(सं0 पटना 896) पटना, सोमवार, 9 िसत(cid:224)बर 2024 ——— vf/klwpuk 30 vxLr 2024 सं॰ सै0क0नि0/04/03/2019-1418—भारतीय संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल जिला सैनिक कल्याण कार्यालयों में कल्याण व्यवस्थापकों की भर्ती एवं सेवा शर्तो को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैं :-

1.

(1) यह नियमावली (2) यह तुरंत प्रवृत्त होगी। (3) इसका विस्तार संपूर्ण बिहार राज्य में होगा। - इस नियमावली में जब तक संदर्भ से अन्यथा अपेक्षित न हो से अभिप्रेत है सक्षम प्राधिकार द्वारा आयोजित (i) से अभिप्रेत है इस नियमावली के प्रवृत्त होने की तिथि; (ii) से अभिप्रेत है जिला सैनिक कल्याण व्यवस्थापक संवर्ग; (iii) से अभिप्रेत है नियम 3 में विनिर्दिष्ट कोटि; (iv) प्रतियोगिता परीक्षाफल के आधार पर कल्याण व्यवस्थापक के पद पर नियुक्त व्यक्ति; (v) से अभिप्रेत है राज्य सरकार द्वारा अधिसूचित जिला सैनिक कल्याण कार्यालय;

(vi) से अभिप्रेत है निदेशक, सैनिक कल्याण निदेशालय; (vii) से अभिप्रेत है कल्याण व्यवस्थापक कोटि में परिवीक्षाधीन रूप से नियुक्त व्यक्ति;

(viii) से अभिप्रेत है नियत तिथि की स्थिति तथा राज्य सरकार द्वारा इस प्रयोजनार्थ बनाये गये नियम के अनुसार समय-समय पर पुनरीक्षित संवर्ग के कर्मचारियों की वरीयता सूची, जिसका संधारण निदेशक, सैनिक कल्याण निदेशालय, गृह विभाग करेगे;

(ix) से अभिप्रेत है बिहार कर्मचारी चयन आयोग/बिहार पुलिस अवर सेवा आयोग; (x) से अभिप्रेत है सैन्य सेवा से सेवानिवृत्त वैसे सैनिक जो कार्मिक मंत्रालय, लोक शिकायत और पेंशन नई दिल्ली का अधिसूचना दिनाक, 04.10.2012 द्वारा भूतपूर्व सैनिक की परिभाषा में आते हैं।

इस संवर्ग के विभिन्न ग्रेडों के पद, उनका वर्गीकरण तथा नियुक्ति प्राधिकार निम्नानुसार होगा :-

2. बिहार राज्य अन्तर्गत जिला सैनिक कल्याण कार्यालयों में नियत तिथि को कल्याण व्यवस्थापक के स्वी—त बल का 70 प्रतिशत कल्याण व्यवस्थापक, 20 प्रतिशत वरीय कल्याण व्यवस्थापक एवं 10 प्रतिशत प्रधान कल्याण व्यवस्थापक कोटि का समझा जायेगा। -सेवा में नियुक्ति/प्रोन्नति में राज्य सरकार द्वारा समय-समय पर निर्धारित आरक्षण का प्रावधान लागू होगा। (क) कल्याण व्यवस्थापक कोटि के पद पर सीधी भर्ती भूतपूर्व सैन्यकर्मी (थल सेना, नौसेना एवं वायु सेना) सेे बिहार कर्मचारी चयन आयोग/बिहार पुलिस अवर सेवा आयोग द्वारा इस उद्देश्य से आयोजित प्रतियोगिता परीक्षा के आधार पर की जायेगी।

(ख) कल्याण व्यवस्थापक में भर्ती हेतु न्यूनतम शैक्षणिक योग्यता प्रवेशिकोर्त्तीण (इन्टरमिडिएट) 102/ समकक्ष/अर्हता तथा भर्ती की प्रक्रिया विनियमावली के उपबंधों के अनुसार होगी।

(ग) भूतपूर्व सैनिकों को कल्याण व्यवस्थापक के पद पर नियुक्ति हेतु उम्र सीमा अधिकतम 57 वर्ष होगी। उससे अधिक उम्र वाले भूतपूर्व सैनिक इसके लिए योग्य नहीं होंगे।

