(सं0 पटना 929) पटना, बुधवार, 18 िसत(cid:224)बर 2024 ——— अधिसूचना 13 सितम्बर 2024 V —भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, बिहार उत्पाद रसायन परीक्षक (भर्त्ती एवं सेवा शर्त्ते) नियमावली, 2015 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते है :-
संक्षिप्त नाम, विस्तार एवं प्रारम्भ।- (1) यह नियमावली ''बिहार उत्पाद रसायन परीक्षक (भर्त्ती एवं सेवा शर्त्तें) (संशोधन) नियमावली, 2024'' कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में प्रकाशन की तिथि से प्रवृत्त होगी। बिहार उत्पाद रसायन परीक्षक (भर्त्ती एवं सेवा शर्त्ते) नियमावली, 2015 के नियम-3 में संशोधन। - उक्त
नियमावली का नियम-3 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-
'' बिहार उत्पाद रसायन परीक्षक संवर्ग में निम्नलिखित पद होंगेः- (i) उत्पाद रसायन परीक्षक- मूल कोटि - अराजपत्रित (ii) वरीय उत्पाद रसायन परीक्षक- प्रथम प्रोन्नति स्तर - अराजपत्रित (iii) मुख्य उत्पाद रसायन परीक्षक- द्वितीय प्रोन्नति स्तर - राजपत्रित
इस सवंर्ग के विभिन्न पदों का स्वीकृत बल तथा वेतनमान/वेतन स्तर वही होगा, जैसा सरकार/ वित्त विभाग, बिहार सरकार द्वारा समय-समय पर निर्धारित किया जायगा।''
बिहार उत्पाद रसायन परीक्षक (भर्त्ती एवं सेवा शर्त्ते) नियमावली, 2015 के नियम-11 में संशोधन। - उक्त
नियमावली का नियम-11 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः- '' परिवीक्षा अवधि में संतोषजनक सेवा होने, प्रशिक्षण सफलतापूर्वक पूरा करने और निर्धारित विभागीय परीक्षा उत्तीर्ण करने पर उत्पाद रसायन परीक्षक की सेवा को सम्पुष्ट किया जा सकेगा। उच्चतर पदों पर प्रोन्नति हेतु सेवा सम्पुष्टि आवश्यक शर्त्त होगी।2 (cid:464)बहार गजट (असाधारण), 18 िसत(cid:224)बर 2024 (1) संवर्ग की मूल कोटि, उत्पाद रसायन परीक्षक (अराजपत्रित) से प्रथम प्रोन्नति स्तर, वरीय उत्पाद रसायन परीक्षक (अराजपत्रित) के पद 'आयुक्त उत्पाद, बिहार, पटना' की अध्यक्षता में गठित विभागीय प्रोन्नति समिति की अनुषंसा एवं वरीय उत्पाद रसायन परीक्षक (अराजपत्रित) से द्वितीय प्रोन्नति स्तर, मुख्य उत्पाद रसायन परीक्षक (राजपत्रित) के पद 'अध्यक्ष-सह-सदस्य, राजस्व पर्षद्, बिहार, पटना' की अघ्यक्षता में गठित विभागीय प्रोन्नति समिति की अनुषंसा के आधार पर प्रोन्नति द्वारा भरे जायेगें।
(2) प्रोन्नति के लिए राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर
निर्धारित न्यूनतम कालावधि को पूरा किया जाना आवष्यक होगा।
(3) प्रोन्नति में राज्य सरकार द्वारा लागू आरक्षण नीति/रोस्टर अथवा एतद् संबंधी
विभागीय परिपत्रों का अनुपालन आवष्यक होगा। (4) प्रोन्नति का आधार वरीयता-सह-योग्यता होगा।'' ——— 13 सितम्बर 2024
V उपर्युक्त अधिसूचना का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से एतत् द्वारा प्रकाषित किया जाता है, जो भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त राज्यादेष का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा। ——— The 13th September 2024
No V —In exercise of the powers conferred by proviso of Article 309 of the Constitution of India, the Governor of Bihar makes the following Rules to amend the 'Bihar Excise Chemical Examiner (Recruitment and service conditions) Rules, 2015:-
1. Short title, Extent and Commencement.
(1) These Rules may be called the 'Bihar Excise Chemical Examiner (Recruitment and Service conditions) (Amendment) Rules, 2024
(2) It shall extend to the whole of the State of Bihar. (3) It shall come in to force from date of its publication in the official gazette.
2. Amendment in Rule-3 of the 'Bihar Excise Chemical Examiner (Recruitment and service conditions) Rules, 2015.:—Rule-3 of the said Rules, 2015 shall be substituted by the following :-
''3. Structure of Cadre. The posts of the Bihar Excise Chemical Examiner Cadre as follows-
| (i) | Excise Chemical Examiner | Basic grade | Non-Gazetted |
| (ii) | Senior Excise Chemical Examiner | First level of promotion | Non-Gazetted |
| (iii) | Senior Excise Chemical Examiner | Second level of promotion | Gazetted |
The number of sanctioned posts and pay scale/pay level of the different posts of this Cadre shall be such as decided time to time by the Government/ Finance Department, Government of Bihar.''3 (cid:464)बहार गजट (असाधारण), 18 िसत(cid:224)बर 2024 3. Amendment in Rule-11 of the 'Bihar Excise Chemical Examiner (Recruitment and service conditions) Rules, 2015.:- Rule-11 of the said Rules shall be substituted by the following :- "11 (a) Confirmation. Excise Chemical Examiner appointed in this service shall be confirmed on completion of probation period satisfactorily, completion of training successfully and if he has passed the prescribed departmental examination. Service confirmation is mandatory for promotion to the higher posts.
11 (b) Promotion.
(1) Promotion to the first promotion level 'Senior Excise Chemical Examiner' on the basis of recommendation of Departmental Promotion Committee headed by 'Excise Commissioner, Bihar, Patna' and Promotion to the second promotion level 'Chief Excise Chemical Examiner' on the basis of recommendation of Departmental Promotion Committee headed by 'Chairman-cum-Member, Board of Revenue, Bihar, Patna'.
(2) It shall be mandatory to complete the minimum time period (kalawadhi) for promotion, prescribed by the State Government (General Administration Department) from time-to-time. (3) It shall be mandatory to follow reservation policy/roster or departmental guidelines in this respect, as prescribed by the State Government for promotion.
(4) The basis of promotion shall be seniority-cum-merit."
