 50 अंको के विरूद्ध प्राप्तांको के योग के आधार पर तैयार की जायेगी। हिन्दी तथा सामान्य ज्ञान का पाठ्‌यक्रम वहीं होगा जो बिहार लोक सेवा आयोग द्वारा संयुक्त प्रतियोगिता परीक्षा के विनिश्चित किया जाय। उद्यान विज्ञान का पाठ्‌यक्रम विभाग द्वारा बिहार लोक सेवा आयोग के परामर्श से तैयार किया जाएगा। उद्यान विज्ञान तथा सामान्य ज्ञान के उपरोक्त तीन पत्रों के प्राप्तांक के योग के आधार पर अभ्यर्थियों को समुचित संख्या में मौखिक परीक्षा के लिए बुलाया जाएगा। मौखिक परीक्षा 50 अंको की होगी।

(vए) मूल कोटि के पदों पर चयन लिखित एवं मौखिक परीक्षा में प्राप्त अंकों के योग एवं समान पद पर संविदा नियोजन के तहत की गयी कार्य अवधि के लिए अधिमानता देते हुए की जायेगी। चयन के लिए अंको की अधिमानता का निर्धारण निम्नवत्‌ किया जायेगा- (क) आयोग की परीक्षा एवं साक्षात्कार में प्राप्त अंकों की अधिमानता- 75 अंक (ख) बिहार सरकार में संविदा के आधार पर समान पद पर किये गये कार्य अवधि की अधिमानता- 25 अंक

(संविदा नियोजन के प्रत्येक एक वर्ष के लिए 5 अंक की दर से अधिकतम 25 अंक होगी);बपकरू464द्ध ;द्ध 1 ;बपकरू292द्ध 2024 3

नोटः- संविदा के आधार पर कार्यरत अवधि का विनिश्चय संबंधित नियंत्री पदाधिकारी द्वारा भुगतान के

आधार पर निर्गत वेतन भुगतान प्रमाण-पत्र के अनुसार किया जाएगा। इस हेतु आयोग द्वारा

प्रकाशित विज्ञापन की तिथि तक की गणना कार्य अनुभव के लिए की जा सकेगी।''

(vi) आयोग द्वारा अभ्यर्थियों की अनुशंसा :- आयोग लिखित एवं मौखिक परीक्षा में प्राप्त अंको के योग के आधार पर सामान्य तथा प्रत्येक आरक्षण कोटि के लिए अलग-अलग मेधा सूची तैयार करेगा। इस प्रकार तैयार की गई सूचियों में से आयोग प्रतिवेदन रिक्तियों के अनुसार अनुशंसा विभाग को करेगा।

(vii) प्रोन्नति द्वारा नियुक्ति ः-बिहार उद्यान सेवा (—षि कोटि-7 ) मेें बिहार उद्यान अधीनस्थ सेवा (—षि अधीनस्थ कोटि-7) से प्रोन्नति दी जाएगी। उक्त प्रोन्नति सामान्य प्रशासन विभाग द्वारा निर्धारित कालावधि, आरक्षण आदि पर विचार करते हुए सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत नीति निर्धारक परिपत्रों के आलोक में वरीयता के आधार पर सक्षम प्राधिकार द्वारा प्रोन्नति दी जायेगी।

6. परिवीक्षा :-

(i) सेवा में सीधी भर्त्ती से नियुक्त प्रत्येक सदस्य पदग्रहण की तिथि से दो वर्षाे की अवधि के लिए परिवीक्षा पर होगा, किन्तु विशेष परिस्थितियों में लिखित रूप में अभिलिखित किये जाने वाले कारणो से यह अवधि विभाग के द्वारा एक वर्ष तक बढ़ाई जा सकेगी। यदि बढ़ाई गयी अवधि में भी कार्य संतोषप्रद नहीं पाया जाये तो एैसे सदस्यों की सेवा सरकार द्वारा बिना कारण पृच्छा के समाप्त की जा सकेगी, किन्तु इसकी लिखित सूचना कारण सहित दी जाएगी।

(ii) परिवीक्षा अवधि की गणना नियमित सेवा के प्रयोजनार्थ की जायेगी।

7. प्रशिक्षण :- बिहार उद्यान सेवा कोटि-7 (उद्यान) में नियुक्त सदस्यों के लिए प्रोन्नति हेतु राज्य सरकार द्वारा विनिश्चित संस्थान से प्रशिक्षण प्राप्त करना अनिवार्य होगा, किन्तु निर्धारित प्रोन्नति के पूर्व यदि प्रशिक्षण आयोजित नही हुआ हो तो प्रोन्नति बाधित नहीं होगी। प्रशिक्षण संस्थानों का चयन समय-समय पर विभाग द्वारा किया जाएगा। 8. विभागीय परीक्षाः-(1) सदस्यों को केन्द्रीय परीक्षा समिति (राजस्व पर्षद), बिहार द्वारा आयोजित विभागीय परीक्षा में उत्तीर्ण होना अनिवार्य होगा।