(घ) भूतपूर्व हवलदार से सुबेदार मेजर नौसेना एवं वायु सेना के समकक्ष तक कल्याण व्यवस्थापक के पद पर नियुक्ति हेतु योग्य होंगे।

(च) जिला सैनिक कल्याण कार्यालयों द्वारा रिक्तियों की सूचना दिये जाने के आधार पर सैनिक कल्याण निदेशालय, गृह विभाग द्वारा आरक्षण कोटिवार अधियाचना बिहार कर्मचारी चयन आयोग/बिहार पुलिस अवर सेवा आयोग को भेजी जायेगी। प्रत्येक वर्ष 01 अप्रील तक की रिक्तियों के लिए अधियाचना बिहार कर्मचारी चयन आयोग/बिहार पुलिस अवर सेवा आयोग को 30 अप्रील तक भेज दी जायेगी। आयु की अर्हता विज्ञापन वर्ष की 01 अगस्त के अनुसार होगी।

(छ) प्रतियोगिता परीक्षाओं के परिणाम के आधार पर कल्याण व्यवस्थापक संवर्ग के उम्मीदवारों का आवंटन सैनिक कल्याण निदेशालय, गृह विभाग द्वारा किया जायेगा।

(ज) संदर्भित प्रतियोगिता परीक्षाओं के लिए पाठ्‌यक्रम सामान्य अध्ययन का होगा जिसमें अंक गणित, रसायन शास्त्र, वनस्पति शास्त्र, भूगोल, इतिहास, अर्थशास्त्र एवं राजनीति शास्त्र के इन्टरमिडिएट स्तर के होंगे। इसके अतिरिक्त भारतीय संविधान, पंचवर्षीय योजनायें, स्वतंत्रता आन्दोलन एवं सामयिक विषय यथा, वैज्ञानिक प्रगति/राष्ट्रीय/अन्तर्राष्ट्रीय पुरस्कार/लिपि/राजधानी/ मुद्दा/खेल-खिलाड़ी इत्यादि होंगे।

(झ) उक्त पद पर नियुक्ति हेतु जिला सैनिक कल्याण कार्यालय में पंजी—त भूतपूर्व सैन्य सेवा के कर्मी ही पात्र होंगे।

(ट) मेडिकल कटेगरी Shape-1 अथवा AYE होना चाहिए। -कल्याण व्यवस्थापक कोटि में नियुक्ति, प्रतियोगिता परीक्षा द्वारा या अनुकम्पा के आधार पर, प्रारम्भ में परिवीक्षा पर की जायेगी। परिवीक्षा अवधि दो वर्षो की होगी, जो नियुक्ति प्राधिकार द्वारा बढ़ायी जा सकेगी।

परन्तु नियत तिथि के पूर्व से कल्याण व्यवस्थापक के पद पर नियुक्त एवं कार्यरत कर्मी इस नियमावली के तहत कल्याण व्यवस्थापक के पद पर कार्यरत समझे जायेंगे।3 (cid:464)बहार गजट (असाधारण), 9 िसत(cid:224)बर 2024 परन्तु यह और कि परिवीक्षा की कुल विस्तारित अवधि तीन वर्षो से अधिक की नहीं होगी। विस्तारित अवधि में भी सेवा संतोषप्रद नहीं होने पर सेवामुक्त किया जा सकेगा।

-परिवीक्षा अवधि में कल्याण व्यवस्थापक को प्रशिक्षित कराने की जिम्मेवारी सैनिक कल्याण निदेशालय, बिहार, पटना की होगी।

-कल्याण व्यवस्थापक संवर्ग में परिवीक्षा पर नियुक्त कोई व्यक्ति संतोषप्रद परिवीक्षा अवधि पूर्ण किये जाने पर नियुक्ति प्राधिकार द्वारा सम्पुष्ट किया जा सकेगा। (क) सैनिक कल्याण निदेशालय, गृह विभाग द्वारा वरीयता सूची तैयार की जायेगी। (ख) बिहार कर्मचारी चयन आयोग/बिहार पुलिस अवर सेवा आयोग की अनुशंसा पर नियुक्त व्यक्तियों की पारस्परिक वरीयता आयोग द्वारा अनुशंसित योग्यता सूची के अनुसार होगी। (क) वरीय कल्याण व्यवस्थापक के पद पर प्रोन्नति कल्याण व्यवस्थापक कोटि के उन कर्मियों से वरीयता-सह-योग्यता के आधार पर की जायेगी जिसकी सेवा सम्पुष्ट हो तथा जो निर्धारित कालावधि यथा, कल्याण व्यवस्थापक से वरीय कल्याण व्यवस्थापक-8 वर्ष एवं वरीय कल्याण व्यवस्थापक से प्रधान कल्याण व्यवस्थापक-5 वर्ष की सेवा पूरी करते हों। प्रधान कल्याण व्यवस्थापक के पद पर प्रोन्नति वरीयता-सह-योग्यता के आधार पर वरीय कल्याण व्यवस्थापकों में से की जायेगी।

(ख) वरीय कल्याण व्यवस्थापक कोटि एवं प्रधान कल्याण व्यवस्थापक कोटि में प्रोन्नति सैनिक कल्याण निदेशालय गृह विभाग द्वारा इस प्रयोजनार्थ गठित विभागीय प्रोन्नति समिति की अनुशंसा पर की जा सकेगी।

-जहाँ इस नियमावली के किसी प्रावधान के निर्वचन के संबंध में कोई संदेह उत्पन्न हो, वहाँ वह विषय सामान्य प्रशासन विभाग को निर्देशित किया जायेगा, जिसका उस पर विनिश्चय अंतिम होगा।

-इस नियमावली के प्रावधानों को प्रभावी बनाने के लिए आवश्यकतानुसार सैनिक कल्याण निदेशालय, गृह विभाग विनियमावली बना सकेगा।

-किसी अन्य नियमावली में कल्याण व्यवस्थापकों के संदर्भ में इस नियमावली के प्रतिकूल किसी बात के होने पर इस नियमावली के प्रावधानों का अभिभावी प्रभाव होगा। ——— 30 vxLr 2024

सं॰ सै0क0नि0/04/03/2019-1419, अधिसूचना संख्या 1418, दिनांक 30 अगस्त 2024 का संलग्न अंग्रेजी अनुवाद एतद्‌ द्वारा बिहार राज्यपाल के प्राधिकार से प्रकाशित किया जाता है जो भारत के संविधान के अनुच्छेद 348 के खंड-(3) के अधीन अंग्रेजी भाषा में उक्त अधिसूचना का प्राधि—त पाठ समझा जायेगा।

——— The 30th August 2024 No SKN/04/03/2019-1418—In exercise of powers conferred under the proviso of article 309 of the Constitution of India, the Governor of Bihar, is pleased to make the following rules to regulate the recruitment and service conditions of Welfare Organisers in the offices of District Sainik Welfare Offices.

1. Short Title, Extent and Commencement.

(a) These rules shall be called "Welfare Organiser Cadre Rules 2024" (b) It shall come into force with immediate effect. (c) It shall extend to whole of the State of Bihar.

2. Definitions. In these rules, unless the context otherwise requires: -

(a) "Effective date" means the date of applicability of these Rules. (b) "Cadre" means District Sainik Welfare Organiser Cadre.

(c) "Grade" means as specified in Rule 3.

(d) "Person appointed by direct recruitment" means the person recruited to of the post of Welfare Organiser on the basis of result of competitive examination conducted by the Competent Authority.

(e) "Subordinate Office" means "District Sainik Welfare Offices notified by the State Government.

(f) "Appointing Authority" means Director, Sainik Kalyan Nideshalaya. (g) "Probationer" means a person recruited to the Grade of Welfare Organiser, on Probation.

(h) "Common Seniority List" means the Seniority List prepared for the purpose from its effective date in accordance with the rules made by the State Government. It shall be maintained and revised from time and time by the Director, Sainik Kalyan Nideshalaya.

(j) "Commission" means the Bihar Staff Selection Commission/ Bihar Police Sub-ordinate Services Commission.

(k) "Ex-Servicemen" means retired defence services personnel who fall under the definition of Ex-Servicemen defined by the Ministry of Personnel & Public Grievances & Pensions, New Delhi vide notification dated 04.10.2012.

3. Constitution of the Cadre— This cadre shall have the under mentioned grades,

Note-1. The number of posts and pay scale/pay level of said posts shall be the same as may be decided/revised by the State Government from time to time. 2. In the District Sainik Welfare Offices, under the State of Bihar, 70% of the approved posts of Zila Sainik Welfare Organisers will be considered that of Welfare Organiser, 20% as Senior Welfare Organisers and 10% as Principal Welfare Organisers, as on the appointed date.