(2) मूल कोटि के वेतनमान में प्रथम वेतनवृद्धि विभागीय परीक्षा उत्तीर्णता के उपरांत ही देय होगा। 9. सम्पुष्टि ः- (1) परिवीक्षा अवधि पूरी करने, विभागीय परीक्षा में उत्तीर्णता तथा विनिश्चित प्रशिक्षण कार्यक्रम मे संतोषप्रद रूप से पूर्ण किये जाने पर तथा सेवा स्वच्छ पाये जाने पर सीधी नियुक्ति के सदस्यों की सेवा स्थायी संवर्गीय पदों के विरूद्ध मूल कोटि में सम्पुष्ट की जाएगी।

(2) प्रोन्नति द्वारा मूल कोटि में नियुक्त सदस्यों की सेवा उप नियम (1) के अधीन वर्णित शर्त्तो (परिवीक्षा को छोड़कर) के अधीन रहते हुए सम्पुष्ट की जा सकेगी।

10. वरीयता का अवधारण :- सदस्यों की वरीयता सामान्य प्रशासन विभाग द्वारा समय-समय पर अवधारित नीति के आलोक में अवधारित की जाएगी।

11. मूल कोटि से उच्चतर पदों की प्रोन्नति :- (1) सेवा संवर्ग के पदसोपान में उच्चतर पदों पर प्रोन्नति ठीक नीचे की पंक्ति में कार्य पदाधिकारियों से वरीयता-सह-मेधा एवं सेवा स्वच्छ पाये जाने के आधार पर तथा समान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत आदेशो के आलोक में दी जायेगी, किन्तु सदस्यों को नियम-7 में यथा प्रावधानित प्रशिक्षण पूर्ण करने पर ही उक्त प्रोन्नति देय होगी।

(2) विभाग द्वारा ससमय प्रशिक्षण आयोजित नही किये जाने के फलस्वरूप उक्त प्रोन्नति बाधित नही होगी।

(3) कार्यरत पदाधिकारियों की मूल कोटि में सम्पुष्टि, गोपनीय अभ्युक्ति, आंतरिक स्वच्छता, निगरानी स्वच्छता एवं लोकायुक्त का प्रतिवेदन सामान्य प्रशासन विभाग द्वारा विनिश्चित कालावधि, आरक्षण, पदों की उपलब्धता आदि पर विचार करते हुये वरीयता के आधार पर सक्षम प्राधिकार द्वारा प्रोन्नति दी जायेगी।

(4) विभागीय प्रोन्नति समिति :-विभागीय प्रोन्नति समिति की अनुशंसा पर प्रोन्नति हेतु विचार किया जा सकेगा। विभागीय प्रोन्नति समिति अलग से सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत संकल्पों/अनुदेशो के आलोक में गठित की जायेगी।

12. प्रकीर्ण : कठिनाई का निराकरण :- (1) इस नियमावली के नियमों की निर्वचन करने के लिए विभाग सक्षम होगा जिसके लिए, आवश्यकतानुसार सामान्य प्रशासन विभाग, विधि विभाग और वित्त विभाग का परामर्श प्राप्त करना अनिवार्य होगा।

(2) विभाग, विधि विभाग के परामर्श से, इस नियमावली के किसी नियम को लागू करने में आने वाली कठिनाई का निराकरण राजपत्र में समुचित आदेश जो इस नियमावली के प्रावधानो से असंगत न हो, के प्रकाशन द्वारा कर सकेगा।;बपकरू464द्ध ;द्ध 1 ;बपकरू292द्ध 2024 4 (3) जिन विषयों या बिन्दुओं का प्रावधान इस नियमावली में नहीं किया गया है, उनके संबंध में राज्य सरकार द्वारा तत्समय प्रवृत संहिता/नियमावली/संकल्प/अनुदेश में किये गये प्रावधान इस सेवा के संदर्भ में लागू माने जायेंगे।

13. निरसन एवं व्यावृति :- (1) इस संवर्ग के कर्मियों की नियुक्ति/सेवा शर्त संबंधी पूर्व में निर्गत सभी परिपत्र/अनुदेश/संकल्प एतद्‌ द्वारा निरसित किए जाते हैं।

(2) ऐसे निरसन के होते हुए भी पूर्व निर्गत परिपत्र/अनुदेश/संकल्प के अधीन किया गया कुछ भी या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी मानो यह नियमावली उस दिन प्रवृत थी, जिस दिन वैसा कुछ किया गया या वैसी कार्रवाई की गयी थी।

No- 01/A.G-(Horticulture)/45/2023-1206/Agri—In exercise of the power conferred by the proviso to Article 309 of the Constitution of India, the Governor of Bihar, is here by pleased to formulate the following rules for the recruitment, promotion and service conditions in the Bihar Horticulture Service (Agriculture Category– 7) :

1. Short title, extent and Commencement:

(1) These rules may be called the Bihar Horticulture Service (Agriculture Category– 7) Recruitment, Promotion and Service conditions Rules, 2024.

(2) These rules shall extend to the whole of the State of Bihar (3) These shall come into force with immediate effect from the date of publication in State gazette.

2. Definition: In these rules, unless otherwise is required in the context-

i. "State" means the State of Bihar; ii. "Governor" means Governor of Bihar; iii. "Government" means Government of Bihar; iv. "Department" means Agriculture Department of Bihar; v. "Agriculture Service Act" means Bihar Agriculture Service Act, 1982 (Bihar Act No. 44, 1982);

vi. (Agriculture Category – 7)' means cited category -07 of clause -2 of schedule -1 of Bihar Agriculture Service Rules 1982,) to be called as Bihar Horticulture Service (Agriculture Category – 7);

vii. "Cadre" means the cadre of Bihar Horticulture Service (Agriculture Category – 7);

viii. "Commission" means Bihar Public Service Commission;

ix. "Year" means financial year i.e. the period from 1st April to 31st March of ensuing year;

x. "Competent Authority" means Authority declared by Rules of Executive Business;

xi. "Member" means Person recruited under Bihar Horticulture Service (Agriculture Category -07);

xii. "Appointing Authority" means Government of Bihar;

3. Cadre Control-This service shall be a state service and Agriculture Department shall be its controlling Department.

4. Hierarchy of the post: I (a) The basic level of post shall be equivalent to a Sub Divisional Horticulture Officer/Assistant Director (Horticulture) and Equivalent Post (b) First Promotion Post- District Horticulture Officer/Dy Director Horticulture and equivalent post

(d) Third Promotion Post -Additional Director (Horticulture)

(2) The structure and strength of the cadre, may be reviewed, from time to time, by the Department as per need.

5. Recruitment and Promotion in the basic category- (1) It shall be mandatory for the candidate to be Indian citizen for the appointment in the service. 67 percent posts of the basic category shall be filled by direct recruitment and 33 percent posts shall be filled up by way of promotion.

(2) Every year, as on 1st April, the calculation of vacant posts for promotion and direct appointment, against the sanctioned posts in the category, shall be made separately. This calculation shall be made on the basis of posts meaning thereby that in case of the post of direct requirement falling vacant, it shall be filled by direct requirement and in case of the posts of promotion falling vacant it shall be filled by promotion. Category wise requisition of these vacancies shall be sent by the Department to the Commission by 30th April.

(3) Educational Qualification - Minimum educational qualification for direct appointment or promotion to the posts of basic category in the cadre, shall be degree of Bachelor in Horticulture Science or Bachelor in Agricultural Science with elective horticulture science from recognized Agricultural University/other University (Faculty of Agriculture).

(4) Direct Appointment

i. Direct appointment shall be made from the candidates recommended on the basis of competitive examination conducted by the Commission. ii. Age Limit- The minimum age shall be 21 (twenty one) years as on 1st August of the year in which application is invited. The maximum age limit shall be the same as may be prescribed by the Department of General Administration, from time to time for direct appointment in the services of the State Government, but it may be increased in special circumstances by the order of the State Government. "But the duly recruited contractual workers on the same or equivalent post will be given relaxation in the maximum age limit up to the number of years for which they have worked in the same post on contractual basis in Government of Bihar, while making regular appointment."

iii. Reservation: The reservation provisions made by the Department of General Administration, from time to time for direct appointment to the services of the State Government shall be applicable.

iv. For direct appointment, the department will send a requisition to the Commission every year with the number of general and reservation category wise vacancies.

6 v. Subjects and syllabus of competitive examination

It shall be compulsory to pass in Hindi subject carrying 100 marks, in the competitive examination mentioned Rule 5 (4) (i) of these rules but the marks obtained will not be counted for the purpose of preparing the merit list.