4. Reservation.—The provisions of Bihar Reservation Act shall apply in Appointment / Promotion.

5. Recruitment as Welfare Organiser : -

(a) Ex-Servicemen (Army, Navy and Air Force) will be recruited by direct recruitment through Bihar Staff Selection Commission/Bihar Police Sub- ordinate Services Commission on the basis of competitive examination conducted for purpose.

(b) The minimum educational qualification for direct recruitment of Welfare Organiser shall be intermediate (10+2) equivalent and the process of recruitment shall be in accordance with the provision of the rules.

(c) Maximum age limit of Ex-servicemen for the appointment to the post of Welfare Organiser shall be 57 (Fifty Seven) years. Ex-Servicemen exceeding the age limit will not be eligible.

(d) Ex-Servicemen from the Rank of Havildar to Subedar Major and equivalent from Navy and Air Force shall be eligible for the appointment on the post of Welfare Organiser.

(e) On the basis of information regarding vacancies, provided by District Sainik Welfare Offices, Sainik Kalyan Nideshalaya, Department of Home shall send the requisition, as per reservation policy, wise to Bihar Staff Selection Commission/Bihar Police Sub-ordinate Services Commission. Every year, requisition up to 01st April shall be sent to Bihar Staff Selection Commission/ Bihar Police Sub-ordinate Services Commission by 30th April of that year. Age limit will be determined with respect to 01st August of the recruitment year.

(f) On being selected through competitive examination, Welfare Organiser shall be posted in the district by Sainik Kalyan Nideshalaya, Home Department, Bihar.

(g) The syllabus for the said competitive examination shall be General studies which shall include Mathematics, Chemistry, Biology, Botany, Geography, History, Economy and Political Science of Intermediate level. Additionally, following will also be tested :- (i) Indian Constitution. (ii) Five years planning. (iii) Freedom struggle (iv) Current affairs to include Scientific achievements, National/ International awards, Capitals, currency, Sports and Sports persons (h) For the appointment to these posts, only those Ex-Servicemen shall be eligible who are registered with their respective District Soldier Welfare Offices.

(j) Candidate, shall be in medical category SHAPE-1 /AYE.

6. Probation Period.—Welfare Organisers appointed through competitive examination or on compassionate ground shall be on probation for initial two years which may be extended by the competent authority. Welfare Organiser appointed before effective date would be considered on probation from the date of their appointment. The probation period shall not be extended for more than three years. In case of unsatisfactory performance during extended period, the services of such Welfare Organisers can be terminated. 7. Training.— Sainik Kalyan Nideshalaya shall be responsible for the training of Welfare Organisers during their probation period. 8. Confirmation.— The service of the Welfare Organisers on probation shall be confirmed by the competent authority on satisfactory completion of their probation period.

9. Determination of Seniority of Welfare Organisers.—

(a) The Seniority list will be prepared by Sainik Kalyan Nideshalaya, Home Department.

(b) The inter-se Seniority of the persons appointed on the recommendation of the Staff Selection Commission/Bihar Police Sub-ordinate Services Commission shall be in accordance with the merit list recommended by them.

10. Promotion— (a) Promotion for the post of Senior Welfare Organiser shall be done on the basis of seniority cum-merit of the Welfare Organisers, once their services are confirmed and who have completed the requisite time period i.e. from Welfare Organiser to Senior Welfare Organiser– 8 Years and from Senior Welfare Organiser to Principal Welfare Organiser– 5 Years. Promotion on the post of Principal Welfare Organiser shall be on the basis of Seniority- cum-merit from Senior Welfare Organisers.

(b) Promotion on the grade of Senior Welfare Organiser and Principal Welfare Organiser shall be on the recommendation of a Promotion Committee constituted for this purpose.

11. Interpretation.—In case of any doubt regarding interpretation of any of the provisions of this rule, the subject shall be referred to General Administration Department whose decision thereon shall be final.

12. Power to make Rules/Regulations.— In order to make the provisions of these rules effective, Sainik Kalyan Nideshalaya may make rules/regulations as necessary.

13. Miscellaneous.—Notwithstanding anything contained contrary to these rules in any other rules with respect to Welfare Organisers of all categories, the provisions of these rules shall have overriding effect.