The merit list shall be prepared on the basis of sum total of marks obtained in two question papers of horticulture sciences each carrying 200 marks, one question paper of general knowledge carrying 100 marks, and oral test of 50 marks. The syllabus of Hindi and General Knowledge shall be the same as may be determined by the Bihar Public Service Commission for the joint competitive examination. The syllabus of Horticulture science shall be prepared by the department in consultation with Bihar Public Service Commission. Based on the sum of marks obtained in the above three papers of Horticulture Science and General Knowledge, appropriate number of candidates shall be called for oral examination.

v(a) Selection on basic category posts will be done on the basis of the sum of marks obtained in written and oral examination and giving weightage to the period of work done under contractual period on the same post of same level.

The merit list for selection shall be made on the basis of total marks by following:

(i) Weightage of marks received in written exam of Commission and interview - 75 Marks

(ii) Weightage on years of experience of working on contractual basis with Government of Bihar - 25 Marks

(For the contractual work experience at the rate of 5 marks per year the maximum marks will be 25)

Note:- "The contractual service period with Government of Bihar shall be decided by the controlling officer on the basis of scale of payment issued under payment certificate.

For the purpose of calculating the work experience period, the service period shall be estimated from the date of publication of the advertisement."

vi. Recommendation for candidates by the commission-

The commission shall prepare merit list separately for the candidates of general category and each reservation category on the basis of marks obtained in written and oral test. The commission shall recommend to the department based on the reported requisition.

vii. Appointment by promotion: Promotion shall be given from the Bihar Horticulture Subordinate Service (Agriculture Subordinate Group-7) in Bihar Horticulture Service (Agriculture Category-7). Considering the time period, reservation as decided by GAD the above promotion shall be given on the basis of seniority by the competent authority keeping in view of policy determining letters/circulars, issued by the GAD.

6. Probation

i. Every member appointed to the service by direct recruitment shall be on probation for a period of two years from the date of joining, but in special circumstances, for reasons to be recorded in writing, this period can be extended by the department by one year. If the work is not found satisfactory even within the extended period, then the service of such members can be terminated by the government without asking any reason, but written notice shall be given along with the reason. ii. The probation period shall be counted for the purpose of regular service.

7. Training- It shall be mandatory for the members appointed in Bihar Horticulture Service (Agriculture Category-7) to undergo training from the institute decided by the State Government for promotion, but if the training is not conducted before the scheduled promotion, then the promotion will not be hindered. The training institutes shall be selected by the department from time to time.

8. Departmental Examination

i. It shall be mandatory for the members to pass the departmental examination conducted by the Central Examination Committee (Revenue Board), Bihar. ii. The first increment in the basic category pay scale shall be given only after passing the departmental examination.

9. Confirmation

i. After completing the probation period, passing in the departmental examination and obtaining the due training satisfactorily and services found clear, service of the member of direct recruitment shall be confirmed against the permanent cadre posts in the basic category.

ii. The services of the members appointed in the basic categories by way of promotion, shall be confirmed subject to the condition as laid down under sub Rule (1) (Except Probation).

10. Determination of The Seniority: The seniority of the members shall be determined in the light of the policy determined from time to time by the General Administration Department.

11. Promotion to higher posts from the Basic level

i. Promotion to higher posts in the hierarchy of the service cadre shall be given on the basis of seniority-cum-merit and clean service from the officers immediately below the line and in the light of orders issued from time to time by the General Administration Department. But the promotion shall be given only after completing the training as provided in Rule 7.

ii. The said promotion will not be hindered as a result of training not being conducted timely by the department.

iii. The working officials shall be promoted by the competent authority on the basis of seniority in the basic category, considering the confirmation, confidential remarks, internal clearance, Vigilance clearance and report of the Lokayukta, the time period decided by the General Administration Department, reservation, availability of posts etc.

iv. Departmental Promotion Committee: It may be considered for promotion on the basis of the recommendation of the departmental promotion committee. The departmental promotion committee shall be constituted;बपकरू464द्ध ;द्ध 1 ;बपकरू292द्ध 2024 8 separately in the light of resolution/instructions issued by the Department of General Administration, from time to time.

12. Miscellaneous: Removal of Difficulty

i. The Department shall be the competent to interpret these rules and as per need shall obtain the opinion of the Department of General Administration, Law Department and Finance Department compulsorily.

ii. The Department, in consultation with the Law Department, may remove the difficulty, coming in implementation of any rules of these Rules, by publication of appropriate order in the official Gazette which is not inconsistent with the provision of these Rules.

iii. The subject or points for which provisions are not made in these rules, the provision made in the code/rules/resolution/instruction for the time being enforced by the State Government, shall be applicable in context of this service in respect of them.

13. Repeals and Savings

i. All circulars/instructions/resolutions regarding appointment of staffs/service conditions of this cadre are hereby repealed.

ii. Notwithstanding such repeal anything done, or any action taken under said circulars/instructions/resolutions shall be deemed to be done or taken under these Rules as if it were enforced on the day on which such things was done, or such action was taken.
